~ITTl'lil.~ 5'Wmf 2008 444 (19) Raipur, the 5th August 2008 NOTJFICATJON 1\o. t l-23i2012/1/(6) ?- In exercise of the powers confen:ed by sub-section (l) of Section l 7 read with sub section (6) of sl!Crion 4 of the Chhartisgarl1 Lok Aayog Adhiniyam, 2002 (No. 30 of20(12) th~ Government of Chhanisgarft hereby make!. •ht: foHowing rules regul2ting such conditions of service of the Pramukh Lok.ayukt and L-okayukt as arr not provided for in ~ection 4 and'or in Second Schedu!e to the Ch.hattisgarti Lok A3yog AdhiniyaM. 2002 (No. 30 of 2002) :- RULES '#" " Short title and commencement: (I) These Rules may be called the Chhattisgam Pramukh Lokayukta and Lokayukta (Condi!ions ofServicei Rules. 2008.
(2) They sha:I come into force from the date of their Publication in the Official Gu.ette.
2 Definitions: l11 these rules, wtless the context otheN-ise requires,-
(a) M Adhiniyam'' means the Chhactisgarh Lok Aayog Adhiniyarn, 2002 (No. 30 of2002) ·,
(b) •· Lokayog" means the Lok Aayog as defined in claase (i) of section 2 of the Adhiniyam ;
( c) " Pramukh Lokayukt" and ., Lokayukta" -shall mean the Pramukh Lokayukta and Lokayukta, as the case may be, appointed by the Governor in themannerprovi<l<d in sub-section (5) of section 3 of the .J·\dhir.iyam.
3. Headquarters of hamukh Lokayukt and L,okayukt : The Headquarters.of the Pramukh Lokayul<t and Lokayukt shall be at Raipur :
• """ Provided that the $rate Government may fix the Headqw,rters of the Pramukh U>kayu~~ ; and/or of the Lokayukt aI any other pla~ in addition to or in lieu of the Headquarters at Raipur.
4. Hours of work and holidays : Tne hours of work and holiday for the Lok Aayog and its office shall be such as may be deciared by the Pramukh Lokayukt from time to time ; 'but save as otherwise decla.'"Cd by the Pramukh Lokayukt , Lok Aayog and its office shall obSC!"VC ·rhe same publif: holidays as are observed by the Government of Chhattisg.a:-h and such _iocal holidays as art declared by the locaJ competent authorities from time to rime.
5. Other Conditions of servke: Other Conditions of service including alk>\\'ances. gratuiry and pension, as are not pi-ovided for in section 4 and! or in the Second Schedule to the Adhiniyam, in tht case of Pramuk.h Lokayukt shall be such as are provided for in the High Court Judges (Salaries and Conditions of Service) Act, 1954 (hereina~r refer-ml to as the Act of 1954) as amended from time to time and the High Court Judges Rules. 1956, including travelling allowances and other Rules, framed under the Actofl954 and as amended from time rotime ;oras provided for in the Supreme Court Judges (Salaries and Conditions of Service) Act. 1958 (he,-,,inafter referred to as the Act of 1958) as amended from time to time and the Supreme Court Judges Rules. including travelling allowances and other Rules ..
framed under the Act of 1958 and as amended from time to time; as the case may be and in the case of Lokayukta shall be such as adm~ssible to a Secretary to the Government of India or to the Chief Secretary to the Government of Chhanisgarh from rime to tin.lC ~ as the case may be.
6. Ordinary place of Residence : Ordinary place of Residence of the Pramukh Lokayukt or the Lokayukt shall be the place where he permanently resided at the rime of his taking oath of office; or any other pf ace as may be changed and notified~ at ~st. 3 n1ootbs before lite da_te of his retirement.
7. Post Retirement Medical Facilities: (I) After mirement, the Pramukh Lokayukt and the members of his family .sh~II be .entitled lo lhe same facilities for medical ~ont and fot accommodation in Government Hospitals as are given from time to lime by the state Government to a retired Oli~f#ustice or a te(ircd Judge of the High Court of Chhaltisgarh, as the case may be.

(2) ~~. ~ 5 31'1.a 2008 After retiremen~ Lokayukta and the members of his family shall be entitled to the same facility for medical treatment and for accommodation in Government hospitals as are given from !.ime to time to a retired Secretary to the Goveniment of India or to the Chief Secretary to the Government of Chhattisgarh, as thease maybe.
11. Other Post Retirement Benefits : After retirement, the Pramukh Lokayul:t shall also be tr>'.itled to a Secre tary and sl!Ch nwnberofattendants as are given fromtimetotimeto a retired Chief Justice or a retired Judge of the High Coun of Chhattisgam, as the case may be. In addition to this, he shall also be entitled to such other post retirement benefits as may be given from time to time to a retired O,ief Justice or~ retired Judge of the High Coun ofChhattisgarh, as the case may be.
9. Removal or difficulty : If any question arises about the inwpretation of any provision of these Rules, the same shall be referred to the Governor, whose ~ision therton shall be final.
