I I 5-l/viii-Trans/2015.- The following draft to amend the Chhattisgarh Motor Jes Rules, 1994, which the State Govermnent propose to make in the exercise of the rs_~onferred by Section 111 of the Motor Vehicles Act. 1988 (No. 59 of 1988), is Y published as required by sub-section (I) of Section 212 of the said Act, for the C' ation of all persons likely to be affected thereby and notice is hereby given that the draft shall be taken into consideration after the expiry of thirty days from the date of ·1~ation of this notice in the Official Gazette, . '· Any objection or suggestions regarding the said draft received from any person before \pecified period, in office hours by the Office of the Additional Chief Secretary , -sport). Government of Chhattisgarh, (Room No. S-4-10). Mahanadi Bhawan, Mantralaya, ya Raipur, shall be considered by the Govermnent of Chhattisgarh.
DRAFT AMENDMENT In clause (b) of rule 170-A.-
(i) After the words means a", the word "Deluxe' shall be inserted; and
(ii) After figure and word "205 inches", the words and no Vehicle other than Deluxe Coach shall be included in it" shall be inserted.
For clause (a) of sub-rule (2) of rule 170-C. the following shall be substituted, narnely-
(a) The arrangement of sleeper berth in the vehicle shall be provided along with the length of the vehicle on the basis of two tier system,

(i) The length of each berth shall not be. less than 1750 mm. and more thar 1760 m.m.
(ii) Where berths are in a row then the width shall not be, less than 650 m.m. and more than 7 50 m.m.
(iii) Where berths are double/joined then the width shall not be. less than 1100 m.m. and more than 1200 m.m.
Provided that measurement specified for structural partition mentioned in sub rule (2) of rule 170-C shall not be applicable.
(b) The thickness of each berth shall not be less than 75 m.m.".
3. For sub-rule (I) of rule 170-D, the following shall be substituted, namely - "(I) (a) The provisions of deluxe sleeper coach shall as far as possible be applicable to the semi-sleeper coach except that the sleeper berth in semi-sleeper coach may be provided along with the length of the vehicle :
in the upper half side of the coach on both sides.
(b) The length of each berth shall not be. less than 17 50 m.m. and more than 17 60 m.m.
( c) Where berths are in a row then the width shall not be, less than 650 mm. and more than 7 50 m.m ..
( d) Where berths are double/joined then the width shall not be. less than 1100 m.m. and more than 1200 m.m.
Provided that measurement specified for structural partition mentioned in sub rule (2) of rule 170-C shall not be applicable.

4. After rule 170-F, the following shall be added, namely - "170-G. Miscellaneous -
(1) It shall be the responsibility of Inspecting Officer to strictly comply with the provisions of rule 46 and he shall also be responsible for ensuring compliance of the prescribed measurements mentioned in rule 170-A to 170- G and other technical provisions of the Act and these rules in respect of each vehicle inspected by him.
(2) This provision shall be applicable after six months from the date of enforcement of this provision on such Stage Carriage and Contract Vehicle (whose wheel base is not less than 205 inches) which has been registered before coming into force of this provision.
(3) Public Service Vehicle found in violation of provision of rule 170-A to Rule 170-D may be detained by the concerned Registering Aurhority I Authorised ~ible be Officer and shall be kept in safe custody at a nearest Police Station/Police berth in" Line or Transport Check Post and the Authority so detaining the vehicle shall vehicle forward such case within twenty four hours to the Registering Authority for taking appropriate action for suspension of Registration Certificate under td more Section 53 of the Motor Vehicles Act. 1988 (No.59 of 1988)".
