ifalll:M~ ;;i, ~ ~ -ITl-l ~ <'IW ~ l~W:!lii I<, 1Rra FR m-ft, fu~q ~ - Naya Raipur, the 30th August 2017 NOTIFICATION No. F I 0-64/2009/29-1 (8).- In exercise of the powers conferred by clause (h), (i) and (j) of sub-section (2) of Section 40 read with Section 24, 27, 28, and 29 of the National Food Security Act, 2013 (No. 20of20 13), Lhe State Government, hereby, makes the following rules of the Chhattisgrah Public Distribution System (Transparency and Accountabil ity) Rules, 2017, which has already been published as required by sub-section (1) of Section 40 of the said Act namely:- RULES

CHAPTER-I

1. Short title, extent and commencement.- (1) These rules shall be called the Chhattisgarh Public Distribution System (Transparency and Accountability) Rules, 2017.

(2) It extends to the whole State of Chhattisgarh.

(3) It shall come into force from the date of its publication in the Official Gazette.

2. Definitions.- (1) In these rules, unless the context otherwise requires,-

(a) "Central Act" means the National Food Security Act, 2013 (No.20 of 2013);

(b) "Central Government" means the Government of India;

✓ (c) "Director" m eans the Director, Food, Civil Supplies and Consumer Protection, Chhattisgarh; •

(d) "District Complaint Redressal Officer" means the·· officer appointed at district level for redressal of the 782 (1 5) co1nplaints related to the provisions under the Public Distribution System, the Central Act and the State Act;

(e) "Social audit" means a process in which the citizen s in a group supervise the implementation of the schemes under Public Distribution System and evaluates the same;

(f) "State Act" means the Chhattisgarh Food and Nutritional Security Act, 2012 (No . 5 of 2013);

(g) "State Food Commission" means the Chhattisgarh State Food Commission formed by the State Government for implementation of provisions of Section 16 of th e Central Act;

(h) "State Government" means the Government of Chhattisgarh;

(i) "Vigilance Committee" means the committee constituted under Section 29 of the Central Act and Section 24 of th e State Act to discharge the functions specified in sub­ section (2) of Section 29 of the Central Act and sub­ section (2) of Section 24 of the State Act, r e spectively.

(2) Words and expression used h erein but not defined shall have the same meaning as respectively assigned to them in the National Food Security Act, 2013 (No. 20 of 2013), the Chhattisgarh Food and Nutritional Security Act, 2012 (No. 5 of 2013), the Essential Commodities Act, 1955 (No .10 of 1955) and the Rules made thereunder.

CHAPTER-II MONITORING AND SUPERVISION 3 . Constitution of Vigilance Committee, meetings, duties and responsibilities. - ( 1) Vigilance Comm ittees shall be established at State, District, Block and Fair Price Shop level to review the implementation and monitoring of the provisions of the Central Act, the State Act and Targeted 782 ( 16) Public Distribution System (Control) Order, 2015 issued by the Central Government and Chhattisgarh Public Distribution System (Control) Order, 2016 issu ed by the State Government.

(2) Following Vigilance Committees shall b e formed , namely :­ !. State Level Vigilance Committee:- (A) Formation of committee:- President: Hon'ble Minister, Government of Chhattisgarh , Department of Food , Civil Supplies and Consumer Protection.

Members: (i) Secretary, Government of Chhattisgarh, Department of Food, Civil Supplies and Consumer Protection;

(ii) Secretary, Government of Chhattisgarh, Department of Panchayat and Rural Development;

(iii) Secretary, Chhattisgarh, Department;

Government of Cooperative

(iv) Secretary, Governm ent of Ch hattisgarh , Department of Women and Child Development;

(v) Secretary, Government of Chh attisgarh, Department of Sch eduled Tribes and Scheduled Castes Development;

(vi) Secretary, Government of Chhattisgarh, Department of School Education;

(vii)Managing Director, Chhatlisgarh State Civil Supplies Corporation;

(x) State Level Coordinator of Oil Companies; and

(xi) Members nominated by the State Government from Scheduled Tribes, Scheduled Castes, Women, Persons with disability (one member from each category) , who have experience of working in the field of food security.

