Provided further that no order prejudicial to any person shall be passed un\ess such person has been given an opportunity of making his representa­ tion.

(5) The Chancellor shall exercise such 9ther powers and perform such other func­ tion_s' as may be conferred or imposed on him by_or 1mder this Adhiniyam.

(1) Every appointment of the Vice-Chancellor shall be made by the Chancellor 'from out' of a panel of three names of eminent persons who possess master degree in the field of veteri~ary and allied sciences with minimum ten years experience as eduationist or researcher or administrator in the university sys­ tem as recommended by the committee referr.ed to in sub section 2 and such panel shall not contain the name of any member of the said Committee:

Provided that preference will be given to a person who possesses doc­ mrate quaJification in veterinary and allied sciences with minimum tea years experience as educationist or researcher or administrator in the university sys­ tem .

(2) For the purpose of sub-section (t), the Commillee shall consist of three per­ mas from whom one shall be nominated by the Executive Council and one shall be nominated by the State Government and one shall be nominated by the Chancellor:

Provided that the persons so nominated shall not be an employee of, ,,r a member of any of the authorities of, or any contractor or service provider ,)f the Vishwavidyalaya.

(3) · "he Vice-Chancellor shall hold office for a period oftive years and shall not be , ligible for reappointment for another term: Provid·~d thal no person shall hold the office of the Vice-Chancellor ho attains the. age of sixty five years: ·•rovided fm1her that:- 1) the Chancellor may direct that a Vice:Chancellor, whose term of o1'tice has expired shall continue in office for such period, not exceed­ ing a total period of six 'months; as may be specified in the direction ; (}1) the Vice-chancellor may, by writing under his hand addressed to the Chancellor, resign his office.

(5) The Vice-Chancellor·shall have power to take actio~ on any matter and shall, by order, take such action as he may deem nece sary burshall, as soon as may be, thereafter report the action taken to the officer or authority or body who or which would have ordinarily dealt with the matter:

Provided that no such order shall be passed unless the person likely to be affected has been given a reasonable opportunity ·of being heard.

(6) Any person, aggrieved by any order of-the Vice-Chancellor under sub-section

(5) may prefer an appeal to the Executive Council within thirty dllyS from the date on which such order is communicated to him and llw Vice-Chancellor shall_give effect to the order passed by theExeculive Council on such appeal.

(7) The Vice-Chancellor shall be responsible for co-ordiriafjon and integration of teaching, reasearch, extension education .and curriculum developmenL

(8) The Vice-Chancellor shall exerc;.se such other duties as may be prescribed. (I) The Registrar shall be a whole t me salaried officer of the V1shwavidyalaya and shall be appoin ted by Government on such terms and conditions as may be fixed by Government. (2'} The Regisrrar shall be a person who is currently serving under the State Gover.nment and. who is not t,elow the rank than that of a Deputy Secretary to the State Government or an officer of the State Livestock Development or Fisheries-department in the ·13ay scale of Joint Director of the departments. Cl) The Registrar shall be the ex-officio Secretary t_o the-Executive Counci l, the Academic Council anti Ehe Board or Sludies.

(4) When the office of the Registrar is temporarily, for a period not exceeding t.hree month~. fall vacant, or when th~ _Regist1ar is, by reason of illness, absence or for any other reason, unable to. e;ercise the powers, perfo-rrn the functions and discharge the duties of his office, the powers, functions and duties of the- office of th_e Registrar shall be exercised, performed and discharged by such person as the Vice~Ch~ncellor may appoint.

(5) IL shal I be the dmy of the Registrar to manage the property and investments of the Vishwavidyalaya including trust and endowed property in accordance with the decision of the Finance Committee and the Executive Council:

Provided that the Finance Offi.cer t>ha)i incur any expendi­ ture or make any investment with prior appron•l of the Exet:utive Council or as may be prescribed.

(6) Subject to the control of the Executive Council, ihe Finance Officer shall :-

(a) ensure that the limits fi xed by the Executive Cou n~il for recurring and non-recurring_ expenditure for a year are no1 c:,ceeded and tha the moneys are expended for tbe purposes .for which they arc !!ran tea or allotted; · · · ·

(e) Finance Officer. In case the Secretary to G~)VehJment in-charge of Animal Husbandry, Dairy and Fisheries or Finance Department is unable to _attend a meeting or the Finance Committee, for any reasons, he may depute any officer of his depart­ ment or his nominee riot below the rank of Deputy Secretary to Govemmen r to attend the meetings, and the officer so depu ted shall have the right to take part in the dhcussion of the meetings but shall not have the right to vote.

