M.P. Raj. Ext. dt. 14-8-1995. p. 768(3)).-In exercise of the ,?owersconferred by sub-section
(1)of Section 95 read with Section 117 of the Madhya Pradesh Panchayat RajAdhiniyam, 1993 (No; 1 of 1994), the~State ;Government hereby makes the followingrules, the same having been pfeviously published as required by sub-section (3) of Section 95 of the said Act, namely:-
1. Short title. Th('se rules may be called the Madhya Pradesh Janapada Panchay<tl Members (TraveJing and other allowanct:s) rules . . 1995.
2. Definitions.-ln these rules unless the context oth
(a) "Act"means the Madhya Pradesh Panchayat Raj (No.1 of 1994);
(b)"Member"means a member of Janapada Panchaya other than the member referred to in clause (iii), of sub-section (1)of Sec' 22 of the Act; R.3 JANAPADA PAN .... TRLVELLING ... RULES, 1995 (PR)259 (c;) "Panchayat" means the JanapadaPanchayat;
(d) "Place of meeting" means a place fixed for the meeting of the Panchayat or a"place to which jOl.:.rney is required to be performed by President, Vice-President and any member under general or special order of Government;
(e) the expression "Place of resLence" means in case of the President, Vice-President and the member and the member of the Janapada Panchayat, the place ill1timated to the Chief Executive Officer, where the member usually resides, if such ple-ce is within the Janapada Panchayat area and if his actual place of residence is situated outside the Janapada Panchayat area, then the specified nearest place within the Panchayat area; (f) "President and Vice-President" means the President and Vice President of Janapada Panchaya-t.
3. Travelling and daily a1lowar.ceadmissible on tour.-(l) Subject to the provisions of these rules, the President. Vice President and the members of the Panchayat shall be entitled to travel in Higher class cf bus or rail as specified in column (4J of the following table and to draw daily allowance at the rate as specified in column (3) of the said table:-. (4) The melllers of Madhya Pradesh Legislati\\ Assembly who are ex-officio membu of the Panchaya( by virtu:e of the provision of the Act shall not be entitJd to draw any alJnwances under tlLese rules.
(5) The PresiC~~nt, Vice Pres:dent or any Inem;)er whose place of residence is at a di--tance of more than eight kilometers from the place of meeting, subject to the provision of these rules. shall be entitled to draw,-
(i) Traveliin~ allowance for the journey perrormed by him for attending, \ meeting of the Panchayat and !lack to his place of residence: t the following'rates,-
(a) by railway. one return actual fare of the Class iI1which he performs the journey;
(b) by road L-;. a Publicbus (stag~carriage)one return actual fare;'
(ii) Daily allowance for the day ofmeeting at the rate mentioned in sub-rule (1);
(iii) the travelling allowance under claus.e (1)of sub-rule (5)shall be calculated by the shortest route and cheapest mode ofjourney.
(6) The travelling allowance payable in a month to the different calegories ofmembers specified in column (2)of the followingtable, shall be limited to the maximum number ofjourneys undertaken as specified against each in column (3)of the said table:- TABLE
4. Tour outside Jurisdiction. J l) If the President, Vice President or any Member undertakes any tour OL... ,J~de the jurisdiction of the Panchayat concerned in connection with any meeting. he shall be entitled to draw daily allowance and travelling allowances at the rate. specified in.sub-rule
(1)of rule 3, subject to the provisions of sub-rule (2).
(2)No such tour shall be undertaken unless authorised by general or specific order of the District Collector:
Provided that no tour shall be undertaken outside the District unless, the State Government specifically permits for it in advance.
5. Tour by own vehicle.-Tour by own vehicle shall not be permitted.
6. Tour by Panchayat vehicle.-(1) When a vehicle is provided to President, Vice President and any member of Panchayat, the monthly ceiling on consumption of Petrol/diesel and the ceiling .ofmaintenance of ._ such vehicle shall be governed by the instructions issued by the Panchayat and Rural Development Department from time to time.
(2)NoPanchayat Vehicle shall be taken outside the jurisdiction of the concerned Panchayat without the written permission of Divisional Com- . missioner.
7. 9. Claim for allowances.-(l) Aclaim for allowance under these rules, shall be preferred within one year of its becoming due.
(2)A claim for travelling. daily allowance and other allowances shall be deemed to have become due on the last day of the month to which it relates.
(3) If claim is preferred after one year, the reasons for the delay for submission of the same sha.ll be stated by the claimant in his bill, to the satisfaction of the _C01,l.I}.t~!:s.igningauthority. 11. Removal of difficulties.-If any dmibt or difficulty arises about the interpretation of these rules, the matter shall be referred to the State Government whose decision shall be final.

3. Sarpanch and Panch not entitled to draw travelling 'and dally allowanpes. -The Sarpanch and Panchs shall not be entitled, to draw any travailing and daily allowance: .
