(1) This Act may be called the Mahatma Gandhi Udyanikee Evarn Vanikee Vish-uravidyalaya Adhiniyam , 2OL9; (21 It shall extend to the whole State of Chhattisgarh;

(3) It shalt come into force from 1"t April, 2O2O. In this Act, unless the context otherwise requires,-

(i) "Horticulture" means the basic and applied science of fruits, vegetables, flower, spices, medicinal and aromatic plants, mushrooms, landscaping, agroforestry and apiculture (bee keeping), production, processing and management and betterment of the rural people; (iil "College" means a college of the Universit5r under the direct control and management of the Board and the Principal Executive Officer of the University whether located at the headquaters, campuses or elsewhere;

(iii) "Extension" rneans all educational programmes undertaken for the purpose of ascertaining the problems of research in horticulture and allied sciences, disseminating the results of research to extension,

(iv) "Hostel" means a unit of residence for students of the University provided, maintained or recognised by it; (") "Registered Graduate" means a graduate registered under the Provisons of this Act;

(vi):T::::"'i:'1,1':-T,I:::'*1L:""H"1T'T: Constitution of India; . (vii) 'iScheduled Tribes" means the Scheduled Tribes specified in relation to this State under Article 342 of the Constitution of India;

(viii) "statutes and RegUlations", means respectively the time being;

(ix) "student of the University" means a person enrolled in the University for taking a course of study for a degree, diploma or other academic distinction duly instituted; 1111 "Teacher of the University" means a person appointed or recognised by the University for the purpose of imparting instructions and/or conducting and guiding research and/or extension programmes and includes a person who may be declared by the statues to be a teacher;

(xi) "Uriversity" means the Mahatma Gandhi Udyanikee Evam Vanikee Vishwavidyalaya of Chhattis garh. CIIAPTER-II THE UNTVERSITY Incorporation. 3. (1) The Chancellor and first Vice-Chancellor of the University and the first member of the board and of the A.cademic Council of the University and all the persons who may here after become such officers or members are, so long as they continue to hoid such office or membership, hereby shall be constituted a body corporate by the name of the University. , GHi'-d3tfrrTER2ole 1822 (6r)

(2) The University shall have perpetual succession and common seal and shall sue and be sued by the said name.

(3) The headquarters of the University shall be located at Tehsil Patan in District Durg.

4. The University shall among others have the following purposes:- Objects of

(a) making provison for the education in horticulture and other University. allied sciences;

(b) furthering the prosecution of research, particularly, in horticulture, and other allied sciences;

(c) undertaking field extension programmes; and

(d) such other purposes related to the aforesaid with the object of improving the level of living of rural people as the State Governrnent may direct, by notification.

5. The Uhiversity shall have the following powers, namely:- powers of

(1) to acquire and hold property both movable and irnneovable, University. to lease, sell or otherwise transfer any movable or irnrnovable property vesting in or acquired by it for the purposes of the University excepting Government land and its institutions ;

(2) to cultivate and promote the study of, and to provide for instruction, teaching and training in :-

(a) horticulture, agriculture engineering and technologz, rural industry and business, and other allied sciences; and

(b) such other branches of learning as the University may deem fit;

(3) to make provision for research and for the advance and dissemination of knowledge in horticulture and allied sciences and to institute and manage Horticulture Extension Service including rural youth programmes;

(a) to institute degrees, diplomas and other academic distinctions;

(6) to institute teaching, research and extension posts required by the universit5r and appoint persons to such posts;

(7) to determine qualifications to recognise teachers as qualified to give instructions in a college or to carry out research and extension work in horticulture and allied sciences ;

(8) to provide such lectures and instructions for and to grant such diplomas to field workers and other persons, not being enrolled students of the Universit5r as it may determine;

(9) to set up laboratories, libraries, horticultural research stations, museums, horticulttrre farms and such other equipments as the University may consider it necessary to organise, in lield of horticulture and atrlied sciences ; (1O) to hold examinations, and to grant diplomas and confer degree and other academic distinctions on persons who have pursued a course of study under the University ;

(11) to contc-r degrees and/or other academic distinctions on persons who have carried on independ.ent research under conditions prescribed in the Statutes ;

(12) to confer honorar5r degrees or other academic distinctions on approved persons in the manner and under conditions prescribed in the Statutes ;

(13) to n-old and rnanage trusts and endowments and to institute and award, fellowships (including travelling fellowships), scolarships, exhibitions, bursaries, medals and other rewards in accordance with conditions prescribed in the Statutes ;