Member-Secretary:- Director, Food, Civil Supplies and Consumer Protection.

(B) Meeting Schedule:- Member Secretary of the State Level Vigilance· Committee i.e. Director sh all ensure that the meeting is convened at least twice in a year.

(C) Duties and Responsibilities:- Duties and responsibilities of the State Level Vigilance Committee shall be as follows , - 782 (18)

(a) monitoring the implementation of all the schem es under the Central Act an d the State Act in the State .

(b) to review complaints Committee .

(iv) District Programme Officer, Women and Child Development Department;

(v) Assistant Commissioner, Scheduled Tribes and Scheduled Castes Developmen t Department;

(vi) District Education Officer;

(vii) Deputy/ Assistant Cooperative Societies;

Registrar,

(viii) Representative of Oil Companies;

(ix) District Manager, Food, Civil Supplies Corporation; and

(x) Members nominated by the State Government from Scheduled Tribes , Scheduled Castes, Women, Persons with disability (one m ember from each category), who h ave experience of working in the field of food security.

Member-Secretary- Collector or Additional Collector/ Joint Collector as authorized by Collector himself, who does not have the responsibilities of District Complaint Redressal Officer.

(B) Meeting Schedule:- Member-Secretary of the District Level Vigilance Committee shall ensure, that the meeting is convened at least once in every quarter and minutes of the meeting is made available to the State Level Vigilance Committee.

(C) Duties and Responsibilities:- Duties and responsibilities of the District Level Vigilance Committee shall be as follows,-

(i) to review the implementation of the provisions of the Central Act and the State Act with respect to Public Distribution System;

(ii) to review the storage of ration commodities under Public Distribution System and its distribution to the beneficiaries;

(iii) to strengthen the Public Distribution System and submit suggestions to the State Level Vigilance Committee regarding implementation of the Central Act and the State Act in the district;

(iv) to ensure compliance of the prov1s10ns of the Public Distribution System Control Order;

(v) to examine and redress the proposals received from sub-ordinate Vigilance Committees and to suggests its redressal and submit necessary suggestions to the State Level Vigilance Committee;

(vi) to take necessary action to generate awareness among consumers regarding implementation of the provisions of the Acts;

(vii) to inform the District Grievance Redressal Officer, 1n writing, of violation of any provisions of the Acts; and

(viii) to inform the District Grievance Redressal Officer, in writing, of any malpractices or m isappropriation of funds found by it.

III. Block Level Vigilance Committee:­ (A) Formation of the committee:- 782 (21) Pre sident- Chairperson of Janpad Panchayat.

Members -(i) Four members of Janpad Panchayat, which includes one member from Scheduled Castes or Scheduled Tribes and two women members (duly approved by the General Body of the concerned Jan pad Panchayat);

(ii) Assistant Inspector;

Food Officer/ Food

(iii) Project Officer, Department of Women and Child Development;

(iv) Block Education Officer;

(v) Cooperative Inspector;

(vi) In-charge of Supply Centre, Civil Supplies Corporation; and

(vii) Four Ration cardholder, which includes one from Antyodaya category and one from destitute or disabled green ration card holder (nominated by the President of ·Janpad Panchayat for two years).

Member Secretary-Chief Executive Officer of Janpad Panchayat.

(B) Meeting Schedule :- Member Secretary of the Block Level Vigilance Committee i.e. Chief Executive Officer of Janpad Panchayat shall ensure, that the meeting is convened at least once in every quarter and minutes of the meeting is 782 (22) made available lo the District Level Vigilance Committee.

{C) Duties and responsibilities:- Duties and responsibilities of the Block Level Vigilance Committee shall be as follows,-

(i) to monitor the implem en tation of the provisions of Public Distribution System, th e Central Act and the State Act at the block level;

(ii) to review the storage of ra tion commodities of Public Distribution System and its distribution to the ben eficiaries;

(iii) to submit suggestions to the District Level Vigilance Committee regarding strengthening of Public Distribution System and implementation of the provisions of the Central Act and the State Act at block levels ;

(iv) to ensure compliance of the provisions of Public Distribution System Control Order and to inform the District Grievance Redressal Officer, in writing, of any violation of the provisions of the Central Act and the State Act;

(v) to examine and redress the proposals received from sub-ordinate Vigilance Committees and to submit n ecessary suggestions to the District Level Vigilance Committee;

(vi) to take necessary steps to generate awareness among consumers regarding the provisions of the Acts and its implementation; and

(vii) to inform the District Grievance Redressa1 Officer , in writing, of any m alpractices or misappropria tion of funds found by it .

