t.?mlfl•I¢ ~~~ -;im~-am~,~~llj,f!R, lrlra~m.ft.~~- Naya Raipur, the 23rd January 20 l 7 NOTIFICATION No. F l 0-64/Food/2009/29-1 .- In exercise of the_powers confen ed by sub-section (1) and clause (a) of sub-section (2) of Section 40 of the National Food Security Act, 2013 (No. 20of20 13) read with sub-section (I) and clause (b) and (c) of sub-section (2) of Section 30 of the Chhattisgarh Food and Nutritional Security Act, 2012 (No.5of2013), the State Government, hereby, makes the following rules relating to regulation of ration card in the State of Chhattisgarh, the same having been previously published as required under sub-section (1) of Section 40 of the National Food Security Act, 2013 (No. 20 of2013), namely:- RULES J. Short title, extent and commencement.- (I) These rules may be called as the Chhattisgarh Ration Card Rules, 2016.

(2) It shall extend to the whole State of Chhattisgarh.
(3) These rules shall come into force from the date ofits publication in the Official Gazette.
Definitions.- ( 1) In these rules, unless the context otherwise requires,-
(a) "Act" means the Chhattisgrah Food and Nutritional Security Act, 2012 (No. 5 of2013);
(b) "Competent Officer" means officer appointed by collector for identification of beneficiaries ofration cards and issuance of the san1e;
( c) "Control Order" means the Chhattisgarh Public Distribution System (Control) Order.

(d) "Department" means the Department of Food, Civil Supplies and Consumer Protection of the Government of Chhattisgarh;
(e) "Director" means the Director Food, Civil Supplies and Consumer Protection;
(f) "Household for ration card" means and includes the husband, wife , their unmarried children and dependent members;
(g) "Notification" means the notification issued under these rules and published in the Official Gazette; and
(h) "State Government" means the Government of Chhattisgarh.
(2) Words and expressions used herein but not defined shall have the same meaning as respectively assigned to them in the Chhattisgarh Food and Nutritional Security Act, 2012 (No. 5 of 2013), the Chhattisgarh Public Distribution System (Control) Order, 2004, the Essential Commodities Act, 1955 (10 of 1955) or in any other relevant Act.
3. Type of ration card and entitlement.- (1) Ration card shall be of Antyodaya, Priority and Mukhya Mantri Khadyanna Sahayata Y oj ana only.
(2) Following persons and families shall be eligible for ration card, namely: -
(a) persons or families mentioned as Particularly Vulnerable Social Group in sub-section (2) of Section 15 of the Act, who are also eligible under Antyodaya Households;

(b) persons or families classified as Priority Households under sub-section (3) of Section 15 of the Act.
4. Exclusion of persons or households for ration card.- Following categories of persons or households shall be excluded for entitlement for the ration card, namely:-
(a) such person and members of the household, who are excluded under sub-section (4) of Section 15 of the Act; .,;
(b) all employees of all the departments, Public Undertakings, Corporations, Board, Autonomous Institutions and Local Bodies of the Central or the State Government, who are permanent or have been appointed on contract basis except daily wager not below the rank of Class-III, Adhoc and Class-IV employees;
(c) the State Government may, from time to time by notification, create more categories of excluded persons or families under this rule and such person and their family mem.bers shall stand excluded from the date of publication of such notification.
5. Guidelines for identification of Antyodaya, Particularly Vulnerable Social Group Household and Priority Households.-(!) Identification of Antyodaya Household- In sub-section (5) of Section 15 of the Act, there is a provision to be specified as Particularly Vulnerable Social Group Household · under Antyodaya Household.
(II) Particularly Vulnerable Social Group Household- ( 1) In sub-section (2) of Section 15 of the Act, the following shall be specified as Particularly Vulnerable Social Group Household: - 60 { 14)
(a) all households of Particularly Vulnerable Tribal Groups as notified by the Central Government, from time to time, i.e all the families belonging to Baiga, Birhor, Hill Korwa (Pahadi Korwa), Kamar and Abhuj Maria tribes;
(b) all households headed by a widow or a single/ destitute women;
(c) all families whose head is suffering from incurable disease specified by the State Government;
( d) all households headed by a person with disability;
( e) all households headed by a person of sixty years of age or more with no assured means of subsistence. or social support;
(f) all households headed by a person_ released from bonded labor;
(g) all household whose head is Ho:.:neless and all the household who belong to Pando and BhunJia Tribe are merged 1n Particularly Vulnerable Social Group Household under clause (g) of sub-section (2) of Section 15 of the Act; and
(h) any other group of households as may be notified by the State Government, from time to time.
(2) Procedure for identification of eligible Antyodaya Household- families applying for Antyodaya Ration Card, shall choose one Category from the Particularly Vulnerable Social Groups, based on their eligibility, and shall produce following certificate , namely:- ,-.;

