Naya Raipur. the 5th April 2017 NOTlFIC A TIO o. F 7-09/2017/12. - In exercise of the powers conferred by Section 23C of the Mines and Mineral (Development and Regulation) Act, 1957 (No. 67 of 1957), the State Government. hereby. makes the following further amendment in the Chhattisgarh Minerals (Mining, Transportation and torage) Rules, 2009, namely :- AME DM ENT In the said ru les.- I. In Rule 2, sub-rule I,-
(a) for clau e (e- 1 ), the following shall be substituted, namely :- '"(e-1) "End use plant/place'' means uch plant/place where the mineral shal I be used finally:"
(b) after clause (i), the following shall be inserted. namely:- "(i-1) ' Lessee' shall have the same meaning as defined under clause (x) of sub-rule (I) of rule (2) of the Chhattisgarh Minor Mineral Rules, 2015:"
(c) after clause (m). the fol lowing shall be inserted. namely :- '"{m-1) ·'Royalty Paid Transit Pass· means a pas generated for the lawful tran portation of minera ls by the storage permit ho lders in FORM-10 either from the Departmental portal or issued by the officers duly authorized at the district level by the Government ofChhattisgarh, Minera l Resources Department:''
(d) for clause (t), the following shall be substituted namely:- "(!) "'transit pass" means a pass generated for the lawful transportation of mineral after depositing advance royalty in prescribed Proforma from the Departmental portal or issued by the officer duly authorized at the district level by the Government ofChhattisgarh, Mineral Resources Department;"
2. For Ru le 3. the following shall be subst ituted namely :- ··3 Prohibition .- (I) o person shall transport, carry or cause to be transpo11ed or carried any mineral/ore and/or it beneficiated products by any vehic le or otherwise from the place of its winning/raising/ torage/beneficiation or from one place to another place without having a valid transit pas issued under these Rules.
(2) No person without having a va lid railway transit pass issued in Form- 17 under these rules shall tran port.
carry or cause to be tran ported or carried any major mineral/ore and/or its beneficiated products by rail way from the place of winning/raising/storage/ beneficiation or from one place to another place :
Provided that where any mineral/ore and/or its beneficiated products is transported or carried from the lease area to the place of raising/storage/ beneticiation or from one place to another place;
248 (11) directly by means of aerial ropeway or conveyor belt or a merry-go-round or pipeline or any other means whatsoever the lessee shall maintain on the departmental portal a log of the total quantity transported by such means every day.
(3) No person shall store for processing or any other purpo e. or establ ish a plant for beneficiation/crushing of any mineral/ore and/or its beneficiated products outside the lease area, or other than the final destination. without obtaining a valid ''storage permit" for the purpose of storage/beneficiation/crushing under these rules.
In Rule 4,-
(a) for sub-rule(!), the following shall be substituted, namely:- "'( I ) (i) II the minerals/ore and/or their beneficiated products excavated in any lease area sanctioned under the Mines and Minerals (Development and Regulation) Act, 1957 (No. 67 of 1957) and Rules framed thereunder shall only be transported along with a valid Mineral Transit Pass issued under these Rules in Form -1.
(ii) Where a railway siding or a storage/crushing/beneficiation unit is located outside the lea e area, any Lranspo1tation by any means whatsoever shall b done along with a valid mineral transit pass issued under these Rules in Form-I:
Provided that the Director shall have the power to grant exemption from thi prohibition under special circumstances for reasons tO be recorded.
(iii) Where any mineral/ore and/or its beneticiated products is transported or carried from the lea e area to the place of raising /storage/beneficiation or from one place to another: directly by means of aerial ropeway or conveyor belt or a merry-go-round or pipeline or any other means whatsoever. the lessee shall maintain on the departmental portal a log of the total quantity transported by such means everyday:
Provided that the Director shall have powers to grant exemption from this prohibition under special circumstances for rea ons to be recorded.