(3) The Vice-Chancellor shall be the ex-officio Chairman of the Finance Com­ mittee a~d the Finapce Officer shall be tqe ex-officio Secretary of the Finance committee.

(4) The Finance Commi ttee shall:

(a) examine the-annual accounts and .tfle annual financial estimates of the Vishwavidyalaya and advise the Executive Council thereon:

(h) . make recommendation to the Executive Council on all manern relating to the finances of the Vishwavidyalaya; and

(e) perform ·such other furtction as may be prescribed. The Executive Council may constitute such othex::authorities of the Vishwavidyalaya as may be necessary in the manner_prescrihed by the stat_u_tes.

CHAPTER-V Funds and Accounts The Vishwavidyalaya shall have a Vishwavidyalaya Fund ro·wmch sbafl be credited its income from fees, endowments, grants, donations and gifts, if any; and any contribu­ tion or grant rrade by the Central Government, State Government, the Vishwavidyalaya Grants Commission established under section· 4 of the Un"1versity C,ants Commission Act, 1956 (No. 3 of 1956) or authority alike or any local authori1y or any corporation owned or controlled by such Government. The Vishwavidyalaya may have such other funds as prescribed . Th~ funds and all moneys of the Vishwavidyalayn shall be managed in such manner as prescribed.. ( ]) The Government shall, every year, make non-lapsable lump sum recurring and n.on recurring grants m the Vishwavidya!aya lo meet such additonal expenditure, as the Government may deem necessary for the proper function­ ing pf the Yishwavidyalaya.

(2) The Yishwavidyalaya shall furnish such statement~, accounts, n.:pons and other particulars relating to any gr;;.·1t made by the Governrnen1 and its utiliza[ion as Lhe Government may require The Vishwavidyalaya Fund shall be utiiized for the following objec L,: (i} repaymen[ of debts incurred I y the Yishwavidyalaya for Lhc purpo. e of this Adhiniy_am an·d the Statutes, a,1d the .Regulations made there under;

(i) The conditions under which U,e research in the Vishwavidyalaya may be car­ ried on;

(ii) the manner in which and the conditions under which the honorary degrees and other-dis tinctions may be conferred; (ii i) the fixation, payment and receipt of fees and other charges;

(iv) the prescription of academic qualification and standards for admission to the VishwavidyaJaya;

(v) the terms and conditions subject to which the Registrar may be appointed and his powers, functions and duli ..:s;

(vi) the terms and conditions subject to which the Finance Officer may be appointed and his powers , functions and du ties;

(vii)

(a)

(b) Any member of the Executive Council may proposed to the Executive Council the draft of a stature and the Executive Council may either accept or reject the draft, if it relates to a matter not falling within the purv1ew of the Academic Council. In case such draft relates to a matter within the purview of the Academic Council, the Executive Council shall refer it for consider­ ation of the Academic Council, which may ei ther report to the Executive Council that it does not approve the draft or submit the draft to the Executive Council in such form as the Academic Council may approve and theE.x.ecuti.¥e- Council may either approve, with or without amendment, or rejea the draft. .

(5) A statute passed by the Executive Council shall be submi-n.ed· lO the Chancel­ lor who may assent thereto or with hold his assent and a statute passed by the Executive Counc:il shall have no validity unless ir has been assented lo by the Chancellor. Subject to the provisions of .this Adhiniyam and the .statutes, the ordinances may provide for all or of the following matters, namely :-

(a) the conduct ·of examinations including the appoinunems of examiners and their terms and conditions;

(b) the admission of the students to the Vishwm•idyalaya a:nd their enrolment and continuance as such and the conditions and proce-dures or dropping students from enrolment ; (cj the fees which may be charged by the Vishwavidyalaya:

(d) the courses of srudy to be laid down for all de_gr.ees, diplomas and other (e ) (fJ distinctions; · the conditions under which srudents shall be admitted to th e degrees d ipl o­ mas or other courses and examinations of the Vishwavidya!aya and their eli ­ gibii ity for the award of degrees and diplomas; the condition of con-ferment of degrees, diplomas and other academic distinctions;·

(g) the maintenance of discipline among the students ofthe Vishwavidyalaya; (h} the special arrangements, if any which may he made for residence, discipline and teaching women ~tw:lenls;