IV. Fair Price Shop Level Vigilance Committee:­ (A) Formation of the committee:-

(i) In rural areas:- President- Sarpanch, Gram Panchayat.

782 (23) Members- (i) Four members of Gram Panchayat, which includes one member from Scheduled Castes or Scheduled Tribes and two women members.

(duly approved in the meeting of Gram Panchayat);

(ii) One member, who shall be a Government employee as nominated by the Collector; and

(iii) Four Ration cardholders which includes one from Antyodaya category and one destitute or disabled green ration card holder (nominated by Gram Sabha for 2 years).

Member Secretary- Secretary, Gram Panchayat.

(ii) In urban areas:- President- Councilor of respective ward.

Members- (i) Four Ration cardholder which includes one from Antyodaya and one 782 (24) destitute or disabled green ration card holder (nominated by Municipal Corporation for two years) ;

(ii) One men1ber, who shall b e th e Government employee; a nd

(iii) Food Inspector of the respective area.

Member Secretary- Officer /Employee au th orized by the Municipal.

(B) Meeting Schedule:- Member-Secretary of the Fa ir Price Shop Level Vigilance Committee shall ensure, that the meeting is convened once in a month and minutes of the m onthly meeting is made available to the Block Level Vigilance Committee.

(C) Duties and Responsibilities:- Duties and responsibilities of the Fair Price Shop Level Vigilance Committee shall be as follows, -

(i) to review the activity and responsibilities of Fair Price Shops being run in the Gram Panchayat/ Ward;

(ii) to review the storage and distribution of ration commodities in the Fair Price Shop as fixed by Director, Food, Civil Supplies and Consumer Protection;

(iii) to Physically verify food grains at the time of storage at Fair Price Shop;

(iv) to organise Rice Festival as fixed by the Dis trict Administration;

(v) to proclaim arrival of food grains monthly at Fair Price Shop ;

(vi) t o iden tify th e lan d a nd to suggest for con stru ction of bu ilding, where fa ir Price Shop building is not available;

(vii) to display fair price shop's name on board, stock board, ration card list, name of m embers of Vigilance Committee at Fair Price Shop;

(viii) to maintain the prescribed registers at Fair Price Shop;

(ix) to ensure display of samples of food grains being distributed at Fair Price Shop;

(x) to check the quality of food grains received at Fair Price Shop;

(xi) to ensure the monthly submission of Declaration Form and Amount/Demand Draft on time from Fair Price Shop sales person;

(xii) to register maximum number of beneficiaries of the village/ward and members of the committee at Department's website, so as to r eceive information through SMS regarding storage of food grains at Fair Price Shop allotted for the same;

(xiii) to make available suggestions regarding functioning of Fair Price Shop t o the Block Level Vigilance Committee;

(xiv) to ensure compliance of the provis10ns of Public Distribution System Control Order, the Central Act and the State Act and inform the District Grievance Redressal Officer, 1n 782 (26) Vlriting, of violation of any prov1s10n of the Central Act and the State Act; and

(xv) to inform the District Grievance Redressal Officer, in writing, of any malpractices or misappropriation of funds found by it.

CHAPTER-III Transparency and Accountability

4. Disclosure of records of PDS.- (1) Public Distribution System related important records such as,-

(i) copy of the Central Act and the State Act ;

(ii) information r egarding implementation of Public Distribution System;

(iii) issuance of ration card;

(iv) district-wise and agen cy-wise information of Fair Price Shop;

(v) district-wise, block-wise, gram panchayat/urban local body-wise ration card report;

(vi) monthly report of allocation, storage and distribution of ration commodities; and

(vii) relevant records pertaining to the mid-day m eals scheme and schemes implemented through aanganwadis for food and nutrition security, shall be placed in the public domain. These documents can be inspected and copies can be provided under the provisions of the Right to Information A.ct, 2005 (No.22 of 2005).