(iv) 1 o per on shal I without having a valid railway transit pass issued in Form-17 under these Rules hall transport. carry or cause to be transpo11ed or carried, any major mineral/ore and/or its beneficiated products by railway from the place of raising/storage/beneticiation or from one place to another place;
The lessee/permit holder shall app ly in Form-16 on the departmental portal with E.D.R.M. order. Under special circumstance an application in Fonn- 16 may be made to the District Collector. in which case the Railway Transit Pass shall be issued by the officer duly authorized at the District level by the Mineral Resources Department:
Provided that where, once a lessee having registered himself on the depar1mental portal has generated onl ine transit pas es in Form 17 he shall not be allowed to receive transit pass in a physical form Lmder any circumstance whatsoever:'
(b) fo r sub-rule (2), the following shall be substituted. namely :- ''(2) (i) A lessee may, within the limits of the annual production mentioned in the Mining Plan or the Environmental Clearance, for a given financial year, whichever is less, generate in Form- I from the departmental portal the transit pass to tran port any mineral/ore and/or its beneficiated products on payment of advanced royalty due for such quantity for a given financial year or under special circumstance shall make an application in Form-2 to the District Collector, along with the original treasury challan of the cost of Transit Book and royalty due of the mineral to be transported up to the limit of annual production mentioned in the Mining Plan or the Environmental Clearance, whichever is less, for any given financial year. The transit pas in Form -1, in such cases. shal l be issued by the officer duly authorized at the District level by the Government of hhattisgarh. Mineral Resource Department:
Provided that where, ooce, a lessee having registered himself on the departmental por1al ha generated online transit passe in Form-I. he shall not be allowed to receive transit pass in Form -I in physical form under any circumstances whatsoever.
(ii) The cost of the transit pass book and the royalty due of the mineral transported hall be deposited in the same manner as prescribed in the Rules.
(iii) Every les ee or permit holder sha ll handover one copy of the transit pass generated in duplicate from the departmental portal to the driver of the vehicle used for transportation of any mineral/ore and/or its beneficiated products from th lease area/storage ite and retain one copy for his record. The driver hall upon reaching the end use place or end use plant, being the final destination of the transported mi neraL hand over the mineral along with transit pass there.
(iv) Where an Authorized Officer of the Mineral Re ources Department, Government of Chhattisgarh. at the District level has issued the transit pass, the lessee or the permit holder sha ll is ue dupl icate copy of the pass generated by using carbon copy on both sides to the driver of the veh icle carrying mineral from the lease area/storage site and keep the original in the transit book safely.
(v) The Transit Passes issued for mineral concessions by District level officers duly authorized by the Mineral Resources Department. Government of Chhattisgarh. shall be printed and issued a per the procedure laid down by the Director, Geology and Mining, from time to time.''
(c) for sub-rule (6), the following shall be substituted, namely:- "(6) Procedure for transportation of minerals/o re and/or its beneficiated products from railway siding to end use plant/place or licensed proce sing plant/place/storage site.-(i) Transportation of mineral/ore and/or its beneficiated products from the railway siding to the end use plant/place or processing plant/I icensed storage site shal I be done through a Local Transit Pass, generated in Form- I 3, from the DepartmentaJ portal.
(ii) ·uch persons/firm/company, who want to transport mineral/ore and/or its beneficiated product brought by rail route, from railway sidings to any end u e plant/place or processing plant/ torage site, shall submit an application on line on the departmental portal in prescribed Form-11 along with the required information and generate on line a local tran it pas in Form-I 3:
Provided that where, once, a lessee having regi tered himself on the departmental po1tal ha generated onlin·e transit passes in Form-13, he shal I not be allowed to receive transit pass in Fo1111- 13 in phy ical form under any circumstance whatsoever.
(iii) nder special circumstances an application may be made to the District Col lector in pre cribed Form-I 1, in which case the Loca l Transit Pass shal l be issued by the officer duly authorized at the District level by the Mineral Resources Department.
(iv) Details of the information received by the District Mining Office under Form- I I hall be maintained in the regi ter in accordance with Fo1111-12. Subsequently Local Tran it Pass shall be issued in Form-13; for transportation of equivalent quantity as per the quantity of 111 inerals mentioned in the application submitted by the applicant. The applicant shall ubmit the details ofu ed and remaining local tran it pas along with th railway receipt in Form-14. The Officer authorized at the District level shall on tallying the quantity of Local Tran it Pas issued previously in Form -13 with the submitted railway receipts at the time of disposal of subsequent application for the local transit pass, which if found correct, shall issue new local transit pass after considering the new app lication.
