1. Short title and commencement.-( ll These rules may be called the Chhatusgarh Vyavsayik P,u•iksha Manda! Sc1vice Recruitment Hules. 2013. (21 These Iiulcs shall come into force from lhe dale of their publication in Lite Official Gazelle.

4. Constitution of the service.- The service shall consist of lhe following persons. namely: - ( I) Persons who a l U1e commcnccmenl of Lhcsc rules arc holding subslanlivcly the posts specified in Schedule-I; (21 Persons recruited lo U1e service before the commenccmenl of these rnles: and

(3) Persons recruited lo U1c service in accordance wiU1 lhe provisions of these rules.

5 . Classification, scale of pay etc.- 111c classification of service, llic number of posls included in service and Lile scale of pay allached U1crelo shall be in accordance with lhc Schedule-I:

Provided that U1e Mandal may, from lime lo lime. ddd lo or reduce lhc number of posls included in lhc service ciU1cr on pcnrnmenl or temporary basis.

6. Method of recruitment.- (ll Hecruilment lo Lite service. after lhc comrncnccmcnl or lhese rules. shall be made by the following methods, namely :- (al by direct recn.1itmenl. through compcliti\'C examination or by selection 011 ti 1c basis of merit and interview: (bl by promoUon of members of the service of the Manda!: (cl by lransfer/depulaLion of lhc persons. who hold in subslanlivc capacity such post in such services, as may be specified in U1is behalf

(2) The number of persons recruited under clause (a). (bl and (cl of sub-rule (1). sha.11 not al any lime exceed U1e pcrcc11Lagc shown i11 Scl11.:dulc-II of Lhc number of duly posls as specified 111 Schedule-l.

(3) Nolwilhslanding .i.nylhing contained in sub-rule (1). if in lhe opinion of the Controller Lile exigencies of U1e service so require. he may. with lhe prior pcnnission of Lhe Chairman, adopl such rncLhod of rl'cruitrnent lo Lile service. 0U1er Llu.m U1ose specified in s.tid sub-rule. as it may prescribe by order issued in this behalf. (4l Officers/employees on depulalion may be absorbed as per the prescribed ,-ulcs of lhc Government.

7. Appointment in service.- J\ll appointments lo the service after the commencemenL of these rules shall be made by lhe Appointing J\uthorily and no such appointment shall be made except after selection by one of the mcU1oc.ls of recruilment as specified in rule 6. ..

8. Condition of eligibility for direct recruitment.- lt1 order lo be eligibk for dirccl rceruilment/selecUon. a candidate musl salisfy the following condiUons, namcly:- (ll Age- (al Ile must have attained U1c age as specified hi column (4l of Schedule-III and rnui:.t not have attained the age .is spt•cilied in column (5) of said Schedule 011 U1c ltrst day of JtUlthU}' of Lhc year ill which the adverllscnwnt for the post is published;

(c) For women candidates lhc upper age limit shall be relaxablc uplo 1 O years as per the provision of lhc Chhatlisgarh Civil Scn1iccs (Special Provision for i\ppoihlmcnl of Women) Rules. 1997;

(d) The upper age limit shall also be rclaxablc in respect of camlidalcs who arc or who have been employees of the Chhaltisgarh Govcrn111c11t or Manda! to Lile extent and subject to the conditions specified below :-

(i) A candidate who is a permanent or temporary Government scrvant should not be more lhan 38 years of age.

(ii) i\ candidate, holding a post temporarily and applying for ,my other post should not be more than 38 years of agc.-This conccssio11 shall also be admissible lo the contingency paid employees. work charged c111ployccs and employees working in the Project lmplcmcnli11g Corn111iltcc;

(iii) i\ camlidalc, who is a "retrenched Government scrvtuit" shall be allowed lo deduct from his age the period of all Lelllporary sci-vice previously rendered by him upto a maximum limit of 7 years even il represents more lhan one spell provided lhal the resultant age does not exceed lhc uppe,· age limit by more lhan 3 years.

Explanation- The term "retrenched Government servant" denotes a person who was in temporary Government service of Lhis Stale or of any of Lile constituent units. for a continuous period of not less Utan G months and who was clisdiargcd because of reduction In establishmcnl not morc Lhtm 3 years prior lo lhc dale of his registration al .. my cJ11ployment exchange or of application made otherwise for c111ployme11l in the Govcrnmc11l sci-vice; (cl i\ candidate who is an ex-servicemen shall be allowcd lo cleduel from his age Lile period or aJl Defence Service previously rendered by hi111. providcd lhal the rcsullanl age docs not exceed the upper age limil by more Lhan 3 years.