(i) the conditions of reside~ce ofstude0ts of l.he Visbwavidyalaya and the levy of fees for hostel;

(j) I lhe recogniti o n and / i;nanagemen.t of hostels not m-ai n Lai ned b the Vishwayidyalaya; and1

(k) any other matter required by A<lhiniyam or Statutes to be deal! by or u nder the Ordinance of lhe Vishwavidyalaya. p.. -. .., I

(3) The Executive Council may issue such directions as it may think fit to the authority concerned to amend any regulation . . CHAPTER· VIII Transfer ·of College9" and Institutions, Employees and Funds

(1) otwithstanding anything contained in ,Lhe Indira Q,!l,ndh( Krishi Vishwa. .• vidya)aya Adhiniyam,, l9&l.(No .. 2.Q.Q.H967), ot.the SLatutes, regulations and orders made thereunder, on and from the·commencement of this Adhi niyam, the Colleges mentioned in the Schedule shall stand transferred to, and mai n­ tained by, the Vishwavidyalaya as consitment college and institutions along with the movable and immovable property of the Vishwavidyalaya.

(5) ~~. ~1~2011 The Government may, at any time after the commencement of this Adhiniyam, transfer to the Vishwavidyalaya any of its lands for the use of the Vishwa­ vidyalaya on such terms and conditions as it may deem proper. The Government may, at any time after the commencement of this Adhiniyam, transfer to the Vishwavidyalaya, the control and management of any of its college or inst.Jtutions on such terms and conditions as it may deem fit. Notwithstanding anything con_~ned in any other Act for the time being in .force, relating to the estabfisl}Inent of a Vishwavidyalaya in the State or the statutes, regulatioijs and orders made there 1mder; on and from the date to be specified by the Government, the colleges and institutions referred to in sub­ section (l) s~all stand de-.affiliated preceding such-specified date and shall be deemed to _be colleges or institutions affiliated to the Visbwavidyalaya and the provisions of thisAdhiniyam shall , as far as may-be, .apply accordingly. otwithstanding anyi:hing contained.in this Adhiniyam, the statures or regulations, every stud.em of the colleges specifiedjn sub-section (1) of Section 45 immediately · before the commencement of this Adh1niyam was studying in such ·colleges or was eligible to be admitted to any exami,nation held or conducted by the Indira Gandhi Krishi Vishwavicl,yalaya _and shall be permitted to complete his course of study or b~ admitted to the examination of the Vishwavidyalaya and the Vishwavidyaiaya shall make arrangements:

(a) for the instructi_on, teaching, training and holding ex;imination for suc;k student for. such period-and in such .manner as may be determined_ by the.Jfrst Vice-Chancellor in accordance with the course of study in the Indira Oa~dhi Krishi Vishwavidyalaya; and

(b) for the conferment 0f the correspondlllg degcee; diploma or other -academic distinction of the Vishwavidyalaya upon the qualified student on the result of such examination .

(2) Every person who, immediately before the commencement of this Adhiniyam, is serving in the college and institutions of the Indira Gandhi K.ri shi Vishwavidyalaya w.hicb· shall get transferred to the Chhattisgarh-Kamdhenu Visbwavi_dyalaya shall, as from the said day, become an .employee of the Chhattisgarh K.amdhenu Vishwavidyalay.a

(a) As soon as may be, after the commencement of this Adhiniyam, the Government may , after consulting the Vice-Chancellor of the Indira Gandhi Krisbi Vishwavidyalaya and the Chhattisgarh Kamdhenu Vishwa;vidyalaya, direc t,. by general or special order, th<1t such employees of the Indira Gandhi Krisbi Vishwavidyalaya and as are specified in such order, shall stand allotted to serve in connection with the affairs of the Indira Gandh.i Krishi Vishwavidyalaya and or Chhattisgarh Kamdhenu Vish.wavidyaiaya with effect from such date as .shall be specified in such order;

(b) With effect on and from the date.specified in the order under clause

(a) of sub-section (2), the persons pecified in such order shall be­ COJJ:1~ employees of the Indira Gandhi Krishi Vishwavidyalaya or Chhattisgarh Kamdhenu Vishwavidyalaya and those transferred 10 the Chhattisgarh Kari:idhenu Vishwavidyalaya, shall cease to be employees of the Indira Gandhi Krishi Vishwavidyalaya, as the case may be.