(14) to arrange for inspection of colleges and other branches of the University and to take measures to ensure that proper standards of instruction, teaching or training, research and extension are maintained ;

(15) to fix, demand and receive payment of such fees and other charges as may be prescribed by the Statutes ;

(16) to supervise and control the residence, conduct and dicipline of students of the University and to make ' Hs3lfrqEt2ole 1822 (631 arrangements for promoting their health, development and generai welfare;

(17) to create administrative, ministerial and other necessary posts and to make appointments thereto, with the prior approval of the State Government ;

(18) to institute and manage :-

(d) lnformation Bureau; Printing and Fublication Department; Employment Bureau; Any other institution authorised by the State Government;

(19) to make provisions, -

(a) for extra-mural teaching and research;

(b) for physical and military training;

(c) for sports and athletic activities;

(d) any other activit5l as may be decided by the State Government; (2O) to co-operate with other Universities and. authorities in such manrrer, to such extent and for such purposes as the University may deterrnine;

(21) to do all such other acts and things, whether incidental to the powers aforesaid or not as may be requisite in order to further the objects of the University.

6. (1) Save as otherwise provided in this Act, the powers conferred on the University by or under this Act, shall extend to the areas comprised within the limits of whole Chhattisgarh.

(2) Notwithstanding anything contained in any other law for the time being in force, no college or ed,ucational institution situated within the aforesiad limits irnparting instructions in horticulture and other allied sciences for bachelors degree and/or above, shalI be associated in any way with or be admitted to any privilege of any other University incorporated by law in India and any such privilege granted, by any such other University to any educational institution within those limits prior to the commencement of this Act, Territorial Jurisdiction. I 1822 (64) , fui631frqwr2ote UniversitY to have exclusive jurisdiction to provide for instruction teaching, etc, horticulture and allied sciences.

7. (1) shall be deemed to be withdrawn on the commencement of this Act, and such'institutions shall stand affiliated to the University till the date they are transferred to the University, under section 57.

(3) The research and. extension work undertaken or conducted by or on behalf of the Indira Gandhi Krishi Vishwa Vidhyalaya in the field of horticulture and allied sciences within the aforesaid limits shall be co-ordinated with and integrated into the activities of the University-

(a) \Mith effect from such date or dates as the State Government may, by notification, specify and different dates may be specified for co-ordination and integration; and

(b) in such manner and to such extent as rnay be determined by the State Government in consultation with the Board. The Unjversity shall have exclusive jurisdiction throughout the areas specified in sub-section (1) of section 6 to provide for instruction, teaching and training in horticulture and allied sciences and notwithstanding anything contained in the law relating to incorporation of any other University in the State, no other University shall be competent to provide for instruction, teaching and training in horticultue and allied sciences in such areas- However, Indira Gandhi I{rishi Vishwavidyalaya will continue to have the powers to make provision for teaching of horticulture, forestry courses and degree programme, basic research and extension programme in horticulture and allied sciences. Notwithstanding anything contained in this Act or Statutes and Regulations made there under any student of the Pt. Kishori Lal Shukla Horticulture College and Research Center, Rajnandgaon, Horticulture College and Research Center, Jagdalpur and affiliated private Horticulture Colleges and Study Departments who immediately prior to'the {2) ' fus 3l frqwt 261e 1822 (5sl day of -2019 was studying for or was eligible to appear ' in any examination, as the case may be, in Horticultur€ and other allied Sciences of the Indira Gandhi Krishi Vishwa Vidyalaya, shall be permitted to complete his course in preparation therefor, and the University shall provid.e for such period not exceeding five years and in such manner as may be prescribed by the Statutes for the instruction, teaching training and examination of such students in accordance with the course of studies of the Indira Gandhi Krishi Vishwa Vidyalaya.

8. It shall not be lawful for the University to impose any test or condition whatsoever relating to religion, caste, sex, place of birth or other opinion in order to entitle anJI person :-

(a) to hold any office in the Universit5r; or

(b) to be a member of any authority of the University; or

(c) to be appointed or admitted as a te'acher; or

(d) to be admitted to any degree, diploma or other academic distinctions or course; or

(e) to enjoy or exercise any privileges of the University of benefication thereto:

Provided that the University may subject to the previous sanction of the State Government, maintain any college or institution exclusively for women, either for education, instruction or residence, or reserve for woriren or members of Scheduled Castes or Scheduled Tribes or of other classes and communities which are educationally backward, seats for the purposes of admission as students in any college or institution maintained or controlled by the University :

Provided further that nothing in this section shall be deemed to require the University to admit to any course of study, students larger in number than, or with academic or other qualifications lower than those prescribed in the Statutes :

Provided also that nothing in this section shall be deemed to prevent the University from exempting indigent persons University open to all irrespective of religion caste, sex, place of birth or opinion. 1822 (661 Bffiqrrdrtqrrd, fui'-d 3t frsqr 2ore !'' Teaching in University. Inspection or inquiry of University. belonging to the Scheduled Castes or Scheduled Tribes or to any other classes or communities which are socially and educationall5,, backward form attending courses o{ study or from the fees levied in whole or in part for attending such courses.

