· 1. Short title, extent and conimencement."" (1) These rules may be called the Chl?,attisgarh . Auxiliary Armed Police Force, (Recruitment~ . Training, Remuneration and Other Allowances, Conditions of Service, Conduct and Control) Rules, 2011.

(2) It extends to the whole State of Chhattisgarh. ·

(3) It shall come into force with effect from the date· of its publication in the Official Gazette.

2. Definitions.- (1) In these Rules, unless the context otherwise requires,-

(a) "Appointing Authority" in respect of the force means the Superintendent of Police of the district concerned;

(b) "Force" ~eans the Chhattisgarh Auxiliary Armed Police Force constituted under the provisions of the Ordinance;

( c) "Local · Resident" means the individual defined under definition of local resident declared by the State Government from time to time;

(d) "Member of the Force" means a person appoi_nted as member of the Chh~ttisgarh Auxiliary Armed Police Force under the provisions of the Ordinance; ·

(e) "Ordinance" means the Chhattisgarh Auxi1iary Armed Police Force,.

Ordinance, 2011 (No. 3 of.2011);

(f) "Other Backward Classes" means the Other Backward Classes of citizens as specified by the State Government vide Notification · No.F.8-5~XXV-4-84, dated 26th December, 1984 as amended from time to time;

(g) "Scheduled Castes" means the Scheduled Castes as specified in relation to this State under Article 341 of the Constitution of India;

(h) "Scheduled Tribes" means the Scheduled Tribes as specified in .

relation to this State under Article 342 of the Constitution of India; •

(i) "Special_ Police Officer" means ·a person appointed as Special Police Officer under Section 17 of the Indian Police Act, 1861. or under Section 9 of the Chhattisgarh Police Act, 2007.

(2) Words and expression used in these rules but not defined specifically shall have the same meaning as defined under the Chhattisgarh. Police Act, 2007 (No. 13 of 2007) and the Chhattisgarh Auxiliary Armed Police Force, Ordinance, 2011 (No. 3 of201 l).

3. Scope and Application.- These rules shall apply to every member of the Force.

4. Constitution of the force.- The force shall be constituted consisting of the persons appointed under the provisions of the Ordinance. The number of the members of the force shall be determined by the State Government from time to time and every member of the force shall be known as Assistant Constable.

, 5. Remuneration etc.- The members of the force shall be paid remuneration as fixed by the order issued by the State Government from time to time under sub-section (I) of Section 9 of the Ordinance:

Provided that, it shall not be less than Rs. 3500/- (Rs. Three thousand five hundred) per month.

Provided further, that on the basis of above remuneration they shall be paid dearness allowance and Special Naxal Area Allowance as admissible to the Police Executive Force Constable (GD) of the concerned district for the time being in· force, as provided under sub-section ( 1) of Section 9 of the Ordinance. Any other allowances may also· be paid. to the members of the force as ordered by the State Government from time to time.

6. Method of Appointment.- A person may be appointed as the member of the force by selection and screening under the following provisions:-

(a) by selection·under provisions of Section 7 of the Ordinance;

(b) by screening under provisions of Section 11 of the Ordinance.

7. Selection Committee.- (1) There shall be constituted a selection committee for appointment, under the provisions of Section 7 of the Ordinance, by the Inspector General of Police of the Range concerned as under:

(a)Additional Superintenderit of the concerned Police District - Chairman.

(b) An officer not below the rank of Deputy - Member Superintendent of Police · · ( c) An officer not below the rank of Assistant Commandant - Member

Provided that, at least one member shall be from Chhattisgarh Armed Force.

Provided further, that at least one member of the selecticn committee shall belong t~ the Scheduled. Tribes.

In case· of non-avai]ability of an officer at the level of Additional Superintendent of Police/Deputy Superintendent of Police in the concerned Police District, an officer of equivalent rank from any oth~r unit may be appointed in the Committee.

Insp,ector General of Police Range may constitute · a selection committee ·different from aforesaid committee, stating reasons l?Y order· in writing, in which: different officers from earlier committee, of equivalent rank, may be nominated.

Eligibility for selection.- (1) The candidate must be a local resident of the concerned district;

· (2) The _candidate should have passed class five school. certificate examination on the last date of submission of application;

(3)The candidate· should not be less than 18 years and above45 years of age on the last date of submission of application;

( 4) The candidate must be aware of local area, topography ·and must be conversant with the local language/dialect;

(5)The candidate.should have good conduct.

(b) Ineligibility for selection.- A candidate shall be ineligible for appearing in selectiQn process- (1) If he has been convicted for any offence or against whom criminal proceedings have been instituted.in any court;

(2)lfhe has been found guilty of violation of Human Rights;

(3)Ifhe/she has more than one spouse alive;

( 4) A candidate who has been employee of Chhattisgarh Government · /Central Government and declared unfit for the Government service.

