Raipur, the 29th August2009 NOTIFICATION No. F-1-5/2008/38-2.- In exercise of the powers conferred by clause (a) of Rule 12 of the Chhattisgarh Private Universities ( Establishment and Operation) Rules, 2005, the State Government hereby makes the following-Regulation for Chhattisgarh Private Universities Regulatory Commission , namely :- REGULATION.
CHAPTER - 1 : PRELIMINARY
1. Short Title and Commencement :- (a) These Regulations may be called the Chhattisgarh Private Universities Regulatory Commission ( Recruitment and conditions of service of officers and employ ees) Regulations, 2009 ; · .,-
(b) It extends to the whole the State of Chhattisgarh ;
(c) It shall come into force on the date of its publication in the official gazette.
2. Scope of Application :- Without prejudice to generality of the provisions contained in the Chhattisgarh Civil Services ( General Conditions of Service) Recruitment Rules, 1961, these rules shall apply -Sec~etary and every employees of Service.
3. Definitions :- In these regulations,,unless the context otherwise requires :-
(a) "Act" means the Chhattisgarh Private Universities ( Establi1:1hmenl-and Operation)·Act, 2005;
(b) , "Appointing Authority "means the Appointing Autllority ·as specified in Schedule - Ill to these regulations ; · · (c ) "Commission " means the Regulatory Commission established under Section 36 of the Act ;
- (d) "Higher Education." means the Higher Education Department of the State of Chhattisgarh;
(e) "Chairman "means the Chairman of the Commission ;
(f) " Member " means the Member of the Commission ;
(g) " Secretary " means the Secretary of the Commission ;
(h) "Year " means financial year ( 1st April to 31 st March);

· (i) " Existing Employee " means an employee of the Commission who is in the service of the Commission on the date of enforcement of this Regulation ;
(j) " Fresh Employee " means an employee recruited under the provisions of this Regulation ;
(k) "Words" and " Expressions " used but not defined in the Regulation shall carry the meaning as have been assigned to them In the Chhattisgarh Private Universities ( Establishment and Operation ) Act, 2005 and the Chhattisgarh Private Universities ( Establishment and Opera tion) Rules, 2005 ;
(I) " Schedule " means the Schedule appended to these Regulation.
CHAPTER - II : CATEGORISATION AND NUMBER OF POSTS ( Categorization and strength of Officers and Employees :- (a) The number, and categories of officers and employees of the Commission shall be as specified in Schedule - I and II ;
·(b)- Subject to the approval of the State Government, the Commission may from time to time, change, increase, reduce, abolish, or re-categorize the officers and employees specified iri Schedule 1 and II· ;
(c) The Commission may also appoint on contract basis, for any suitable period, Advisors and avail of the services of Consultants, to assist the Commission, on such remuneration and other terms and conditions as may be decided by the Commission.
5. Filling up of the posts :- Nothing in sub-cla_use (a) of regulation 4 shall be construed as requiring the Commission to have the officers/employees serving in all ~he categories of posts at all times. ·
CHAPTER - 111 : PLACEMENT
6. Placement of OfficerstEmployees :- (a) Subject to exigencies of service or availability of posts. an officer/employee may be placed in any post other than the post to which he has been appointed, depending on his qualification and suitability corresponding to his grade. However, the concerned officer/ employee shall have no right of regular service on that, i.e. the other post. He will have lien on the original post ;

(b) . Any officer or employee may be required to hold more than one post for which no extra remuneration may be paid.
CHAPTER-IV RECRUITMENT AND OTHER CONDITIONS OF SERVICE Mode of Appointment:- (a)The existing employees of the Commission will be deemed to have been appointed under the provisions of this Regulation ;
(b) .The mode of appointment of fresh officer/ employee will be as follows:-
(i) Direct recruitment ; .
(ii) Promotion ; ·
(iii) Deputation from he . State Government/ Higher Education Department / Govt.
undertakings, and
(iv) ·Contract
(c) The method of recruitment of officers and employees shall be as specified in Part-A and Part -B of Schedule -II. · ~I

(d) The appointing authority, disciplinary authority, appellate authority and reviewin~ authority in respect of officers and employees of the Commission, shall be as specified in Schedule - Ill .

(e) The complete details of existing employees/ persons employed by the Commission P,rior to

(g) · commencement of this regulation 2009, are specified in Schedule - I.
The _qualification and experience required for various posts shall be as prescribed in Schedule.
- IV. However, the Commission after recording reasons in writing, may relax the eligibility criteria for appointment, in respect of posts and persons, in appropriate cases.
All appointment shall be subject to verification of characterand antecedents as may be de ·.
clded by the Commission from time to lime. ' Constitution of Selection Committee:- (a) There shall be a Selection Committee to consider and recommend candidates for appointment by direct recruitment to the posts mentioned in Part - A of Schedule - II , C9nsisting of the following :- ·
(i) Chairman of the Commission a~ its Chairman ;
(ii) Member of the Commission, and
(iii) One or more experts/ specialists of the subjects to be nominated by the Commission as members; and (M Senior most officer of the Commission will be the Convenor of the Committee.
(b) · There shall be a Selection Committee to consider and recommend candidates forappbintment by direct recruitment to the posts mentioned in Part - B of Schedule - II which shall consist of

· Secretary I Sr. Most Officer, and Dy. Director as Member;
Dy. Direc_::tor or any other officer nominated by the Chairman will be the convenor of the Committee.
The recommendation of the Selection Committee shall be final and remain valid for · a period of 6 months or for~ longer period as may be decided by the Commission .
The Committee may in.suitable cases recommend higher pay than the pay which a post carries or at a higher stage in the pay scale of the post for consideration of the Committee.
(d). The Commission may lay down the procedure to be followed by the Selection Com:11ittee.
Age Limit :~ The age limit for direct recruitment to the posts of Jr. Accounts Officer, Assistant Pro grammer, S~ographer Grade- Ill, Accountant, Data Entry Operator, Steno Typist, Assistant Grade - Ill, Driver, Peon and simJlar categories of employees shall be as per the prevailing rules of the State Government. The age limit for other posts to be filled by direct recruitment may be decided by the Commission keeping in view the years of professional experience required for the post.