Explanation. - A person shall, for the purposes of this proviso, be deemed to be an "indigent person" if the annual income of such person or his guardian (where such person is for his livelihood and education dependent upon such guardian) is less than such amount as may be specified by the State Government, by notification, in this behalf.

9. (1) Al1 recognised teaching in connection with the University courses shall be conducted by the teachers of the University in accordance with such scheme as may be framed for each academic year by ,the Academic Council and shall includes lecture, tutorial classes, laboratory work, field work or other teachings conducted in accordance with the course of study prescribed by the Regtrlations.

(2) The authorities responsible for organising such teaching and the maximum nurnber of students that shall be adrnitted to a course shall be prescribed by the Statutes.

(3) The courses and curriculam shall be prescribed by the Regulations. 1(). (1) The Chancellor shall have the right to cause an inspection to be made by such person or persons as he may direct, of the University generally and other matters particularly such as its buildings, laboratories, libraries, museums, Horticulture Research Stations and farms, workshops and equipment and of any college or hostel, maintained by the University, of the teaching and other work conducted by the University or any college or institution and of the conduct of examinations held by he University and to cause an inquiry to be made of any matter connected with the University:

Provided that the Chancellor shall, in every case, give notice to the University of its Intention to cause an inspection or 1822 (67) i adem rrqqd, frqiq' 3l fri{1qq 261 e inquiry to be made, and the University shall be entitled to be represented thereat.

(2) Such person or persons shall report to the Chancellor the result of such inspection or enquiry and the Chancellor shall communicate to the Board his views with reference to the results of such inspection or enquiry. The Board shatl thereupon take appropriate action as may be directed by the Chancellor.

(3) Where the Board does not, within a reasonable time take action to the satisfaction of the Chancellor, the Chancellor after considering any explanation furnished or representation made by the Board issue such directions as he may think fit, and Board shall comply therewith.

(a) The report of the inspection and the directions issued by the Chancel'lor as a result of such inspection or inquiry shall be laid on the table of the Legislative Assembly. cur OFFICERS OF THE UNTVERSITY

11. The following shall be the officers of the Universit5r, namely:-

(1) The Chancellor;

(2) The Vice-Chancellor;

(3) The Registrar;

(4) The Comptroller;

(5) The Deans;

(6) The Directors; and

(7) Such other officers in the service of the University as may be declared by the Statutes to be officers of the University. L2. The Governor of Chhattisgarh shall be the Chancellor of the Universif. He shaIl, by virtue of his office, be the Head of the University and shall, when present, preside at any convocation of the University.

13. (1) The Chancellor ffi?y, -

(b) for reasons to be recorded, refer any matter exqept a matter falling under Section 43 for reconsideration to any officer or authority of the Universit5r that has previously considered such matter. The Chancellor may by an order in writing annul any proceeding of any officer or authority of the University which is not in conformity with this Act the Statue or the Regulation: :

Provided that before making any such order, he may call upon the officer or authority concerned to show cause why such an order shall not be rnade and if any cause is Shown within the time sBecified by him in this behalf, he shall consider the same. Everyr proposal to confer an honorary degree shall be subjeet to the confirmation of the Chancellor. The Chancellor shall exercise such powers as may be conferred on him by or under this Act. The Vice-chancellor shall be appointed by the Chancellor from a penal of not less than three persons recommended by the committee constituted under sub-section (2):

Provided that the first Vice-Chancellor shall be directly appointed by the Chancellor:

Provided further that if the Chancellor does not approve of any of the persons so recommended or the person or persons approved by the Chancellor out of those recommended by such committee are not willing to accept the appointment, the Chancellor may call for fresh recommendations from such committee. The Chancellor shall appoint a committee consisting of the following persons, namely:-

(i) Those persons who have not been employed by or on behalf of the University or any college, a person eiected by the Board,

