No. 41?5/5170/18/2010.-In exercise of the powers conferred by Section 37 and Section 73 read with Section 433 of the Chhattisgarh Municipal Corporation Act; 1956 (No. 23 of 1956), and Sections 70 and 110 read with Sections 355 and 356 of the Chhattisgarh Municipalities Act, 1961 (No. 37 of 1961 ), the State Government hereby makes the following further amendment in theChhattisgarh Municipalities (The Conduct of Business of Mayor-in-Council/President in Council and the Powers and functions of the Authorities) Rules, 1998, n~mely :- AMENDMENT In the said rules,- I. For Clause (i) and (ii) of sub-rule (1) of Rule 5, the followingdause shall be substituted, namely:­ "(1) In the case of Municipal Corporation - No. (I)

1.25 Crore. For sub-rule (2) and (3) of Rule 5, the following sub--rule shall be substitued, Namely:- Nagar Panchayat

(5) Upto Rs. 25,000/- More than Rs. 25,000/- but not more than Rs. JO.Lacs. More than Rs. 10 Lacs .. but not more than Rs. 75 Lacs. "(2) For expenditure in ex.cess of Rs. 5 Crores in the case of Municipal.Corporations h~ving population of more than 3 lacs, . · ·_. -·and expenditure in excess of-Rs: 3·Crores in the case of Municipal Corporations having population less than Rs. 3 lacs. prior approval of the State Government will be necessary. •

Provided: howeJer, that the ~nancial powers oi.the Commissi<;:mer, Bilaspur Municipal Corporation s_hall be upto Rs. 50 Lacs. ;

(3) · For expenditure· in excess of Rs. 2 Crores in the case of Municipalities having population of 50,000 or more, and . expenditure in excess of 1.25 Crores in the case· of Municipalities having population less than 50.000, and expenditure in excess of Rs. 75 lacs in the case ofNagar Panchayats,.prior approval of the State Government will be necessary." J_ Sub-ruk ( 4) and (5.) of Rule 5 shall be omitted:

4. . for sub-rule (5-Bfof Rule 5, the following shall be substitued, namely- ··5~B. The p,'ocedure prescribed for procurement of building materials for public works shall be followed:- . . . .

(a) For special construction and other building works and for procurement of building and.other materials; the rates approved under an earlier work/purchase will not be adopted and it will be compulsory to follow the prescribed procedure deeming the work/procurement to be a new case.

(b) The Tender Notice and Terms and Conditions must be approved, according to the value of tender, by Engineers authorized by the State Government. Tenders shall be invited only on the proforma of Tender Notice mid Terms and Conditions as approved by the Competent Authority. ·

(c) Splitting of the estimate will not be perniitted. but, if it becomes necessary to split the estimate. only the officer competent to grant administrative sanction will be competent to grant approval.

(d) Procurement shall be made in accordance with the Procurement Rules of the State Government.

(e) Coal-tar will be procured from the undertakings of Government oflndia, complying with the rules for procurement of stores. · ... • • .. .. •

(t) All matters relating to financial powers of mayor-in-Council/President-in-Council and sanction shall be plact·d 1,,r inform~tion at the following meeting ·of the Corporation/Council. Failure to do so shall render the expe11dit111-.· iUegal.

(g) If any officer expends amount correspo,~ding to-fifty percent or more,of the financial power vested in him. ht· ~11. i I 1 repoittth~texpenditure 'to his superior authority within-fiftee~ days of such expenditure."

5. For sub~rule (1) in rµle 6, the following shall be substituted, namely - "6 (1) The Tender Committee shall be as follows: · (I) According to the value of,~orks/procurement, Tender/Purchase Committees shall be formed at the local h11d, l.eYtl .as .follows :

After.obtaining recommendation of the above Co~mitt~e, the local body shall, in accordance with its financial powers, submit the proposal for financial sanction."

6. In sub-rule (3) of Rule 6, for the words and figures 'Rs. 50,000', 'Rs. 25,000' and 'Rs. 15,000' the words and figures '.Rs. I lac', 'Rs. 50,000', and 'Rs. 30,000' respe~tively shall be subst,ituted.

7. For Proviso of sub-rnle (3) of Rule 7, the following proviso shall be substituted, namely - "Provided that tne amount of Security shall be in accordance with the terms of the tender for works."

8. For Rule 8 the following Rule shall be substituted, namely:

Technical and Administrative Sanction - In respect of Municipal Corporations, the senior-most technical official of the department posted there shall approve the estimate for every construction/repair work, and adminis­ trative sanction shall be granted by the authority according to the limits of financial powers vested in him. The . Technical Sanction shall be granted according to the value of the estimates, in accordance with the provisions contained in the Chhattisgarh Financial Code Part II, by Engineers in the Urban Administration and Development Departm,ent who are at par with the authorities in the government works departments (Public WorksDepartinent, Water Resources Department, and Public Health Engineering Department) competent to grant technical sanctions, and who will be enlisted by the State Government from time to time." · For provision to Rule 8~A the following provis_o shall be substituted, namely - , "Provided that before presenting a proposal before the Mayor-in-Councii or the President-in-Council, as the case ♦ may be, technical sanction under rule 8 from the enlisted engineer of the Urban Administration and Development Department occupying the competent post will have to be obtained." , • • I • •
