3.5 Labour Payment.-
3.5.1 The unskilled labours engaged under Mahatma Gandhi National Rural Employment • Guarantee Scheme in the State, shall be paid as per the labour rate notified in the Official Gazette, from time to time, by the Government of India.

3.5.2 Labour Payment to men and women shall be made at equal rate.
3~5.3 Labour Payment shall be made weekly or at least fortnightly.
3.5.4 Lahour payment shall be made through the single or joint saving accounts opened in the hanks or post office as per the din.:ctions or the Government of ~ndia .
. ,5.) Till· details' or labour payment shall be entered in the Emplyment card by the Implementing agency.
3.5.6 The Schedule of labour rate for different unskilled labour shall be decided in such manner that any adult person working for eight hours including one resting hour should be able to earn at the equal general labour rate.
3.5.7 . If there is any adult labour, in whose work days resting period is included, then the same .
shall be arranged in such manner that his working hours would not be more than twelve hours in any day.
3.5.8 To ensure labour payment within fifteen d;iys from the date of closure of the muster roll under the scheme;the maximum time limit for payment proceess and liabilities shall .be as , follows:- No. Designation of ( )nicer/Employee r~sponsihle (II (2) I. Technical assistant/ Sub-engineer.

3.5.9.1 For any delay in labour payment to the labour, the labour shall be eligible to receive compensation under the provision and the cost of compensation will be borne by the State Government. Such compensation amount shall be recovered from the concerned agencies/Officers and shall be adjusted in the State Govern ment account.
3.5.9.2 Ir the labour payment is made after fifteen days from th<.: date of closure of the muster roli then the compensation as calculated shall he paid along with labour payment. for such delay in payment the lahour need not make any separate claim, this will not affect the right of the person"s (lahour) un<ler any other rdated laws.
3.5.9.3 The <lctails of compensation information paid due to delay in lahour payment shall he displayed on the MIS separately, so that this can he added to the total decided amount to be paid to any labourer.
3.5.9.4 The·status of delay in labour payment and responsible agency/officer must be shown in the MIS information.
3.5.9.5 On 05th and 20th of every month, information regarding delayed labour payment shall be prepared by the Janpad Panchayat Programme officer, such shall list of the responsible officers and anticipated compensation amount to be recovered from responsible persons along with recommendation also must be submitted to Additional District Programme Coordinator (Chief Executive Officer/Project Director, Jila Panchayat).
3.5.9.6 The Additional District Programme Coordinator (Chief Executive Officer/Project Director. Jila Panchayat) after compiling district level information of delay in lahour payment. along with the information and recommendations received from programme olfa:er. Janpad Panchayat, shall submit the compiled information along with 11is rccommcnda11ons to the Distdct Programme Coordinator within two days.
3.5.9.7 The District Programme Coordinator shall pass recovery orders within 15 days, after through hearing upon the recommendations of the agencies/officers respon sible for the delay in labour payment to the labours.
3.5.9.8 In case the orders are not passed by the District Programme Coordinator within 15 days, then the recommendations of Additional District Programme Coordinator (Chief Executive Officer/Project Director, Jila Panchayat) will be taken to be accepted and accordingly orders shall be passed and intimated to the concerned persons.
3.5.9.9 Compensation for delay in labour payment due to natural disasters or any likewise conditions which are beyond the control of the responsible officer/ employee. shall not be payable .
. ,.5.9. IO Recovery process will start automatically by the orders arc issued from District Programme Coordinator from the responsihlc officer/agencies salaries and the amount to he paid.

3.5.9.11 In case of delay in labour payment, labours shall be paid compensation as per the rate prescribed by the Ministry of Rural Development, Government of India.
3.5.9.12 District Programme Coordinator and Programme officer will be responsible for implementation of these provisions.
3.5.10 Provision of Appeal-
3.5.10. I An appeal shall be made before Divisional Commissioner (Revenue) against the orders passed hy the District Programme Coordinator regarding recovery of crnnpcnsation amount due to delay in labour payment.