(a) caste certificate issued by the State Government, for families of Baiga, Hill Korwa (Pahadi Korwa), Birhor, Kamar, Abhuj Maria, Pando and Bhunjia Tribes;
(b) certificate issued by Secretary, Panchayat in rural areas and Competent Officer of Urban Local Bodies in Urban Areas, for identification of Widow or Single Women;
(c) certificate issued by a Competent Officer of Health Department of concerned area, in case of suffering from incurable diseases which are specified by the State Government;
(d) disability Certificate issued by the Competent Officer, for verification of Persons with Disabilities;
( e) certificate issued by the Secretary, Panchayat in rural areas and Competent Officer of Urban Local Bodies in Urban Areas for verification of Destitute person;
(f) certificate issued by the Competent Officer of Labor Department for verification of Bonded Labour;
and
(g) certificate issued by Secretary, Panchayat in rural areas and Competent Officer of Urban Local Bodies in Urban Areas, for the verification of Homeless people.
(3) Competent Authority after receiving the application in Proforma-I along with certificates regarding eligibility for Antyodaya Household shall verify the same and on 60 ( 16) finding her /him eligible shall certify eligibility of the applicant for Antyodaya Ration card.
(III) Identification of Priority Household- (1) Subject to the provision of sub-section (3) of Section (15), all households belonging to the following categories shall be designated as priority households, namely: - ( a) all households, which are eligible to receive food materials as per the criteria specified under the Mukhya Mantri Khadyanna Sahayata Yojana, to the extent of their entitlements under the said Yojana, from the date of commencement of the Act;
(b) all households of landless agricultural laborers;
(c) all households of small farmers and marginal farmers;
(d) all households headed by a person registered as an unorganized labour under the provisions of the Unorganized Workers' Social Security Act, 2008 (33 of 2008); and ( e) all households headed by a person registered as construction worker under the provisions of the Building and Other Construction workers (Regulation of Employment And Conditions of Service) Act, 1996 (27 of 1996).
(2) Procedure for identification of Priority Household Families applying for Priority Household Ration Card, keeping in mind their eligibility, shall choose one category from the Priority Household and shall produce following certificates, namely: - 60 ( 17)
(a) photocopy of Ration Card, 1n case of being an eligible ration card holder of Mukhyamantri Khadyanna Sahayata Yojana, from the date of commencement of the Act;
(b) certificate issued by the competent officer of Revenue Department, for the verification of households of landless agricultural laborer;
(c) certificate issued by the competent officer of Revenue Department, for the verification of households of small and marginal farmers;
(d) certificate issued by the competent officer, for the verification of a person registered as an unorganized labour under the provisions of the Unorganized Worker's Social Security Act, 2008 (33 of 2008);
(e) certificate issued by the competent officer, for the verification of a person registered as construction worker under the provisions of the Building and Other Construction workers (Regulation of Employment And Conditions of Service) Act, 1996 (27 of 1996).
(3) Competent Authority after rece1v1ng application alongwith certificates regarding eligibility of Priority Household shall verify the same and on finding her / him eligible shall certify eligibility of the applicant for Priority Ration card.
6. Utility of ration card. - ( 1) Ration Cards shall not be used for any other purpose except for the entitlement of consumer rates and quantities of ration commodities.

(2) Eligibility of ration commodities under ration card shall be according to the provisions laid down in Schedule-I of the Act.
7 . Continuance of the existing ration cards. - All valid ration cards issued before the commencement of these rules and in existence shall remain in force till they are cancelled under this rules.
8. Procedure for preparation or transfer of ration cards and addition or transfer of members.- ( 1) Application for new ration card or transfer of ration cards to any other region within state shall be submitted in proforma-1 to the con(?erned Urban Local Body or Gram Panchayat.
(2) In order to addition of name of new members in ration card or to transfer their name in any other ration card, application _in_ proforma-2 shall be submitted to the concerned Urban Local Body or Gram Panchayat.
(3) for the identification of Head of the Family a.t7.d its members and error free confirmation of Residential Address, following documents shall be enclosed with the application, namely: -
(a) Any photo identity card of the head of the household and other members of the family applying for head of the household in ration card, duly approved for this purpose by the Director;
· (b) Passport size photograph of head of the household and other members;
(c) Birth Certificate, in order to addition of the name of minor in Ration Card or Photocopy of the certificate issued by the 60 ( 19) School wherein Date of Birth has been specified or any other document approved by the Director;
( d) Photocopy of Aadhaar Card or Voter Identity Card (Epic Card) of head of the family and other members of family;
(e) Information of Bank Account number and I.F.S.C code number of head of the household or any other member of the ,,;
household; and (:f) Copy of Certificate regarding eligibility of being included under Antyodaya or Priority Household category.
(4) On receiving the application forms, competent officer of concerned Urban Local Body or gram panchayat shall inspect the certificate(s) enclosed with the application form, other documents and declarations. Upon finding any discrepancies in the information given in application or any doubt regarding the authenticity of the document, competent officer shall cause verification of the certificate by the Government official or issuing officer/ employee, so that only eligible families can issued Ration Card.
(5) Competent Officer shall tally the members of family with the report of survey done in census 2011, · based on Social, Economic and Caste norms. On finding it correct, shall attach a photocopy of the information of the family along with the application.