(c) Phy.sical qualifications.- Only those candidates shall be eligible fot the appointment to the force who possesses the physical qualifications as prescribed for the appointment us the Police Executive Constable (GD) in the concerned district. ·

(d) Committee's decision about the eligibility of the candidates.- The decision of the Selection Committee with regard to the eligibility or ineligibility of applicant/candidate in respect of admission to the examination shall be final and no applicant/candidate to whom admission card has not been issued by the committee, shall · be admitted for appearing in the test. · ' .

8. Selection process.- (1) Advertisement and application form- The Police Headquarter shall issue advertisement in a prescribed format for district-wise selection in the force, keeping in view the vacancy in the force. The candidate shall submit application _form, in prescribed format given in the advertisement, to the office of the Superintendent of Police of the concerned district. Giving false information in the application or suppressing any factual information by the candidate shall make him ineligible· for selection or· for continuation in the force.

(2) Scrutiny of applications- Applications received by the stipulated date shall be scn1tinised by the Selection Committee.

(3) Physical measurement- The physical measurements of the candidates shall be done by the Selection Committee under provision of clause ( c) of sub­ rule (2) of Rule 7. Sub-committees consisting of officers from the District · Police and the Chhattisgarh Armed Force may be formed by the Chairman of the Selection Committee for this nurpose, but the Committees shall be folly responsible.for valuation, maintaining of records etc.

( 4) Physical efficiency test- (a) Physical efficiency test is compulsory for all the candidates. Criteria for the Physical efficiency test will be the same as applicable to Police Executive Constable (GD) in the district concerned under prov1s10ns of the Chhattisgarh Police Executive Force, Constable (Recruitment and Conditions of Service) Rules, 2007.

(b) The male and female candidates found eligible in physical efficiency test shall have to complete 15 Kms run/walk and 8 Kms run/walk respectively in two hours and only then they will qualify for interview. No seperate marks shall be prescribed for this test.

( 5) Interview- The Selection Committee shall conduct interview for the candidates successful in the aforesaid· physical efficiency test and run/walk test. During the interview~ preference shall be given to those having · knowledge of local area, topography and local language/dialect e_tc. The interview will be of 15 marks.

9. Selection list.- Selection list shall be prepared on the basis of physical efficiency test ( 100 marks) and interview ( 15 marks). The reservation rules applicable to the Scheduled Castes/Scheduled Tribes/Other Backward Classes and Women, for the recruitment on the post of District Executive Constable (GD) shall be adhered to at the time of preparation of the selection list. ·

10. Approval of selection list.- The selection list prepared by the committee shall be forwarded to the Appointing Autho_rity alongwith with all records/ C ,\ 498 (12) <Jffifl'I~ ~, ~ 19 m 2011 documents. The appointing authority shall consider the list prepared by the committee alongwith other documents received from the committee and unless it considers any change necessary, approve the list.. Appointing Authority may cancel the selection list stating reasons · by . order in writing.

Intimation regarding cancellation of select list shall· be communicated · forthwith to the Police Headquarter.

11. Appointment to the force from the select .list- Final merit list for.

recruitment shall be prepared on the basis of marks obtained in physical test and interview. Appointment shall be made from the merit list subject to the availability ·of posts.

Character verification and medical examination of the candidates shall be done before issuance of the appointment order. An appointment order, may be issued only after confirming that no adverse remarks are there in the character verification and the candidate is medi~ally fit as per the prescribed criteria. A certificate of appointment shall be issued to· a successful candidate by the appointing authority which shall be returned im.mediately to the unit head if he/she ceases to be the member of the Force.

12. Appointment by screening.- (1) There shall be constituted a scr~_ening committee in accordance with the provision of sub-section (2).ofSection 11 of the Ordinance, for the purpose of. screening of the persons deemed to be members of the force under provision of sub-section ( 1) of Section 11 of the Ordinance.

(2) The s_creening committee, while scrutinizing the cases of Special Police .

Officers for the purpose of ass~ssing their suitability, shall screen, inter-alia, on the basis of following points:-

(a) The eligibility criteria under clause (a) of sub-rule (2)ofRule 7:

Provided that, if· a person .deemed to be a member of the force does not possess the prescribed educational qualification, i.e.

fifth class s~hool certificate, then he shall be imparted elementary education through the specially designed course during the training period as specified under Section 8 of the Ordinance; .

(b) Ineligibility criteria specified under clause (b) of. sub-rule (2) of Rule 7;

( c) Physical qualifications specified under clause ( c) of sub-rule (2) of Rule 7 and clearance in the physical efficiency test as specified under clause (a) and (b) of sub-rule (4) of Rule 8; · ( d) Consent letter of the person concerned for continuing as member of the force. · ..

(3) The screening committee shall conduct/complete medical examination and character verification of those persons who have fulfilled requirements mentioned in clause (a) to (d) of sub-rule (2) of Rule 12. The screening committee shall make a list of the persons found fit to be appointed as a member of the force in the order of their seniority. The seniority shall be assessed on the basis of the total length of service rendered as Special Police Officer.