(3 ) Every person r~ferred to in sub-section ('I) shall hold office under the Chhatt.isgarh Kamdhenu Vishwavidyalaya for the same tenure and at the same remuneration and upon the same right and privilege as to pensron or gratuity, I -· r

(4) The liabiliries to pay pension and gratuity and accumulated superannuation fund or other like funds, to the person ·referred to in sub-section (l) shall be the liability of the Indira Gandhi Krishi Vishwavidyal~ya, and Chhattisgarh Kamdhenu Vishwavidyalaya proportional to the length of service in Vishwavidyalaya's mentioned above. ( I.) The sums of the credit of the provident fu"nd accounts of the persons referred to in sub-section (3) of t!Ction 47 as on the appointed day and of the persons referred to in sub-section (2f of that section as on the date specified in the order under clau ·e (a) of the aid sub-section (2) shall be tran_ferred to the Cl:hattisgarh Kamdhenu Vishwavidyalaya and the liability in respect of the said provident fund accounts shall be the liability of the Chhattisgarh Kamdhenu Vishwavidyalaya. ·

(2) There shall be paid to the Chhattisgarh Karridhenu Vishwavidyalaya out of the_accumulations in the superan nu_atiori fund and _other like funds., if any, of the Indira Gandhi Krfshi Vish.wavidyalaya and or, as. the case may be, of the Government such amounts as have been credited to the superannuation fund or other like funds, if any, on behalf of the person referred to in sub-section

(1) and_(4) of seclion-47, and the:amounts so paid shall form part of the super­ annJ.!ation fund or other like funds, if any, thal m_ay be established hy Chhattisgarh Kamdiienu Visbwavidyalaya for the benefit of its employee .

(l) 1 he lndira Gandhi Krishi Vishwavidyalaya shall, out of its fund as on the c )mmencement of this Adhiniyam, pay to the Vishwavidyalaya such amount «J the Government may, in consultation with the lodira Gandhi Krishi Vishwavidyalaya and Chhattisgarh Kamdhenu Vishwavidyalaya by an order specify.

(2) The State Government shall make an endeavour to issue the order under sub­ seetion {I) within 18 months of the establishment of the Vi.shwavidyalaya. (I)

CHAPTER-IX _ Emergency Powers of the State Government .i.f the State:: Government is satisfied that owing to ma! administration or finan - 1 ial misinanagem1;nt in "the Vishwavidyalaya, a situation has arisen where by i nancial stability of the Vishwavidyalaya has become insec·ure, it may by ! :itification, declare that the finances of the Vishwavidyalaya shall be subject _ 1 1 the control of !he State GovernmenL

(5) Notwithstanding0anyth"ing contained in this Adhfoiyaii?, it shall be binding on every authority of.,the Vishwavidyalaya and exery officer. of the Vishwa­ vidyalaya to give_afect to t~e _direction given ~ndei this section.

(6) Every officer of.the Vi;hwavidyalaya.shall be personally liable for misappli ­ catioll of any fund or property of the Vishwavidyalaya as a result of non­ compUanc.e.of the •direction ,given under this $ect1on .to which he shall have been a party or which shall have· happened through or been facilitated by gross neg)ect-of'.,his duty as· such officer and the loss so incurred shall, ,on a certificate issued .by the Secr.etary in charge of Animal Husbandry Depart­ ment, be recovered from suc·h officer as an arrears of land revenue : (I)

Provided ihat no ac'tion to recover the amount of loss as an arrear of land revenue shall be taken until reasonable opportunity has been given to the person concei:ned to furnish i.l.ll explanation and such explanation has been considered by the Goyemment. 1f the State Government, on receipt of report or otherwise is satisfied that a situation has arisen in whic_h the administration of the Vishwavidyalaya cannq~ be carried out in acc,ordance with the p~oyisions of the Adhiniyam, without detriment to the interests of the Vishwavidyalaya, and it is expedient in the interes.t of the Vishwavidyalaya so to do, it may by notification, for reasons .to be mentioned there in, direct that the provisions of sub-section (2),

(3), (4) and (5) shall, as from die date specified in the notification (11ereinafter in this section referred to as the appointed date) apply to the Vishwavidyalaya. (4) Tbe Executive Counc il may remove, py an ord~r in writing made in this behalf, any-persoa from membership of any aut~ority of the Vishwavidyalaya by a re olutioo passed by a majority of the total membership of the Executive Council and by a majority of not less than two third of the members of the Executive Council present an voting at the meeting, if uch person has been convicted by a criminal court on an offence wliich in 'the opinion of Executive Council involves moral turpitude or if he has been guilty of gross misconduct and for the ame reason the Execu4ve Council may ~ithdraw any degree or diploma or o~_er academic distinction conferred on, or.granted to, that person by the Vishwavidyalaya. . The Vice-Chancellor, the Regisrrar, the Comptroller, the D~ans and the Directors and other employees of the Vishwavidyalaya all be deemed, whe!l acting or purporting to act in pursuance of any oflhe provision of the Adhiniyam, to be public servants within the meaning of ection 20 of the Indian Penal Code, 1860 (No."45 of J 860).

