CHAPTER :X: PENSION, FAMILY PENSION & COMMUTATION BENEFITS

70. of pension benefits admissible to the Govt. servant of ~ Madhya pradesh, under the Madhya pradesh Civil Servi~e3 (pension) R'J.les 1976 and the M. P. Givil Pe1~&ion (Commut.:1.- tion) Rules 1976, as amended from time to time may be made applicable to the offiee teachers, and service personnels, other then the Chancelloi; and the Vice-Chancellor, with effect from 1.4.1987. These rules shall not apply to:-
(i) Persons ·paid from Contingencies.
(ii) Persons in · casual and daily rates employment. Schemes:- Consequent thereon, there shall be the following two schemes in operation, in the Vishwavidyalaya. Scheme=~ A. _Employees contributory Provident Fund Scheme, as per statute 39 ·to statute SO, under Chapter-V of the IGKV, Statute 1987, and Scheme:- B. Pension and Gratuity Scheme of the State Govt. of Pradesh; under the M.P.Civil Services (Pension) Rule 1976, as amended from time to time.
71.l Option:- All employees, officers and teachers who were in the service of the Vishwa Vidyalaya as on 31.3.1987 and were eligible for employees _cc;mtributory Provident Fund Sc~eme (Scheme~A) and who ar~ continuing .in the services of the Vishwa Vidyal~ya _wi~l be required to give an option to elect to continue under the existin~_employees contri- 2 butory Provident Fund Scheme (Scheme-A) or to elect to come un<ler the pension and gratuity -scheme. _(Scheme-B). The form pf .option is enclosed (appendi~) .
71.2 Option:- Once exercised shall be final AND BINDING, which should be exercised within, a period of 60 days form the date of issue of the Additional Statute, in the prescribed form (Form enclosed) in QUADPRUPLICATE, to be signed in the presence of the Head of Office. The FIRST copy shall be pasted in _the Service-book of the employees (and recorded in the Service Book, under the signature of the Head of the Office, of his having given the option for the scheme, A or B with the date of r option), the SEco_ND copy shall remain in the personal file of the employee maintained by the Head· of the Office/ D00 , the THIRD copy shall be sent for record, to be kept in the personal file of the employee, maintained by the fund Section and the FOURTH copy shall be sent to the office of the Registrar, for safe record. In case one fails ~ogive an option, within the prescribed period, it may be construed that he has retained to remain under the Contributory Provident Fund (Scheme-A).
71.3 Where an employees has died on any date prior to the stipulated date of Option, his family has to be given the benefit of Pension and qratuity Scheme-or the Employees Contributory Provident Fund Scheme, according to family 1 s option (legal hefr) •

74.1 3 Counting of ~ast _~ervice for Pension:- Anemployee joining the Vishwa Vidyalaya Service after continuous qualifying service on permanent or temporary basis shall, in the event of permanant appointment or absorption in the Vishwa Vidyalaya at his option, will be allowed the benefit of past contin~ous service ren dered in the Government or other Organisat -ions, fully or partly financed by the State Govt. of M.P. or Central Govt. or any organisation of repute , which has recogni tion of State/Central Govt. The amount . of retirement benefits deposited to Pension Fund shall be commensurate ~ith the period for which retirement benefits are deposi ted by the employee provided:- i. The absorption is in public interest~ and ii. All retirement benefits received by the employees ar~ refunded to the Vishwa Vidyalaya for depositing in the Pension and Gratuity Fund. iii. In such cases only such period of service rendered on the regular establishment against a regular time scale of pay will be taken in to account as qualif ying service for pension and/or Gratuity as may be ~dmissi-ble under the Rul~s-.- - Since the Vishwa Vidyalaya had adopted the M.P . Civil Services (Pension) Rules 1976 this•will be regul~ted acco rding to the Provision of Chapt~r III of Pension Rules. Persons retiring after 1.4.1987: The employe~s who have already RETIRZD on or after 1.4.1987 and have given option for joi~ing the Pension and Gratuity Scheme and have received part or full amount with interest of their contributory Provident Fund shall be required to -f:+J.ff w[/ '!, ~ ·---~. r,, 4 deposit in one inst -~ lment in the Vishwa Vidyalaya the part or full share of the Vishwa Vidyalaya contribution towards Provident fund along with interest thereon paid to . them along with interest on the above amount at the rate it was last allowed to them on the date of retire ment .from.the date of receipt of the amount till the date \ . . on whic~ the amount is credited ~ack to the Pension Fune with in a period- of two months from the date of issue th.is order to avail of the ben'efi t of the Pension and Gratuity Scheme. 742 The employees who have retired after J.4.1987 have not received part or full amount of their contributory · Provi dent Fund with interest tr.ereon, relating to Vishwavidyalaya share shall have to _give a written undertaking to the

