"Application" means an application made to the.tribunal und~r section 5 of the· Act; . .• 11nfood rehdions", in the context of a male and a female inmate, means father­ daughter,Mother--son, and brother (not cousins);

"Inmate", in relation to an old age home, means a senior citizen duly admitted to r~,side in such home;

"Opposite Partyi' means the party against whom an application for· maintenance has been filed under section 4 read with Section 5 of the." Act ;

'tPresiding Officer" mearis an officer appointed toprcside over a Maintenance ' Tribunal referred to tmdersub-section.(2)of section 7, or an Appellate Tribunal under sub-~cction (2) of section 15;

"Schedule" means a Schedule appended to these rules;

"Section" means a section of the Act;

"State G(>Veri1mentn means the Government of Chhattisgarh.

(2) · All <)ther words and expressions used but not defined in these. rules shall have the same meaning as assig11ed t.o them in the Act.

Chapter 11· Procedure for Mainlenan<.,-e T:ribunal and Conciliation Ofl'icers 3; Panel fo'r. appointment as Conciliation Otlicers.- (1) Every Tribunal shall prepare a · ·· panel of persons suit.1blefor appointment as Conciliation Officer under sub-section (6) ·. of section 6, whifh_ shall indude the Mafotenance Officers ·designated under section 18.

(2) Persons referred to under sub~mle (I), ·other than Maintenance Offi~ers designated under section 18, shall be chosen subject to fulfilling the following conditions;

namely:- . (a) He should be associated with an organisation which is worhng f~r the welfare . of senior citizens and/or weaker sections, or in the are<1 of educ~tion, health, poverty-alleviation; women's enipo\vennent, Social Welfare, rnral development or related fields, for at least two years with an unblemished Tecord of. service:

(b) He should b.e a senior office-bearer of the organisation; :ana

(c) He should possess good knowledge of law: · · · Provided thata person who is not .associated \vith an organisation of the . k111d mentioned· above, ri1ay also be included in the panel mentioned fo sub­ . mle (1) subject to fulfilling the following conditions; namcly:-

11." Pr()Ceedings by Conciliation Officer.~ (l) lipon receipt of a reference under mle 10, the Conciliation Officer shall·· hold meeting with the two parties as. necessary, and shall try to work out a settlement acceptable to both the parties, within a period of one month from the .

(2) If tlie Conciliation Officersucceeds in workihg out a .settlement acceptable to both the parties, he shall draw up a 1nemorandum of settlenient in Fonn 'F', get.it signed by both . parties,. arid forward it, with a report jn · Form 'G', _ along with all records of the case received from the Tribunal, back to the Tribunal witJiin a month from the receipt to the reference. _ . .

· (3) If the Coriciliation .Officer is unable to a1Tive at a settlement within one month of ·. receipt of a refer~nce under rule O 0), he shall tetum the papers received frorn the Tribunal alop.g with a report in Form 'H' showing efforts made to bring about a §ettl~rnent and the points of difference between the two parties which could not pe reconciled.

12. Action by the Tribuuai in case of seU.lemtmt before a Conciliation Officer.-(l) In case, t.he Tribunal recejves a report from the Conciliation Officer under sub-1ule (2) of Rule 1 J, i1long with · a men1or.a11dum . of settlement, it sh,lll give notice to both parties . to appear before it on a date to be specified 111 the nmicc, and confirm the settlement. .

Chapter IV Scheme fol' Manugement of Old age homes ~smblisbed under sectiou 19

18. Scheme for management of old.age homes for indigent senior citizens.- (1) Old age · hornes .established und~r secrion 19 shall· b~ run in accordance with the following norms and standards:'7 · . . . · · (A) The home· shall. have phys.ical facHities and shall.be run in accordance with the . operational 11orms as laid down in the Schedule. · 284 (24) (B} · Inmates of the horne shall be sel~cted in accordance with the following procedure:­

(a) Applications shall be invited at appropriate intervals, but at least once every year, fron1 indigent. senior citizens; as defined in section 19 of the -Act, desirous of living in_the hoine;· · _

(b) In case the number of eligible applicants on· any 'Occasion is more than.the number of places available in a home foi· adrniss10n, selection of llllllates will be made inthe following maimer:- · · ·

(i) The more indigerit and needy will be gi,ven preference over the less indigerit applicarits. · · ·

(ii) Other things being equal, older senior .citizens will be given preference over the less old, and - -. ·· . · - ·

(iii) Other things being equal, female appficants wtll be given preference.

· (E) Day-to-daY affairs of .the old age home shall be managed by a Management ·. Committee which · shall be constithted it,1 accordance with orders and guidelines issued by the State Government from time to time, in such committee inmates shall be given sufficientrepresentation. ·

(2)" State Govermnent i11ay issue detailed gui~iries/orders frOil) time to time of admissio11 into ;:ind management of old age homes in accordance with the norn1s and standards laid down in sub-rule (1) and the Schedule. · ChapterV Duties & Powers of the District Magistrate 19; Dutit~s mid P.tnv.ers of the District Magistrate.- (l)Thc District Magistrate shall perform the d.uties and exercise the powers mentioned in sub-rules (2) and (3) so a_s to ensure that . the provisions of the Act are properly carded out in his district.

(2) Ilshallbe the duty of the District Magistrate to - .

(i) ensure that life and property of senior citizens of the district are protected and they are able to live with security and dignity;

· (ii) oversee and monitor the work of Maintenance Tribunals and Maintenance _ Officers of tJ1e district with a view to ensuring tin1ely and fair disposal of applications for maintenance, and execution of Tribunal's orders;

· (iii) oversee and monitor the wcirkihg of old age homes in the district so as to ensure lhatthey conform tothe standards laid down in these rnles, and any •. otherguidehnes and orders of the State Government;

(iv) . ensure regular and Wide publicity ofthe provisions of the Act, and Central and State Governments' progranunes for the welfare of senior citizens;

(vii) 284 (25) encourage and. coordinate with panchayats, mtinicipa.lities, Nehru Yuwa Kendras, · educational institutions · and especiaHy their National Service Scheme Units, organisations, specialists, experts; activists, etc. working in the district so that their resources and efforts are effectively pooled for the welfare of senior citizens of the. district; _ _ ..

ensure provision of timely assistance and relief to senior citizens in the · event of natural calamities and other emergencies;

promote establishment of dedicated help lines for senior citizens at district ·._ headquarters, to begin .with; and perform such other functions as the State Government may, by order, assign_to the District Magistrate i11 thi_s behalf, from time to time.

(3) Witl1 . a view to perform the duties mentioned in sub-r~1le (2)', the District Magistrate shall be competent. to issue such directions, not incons'istent with the Act, these rules, and. general guidelines of 1l1~ State Government, as rnay be necessary, to any conce,:iied government or statutory agency or body working in the district, and especially to the following:~ ._ · ·

(a) Officers of the State Government in the Police, Health and Pliblicity Departments. And (he Department dealing with \Velfare ofSenior citizens;

(b) M1.1.internmce.Tribu.nals and Conciliatim1·Qfficers;

(c) Panchayats and Municipalities; ancl

(d) Educational institutions.

Chapter VI Prote~tionof Life.and Property of Senior Citizens

20.
