CHAPTER-I This Act may be called the Chhattisgarh State Upcharyagriha Tatha Rogopchar Samhandhi Sth,q1anaye Anu yap:.111 Adh1niyam, 2010
(2) It extends to the whole State oi Chhamsgarh (3J II sh:ill come into force from the date of its publication in the Oftit:ial Ga1.et1e In thi~ Act, unless the context otherwise rcquires.-
(a) "Act" means thc Chhauisgarh • tate Upcharyagriha Tatha Rogopchar Sambandhi Stha panaye Anugyapan Adhi niyam. 2010
(b) "Clinical establishment" means a medical lahorarory. a Physiotherapy estab lishment or clinic or a Hospit:il or o.ny other establi~hment analogous tu any of them, by whate,er name called.
(c) "Clinic'· means any premise hnvrng focilities for treatment of sick nnd usi:!d for their reception and not stay.
(d) "Ho pual" means any premise havi ng facilities for trcmment of :;ick and used for their reception or stay.
(e) "Maternity Homes" means any premi.se used or intended 10 he used for tht!
reception of pregnant women m· women for clt!livery or 1mrncd1ately after childbirth.
(f) "Medipl Laboratory" means an establishment manned by qualified patholo gist and rad iologis t where Bio-Medical tests sud, a., hematology, biochemis try, serological tests, bacteriological, cytology, histology genet i i'.' invel>tiga Lion:.. or any other diagnostic te~ll> are carried.out.

··Qualilied Dentist" means a person possessing qualification recogni1.cd hy rhe Dental Council Ac1.
"'Radiologist" means a medical practitioner that deals with the study and application of imaging ll::chnology like X-ray and radiation tn diagnose and treat disease related therewith .
"Qu~litied Midwife" mt:ans a midwift: or an auxiliary nurfil:.::..ill..lwife who possesse~ any of the qualifcations included in sec Lion~ or C, as the case may he, of pan I of the Schee.Jule ro 1he [ndian Nursing Council Act, 1947 (48 of I 947), and who is enrolled as a mid-wife or as un auxiliary nur,e-midwife in a State.
'"QtJalilie~ Nurse" means a person who pos~esses the quuliticauon. included in section A of Parll of th~ Schedule to the Indian Nursing Council Act 1947 (48 of 1947) and who is enrolled as a nurse.
(n) ··Register" means a register maintained under this Act and the CJ\pression " registered" and "registration': hall be construed .'.lccordingly.
(o) '·supervisory Authority" means the porson or au1hori1y appointed hy the State Governme nt hy not itication to perform all or any of the functions of the super vi_sing author~ty as specified under this Acc.
(p) "Notitiahle di~ease" means a disease which a Registered l'vkdical Pracutioner is required to notify to che Chief Medical and Health Officer or his area under the law for the 1ime being in force.
(q) "Trnined Nurse" means nurst:s who haw taken tr.iining or six months duration Ill govern ment recognize insti tutions. She will only work under the upervision of qualilied nurse as above de!ined .
CHAPTER-If Any person, company, corporate body or association/partneri;hip firm wh1) intend to setup a nursing home or a clinical establishment as dt:lined in this Act ~hall apply to the supervi,ory uuthority along wi'th tht: details as may _be prescribed. The supervisory authority shall grant license to the nursing home or a clinical estahlishemenl as the case may be if' it is satisfied that the eligibility norms for ohtarning the license ore; fullilled by _the applicn~t.
Provided further Lhat all nursing homes or clinical e.~rnhli~hment which are already in existence on the date of commencement of this Act, shal l apply 10 supt:rvi sory authority within 90 days of commencement of this Act. The supervisory authority shall grnnt them lict:nse if il is arisfied chat the applicant f!,)ltill; the norms prescribed in this regard.
Whoever runs a nursing home or a clinical establishment as defined in this Act wirhout obtaining a license shall be punishable with a line of Rs. 20.000.
Every application for license made to lht: supervisory authority, shall contu111 such par ticulars, information-and shall be accompanied by such fee as may be prescribed io chis regard.

~~'~23~2010 510 ( 15) Notwithstanding anything contained in the Code of Criminal Procedure, 1973 (No. 2 of 1974), no court inferior to that of a Magistrate of toe first class shall try a11 offence punishable under this Act.
All offences under I.his Act shall be cogoizable and bailable, ( l)
(2)
(1) CHAPTbR- No suit or ocher legal proceeding shall lie against the Government in respect of any 1Jss or damage caused or lilcely to be caused by anything which is done in good faith or intended to be done in pursuance of the provisions of this Act or any rule made there under.
No 'suit, prosecution or other legal proceeding shall lie against any authoricy or any officer authorized in this behalf by the State GovernmeJ1t ln respect of anything which is done in good faith or intended to be done in pursuance of the provisions of this Act or any rule made there under.
The State Government may, by notification and subject to condition of pre vi, ous publicalion make rules for carrying oul the purposes of this Act.
(2) In pa.-ticular and without prejudice to the generality of the foregoing power such rules may provide for all or any of the following matters, namely :-
(a) The form of the application to be made under section 3 the d te on v,hich such application is to be made and lhe fees to be paid for such lkense or renewal of license.
(b) ,The particulars which an application under section S shall contain ard the fee wilh which such app!icarion shall be accompanied.
(c) . Tot! conditolns, which an applicant and a nursing home or. a clinical establishment shall fulfill under ection 3 and the form of certificate of li:ense.
(d) The recs to the paid for an appeal under section 10 of the Act and procedure for apP".,al.

(e) The fo--!f] of the register or registers to be maintained under this Act.
(f) The record~·to be lcept of the patients received in a nursing home and in the case of the maternity home miscarriage, abortions or still-births occurring in ·the nursing home and of the children born therein and of the children so born who are discharged from the nursing home otherwise than to the custody or care of any parent, guardian or relative.
(g) The condilions regarding accommodation, sanitary and other facili ties and minimum equipment's.
(h) • Any other matter which has to be, or may be prescribed.
(3) Every rule made under this Act shal I be laid as soon as may be after it is made.