(ii) a person nominated by the Chancellor, and

(iii) a person nominated by the State Government. The Chancellor shall appoint one of the three persons to be the Chairman of the Committee. The chancell0r shall constitute the committee under subsection {21 before the expiry of the term of the Vice- Chancellor. The committee shall submit the panel within six weeks from the date of its constitution or such further time not exceeding four weeks as may be extended by the chancellor. If the committee fails to submit the panetr within the period specified in sub-section (4), the Chancellor may appoint any person whom he deerns fi-t to be the Vice-Chancellor. The Vice-Chancellor shall hold office for a term of five years and shall be eligible for re-appointment, but not beyond the age of sixty live Years:

Provided that the first vice-chancell0r shall hold office for a term not exceeding five years as the Chancellor may determine:

Provided further that, notwithstanding the expiry of his term the first Vice-Chancellor shall continue in office until his successor is appointed and enters upon his office, but this period shall not exceed six months.

(7) In the event of the occurrence of any vacancy in the office of Vice-Chancellor by reason of his death, resignation or otherwise the senior most Director, Dean of Faculty or any officer of the Government nominated by Chancellor shall act as Vice-Chancellor until the date on which a new Vicechancellor, appointed under sub-section (1) to fill such vacancy enters upon his office:

Provided that the person so nominated sha1l not hold office for a period of more than six months-

15. The emoluments and conditions of service of the Vice-Chancellor shall be such as may be prescribed by Statutes but shall not be varied to his disadvantage after his appointment' L6. (1) The Vice-Chancellor shall be Principal executive and academic officer of the Universit5r and shall, in the absence of chancellor preside at any Convocation of the University' He shall be ex-officio member and chairman of the Board and of the Acad.emic Council and Chairman of such other authorities of the University of which he is a member. He shall be entitled to be present and to speak at any meeting of any authority or other body of the University but shall not be entitled to vote thereat unless he is member of the authority or bodY concerned.

(s) observed and he shall have all powers necessary for this purpose. The Vice-Chancellor shall have power to convene meetings of the Board and the Academic Council. In any emergency which in the opinion of the Vice- Chancellor requires that immediate action should be taken, the Vice-Chancellor shall take such action as he deems necessary and shall at the earliest opportunity thereafter report his action to such officer, authority or body as would have in the ordinary course dealt with the matter, and if the officer, authority or body disagrees with the action of the Vice-Chancellor the matter shall be referred to the Chancellor whose decision thereon shall be final. When action taken by the Vice-Chancellor under subsection (4) affects any person in the service of the University, such person shall be entitled to prefer an appeal to the Board through the officer, authority or body rhentioned in the said sub-section within thirty days from the date on which such action is communicated to him. The action taken by the Vice-Chancellor shall be deemed to be the action taken by the appropriate authority until it is set-aside by such officer, authority or body after considering the report made by the Vice-Chancellor under sub-section

(4) or is rnodified or set-aside by the Board under subsection (5). The Vice-Chancellor shall exercise general control over the affairs of the Universit5r and shall give effect to the decisions of the authority of the University. The Vice-Chancellor shall exercise such other powers as may be prescribed by the Statutes and Regulations. If at any time upon representation made or otherwise and after making such enquiries as may be deemed necessary, it appears to the Chancellor that the Vice-Chance1lor,-

(i) Has made defaults in performing duty imposed on him by or under this Act; or

(3) (iil Has acted in a manner prejudicial to the interest of the University; or

(iii) Is incapable of managing the affairs of the Universitlr, the Chancellor ffiay, notwithstandi4g the fact that the term of of{ice of the Vice-Chancellor has not expired, by an order in writing stating the reasons therein requires the Vice-Chancellor to relinquish his office as from such date as may be specified in the order. No order under sub-section (1) shall be passed unless the particulars of the grounds on which such action is proposed to be taken are communicated to the Vice-Chancellor and he is given a reasonable opportunity of showing cause against the proposed order. As from the date specified in the order under sub-section

(1) the Vice-Chancellor shall be deemed,to have relinquished office and the office of the Vice-Chancellor shall fall vacant. The Registrar shall be a whole time salaried officer and shall act as the Secretary of the Board and of the Academic Council. He shall be appointed by the State Government and his emoluments and conditions of service shall be such as may be prescribed by the Statutes. He sha11 exercise such powers and perform such duties as may be conferred or imposed on him by the Statutes and the regulations:

Provided that the first Registrar of the University shall be appointed by the Chancellor and he shall hold office for such period not exceeding five years and on such terms and conditions as the Chancellor may determine.

