-,. - ' (a) "Act" means the_. Chhattisgarh Municipal Corporation Ac~ 1956 (No. 23 of 1956) and the Chhattisgarh Municipalities Act, 1961 (No. 37 of 1961);
(b) . "Council" means Corporation in case of Municipal Corporation and Concil in case ofa fvlunicipality or Nagar Panchayat, as the case may be;

(d) "Mohalla Samiti" means the Mohalla Samiti constituted under Rule 4 of said rules;
"Municipal Area" means the area notified under Section 7 of the Cl;hattisgarh Municipal Corpor,1ii,,n Act, 1956, in case of a Municip~I Corporation and under Section 5 of the Chhattisgarh Municipr,litics Act, 1961 in case of a Municipal Council or Nagar Panchayat;
(e) "Municipality" means any Municipal Corporation constituted under Section 7 of the Chhntti,.garh · Municipal Corporation Act, 1956 (No. 23 of 1956) and any Municipal .Council or Nagnr Panc:,ayat constituted under Section 5 of the Chhattisgarh Municipalities Act, 1961 (No. 37 of 1961);
(I) "Section" means a Section of the Act;
(g) "Territorial Area" means the territorial area of any Mohalla, (Sarniti) ...
(h) "Chairman District Planning Committee" means such member ofCahinct who is nominate(! as Chainmn of the District Planning Committee under the provision of Clause (a) of sub-section (3) of Sect inn 4 of Jila Yojana Samiti Adhiniyam, 1995.
J. Determination of Territorial Arca of Mohalla Samiti: 11,e area of each ward of Munic_ipal Corporation, Municipal Council and Nagar- Panchayat, shall be territorial area ofMohalla Samiti and for every such tmiw, ial nrea a Mohalla Samiti shall be constituted.
4.· Constitution ofMohalla Samiti - .(I) Every Mohalla Samiti shnll consist of following -
(a) Mohalla Samiti shall consist of Ward Councillor and the nominated members. of tl1c ward .

(2) Nantes of the persons for nomination, shall he sobmitled to the District Planlling Committee, by the'{ Cnllcctor. Approval of the names for nominntio11. shall he made by !he Chairman nf the District Planning Committee nn the hw•;is ·or following conditions. · Ou! of total nun1ber of nominated members, at least hair of the members :,hall he from \\\nncn, Scheduled Casie, Scheduled Tribe, Other Ba~k•:.-ard Classes and Non-Government organisation residing in its territorial area.
(3) Members shall be nominated from the people who are rcsidcnt'ofthat territorial area and arc eligible for council election.
(4) The dcctcd councillor of the ward shall he the President of the mohalla samiti.
(5) The Vice-President and Treasurer shall he nominated hy the Chairman of the District Planning Comm ii Ice from amongst such persons who are resident of the Mohalla concerned and are cligihlc for ck:cti011 as Councillor. The term of oflice of the Vice l'residenl';nd Treasurer shall be co-terminus with the term of Persidenl.
(6) Mayor in the case of Municipal Corporation and President in the case of Municipal Council and Nagar P,inchayat shall he·carc- laker of the Mohall a Samiti.
• 5. Term of Mohalla Samiti : The term of each Mohalla Snmili shall he co-lcrminous with lhc term or Council.

6. Powers and functions of the· Mohalla Samiti : The 'powers and functions of each mohalla Samiti shall he as follows;
(I) powers and functions assigned by lhc Municipality or any department of the Slate Govcrnnient.
(2) To prepare proposal or sche~cs relating to the development of m<:halla,
(3) To receive funds from the residents of the mohalla for development work mohalla and carryoul the · development work subject lo the procedures laid by the municipalities.
(4) To motivale·pcpolc for participation in the developmeiit works.
(5) To protect and maintain property of the Municipality such as park\ open land anJ other public places.
(6) To asses and collect t~x/fees subject to the porcedurcs determined hy the local body anJ cpnduct all suCh busirn:•ss related to it.