(v) Not specifically m~tioning the date, time and quantity in the local transit pass or del iberate overwriting/making changes. in it or not transporting as per the final destination mentioned or in any other way misusing the. local transit pass and all uch omissions and commi sions related thereto shall be puni hable under Section 21 of the Mines and Minerals (Development and Regulation) Act, 1957 (No. 67 of 1957).
(vi) No local transit pass .shal I be. required where the railway siding for unloading the minera l/ore and /or its beneficiated products transported by rail routes is situated within the premise of the end u e plan t/place:'

4. In Rule 7.-
(a) for sub-rule (I). the following shall be substituted. namely :- "(I) (i) Any mineral mentioned in Part A and Part of the First schedule of the Mines and Minerals (Development and Regulation) Act, 1957 ( o. 67 of 1957) or chedule I and chedule II of the Chhatti garh linor Mineral Rules. 20 15 which has to be tored. beneficiated or cru hed or processed by any other mean or temporarily stored out ide the lease area the permis ion for uch storage/beneficiation/crushing plant shall be gi en in Form-7 to be is ued by the Di trict Collector of the concerned Di trict.
(i i) Any mineral mentioned in Part 8 of the First schedule of the Mines and Minerals (Developmem and Regulation) Act, 195 7 ( o. 67 of 1957), which ha to be stored, beneficiated or crushed or processed by any other means outside the lease area, the permission for such storage/beneflciation/ crushing plant hall be given in Form • 7 to be is ued by the District Collec tor of the concerned District after approval by the tate Government.
(iii) Storage Permit as pecified in Form-7 hall not be required for storage of cut. poli hed and processed slabs and tile of minerals mentioned in Part A of chedule I of the hhani garh Minor ineral Rule .
~O I 5. However, for the transportation of any processed mineral in this Part it shall be mandatory to submit in Form- I Mineral Transit Pass issued for tbe purpose with the Di trict Mining Office and get in return the Royally paid transit pass in Form- I 0.
(iv) torage Permit as pecified in Form-7 will not be required for storage of cut, processed and polished slabs and Ii le of mineral flagstone mentioned in erial no. 2 in Part C of Schedule I of the Chhattisgarh Minor Mineral Rule , 2015. However for the transportation of this processed mineral , it hall be mandatory to submi t in Form - I the tran it pas i sued for the purpo e with the District Mining Officer and get in return the Royalty paid transit pas in Form- I 0.
( ) For minerals mentioned in Serial no. I and J of Part C of chedule I of the Chhatti garh inor Mineral Rules, 2015, the torage permit specified in Form-7 shall be available free of cost within the periphery of 500 meter from the own quarry lease boundary. Howe er for the transportation of the e proce . ed minerals it hall be mandatory to submit in Form -.I the mineral transit pass issued for this purpo e with the District Mining Officer and get in return the Royalty paid transit pas in Form- IO and submit a monthly return in Form-15.
(vi) The Storage Permit pecified in Form -7 under the clause (i) and (ii) of these Rule may be generated online through the departmental portal as well.''
(b) for sub-rule (2). the following hall be sub rituted, namely:- ·'(2) The application for permit and its renewal for temporary storage/beneficiation/ crushing hall either be made on line on the departmental portal or be made to the Collector of the concerned di trier in Form-4 afongwith the copy of the duly paid challan of required fees (non-refundable) in the prescribed revenue account head."
(c) in sub-rule (4),-
(i) for clau e (ii) and (iii), the following shall be-substituted. namely:- "(ii) o objection certificate from the ational Highways Authorit of India. if proposed/temporary storage/beneficiation plan crushing plant i within 100 metres but not beyond 500 m tres from the ational Highway.
(iii) No objection certificate under the Water (Prevention and Control of Pollution) Act, 1974 (No. 6 ofl974)andAir(Preventionand ontr l ofPollution)Act, 1981 ( o.14of l981 )."

(ii) after clause (v), the fo llowing shall be inserted, namely:- "(vi) \Vhere the application i made online on the departmental portal, the document to be attached with the application shall be scanned and uploaded on the website."
