Short title and extent ( i) This Order may be called the Seed<;

(Control) Order, 1983.

(ii) It extends, to the whole of India.

(iii) It shall come into force on the 30th December, 1983.

2. Definitions :

In thi<. Order, unles<; the context othern·ise re­ quires, ( a) ''Act" means the Essential Commodities Act, 1955 (10 of 1955).

( b) "Controller'' mcam a person appointed as Contro11er of Seeds by the Central Government and includi:s any person empowered by the Central Government ta exercise all or any functions of the Controller under this Order;

(c) "Dealer" means a person can;ying on the business of selling, exporting or im­ porting seeds, and includes an agent of a dealer;

(d) "Export'' means to ta.te or cause to bo taken out from any place in India to a place outside India;

( e) ''Form" means a form appended to this Order;

(f) "Import" means to bring or cause to be brought to any place in India from out­ side India.

(g) ''Inspector'' means an Inspector ot seeds appointed under clause 12;

(h) "Registering authority" means a licens­ ing authority appointed under clause 11;

(i) "Seeds" means the seeds as denned in the Seeds Act, 1966 (54 of 1966).

( j) ''State Government" in relation to a Union Territory means the Administra­ tor thereof by whatever designation known.

DEALER IN SEEDS TO BE LICENSED

3. Dealer to obtain licence :

( 1) No person ::;hall carry on the business of se11ing exporting or importing seeds at any place except under and in accord• ancc with the terms and conditions of licence granted to him under this order.

8 THE GAZETTE OF lNDlA : EX'rRAORDINAR Y (PARf II -SEC, J(i)J -- - -========---· =-.,:c-~-,---=---- ~- ---- -----~--------c- -~...::=-.:=:- - _: (2) Notwithstanding anything contained in sub-clam~ ( 1), the State Government may, by notification in the Official Gazette, exempt from the provisions. of that sub-clause such class of dealers in such are.as and subject to such conditions as may be specified in the notification.

4. Application for licence :

Every person desiring to obtain a licence for f;elling, exporting or importing seeds shall make an application in duplicate in Form 'A' together with a fee of rupees fifty for licence to Jiceminp; authority.

5. Grant and refusal o( licence :

( 1) The licensing authority may, after mak­ ing such enquiry as it thinks fit, grant a licence i.n Form '13' ta any person who applies for It under clause 4:

Provided that a licence shall not be issued to a person-

(a) whose earlier licence granted under this Order is under suspension, dur­ ing the period of such suspension:

(b) whose earlier licence granted under this Order has been cancelled, with­ in a pcric,d of one year from the date of such cancellation.

( c) who has been convicted under the Essential Commodities Act, 1955 ( 10 of 1955) or anv order issued there­ under within three vears preceding the date of application.

( 2) When the licensing authority ref uses to grant licence to a person who applies for it under clause 4, he shall record his reasons for Joing so.

6. Period of validity of licence :

Every licence under this Onkr, '.:>haB, unless previously smpended or cancelled, re­ main valid for three years from the date of it5 · issue. . -

7. Renewal of licence :

( 1 ) Every holder o[ licence desiring to re­ new the licence. shall, before the date of expiry of the licence, make au appli­ cation for reuewal in duplicate, to the licensing authority in Fonn 'C' together with a fee of rupee.., twenty for re­ newal. On receipt of such application, together with such foe, the licensing authority may renew the licence.

( 2) If any application for renewal is not made before the expiry of the licence, but is 1D-nde within one month from the date of expiry of the licence, the licence may be renewed on payment of addi­ tional fee of rupees twenty five, in addi­ tion to the fee for renewal of licence.

8. Dealen. to display ~tock :1nd price list :

Every dealer of seeds ~hall display in his place of business :

(a) the opening and closing stocks, on daily basis. of different -;eeds held by him;

(b) a 1ist indicating prices or · rates of different seeds. ·

9. Dealers to give memorandum to purchaser:

Every dealer shall give a cash or credit me• morandum to a purchaser of seeds.

10. Power to distribute seed,:; :

Where it is considered necessary to do so in public interest, the Controlkr may, by an order in v.riting direct any producer or dealer to sell or distribute any seed in such manner a'i may be ~pecified therein.

ENFORCEMENT AUTHORITY :

11. Appointment of licensing authority The State Government may by notification in the Official Gazette appoint such number of persons as it thinks necc.ssary ta be licen~ing authority and may al'io define in that notification the area with­ in which each such iicem,ing authority shall exerci~;J his iurisdictio11.

12. Appointment of Im,pectors :

The State Government may hy notification in the Official Gazett~ appoint such numher of persons as it thinks necessary to be Im;pe<.:tors and may in such noti~ fication define the local area within which each such Jnspe<.:tor shall exer­ cise his jurisdictinn.

13. Inspection and Puni-;hment :

(I) An Inspector may with a view to secur­ ing compliance with this Order-

(a) require any dealer to give :my informa­ tion in his possession with n~spt:ct to purclrnse, storage and sak of s..-ed.., hy him:

(b) enter upon and 'iearch any premi,cc;

where any seed ic; stored or exhibited for sale to ensure compliance with the provi<:i0n of this Or<lef;

(c) draw samples of seeds meant for sale, export and seeds importi!d, and ~end the ~rune in accordance with the pro­ cedure laid down in Schedule L to a laboratory notified under the Seeds Act, 1966 (54 of 1966) to ensure the sample conforms to standard of quality claimed;

(d) ~ei7.,e or detain any Si~etl in respect of whicl). he ha~ rea<;on to believe that a contravention of this Order has been committed or i'> being committetl;

( f:) ~.eize any books of accounts or docu­ ment relating to any s.eed in ~spect of which he has reason to helieve that a contravention of the Order has been conu11itted or i,, being committed.