(1) The Comptroller shall be a whole time salaried officer of the University. He shall be appointed by the State Government and his emoluments and conditions of service shall be Such as may be prescribed by the Statutes.

(2) Where any temporary vacancy in the office of the Comptroller occurs by reason of leave, illness or any other cause, the Vice-Chancellor shali make arrangements as he deems fit, to carry on the current duties of 'the Comptroiier. Registrar; 18.

(3) The Comptroller shall- __ .' , (") exercise supeiwision over the funds of the Llniversity under the general control of the Registrar and shall advise the Vice-Chancellor in regard to the financial policies of the UniversitY ;

(b) subject to the control of the Vice-Chancellor shall manage the investment of the University ;

(c) be responsible for seeing that all moneys are expended on the purpose for which they are granted or allotted and no expenditure not authorized. in the budget, is incurred by the University ;

2L. The appointment of other officers of the University referred to in other section 11 shall be made in such manner and the conditions of officers' their service and their powers and duties shall be such as may be prescribed by the Statutes and Regulations:

Provided that such post which in the sanctioned set-up of Mahatma Gandhi Udyanikee Avam Vanikee Vishwavidyalaya are to be filled on deputation shall be filted by the State Government.

24. Subject to the provision of this Act, the Council shall exercise the following powers and perform the following duties:- To act as an advisory body in all matters relating to Horticulture University. To review broad policies and programmes of the Horticulture Universities and to suggest measures for the improvement and development of such University. To act as a Co-ordinating body between Horticulture Universities established in the State by law.

CHAPTER.TV AUTHORITIES OF THE UNryERSITY 25, The following shall be authorities of the Universit5r:- Authorties of(i) the Board ; UniversitY.

(ii) the Acad.emic Council ;

(ii) the Faculties ;

(iv) Finance Committee; and

(v) such other authorities as may be declared by the Statutes to be the authorities of the University'

26. (1) The Chancellor shall constitute the Board within two Constitution tnonths of the establishment of the University. of Board.

(2) The Board shall consist of the following persons, namely:- Ex-Officio Members

(i) the Vice-Chancellor- Chairman;

(ii) the secretary /special secretary to Government of Chhattisgarh

(a) Agriculture/Horticulture Department ;

(b) Finance DePartment ;

(c) Forest DePartment ;

(d) Water Resources DePartment ;

(e) Rural Industries DePartment ; Members nominated by the Chancellor

(iii) three eminent scientists with background of research or education in-

(a) Horticulture;

(b) Agriculture;

(c) Agricultural Engineering; Members nominated by the State Government

(iv) a distinguished industrialist or manufacturer having special knowledge in horticulture development;

(vi) one progressive farrners preferably belonging to' Scheduled Castes/ Scheduled TribeS. Other Member

(vii) one representative of Indian Council of Agricultural Research to be nominated by the Director-General of that Council; The Registrar shall be the non-member Secretary of the Board. The members other than ex-officio members of the Board shall hold office during the pleasure of nominating authority but their tenure shall not exceed three years. Further, such member shall not continue to be a mernber if he is declared insane, insolvent, absconder or otherwise incapable of discharging his duties as a member or he has resigned fitom the membership in such case a fresh nomination shall be rnade by Universitlr atrthorify, as sooR as possible, The members of the Board shall receive such travelling and daily allowance as may be prescribed by Statutes. The Board shall meet as often as may be considered necessary on such dates as may be fixed by the Vice- Chancellor:

Provided that a period of three months shall, as far as may be, not intervene between the last sitting of the Board and the date fixed for its first sitting in the next meeting. A meeting of the Board fixed by the vice-chancellor under sub-section (1) shall not be cancelled or postponed by the vice-chancellor, but the chancellor may, for sufficient cause, postpone the meeting to any date not later than fifteen days from the date originally fixed by the Vice- Chancellor. The Vice-Chancellor shal1 upon a requisition, in writing, signed by not less than five members of the Board, convene a special meeting of the Board within ten days of the receipt of such requisition.

(3) , ffi{31frqq{2ote tszz (77) When a date has been fixed for the meeting of the Board by the Vice-Chancellor under sub-section (1) or sub-section (3), the Registrar shall give clear seven days notice, in writing to the members of the board of such a meeting. The quorum for every meeting of the Board shall be five.