(2) The following actions needs to be taken in order to maintain Transparency and Accountability, namely:-

(a) Janbhagidari Website- Important information of Public Distribution System with reference to the provisions of the Central Act and the State Act shall be displayed at "Janbhagidari" website. There shall be provision for lodging of complaints and suggestions by the general public in the website and a lso to r egister the mobile numbers to obtain 782 (27) infoi-111; 1 I ion regarding storage of ration commodities in the F:1i 1· Price Shop under Public Distribution System. Jn c1cl ciition, the following information of the department shall ,ilso be displayed on the \1/ebsite, namely: -

(i) District-wise , Block-wise/Municipality-wise and Panchayat-wise Fair Price Shops;

(ii) District-wise, Block-wise/Municipality-wise and Panchayat-wise r a tion cards;

(iii) District-wise, Fair Price Shop-wise monthly allotment;

(iv) Detailed information of Fair Price Shop-wise ration cards;

(v) Rules and Acts of the Department; and

(vi) Other information of the department as specified by the Director, Food, Civil Supplies and Consumer Protection, from time to time.

(b) Rice Festival -

(i) In order to ensure transparency in distribution of ration commodities under Public Distribution System, the Central Act and the State Act, Rice Festival shall be conducted every month at Fair Price Shops.

(ii) In such villages where Fair Price Shops are run and Hat Bazars are in operation, Rice Festival shall be conducted on tlie day of first h at bazaar of every month and in the remaining Fair Price Shops the same shall be condu cted on 7 th of every month.

(iii) A Nodal Officer for Rice Festival shall be appointed by th e District Collector at each Fair Price Shop.

(iv) Monthly quota of ration commoditie s shall b e distributed to b eneficiaries in th e presence of 782 (28) mdl-a•1~~ . ~ 1~2011 members of Vigilance Committee and Nodal Officer at Rice Festi\·al.

(c) Social Audit:- In order to ensure transparency in the implementation of Public Distribution Syste111 , the Central and the State Act, the State Government shall make available all records to the general public . Social Audit shall be done in accordance with the following procedure, n amely:-

(i) All records related to allotment, storage and distribution of ration commodities under Public Distribution System at Fair Price Shops shall be placed at Gram Sabah on 15th of August and 26th of January every year for social a udit .

Records related to mid-day m eal scheme and Integrated Child Development Services (ICDS) centers in the panchayat or ward area shall also be submitted for social audit.

(ii) For this purpose, in rural areas, documents of intervening period of the Gram Sabhas in the Gram Sabhas days specified in the sub-clause (i) of clause (C) of Rule 4 shall be produced by the Fair Price Shop Owner and concerned Food Inspector for social audit.

(iii) After audit of documents at Gram Sabah, the report along with recommendation shall be submitted to Block Level Vigilance Committee.

After examination by Block Level Vigilance Committee, recommendation shall be forwarded to District Level Vigilance Committee for further necessary actions.

(iv) In urban areas , the urban local body shall convene a meeting of the residents of the ward on the fixed date and shall conduct social audit.

Meeting at ward level shall compulsorily be conducted at least once in six months for social audit.

(vii) After co1npiling the social audit report of Fair Price Shops. District Collector shall take appropriate aclion to address the issues arising from the audit. Action taken on the social audit report shall be forwarded lo Direclorale and the Stale Government.

5 . Exemption.- For smooth functioning of Public Distribution System, the Slate Governn1ent, by keeping consistence v,rith Targeted Public Distribution System (Control) Order, 2015 issued by the Central Government, may grant an exemption from all or any of the provisions of this rule and may revoke or suspend such exemption at any time.

6. Protection of the action taken under this rule .- No suit, prosecution, or other legal proceeding shall lie against any person for anything which is in good faith done or in tended to be done under this rule.

7 . Powers to issue orde rs for compliance of instructions. - The State Government or the Director may issue n ecessary orders / instructions, from time to time, to ensure compliance of various provisions of. this rule and for the transparency, accountability and implementation of innovations in Public Distribu tion System.