(6) For the verification of the information given 1n the application, the Competent Officer shall inspect the locality and compulsorily take the statement of the local people.
(7) Competent Officer, after verification, shall submit his verification report to the Chief Municipal Officer or Commissioner of the Urban local bodies or Chief Executive Officer of Janpad Panchayat in Rural areas.
9. Call for objection of general public in case of application for Ration Card.- After completion of process given in rule 8 being completed, following steps shall be taken for calling objection of the general -public on the application for ration card-=-- ( 1) Details of the applications verified by the Commissioner or Chief Municipal Officer of Urban Local Bodies and Chief Executive Officer of the Blocks, shall be village-wise and urban body-wise displayed on the website of the Food, Civil Supplies and Consumer Protection Department.
(2) Details of the verified applications shall be displayed on the notice board of Urban Local Bodies or Gram Panchayat.
(3) Details of the applications received shall be read before the public present at village or ward meetings.
10. Hearing of objection.- If any objection on the application for ration card is received, the same shall be heard by the Chief Municipal Officer or Commissioner or the Competent Officer authorized by hirn in urban areas and Chief Executive Officer, Janpad Panchayat in rural areas.

11. Order on the application for ration card.- After completion of process given in rule 8 , rule 9 and rule 10 of these rules, the Chief Municipal Officer/ Commissioner or the Competent Officer authorized by him in urban areas and Chief Executive Officer, Janpad Panchayat in rural areas shall issue final order and thereafter, process of making ration cards, amendment or transfer shall be made and copy of the order shall be made available free of cost.
12. Time limit for issuance of Ration Card.- Time limit for issuance of ration card shall be such as prescribed under Chhattisgarh Lok Seva Gurantee Act, 2011 (No.23 of 2011). _ _ _
13. Appeal.- An appeal against the order made by Commissioner or Chief Municipal Officer or competent officer authorized by him in urban areas and Chief Executive Officer, Janpad Panchayat in rural areas shall be presented to Tehsildar within 30 days from the date of such order and the decision taken by Tehsildar shall be final.
14. Verification of ration cards.- Every year Intensive verification campaign of ration cards shall be organized and lists of Ration Card shall be updated as follows:- ( 1) Intensive verification of ration cards shall be done necessarily in those villages or wards where the number by ration cards or number of members of household is abnormally more than that is found 1n 60 (22) Census and Socio economic information and for this purpose, list of Fair Price Shops shall be prepared by the Collector.
(2) Director or Collector may, at any time, issue order for intensive verification of ration cards of any area.
(3) for intensive verification, notice shall be issued to all concerned ration card holders of selected Fair Price Shops, asking them to submit declaration and certificate in such form as prescribed by the Director, food, Civil Supply and Consumer Protection, to the effect that they do not come under the purview of excluded categories and are required to produce the same as proof for Ration Cards.
(4) after completion of process given in rule 8, rule 9 and rule 10 of these rules, order shall be issued under rule
11.
(5) after the completion of the said procedure updated list of ration card shall be displayed.
15. Punishment for giving false information for issuing ration card and concealing of evidence or fact.- If a person gives any false information in the application or declaration under these rules or conceals any information intentionally or if any person issues bogus or ineligible ration card on the basis of any false information or certificate in the application or declaration under th ese rules , he shall be punished under the provision of relevant Act or Rules made thereunder or any other law for the time being inforce. If any procedure mentioned in the rule is not followed for the issuance of t , 60 (23) ration card, departmental disciplinary action shall be taken against the competent officer, officer and employees authorized by the collector for the verification of application form and documents.
16. Power to issue order for compliance of instructions.- For compliance of the various provisions of these Rules. the State Government may, from time to time, issue necessary orders,.