5. In Rule 8.-

6. In Rule 9,-

7. In Rule I 0, for Sub-rule (2), the following shall be substituted, namely:- ·'(2) Every application in Form-4 for the renewal of temporary storage permit shall be submitted within 90 day prior to the expiry of the permit along with fee deposited in such a manner as pre cribed in ub-rulc
(3) of Rul e 7 along with all the relevant documents, which were required to be submitted at the time of original applicati on as per sub-ru!e (4) of Rule 7. If the application for such renewal i not di sposed off with in the prescribed time period, the period of such permit shall be deemed to have been extended by a further period for which the permit was originally granted till the Competent Authority passes an order thereon:
Provided that where an application for renewal has been received after the time limi t provided above then for reasons to be recorded in writing shall be acceptable on payment of additional fee of Rupees Five Thousand :
Provided further that a delay of up to thirty day only shall be condoned in this regard by the Competent Authority.
8. lnRulell.-

9. In Rule 14, for clause (i ii ), the fo l lowing shall be substituted, namely :- "(iii) The permit holder shal l issue royalty paid transit pass generated from the departmental portal in Form-10 for every vehicle (carrier) transporting any minera l/ore and/or its beneficiated products from the temporary storage/ proce sing site. Under special circumstances, an application may be made to the Collector of the concerned district for issuance of a royalty paid transit pass with the rcqui ite information, in which case the royalty paid transit pas in form-10 shall be issued by the au thorised offic r:
Provided that where once a le see having registered himself on the departmental portal ha generated on line transit passes in Form-I 0. he shall not be allowed to rece ive transit pass in Form- IO in a physical form under any circumstances what oever." · mJl-t1•1~~.~ s~2011 248 (IS)
10. For Rule 17, the following hall be ubstituted. namely:- "17. Registration of lessee/licensee, vehicle owner, vehicle transporting the mineral and regi tration of end u e plant.- (I) Registration of lessee/licensee :
(i) II such persons, societies, firms, partnerships and companies, who ar a lessee a defined under the Mines and Mineral (Development and Regulation) Act, 1957 o. 67 of 1957) or clause(, ) of ub-rule (I) of Rule 2 of the Chhattisgarh inor Mineral Rules, 2015 ha ll compul oril register themselves free of cost on the departmental portal. On registration on the departmental portal a regi lration number (code) shall be allotted.
(ii) Every le see who is not registered on the depa11mental portal after the notification of these Amendment Rule , shall not be entitled to get a tran it pass on line or entitled for an other er ices on the departmental portal.
(:.:!} Registration of vehicle owner:
(i) A II such persons, societies, firms, partnerships and companie through who e eh icle major minerals/ore and/or it beneficiated products are transported by road, hal l compulsoril regi ter free of cost through an application in Form-18 on the departmental portal. On registration on the departmental portal a registration number (code)\ ill be allotted.
(ii) Transporting major minerals/ore and/or its beneficiated products without regi tration a a transporter on the departmental portal after the notification of these mendment Rules shall be prohibited.
(3) Registration of veh icle used for transportation :
(i) All vehicles transporting major minerals/ore and/or its beneficiated product by road hall compulsoril register themselves through application in Form-19 on the departmental portal. On payment of annual registration fees of rupee Five hundred on the departmental portal a registration number (code) shall be allotted. The registration fees collected hall be deposited in th Government Trea ur (non-refundable) in the pre cribed revenue account head.
(ii) Tran porting major mineral /ore and/or it beneficiated product without installing a Global Positioning ystem GPS) based tracker within 180 days from the notification of the e mendment Rule shall be prohibited.
( ➔) Registration of end user :
(i) All such persons, societies, finn , partnerships and company who utili ze a a major raw material a major mineral/ore and/or its bene.ficiated product in a end use plant hal l apply for registration free of cost on the departmental portal in Form-20 and register themsel ve a end u ers.
(ii) On the basis of such application received in Form-20 a regi tration number (code) will be allotted onl ine. The list of al I end use plaot so registered shall be di played on the departmental portal:· I 1. In Form- I, in serial number 7,-
(a) for the words ··Name of the Owner of the vehicle", the words· ame. address and mobile number of the 0\ ner of the vehicle" shall be ubstituted; and
(b) for the words ·· ame of the driver of the vehicle", the word ·· 1 am , address and mobile number of the driver of the vehicle" shall be substituted.
12. In Form-2, for the ymbol , words and figure "[See Rule 3(2) (i)J", the symbols, words and figures "[ ee Rule 4(2) (i)]" shall be substituted.
