Chhattisgarh State Skill Development Authority (State Skill Development Fund) Regulations, 2014
1. Short title, application and commencement
1. J These Regulations may be called Chhattisgarh State Skill Development Authority (State Skill Development Fund) Regulations, 2014.
1.2 These shall take effect from the date of th 0 eir publication in the Official Gazette.
1.3 The manner of maintenance and operation of the State Skill Development • Fund, hereinafter referred to as the Fund, shall be as provided in these Regulatio~s.
2. State Skill Development Fund
2.1 The moneys received for the Fund from the sources specified in section 18 of the Chhattisgarh Right of Youth to Skill Development Act, 2013 (No. 17 of 2013), hereinafter referred to as the Act, shall be credited to one or more accounts opened in any of the banks included in the Second Schedule of the Reserve Bank oflndia Act, 1934 (No. 2 of 1934):
Provided that nothing in these Regulations shall prevent the Chhattisgarh State Skill Development Authority, hereinafter referred to as the Authority, from deploying such cre~ited moneys in any financial instrument for saving or investment with the prior concurrence of the State Government in the Finance Department:
Provided further that the Chief Executive Officer may cause to be maintained an imprest account in cash of up to such maximum amount as the Executive Committee may authorise, which shall be maintained and operated in accordance with the provisions governing imprest accounts in the State Government, with such modifications as may be deemed appropriate and approved by the Executive Committee.
2.2 Any account as provided for in Regulation 2.1 above shall be operated jointly by the Chief Executive Officer and such other employee of the Authority as the Executive Committee may appoint:

Provided that the Executive Committee may, on the recommendation of the Chief Executive Officer, authorise any other employee of the Authority to operate such joint account in place of the Chief Executive Officer:
Provided further that any employee so authorised shall operate such account under the directions of the Chief Executive Officer.
2.3 The Annual Financial Statement of Accounts of the Authority, which shall include the ann~al financial estimates of the Authority for the financial K98(16) year, shall be prepared and approved before commencement of the corresponding financial year:
Provided that, notwithstanding anything in these Regulations, the Governing Council shall have the power to authorise appropriation from the Fund in advance in respect of the estimated expenditure for a part of any financial year pending the completion of the procedure prescribed under the Act for approval of the Annual Financial Statement of Accounts, where it is satisfied that the situation so demands.
2.4 Payments from the Fund shall be subject to the availability of funds and provision in the Annual Financial Statement of Accounts or authorisation. under the proviso to Regulation 2.3 above, and shall be made as per sanction accorded for expenditure by the authority competent to do so:
Provided that, notwithstanding absence of adequate provision in the Annual Financial Statement of Accounts, where in the opinion of the Chief Executive Officer the situation demands that immediate decision be taken on sanctioning any expenditure in the interest of carrying out the purposes of the Act, he may recommend sanction therefor to the Chairperson of the Executive Committee, and the Chairperson, if satisfied that the situation so demands, may authorise the Chief Executive Officer to sanction the expenditure and to lay such sanction for ratification and making suitable provision and modification in the Annual Financial Statement of Accounts before the Executive Committee and, thereafter, the Governing Council at their next meetings.
2.5 In case the total expenditure .to be incurred on any account is not in excess of Rupees twenty-five lakhs, the Chief Executive Officer shall be the authority competent to sanction the same.
2.6 In case the total expenditure to be incurred on any account exceeds Rupees twenty-five lakhs, the Executive Committee shall be the authority competent to sanction the same:
Provided that where in the opinion of the Chief Executive Officer the situation demands that immediate decision be taken on sanctioning any such ,expenditure in the interest of Cflrrying out the purposes of .the Act, he may recommend sanction therefor to the Chairp.erson of the Executive Committee, and ·the Chairperson, if satisfied that the situation so demands, may authorise the Chief Executive Officer to sanction th·e expenditure and to Jay such sanction for ratification beforethe •Ex.~cutive Committee.at its.next meeting.