Vishwa Vidyalaya to transfer the remaining or full amount with interest thereon to the Pension Fund within two months from the date of issue of the order, to be eligible for Pension and Gratuity Scheme. Persons who do not fulfil the conditions by the date prescribed above shall not be eligible to get the benefit of the Pension and Gratuity Scheme. Nomination Form. The employees who now decide to witch over to the Pension and Gratuity Scheme· are · advised to submit the NOMINATION FORM in QUADRUPLICATE, alongwith the OPTION FORM, as per rule 46(i) (Form I and II as endorsed) or the M.P.Civil Services (Pension) Rules, 1976 copies of which shall be pasted in the Ser.vice book and kept in record, with the Head of the Officer/DDO Fund Section and the Office of the Registrar, mq.tatis-mutandis, ~f-t•1~ I • ,..._. 5 as per procedure brought under clause 71.2 of the Aditional Statute.
76. Pension and Gr.atuity Fund :- In order to meet the expenditure on pension and Gratuity disbursement to the empl9yees of the Vishwa Vidyalaya as prescribed in the M.P.Civil ServicJ (Pension Rule 1976 and in order to meet other incid0ntal expenses on the operation of the Scheme a Pension and Gratuity Fund shall be created centrally, to be operate py the Comptroller. · It shall comprise and constituted out of the following amounts:-
(a) Monthly constributory provident fund subscription made by the Vishwa Vidyalaya to the account of each employee as the Vishwa Vidyalaya share in respect of persons who elect to join the pension and gratuity scheme under this Statute.
(b) The accumulated balance of the subscription to the contributory Provident Fund of each employee ma'-. .'.? by the Vishwa Vidyalaya as Vishwa Vidyalaya share Eogether with interes·t ·thereon 'Upt6 .. 31--:-3;19s7 will be credited to the Pension and Gratuity Fund. The Vishwa Vidyalaya share of the employees who h~ve opted to retain the contributbry Provident Fund Scheme will not be transfarred to the Pension and Gratuity Fund but ~hall be continued to be maintained sepera tely as per provisions of the existing contributory Provident Fund Scheme.
(c) Grant-in-aid sanctioned by the Government from time to time to cover the deficiency of funds in running the Pension and Gratuity Scheme.
(d) Amount earned as interest on investment of the Fund. --~~~k ~- ·I-\., ' .

(e) Amount mention~d under Statute 74.2 above.
(f) The employees who have already retired on or after
1.4.1987 and have - given option for joining the Pension and Gratuity Scheme and have received part or full amount with interest of their contributory provident fund, shall be required to deposit in one instalment in the Vishw2 Vidyalaya contribution towards provident fund alongwith the interest thereon paid to them along with simple interest on the ~~ove amount at 5¾ from the date of receipt of the amoun~ till the date on which the amount is credited to the Pension fund for transfering to the Pension and Gratuity fund with in a period of six months from the date of promulgation of this Statute to ~ ~ get the benefit of the Pension and Gratuity Scheme. Pension retiring after 1.4.1987 :- The employees who have retired after 1.4.87 but have not received p~rt or full amount of their contributory provident fund interest therzon shall have to give a written undertaking to the ·Vishwa Vidyalaya to transfer the remaining pa:?.:"t or full amount v!i th interest to the Pension an<:! 9ratu_i tY. .~J..lnd_wi.:thin two.-..r.ir.mths f-rom the date of promolgation of this Statute to be eligible for ?ension and Gratuity benefits under t~is Statute . p;rsor.s who do not fulfil this condition by the date prescribed above .shall not be eligible to get the benefites of the Pension and Gratuity Scheme.
78. Contribution to Pension Fund:- The monthly contribution towards contributory Provident Fund amount of each e mpl0yee as Vishwa Vidyalaya share shall be fixed once in a year preferebly in April every year and the amount so determined in resp2ct of the eligible employees of the Vishwa Vidy~laya shall be ~ 7 7 credited in the Pension and Gratuity Fund. The assess mant of th-::::i amount will be done in the month of may of the following year and the difference of amount, if any, will be made good. '
79. Audit -of Pension Fund : - The amounts of pension fund at the Vishwn Vidyalaya head quarter will be checked and audited by the Local Fund Accounts, Department or State Govt. of M.P., Gwalior, through their resident auditors stationed at the Head quarter of the Vishwa Vidyalaya.
80. General Provident Fund Rules:- The M.P. General Provident Fund Rules 1955 as amended from tim2 to time shall be applicable to the employees enjoining the benefit of the Pension and Gratuity Scheme (Scheme-B).
81 . General Provisions :- In case of doubt or where any provision in the Statute is not clear, the rules as laid down in the M.P.Civil . - - -- -- . - - ·- - - - ·--- -- - ·- - -----•-·--- Services (Pension) Rules 1976 will b~ applicable.