(1) If any difficulty ari es in giving effect to the provisions of this Adhiniyam, the tale Government may by order published in official Gazette not incon­ sistent with the provision of this Adhiniyain remove the difficulty:

Provided that no such order shall be issued after the expiry of two years from the appointed day.

(2) Every notification issued under sub-section (l) or under any other provisions of this Adhiniyam shall as soon as possible after it is issued be placed on the table of the Vidnan abha, and if before the expiry of the session in which it is so placed or the next session the Vidhan Sabha makes any modification in any such notification or th<:_~ _sembly decides that the notific4:tion should not 554 ( 59) Removal from membersltip. (2) Such cessor shall not affect-

(a) the previous operation of the aid adhiniy_am; or

(b) any penalty forfeiture or punishment incurred in respect of any offence c"oI1ll'.flitted against the said adhiniyam; or

(c) _ any investigation, legal proceeding or remedy in respect of such penalty forfeit1.Jre or .punishment and any such investigation legal proceeding or remedy may be instituted, continue or enforced and any :mch penalty forfeiture or p~nishment may be imposed as if this Adhiii iyam has not been passed.

(3) Notwithstanding anything contained in sub-section ( I) all statutes and regulations made under the Indira Gandhi Krishi Vishwavidyalaya Adhiniyam, J 987 and in force on the appointed day shall in so far as they are not inconsistent with the provisions of this Adhiniyam, continue to be in force until they ·are repealed by statutes and regulations to be made under this S. t.,lo. l. .2.

Be it enacted by the Chhatitsgarh legislature in the Sixty-eighth Year of the Republic of India, as follows:- I.

2. ( I) This Act may be called the Chhattigarh kamdhenu Vishwavidyalaya (Sanshodhan) Adhiniyam, 2017 .

(2) It shall extend to the whole State of Chhattisgarh.

(3) It shall come into force from the date of its publication in the Official Gazette. In the Chhattisgarh kamdhenu Vishwavidyalaya Adhiniyam, 2011 (No. 21 of 2011 ), (hereinafter referred to as the Principal Act), in Section 9; in sub-section (3),-

(i) for the words "and shall not be eligible for reappointment for another term" , the words "and shall not be eligible for appointment for more than two terms" shall be substituted; and

(ii) in the first proviso, for the words "s ixty five", the word "seventy" shall be substituted. Short title , extent and commencement. Amendment Section 9. of 276 (2) Amendment Section JO. In Section 10 of the Principal Act, in sub-section (!), for the words and punctuation "Provided that, the Vice-Chancellor so appointed shall not be eligible for reappointment for aunother term.", the words and punctuation "Provided that, the Vice-Chancellor so appointed may be eligible for reappointment under Section 9 of the Act." shall be substituted. In Section 22 of the Principal Act, in sub-section (2),-

(a) under headidng "Ex-Officio Member",-

(i) in entry (iv), for the words "Al I Directors", the words "One Director, as nominated by the State Government" shall be substituted;

(ii) in entry (v), for the words "All Deans ofFaculties", the words "Dean of one Faculty as nominated by the State Government" shall be substituted; and

(iii) in entry (vi), for the words "All Deans of Colleges", the words "Dean of one college, as nominated by the State Government" shall be substituted.

(b) Under the heading "Other Members",

(i) in entry (iii), for the word "one", the word "two" shall be substituted;

(ii) in entry (v), after the words "industries connected with dairy", the words " and one representative of livestock production and conservation" shall be inserted; and

(iii) in entry (vi), for the word "one", the word "two" shall be substituted. In Section 5 l of the Principal Act, after sub-section (5), the following shall be added, namely:- "(6) Election of student union at University and College level shall be held in accordance with the regulatio'ns to be framed by the Executive Council on the recommendation of the Academic Council; as per the guidelines of Government ofChhattisgarh issued from time to time."
