(2) The assessment proceedings of above dealers under the Chhattisgarh Vanijyik Kar Adhiniyam, 1994 (No. 5 of 1995), the Central Sales Tax Act, 1956 (No. 74 of 1956) and the Chhattisgarh Sthaniya Kshetra Me Mal Ke Pravesh Par Kar Adhini~am, 1976 (No. 52 of 1976), due for completion by 31st January, 2003 under the provisions ())f sub-section (8) of section 27 of the Chhattisgarh Vanijyik Kar Adhiniyam, 1994 (No. 5 of 1995), have to be completed before 31st January, 2003.

(3) Correct assessment of all above dealers on merits has to be made after affording them a reasonable opportunity of being heard; Now, therefor, in exercise of the powers conferred by sub-section (9) of section 27 of the Chhattisgarh Vanijyik Kar Adhiniyam, 1994 (No. 5 of 1995), the State Government hereby extends upto 30th June, 2003, the period for completion of every such assessment proceedings in respect of above dealers under the said Acts, which is not completed by 31st January, 2003. (ii) Sub-section ( 5) of Section 8 of the Central Sal9s Tax Act, 1956 (No. 74 of 1956 ), The State Government hereby specifies that a de 11er who manufactures Ferro alloys and holds eligibility certificate under notificatio 1 No. A-3-24-94-ST-V( 108) dated 06-l 0-1994, closes down the industrial unit during the period of exemption and restarts production in such unit subsequently its revival and, if the dealer proves to the satisfaction of the authority competent to decide he eligibility for exemption under this notification that the industrial unit had to be \closed down for that period for the reasons beyond his control, the dealer, subject ~o the provision of extent of maximum exemption of cumulative quantum of tax, sh~ll be eligible for exemption for a further period equal to the period during which he industrial unit remained closed, commencing immediately after the expiry of the period of eligibility or from the date of restart of production in the unit after its revival whichever is later.

Explanation - The expression "for reasons beyond his control" means the reasons which shall be decided by the State Level Committee ac I rding to the merits of each case. 2. This notification shall be deemed to have come into force with effect from
