CHAPTER-I Preliminary This Act may be called the Chhattisgarh IJI yav ayi l-. Shi~ hon San,tha (Pravesh Ka in1yaman Avam Shull-. Kn irdhnran) dhiniyam. :mo .

(3) It hall come into force from the date of it puhlica110n in the Oflicial Ga,ellc. This Act applies to ,-
(a) insti tu1ions deemed 10 be universities, or constitutent units thereto. imparung professional education. other than those promoted and maintained by the Central or State Government, and
(b) the private unaided professional educational institution affiliated lo a university estahli hed under the Central or Chhallisgarh Act In this Act, unles the context otherv.1ise requires.- Ca) "appropriate authority" means a Central or State authority established h the Central or the tate Government for laying down norm and condition for ensuring standerds of professional education ;
(h) "capitation fees" mean any amount h "hatev~r name called whether in cash or in kind paid or collected or received directly or indirectly m adduion to 1he fees determined under this Act :
(c) "committee" means the Admission and Fee Regulator) Commilltc! .. constituted under section 4 ; • (d )

(t) "common entrance 1es1" means an entrance test , condu ted for determination of merit of 1he candidates followed by centralized coun el ling for the purpoc;e of merit ba ed admission 10 professional colleges or institutions through a smgle window procedure by the State Government or by an. agenc) nulho rized by it; '·fee" means all fee ioclud1ng tuition fee and development charges : '"foreign candidate" means a per on holding a foreign passpo~ cc~mr admission in a deemed univer ity impamng professional educauon or 10 : private unatded professional ms111ution m Chhatmgarh ,

(h) ·•minonty"' mean. a minorit defined under section 2 (f) of the ational Com mi . ion for Minority Educational In utulion Act, 2004 (2 of 2005) ; Ci) ·•minority in!.litution·· means an institution imparting professional education, establl hed and administrated b) a minority and recognised or notified as such by the Late Go,emment subject to such conditions a may be pr cribed;
(j) "non-re5ident fndian" shall have the same meaning as assigned to it in clause (e of ection I I SC of the Income-tax Act, 1961 (43 of 1961) ;
(k) .. Other Bach.ward Classe ·· means the Other Backward Classes of citizens as pc ified h) the Staie Government vide olification o. (n) .. profe · ·ional educational institution" means a college or a school or an insti tute by whatever name called. imparting professional education. affiliated 10 a late University, including a pri ate university established or incorporated by an At·t of the State Legi lature or consmuent unit of a deemed to be uni ersity under ection 3 of the University Grants Commission Act, 1956 (3 of 1956) and appro ed or recognized b) the competent stalutor) body regulating pmfessional education ;
(o) "re crved eat .. means the seat reserved in fa our of persons belonging 10 the Scheduled Cas1es, the Scheduled Tribes and Other Backward Classes as may be notified by the State Go emment:

(q) " ch~uled Caste- mean any caste. race or tribe or part of, or group within ca te, race or tribe pe.cified as cheduled Castes with respect lo 1he Stale of Chhatt..isgarh under article 341 of the Constitution :
(r) '· cheduled Tribe"' means any tribe or tribal community or part of, or group " nhin uch tribe or tribal community specified as Scheduled Tribes with r peel to the tate of Chhanisgarh under anicle 342 of the Constitution : ( I )

Provided that otwithstanding anything contained in any act the once fixed shall be revisable every year or in a gap of Lhree years~ ma necessary, by the Fee Regulating Commiuee. The Commiuee shall be presided by a Chairper. on who ha. been a V Chancellor of a Central University or a talt University or an in titul deemed to be Univer ity or a judiciaJ officer not below the rank of Supcrt1 scale or ·enior admini trative officer nol below the rank of Princ11 Secretary to the State Government or Joint ecrelary 10 the Go emrneni India and shall include four other members having expertise in mauer · finance, administration or law, technical education and h1edical edu"catio (Financial expenses will be met separately by the department 1 technical education/medical education. Budget 10 meet out rhe expen. t incurred in functioning of the committee will be allocated by the • 1.a1 Government separately every year.} The terrn of the Committee shaJl be three years from the date of iLS notifica tion and in case of any vacancy arising earlier, for an}' reru on. th· Stat1.: Government shall fill such vacancy for the remainder of the 1erm. o Act or proceedings of the Committee shall he deemed to be invalid hy .reason merely of any vacancy or any defect in the constitution of the Committee. o person who is associated with a private aided or unaided educational institution shall he eligib1e for being a memher of the Committee. The Chairperson or any member of the Committee hall cease lo be so, if he perfonns any Act, which in the opinion of the State Government i. unbecoming of Chairperson or a member of the Committee. The Committee may frame its own procedure in accordance with the regulil tions notified by the State Government in chis regard. 6. dehor merit and therefore invalid and communicate the same to Lhe concerned university, and on the receipt of such communication. the Univer- ~it hall debar such candidates from appearing in the examination and cancel the result of examination already appeared for.
( 10) The Comminee may. if atisfied that an unaided professional college or .institution hn. iolated any of the pro ision of thi Act and after approval of the tale Government, recommend 10 the University or appropriate Authority for withdrawal of the affiliation or recognition of such college or institution or decide any other course of action as it deem fit.
( 11 ) The Comminee shall have the power 10 r~gulate it own procedure in all matters ari. ing oul of the discharged of it functions and shall for the purposes of making any enquiry under this Ac1 have all the powers of a civil court under the Code of Civil Procedure, 1908 (5 of 1908) while trying a suit in~especl of the folio ing matters, namely :- ,
(a) summoning and enforcing the auendance of any witness and examining him on oluh ;
(b) requiring_the discovery and production of any document ;
(c) receiving evidence on affida its :
(d) i suing commissions for the examinations if witnesses. ( I 2) The Committee shall en ure that the admission in an inslirution is done in a fair and tran parent manner.
CHAPTER-ill dmi ions The eligibility for admission ro a private unaided prof es ional educational in Litulional hall be such as may be notified by Lhe appropriate authority.