Provided that the Inspector shall give a receipt, in respect of the books of account.;; or documents seized, to the person from whom they have been seized.

Provided furlher that the seized boe1ks of account·, or document& shall be returned to the pen,on from whom the same had been seized after copies thereof or extracts therefrom as certified by such person have been taken.

( 2) Subject to the prov1s10n of paragraph ( d) of sub-clamc ( 1 ) , the provision, of s~ction 100 of the Code of Criminal Procedure, 1973 (2 of 1974) relating to search and seizure ~hall, so far as may be, apply to ~earches and seizures under this clause.

( 3) Where any seed is seized by an Inspec­ tor under this clause, he shall forthwith report the fact of such seizure to a Magistrate whereupon the provisions of sections 457 and 45!1 of the Code of Criminal Procedure, 1 97 3 ( 2 of 197 4) shall, so far as may be, apply to the custody and disposal of such seed.

( 4) Every person, if so required by an Ins­ pector, shall be bound to offer all neces­ sa,ry facilities to him for the purpose of enabling him to exercise his power under this clause.

14. Time limit for analysis :

The laboratory to which a sample has been sent by an Inspector for analysis under this Order shall analyse the said samp­ les and send the analysis report ta the 1246 Gl/83-2 9 -~---=----==--=-- ·- --- . -_-_-----.

concerned Inspector within 60 days from the Jate of receipt of the sample in the laboratory.

15. SuspensionlCancellation of licence :

The licem,ing authority may, after giving the holder of the licence an opportunity c,f' being heard, 'lU<;pend or cancel the licence on the lollowing grounds, name­ ly:-

(a) that the Jice11CL' had been obtained by misrepre~ntacio11 as to a material particular; nr

(b) that any of the provision:; of this Onlcr or any condition of licence has been ccmtraveneo.

16. Appeal :

Any person aggrieved by an order- ( a) refusing to grant, amend or renew the licence for sale, export or import of seeds;

(b) suspending or cancelling any licence.

may within sixty days from the date of the order, appeal to ~uch authority as the State Government may speciiy in thi& behalf, and the decisian of such authority shall be final :

Provided that nn application for shall accomranv an appeal rupees fifty.

}.IHSCELLANEOUS :

17. Amendment of licence appeal fee of The licensing authority may, on receipt of a request in writing together with a fee of rupees ten from a dealer, amend the licence of such dealer.

18. Maintenance of records and submissian. ot returns, etc. :

(1) Every dealer shall maintain such books, accounts and records relating to his business as may be directed by the State Government.

( 2) Every dealer shall submit monthly re­ turn relating to his business for the pre­ ceding month in Form 'C' to the licens~ ing authority by the 5th day of every month.

(b) 501 to 3,000 kilograms--?ne indi­ vidual sample for each 300 k1Jograms, but not less than 5 individual samples.

(c) 3,001 to 20,000 kilograms-one in­ dividual samples for each 500 kilogrnms but not l1iSs than 10 individual samples.

For seed in bulk the indivjdual samples should be distributed at random all over the bulk and the samples drawn from varying depths. Bag sampling-For seed lots in bags or other contain­ ezs the following sampling intensity should be regarded as a mini mum requirement :

(d) upto 5 containers-sample each cnn­ taincr but always take at least 5 indivi­ dua 1 samples.

(e) from 6 to 30 containers-sample at least one in every three containers but never less than 5.

(f) 31 containers or more-~ample at least one in every five containers but never less than 10.

Unless doubt exists about the homogeneity of a lot, all such primary samples should be combineJ.

to make a composite sample of the lot for sub­ mitting to the seed testing laboratory. If the. in· dividual or primary samples are not sufficiently homogenoU8, they may be sent to the laboratory for a heterogeneity test.

II. Containers to be labelled and addres­ :-ed-All containers containing samples for analysis shall be properly labelled and the parcels sliall be properly addres­ sed. The label on any sample of seed sent for analysis shall bear- --..-- -------·---'----~---- -~-~-;----= ~~- - ~~

(a) serial number~

(b) name of the sepder with ofliail de­ signation, if any ;

(c) name of the person from whm the sample _has been ta,k:en;

(d) date and place of taking the sa1ple;

(e) kind or variety of the seed fonna• lysis;

(f) nature and quantity of preservave, if any, added to !he sample.

IV. Manner of Packing, Fastening nd Sealing the Samples-All samples of seeds sent for analysis shall be packd, fastened and sealed in the followi g manner :

(a) The stopper shall first be securey fastened so as to prevent lea\:age of tle containers in, transit.

(b) The container shall then be corr.ple­ tely wrapped in fairly strong ~ paper. The end<; of the paper shall he neatly folded in and affixed hy mean~ of gum or other adhesive.

(c) The paper oovcr shall be fur1her secured by means of strong twine or thread both above and across the CJn­ tainer, and the twine or thread slaU then be fastened on the paper cover by ineans of sealing wax on which th1re shall be at lea1;t four distinct and char impressions of the seal of the sendr, of which, one shall be at the top of tie packet, one at the bottom ap.d the otbr two on the body of the packet. Te knots of the twine of thread shall ,e covered by means of sealing wax bea­ ing the impression of the seal of th sender.
