Raipur, the 22nd March 2016 NOTIFICATION No. 325/F 8-146/35/2015.- In compliance of the honourable Supreme Court order dated 06.08.2008 (Writ Petition Number-440/2000, Miss Geeta sheshmani Versus Union of India and others) and section 4(1) of "Prevention of Cruelty to Animals Act, 1960"; Government of Chhattisgarh hereby pleased to constitute "Chhattisgarb State Animal Welfare Board" under Livestock Development Department.

ifo·-flfl•li;; ~~. ~ - 30J:IT'ci2016 Objective of the Board :- Objective of the Board is to protect the animals from infliction of unnecessary pain or suffering by enforcement of "Prevention of Cruelty to Animals Act, 1960".
3. Definitions :- 3 .1 "Act" means the Prevention of Cruelty to Animals Act 1960 (No . 59 of 1960)
3.2 "Chairman" means the Chairman ofChhattisgarh State Animal Welfare Board.
3.3 "Member" means the member ofChhattisgarh State Animal Welfare Board.
3.4 "Executive Committee" means Executive Committee ofChhattisgarl1 State Animal Welfare Board.
3.5 "Member Secretary" means the Member Secretary of Chhattisgarh State Animal Welfare Board.

Member Member Secretary The term of Chhattisgarh State Animal Welfare Board shall be of five years from the date of notification.
4.2 In order that the Chairman and other members of the Board hold office till the same date and that their terms of office come to an end on the same date, the state Government may, reconstitute, as soon as may be after foe notification of Chhattisgarh State Animal Welfare Board in the official gazette.
4.3 The Board as reconstituted under sub-section 4.2 shall be reconstituted from time to time on the expiration of every fifth year, from the date of its reconstitution.

5. Terms of office and conditions of service of members of the Board:-
5.1 The term of the office shall be five years from the date of the reconstitution and the Chairman and other Members of the Board as so reconstituted shall hold office till th e expiry of the term for which the Board has been reconstituted.
5.2 The term of office of an ex-officio Member shall continue so long as he holds the office by virtue of which he is a member of the Board.
5.3 The term of office of a Member elected or chosen under section 4 (A) shall be co-terminus with their membership of the body for which he had been elected.
5.4 The term of office of a Member appointed, nominated, elected or chosen to fill a casual vacancy shall continue for the remainder of the term of office of the Member in whose place he is appointed, nominated, elected or chosen.
5.5 If member of the Board found absent without prior notice in the last three consecutive meetings, his/her membership shall be considered to be terminated.
5.6 The State Government may, at any time, remove for reasons to be recorded in writing a member from office after giving him a reasonable opportunity of showing cause against the proposed removal and any vacancy caused by such removal shall be treated as casual vacancy for the purpose of clause (5.4).
5.7 The members of the Board shall receive such allowance, if any, as the Board may, subject to the previous approval of the State Government decide.

6. FundsoftheBoard:- The funds of the Board shall consist of grants made to it by the Government and of contrib utions, subscriptions, bequests, gifts and the like made to it by any local authority or by any other person from time to time.
7. Accounts, Budget, Audit and Banking:-
7. l The Member Secretary of the Board shall be responsible for maintenance of the accounts subject to approval in the meeting of the Board. He may be assisted by the officer/officers appointed by the Board in this behalf.
7.2 The accounts will be audited by the auditors of the Government of Chhattisgarh as per rules in force.
7.3 The Budget estimate for the ensuing year shall be prepared by the Secretary, State Animal Welfare Board and be placed before the Board meeting for approval before March every year.
7 .4 The Member Secretary of the Board or any officer authorise by him in this behalf shall operate the Bank accounts with any Nationalised Bank.
8. Functions of the Board :-
8.1 To promote animal welfare activities and advice the state government on matters related to welfare of animals.
8.2 To review the work of District level Society for Prevention of Cruelty to Animals .

8.3 To keep the law in force for the Prevention of Cruelty to Animals under constant study and to advise the go vernment on the amendments to be undertaken in any such law time to time .
8.4 To take all such steps as the Board may think fit for welfare of animals like construction of sheds.

8.5 To advise the Government or any local authority or other person in the design of slaughter houses or the maintenance of slaughter houses or in connection with slaughter of animals so that unnecessary pain or suffering, whether physical or mental, is eliminated in the pre-slaughter Stages as far as possible, and animals are killed; wherever necessary, in as humane manner as possible;
8.6 To take all such steps as the Board may think fit to ensure that unwanted or dangerous animals are destroyed by local authorities whenever it is necessary to do so either instantaneously or after being rendered insensible to pain or suffering.
8. 7 To encourage by the grant of financial assistance or otherwise, the formation or establishment of animal shelters, rescue homes, sanctuaries and the like where animals and birds may find a shelter when they have become old and useless or when they need protection.
8.8 To co-operate with and co-ordinate the work of associations or bodies established for the purpose of preventing unnecessary pain or suffering to animals or for the protection of animals and birds.
8.9 To give financial and other assistance to Animal Welfare Organisations functioning in any local area or to encourage the formation of Animal Welfare Organisations in any local area, which shall work under the general supervision and guidance of the Board.
8.10 To advise the Government on matters relating to the veterinary care and attention and to give financial and other assistance to Veterinary hospitals whenever the Board think necessary to do so.

