Short title, extent and commencement :-

(3) It shall extend to the whole of Chhattisgarh, It shall come into force from the date of its publication in the Official Gazcue. Definitions :- In these rules, unless the context otherwise requires :- , (I) "Code" means, Chhattisgarh Land Revenue Code, 1959' (No. 20 of 1959 ), . (2) "State Government" means, Government of Chhattisgarh,
(3) "Government Organization" means, Government'Undertakings of Government of Chhattisgarh. sui.:h as CREDA, Forest Development Corporation, Agriculture and Seed Dcvek)pment Corporation. etc ..
(4) , (5) "Interdepartmental Committee" means, the Interdepartmental Committee constituted by (io,crnmcnt n!° Chhattisgarh Revenue Department, "Ratanjot/Karanj and bio-c;liesel based processing unit" means and includes establish11ie:11 or compk:xJ~ or estates comprising Ratanjot/Karanj plantation and bio-dfosel processing industrial uni.ts. C1unpfisi1c high technology agricultural projects in the areas ofBio-fuel, hybrid seed prciductron, micro-pi•<ipagation through tissue culture etc., and research and development activities including training.
(6) "Lease" means, lease given under these rules but does not include suh~leasc,
(7) "Lessee" means, the organiza.tion which has been granted a lease under these rules,
(8) "Ravine land" means, land spoiled by water into gully and narrow gorges and unfit for cultivation hy ordinary means,

(2) Waste land required for the use of the concerned village shall not he given on lease under these rules.
5. Procedure for Grant of lease :-
6. (I) The application for lease shall be made to the collector in the fonnat given in schedule- I.

(9) ( I 0) Within·one month of the receipt of°the application. the committee constituted under rule:; shall c:,;a111111,· it and give its recommendation. Collector shall send the proposal to the Revenue Department in the format given in scheduk-2 ,dllng with the recommendation of the committee, Revenue department shall submit the cases received by it after ex,imination tll Chhattisgarh Bio-dics~·I Development Authority, · On receipt of the recommendation of Chhattisgarh Bio-diesel Development Authority the c.1sc shall he submitted for decision to the Interdepartmental Committee of the Revenue Department. The dccisilln or the Interdepartmental Committee with respect to the lease shall be final and shall he deemed to Ix 1hc decision of the State Government, The decision of the interdepartmental committee shall be communicated to the collector by the Revenue Department, The decision of the State Government shall be communicated to the applicant in writing h_v the c·olkctllr. If the State Government has decided to grant lease, the lease shall be executed by the Collector. ~ ' If more than one application is received for the same land, Chhattisgarh Bio-di1:.,d Development Autho rity shali rett,mmend oneapplicantkeeping in view the previous experience of the applic •1ts.lnn\vled~c in the field of bio-fuel and the possibility of proper utilization of land. Land situated withi,n 16 Kms of the limits of the area of a Municipal Corporatipn. X Kms or the limits of the area of a Municipal Committee/District Headquarters or 4 Kms of the limits of the area (1r a Nagar Panchayat shall not be g!ven on lease under these rules. · Conditions of Lease :- I 1 ~I) Waste land will be allotted first for 20 years. the State Government may renew tile lease aft.er considering the compliance with the conditons of the lease. necessity of the land in future and public .intcrcs1. fnr a further period of IO years. ·

Lessee shall not sub-lease the land: · Lessee shall be responsible for the payment of all Government and public tax. cess etc .. Lessee nfay get the Jatropha and Karanj plantation a~d Bio-diesel based processing unit managed hy a company in which the lessee Gov~rnment Organization has at least 26 percent share holdin~. hut the lessee shall neither transfer the land lo anybody nor sub-lease it under any circumstance.
7. Lease Rent:-· The lease rent shall be as follows :- (I)

(4) First Year Second to Fifth Year Sixth and Seventh Year Eight Year and afterwards Rs. 500/- .hectare Rs. 625/- hectare Rs. 900/- hectare Rs. 1400/- hectare.
8. Security Deposit :- No allotment ui:ider these rules shall be made unless lessee deposits Rupees 5000/- hectare, which shall he refundable without interest to the lessee after completion of the Project.
9. · Inspection :- The committee constitut~d under rule 3 shall inspect the wor~ of the lessee at least once a year and the insr.cclion report shall be submitted through the collector to the Chhattisgarh Bio-diesel Development Authority.
10. Cancellation of lease, return of ~ossession and re-allotment :-
(l) The State Government may, after giving an opportunity of being heard, cancel the lease at any time if the lessee contravenes, any provision of any Act or Rules for the time being in force.or the conditions of the lease. · · ·
(2) On the basis of the inspection report under rule 9 or on non-compliance.with the conditions of the lease

(4) · by the lessee in any other maimer, Chhattisgarh Bio-diesel Development Authority may recommend the cancellation oflease to the State Government, and the State Government may cancel the lease on the basis of this recom_mendation after giving an opportunity of being heard to the lessee. After cancellation of the lease the possession of the lessee shall be deemed io he unauthorized possession under section 248 of the code and revenue office1:s shall be competent to take ,fction against such lessee under section 248 of the code. In addition to the action.under section 248 of the code the lessee shall be liable to pay. a penalty of . Rs. I 0,000/- per hectare per month ·{iii the,J~nd is vacated by the lessee. . . ' . - . (5) . After the cancellation of the lease the State Government may allot the waste. land to annther lessee.

11. Removal of difficulties :- If any difficulty or dispute arises in carying out the provisions of these rules, the decision of the Revenue Department. shall be final.
12. Relaxation :- /
13. State Gove;nment may by notification in the official gazette relax any provisions of these rules. Repeal and Savings:- Lease (Government land for Jatropha/Karanj plantation and Bio-diesel based processing unit) Rules, 2005, and orders, resolutions,. if any in force immediately before the commencement of these rules, are herehy repealed or rescinded as the case may be in respect of matters covered by these rules.
