Short litle.-These rules may be called the Madhya Pradesh Nirashriton Avarn Nirdhan Vyaktiyon Ki Sahayata Niyam. 1999.
2. Definitions.-In these rules, unless the context otherwise requires,-
(a) "Act" means lhe Madhya Pradesh Nirashriton Avam Nirdhan Vyaktiyon Ki Sahayata Adhiniyam 1970 (No. 12 of 1970); ·
(b) "Director" means. Director, Panchayat and Social Welfare Madhya Pradesh or any other officer authorised by the State Government for this purpose;
(c) "District Planning Committee" means a committee constituted unda Section 3 of the Madhya Pradesh Zila Yojna Samiti Adhiniyam. 1995 (No. 19 of 1995); ·
(d) "Form" means form appended to these rules;
(e) "Home" means the horne established under sub-rule (I) of Ruic 4; . ' ' ......... --~ .~

(g) . "6ecti~n" means· a Section of the Act; "Sponser" means a local authority, or voluntary organisation registered under the Madhya Pradesh Society Registrikaran Adhiniyam. 1973 (No. 44 of 1973).
3. Requirements for destitute~.-( I) A destitute shall be a resident of sttch local area iii whicli home s established. ··
(2) For the purposes of clause (a ) of Section 2, "old and infinn person" means those who have attained the ige of six.ty years and who is physically incapacitated either-congenitally or due to old age or ailment of leprosy or iny other disease or accident so as to be incapable of earning his livelihood or a person who is visually handicapped. iearing impaired, mentally retarded. me ntally ill or having locomotor disability:

(7) Grant for construction of the building will be released in three instalments in lbe ratio of 40%: 40% : 20%·. Before releasing each instalment the sponser will submit a certificate frcm rhe registered valuer that the amount of prev;ous instalment has been fully utilised before the date of submissic"l of the certificate . .
7. Right to take over the Homes.-The Distric: Planning Commiltee shall"have the right to take over any Home set up under rule 4 temporarily or pennanenrly in case it _is not :nanaged properly, ~r is being ini:.used. Under sud· circumstances. the building and the land on which it has been coo~!ru.:l::d alongwi<h its compound wall shall come under the possession of the State Governmen·t and the District Planning Committee sball make necessary arrangement for l"lanaging the same. · ·
8. Financial Sanction.-( I) Maintenance, addition and alteration in buiiding shall be done by the sponser. In special cases, when economic condicioo of che sponser is wealc, Collector may saf'lciion amount for maintcuance addition imd alteration at a rate of on!= per cent pe~ ye-;:.r for ~rst three yea.rs :lnd after that 2 per cent. p<r-c:: t~ cost of.b1.;ilding . . - ...
(2) At the time of ~ uing up of a Home the Collector ,nay sanct ion up ,o Rs. 1ooo·p.:r bed for fo,;niturc and cquipm.-:nts, cooking utens1is. etc.
(3) On the recommendation. of the Chief Medica1 Officer, \he Collector_-may sanction. equipments like wheel chair, Hearing aid machines, spectncles. artificial limbs, c:rutch~s etc., to the inmates of nome~ accord ing to their need and requirement. ·
(4) The Cqllector may after survey of destitute person, provide applianc<".s as menµoned iri sub-rule (3). (i) Representative of the Collector.
(ii) Representative of Panchayat or other Local Body as the case may he.

(2) (a) 1nc amount collected from Krishi UpaJ Mandi Samili and from other Sources under Section 4 of thc·A:ct sha~/ be kept in Nati~nalised Bank in fixed deposit in favour of the Nirashrit Fund ,nd ·the int.crest earned on such deposits shall be credited in current or savings Accounts. 21. Audit, Inspection and Returns.- (I) The·accounts of the Homes shall be audited periodically by the auditors of the Social Welfare Department or by the chartered accountant. · • . . ~ .
(2) The homes ·shall be inspected by the representatives of the local bc:>dies, Panchayat and Collector. in their jurisdiction and by persons authorised by the District Planning Commiue and the Social Welfare Qepartmcnt.