(4)The list prepared by the screening committee shall be forwarded to the appointing authority, The appointing authority shall make appointments from the list in the order in which their names stand in the list.

( 5) A person appointed after screeping shall be issued an appointment order/ certificate in which it sh~ll be clearly mentioned that his appointment shall be treated as made under the relevant·provisions of these rules.

Training.- (I) The member of the force appointed under the provisions of the Ordinance shall be imparted six months' training which shall also include practical training. The following subjects, generally, shall be included in the training curriculum:- ·

(a) important characteristics of the Constitution of India;

(b) general introduction of Fundamental Rights;

( c) general understanding of human behaviour, as individual, as a group and as crowd and behaviour of police towards public;

( d) code of conduct for police;

( e) community policing;

(f) basic knowledge of Human Rights;

(g) basic knowledge of criminal law and procedure;

(h) intelligence/infm.nation collection;

(i) selected case studies to stress· upon the irrip0rtance of general courtesy, impartiality and integrity; · G) knowledge of the instructions relating to the security of Very Important Persons; ·

(k) role as member of a group during operations;

(I) map reading;

(m) arms training - Specially related to SLR, INSAS. and LMG training (training curriculum for different categories of arms will be .in accordance with the Chhattisgarh Musketry Regulations);

(n) prevention and control of fire;

( o) relief work during riatural or mah-mad~ disaster;

(p) unarmed combat;

( q) primary medical aid;

· (r) field-craft and tactics.

(2) Such other subjects may be included in the training curriculum as decided by Police Headquarter from time to time, keeping Jn v1ew the needs of the training.

(3) During training period, elementary ~ducation, as mentioned in the proviso to clause (a) of sub-rule (2) of Rule 12, shall ·be imparted to the concerning members of the force.

(4) If any member of the force has undergcne the prescribed training as ' - .

Special Police Officer, the period of such vrevious training shall be included in the prescribed training period under these rules.· ( 5) . After appointment, the prescribed training shall be given in the spt:cified training institutions and in other training units. The training period may be extended or he/she may be discharged fr~m the force in case of being unsuccessful in training or being unable· to achieve the objectives of training as prescribed from time to time.

14. Posting and controt- The member of the force may be posted in police stations/out posts or police -line or security -~amps · and shall work under _ command and control of such officers as specified by the Superintendent of P·olice.

15. Uniform· and accoutrements.- The members of the force shall wear uniform and accoutrements as specified by the Director General of Police.

16. General conditions of service.-Every member of the force-

(1) shall devote his full time to the force only. He shall not take part in any _ trade or commerce; · _

(2) shall sincerely and honestly use his best abilities to perform all his duties as a member of the force;

(3) shall know and comply with all policies,. procedure and guidelines that ~elate to their duties and must comply with - any lawful order and reasonable direction· given by someone who has authority to give -the direction and abide by the-provisions of police regulations and all rules, which shall, from time to time,- be made for the good order of the Force.

(4) 3hall serve and reside wherever he may be directed to serve and reside; _

(5) shall practise self:-discipline in word and deed both on and off duty and must pay respect to seniors, must trc at members of the public and colleagues with courtesy;

(6) shall wear, when Oh duty, such dress and accoutrements as shall, from time to time, be prescribed for every member- of the force and shall be always neat and clean· in his appearance .. Any member of the force shall not appear partly in uniform and partly in mufti; · - · . (7) shall not withdraw himself from the force without specific permission in writing, or (in the absence of such permission) without giving two months previous notice of his intentions to do so;

(8) shall not, on any occasion or under any pretext, directly bi indirectly, take or receive any present, gratuity or fee from any person without the sanction of the Superintendent of Police;

(9) shall make every effort to respect and uphold the rights of all people in the community regardless of race, social status or ·religion and shall perform their official duties and so arrange their private affairs in such a manner that public confidence and trust in the honesty, integrity, objectivity and impartiality of the member of the force are conserved and maintained; · .

(10) On ceasing to be member of the Force, he shall immediately return all kit and accoutrements, and vacate any quarter which has been allotted to him. .

17. Misconduct.- ( 1) Violation of general conditions of service;

(2) Wilfully disobeying lawful orders/instructions of controlling/supervisory officers; · ·

(3) Indulging in any work that has been termed as misconduct, for member of the force by written order of the Director General of Police.

18. Departmental punishment.- If any member of the force is found guilty of misconduct under Rule 17, the Superintendent of Police may, after giving an opportunity of being heard and for the reasons to be recorded in writing, terminate such member from the Force. . .

Apart •from above, the member of the force shall be liable to such department<l,l punishment as may be prescribed by order in writing by the Director General of Police.

19. Representation against termination/punishment.- Subject to the provisions of Rule 18, a member of the force may make a representation against order of termination of service or imposition of punishment, · in accordance with sub­ section (3) of Section 10 of the Ordinance, to the Inspector General of Police Range within 30 days· of such order. Superintendent of Police shall maintain the record of service books in the same manner as applicable in the case of Police Constable (GD) of the district.