8.12 To advise the State Government on any matter related with animal welfare or the Prevention of infliction of unnecessary pain or suffering on animals.
8.13 To advise the State Government to ascertain implementation of the Prevention of Cruelty to Animals Act, 1960 and other provisions framed thereunder.
8.14 To recognize and affiliate Animal Welfare Societies/ Organizations established in the state for the purpose of prevention of infliction of trauma, pain or suffering to animals and conservation of animals and birds as well as to coordinate and co-operate such organizations.
8.15 To formulate suitable manuals for carrying out its functions and establishing administrative system and shall propose the same to the government for approval.
8.16 To make correspondence with state government, government departments, local bodies, and other statutory bodies to seek relevant information and shall visit to such places within the state to fulfil its functions.
9.1 (A) General Body Meeting:-
9.1.1 General Body meeting shall be attended by the members as shown under section 4 (A).
9 . 1.2 General Body meeting shall be held twice in a year at venue decided by the chairman.
9.1.3 The Chairman shall preside over the General Body meeting of the board. In absence of the Chairman, the Vice-Chairman shall preside over the chair.
9.1.4 Two third of total number of members of the Board shall form a Quorum.

9. 1.5 All the members shall be informed I 5 days prior notice to attend the meetrng. An extraordinary meeting can be convened by t\]e chairman with prior notice of 7 days to members.
9.1.6 The minutes of the meeting recorded by the Member Secretary shall be circulated to all members and to state government.
Special:- On written request by 213rd member, a general body meeting can be called in order to review indicated subjects . A copy of Special resolution passed shall be send to the state government within a period of 45 days.
9.2 (B) Powers and duties of the General Body :-
9.2 .1 To approve detail annual progress report of previous years of the institution.
9.2.2 To manage consolidated funds and property of the institution properly.
9 .2.3 To consider subject matters proposed by the Executive Committee.
9.2.4 To approve receipt-expenditure account statement of the institutions governed by the Board.
9 .2.5 Approval of budget.
10.1 (A) Executive Committee:- The following members ment ioned under section 4 A shall be nominated as Ex-officio member of the Executive Committee:- Cbairman

10.2 (B) Powers and duties of Executive Committee:-
10.1 To fulfil the objectives for which the Board is established and to make arrangements for its fulfilment.
10.2 To propose audited receipt & expenditure account statement of previous year along with progress report annually at general meeting.
l 0.3 To pay taxes etc levied on movable /immovable property of the board.
l 0.4 To constitute standing committee on related subject matter.
10.5 To carry out other important works assigned during the meeting from time to time.
10.6 To organize quarterly meeting of the Executive Committee. The agenda for meeting shall be decided by Chairman/Member Secretary of the Executive Committee, which shall be informed to the hon 'ble members prior to meeting.
10.7 The Member Secretary of the Executive Committee shall be responsible to organize the meeting.
11. Powers of Chairman of the Board :- 11 .1 The decision of the Chairman of the board on the matters presented to Board for consideration shall be Final.

11.2 Chairman of the Board shall have full financial and admi nistrative powers.
11.3 Chairman of the Board shall have the rights to take final dec ision on disputed matter/s.
12. Powers of the Membe r Secreta rv :-
12. l To present the audited receipt and expenditure statement in General body meeting prepared by the auditor.
12.2 To organize General Body and Executive Committee meeting and to present all referred proposals and applications received to Board/Committee before General body and Executive Committee meeting time to ti me.
12.3 Operation of funds after approval of the Chairman of the Executive Committee.
12.4 He/She will have rights to sanction office causal expenses up to Rs 50,000/- (Fifty thousand rupees only).
12.5 To maintain account and assets registers etc. of the Board.
12.6 Full administrative powers to operate office of the Animal Welfare Board.
12.7 To keep cooperation and coordination with Ministry of Env ironment and forest, government of India, Animal welfare board of India and other related department of state govt and C.G. State Go-Sewa Aayog.
12.8 To follow up the instructions given by Chairman of the Board or Executive committee time to time and to carry out daily routine works .

Power of the Boa rd to make regulations:- The Board may, subject to prior approval of the State Government can make such regulations as it may think fit for the fulfilment of its responsibility and to carry out its administrative functions.
14. Power of the Board to make amendrnent:- On the basis of the majority of the two third (213 rd ) members present and voting in the General Body meeting, the Board shall recommend amendments or changes in the rules, subject to the approval of the State Government.
15 . Miscellaneous:-
15. 1 The Board shall commence its functioning from date of publication of this notification in the Chhattisgarh state official Gazette.
15.2 The board shall be registered under Chhattisgarh Society Registration Act 1973 on the basis of above mentioned provisions.
15.3 This notification shall be effective from the date of publication in the Chhattisgarh official Gazette.