28. The Board shall be an Executive Authority of the University and shaIl, subject to such conditions as may be prescribed by or under the provision of this Act and the Statutes, exercise the following powers and perform the following duties, namely:-

(i) to approve and sanction the budget of the University;

(ii) to consider the annual accounts and the annual financial : estimates placed before it by the Vice-Chancellor and pass them without modilication or with such modifications as it may deem fit ;

(iii) to lay before the State Government annually a full ' statement of the financial requirement of all branches of the UniversiSr ;

(iv) to mak-e provision for instruction, teaching and training in such branches of learning and courses of study, as it may think fit, for research and for the advancement and dissemination of knowledge;

(v) to provide for the establishment and maintenance of colleges, departments, hostels and institutions of research and specialized studies and to manage them ; (vil to organize and make provision, for laboratories, libraries, horticulture research stations, museums, horticulture farms including breeding farms and such other equipments as the University may consider it necessary to organize and provide for in the field of horticulture and allied sciences ;

(vii) to run Agricultural Rural Life Research and Extension Services ;

(viii) to make provision for-

(a) (ii extra mural teaching'and research ; and

(x) to institute and confer .degrees, diplomas and other academic distinctions;

(xi) to recommend to the Chancellor the conferment of honorar5r degrees and other academic distinction in the manner prescribed by Statutes; (*i) , to provide,for qrrie institution, rnaintenance and award of fellowships,' scholarships, studentship, exhibitions and medals;

(xiii) to app1,oye the schedule of fees and other char$es as rnay be prescribed by the Statutes;

(xiv) to make, amend or repeal statutes;

(xv) to approve, reject, modif5r or refer back any Regulation to the appropriate body;

(xvi) to determine the form of, provide '' for the custody and regulate the use of the common seal of the University; {xuii) to hold, control and administer the property and funds of the university;

(xviii) to transfer any movable or immovable propert5r on behalf of the University subject to the provisions of this Act and the Statutes;

(xix) to accept on behalf of the University trusts, bequests donations and transfers of movable and immovable property to the University; ("x) to enter into, v&IY, carryout or cancel contracts on behalf of the University in the exercise of powers conferred on it by this Act and the Statutes ; , frlii-o3rfrqwr2ore 1822 (7el

(xxi) to make provisions for buildings, premises, furniture, apparatus, books and other means needed for carrying on the work of the UniversitY; (>orii) save as otherwise provided by this Act or the Statutes to approve the appointment of officers (other than the Vice- Chancellor) teachers and other servants of the University and to provide for the filling of temporary vacancies in their posts; ()odii) to institute -

(a) a Printing and Publication Department;

(b) an Information Bureau; and

(c) EmPloYment Bureau; (>o.iv) to approve such teaching posts as may be proposed by the (1+") to abolish or suspend ,suo motu or to report the Academic council thereon, and teaching post in the university; (xxvi} to lay down scales of salaries, and conditions of service of the Vice-Chance1lor, the Registrar or such other officer of the University or a Committee appointed by it as it may deem fit; (>orvii) to delegate by regulation and of its powers to the Vicechancellor, the Registrar or such other officer of the universit5r or a committee appointed by it as it may deem fit; (;orviii)to exercise such other powers and perform such other duties not inconsistent with the provisions of this Act or Statutes aS may be necessary for carrying out the purposes of this Act. The Academic Council shall affairs of the UniversitY and members, namelY :- be in charge of the academic shall consist of the following Academic Council.

(iv) One teacher frorn each faculty of the University to be elected' from amongst theinselves in the manner prescribed by Statutes;

(v) Three officers/teachers of the. sister Horticulture Universities co-opted by Academic Council for this special knowledge in subjects recognised by the University.

(vi) Heads of the Department of all faculties. Not less than half of the number of members of the Academic Council for the time being shall form a quorum. The Academic Council shall have power to co-opt as members, two persons having special knowledge or experience in the subject matter of any particular business whieh,rna5{ comebefore the council for consideration, The mernb.ers so co-opted shall have the rights of the members of the .Academic Council in regard to the transaction of the business:in relation to which they may be co'opted. A.l1 rnembers:of, the Academic Council'other than ex-off,rcio members and members referred to in sub-section (3) shall hold of,iice for a term specified in the Statutes.

30. The Academic Council shall , (a) Subject to the provision of the Act and the Statrrtes generall5r regulate and have the control of and be responsible for, the maintenance of standard of teaching research and examination of the University and for the fulfillment of requirement for obtaining degrees;

(b) Advise the Board and other authorities of the university on all academic matters;

(c) exercise such other powers and perform such other duties as may be conferred or imposed upon it by or under this Act. The University sha1l have srlch faculties as may be prescribed bY the Statutes. (21