Explanation- The Lenn "Ex-Servicemen" denotes a person who belongs LO any of lhc follo~ing categories and who was employed ulldcr the Government of India for a continuous period of not less than 6 monlhs and who was retrenched or declared surplus as a result of the rccomme11clalion of U1e economy unil or due lo normal reduction in establishment for nol more than ~3 years before lhe dale of his registration at any employment exchange 01· of application made otherwise for employment in U1e Government service :-

(g) The general upper age limit shall be relaxable uplo five years in respect of awarded higher caste parlner of a couple under the lnter­ caslc marriage incentive scheme as per Chhattisgarh Inter-caste Marriage, promolionaJ scheme under Untouchabilily 1-:radication Rules, 1984;

(h) The upper age limit shall aJso be rclaxable upto 5 yea.rs in respect of Shaheed Rajiv Pandey Award, Gundadhur Award. Maharaja Pravecrchand [3hanjdeo Award holder candidates and Nalional Youth Award holder young candidates;

(i) The upper age limit shall be rclax:able upto five years in respect of sportsperson who have been awarded the Vikram Award; UJ The upper age limit shall be relaxablc up lo fifteen years in respect of widow, estranged or divorced woman candidate 011 her first appointment lo lhe service; (kl The upper age limit shall be rclaxable up to a maximum of 10 years in respect of persons wilh disability. This relaxation shall be given only on the basis of lhe certificate provided to the persons with disability by U1e District Medical Board or by the nehabilitaUon Centre or Disabled Entrepreneur established by lhe Ministry of LaboUJ a 11d Employment, Government of India. (I) After providing relaxation on lhe basis ol any ene or more of lhe above category for entering in Government service U1c maximum age limit must not exceed 45 years;

(m) Apart from above in respect of age limit, the directions issued by U1e General Administration Deparlment of the Govcrnmenl. from Lime lo lime shall also be applicable.

(2) Educational Qualifications-The candida te must possess lhe educational qualification s prescribed for the service as s hown in column (6) of Schedule­ lll :

There shall be posts reserved for the persons belonging to the Scheduled Castes, Scheduled Tribes and Other Backward Classes al the stage of the direct recruitment in accordance with the provision!! contained in the Chhatlisgarh Lok Seva (Anusuchil Jatlyon, J\nusuchit Jan Jatiyon Aur Anya Pichhtle Vargon ke Hye Arakshan) Adhinlyam, 1994 (No. 21 of 1994). Al the stage of direct recruitment 30 percent posts shall be reserved for women candidates, in accordance with the provisions oi the Chhalllsgarh Civil Services (Special Provision for Appointment of women) Rules. 1997. This reservation shall be horizontal and compartment-wise. 14. 1994 (No. 21 of 1994) and Lhc Chhaltisgarh Public Service (Pro1110Uo11) Hules, 2003 and Lhc inslructions issued in lhe light of lhc provision s of lhc said Act and U1c rules by' the State Government and that he has laken fu ll cognizance of the provisions of sub-section (1) of Section 6 of the said Act. Conditions of Eligibility for Promotion.- (1) Subject to lhc provisions of sub-rule

(2). lhc Committee shall consider lhe cases. of all persons who 011 first day of Ja11uary of thal year had completed such number of years of service (whether officiating or substantive) in lhe posts, from which promotion is to be mudc or 011 any other post or posts declared equivalent thereto by lhe Government as specified i11 column (4) of Schedule-IV and are within lhe zone of consideration in ,1ccordancc with the provisions of sub-rule (2).

Explanation- Method of computation for eligibility for promotion- The calculalion uf the period of qualilying service on lhe 181 January of lhc relevant year in which Dcparlrncnlal Promotion Commillee/Scruliny Commillcc is convened. shall be counted from lhe calendar year in which public servant has joined the feeder cadre/part of service/pay scale of the post and not from the date of J0ining of the cadre/part of service/pay scale of the post.

(2) (i) In such cases where promotion is lo be given on seniority cum ntncss basis or 011 seniority basis leaving unsuitable candidate, there will be no grounds for c011sidcration for all categories. Proposals of such number of public servants shall only be considered as per seniority that shall be sufficient for lllling Lile existing posts in each category and number of expected vacant post due Lo retirement/promotion during 1 year.

(ii) In such cases where promotion is Lo be made on merit cum seniority basis, the area li.>r consideration shall be four more lhan Lwo Limes of the total vacant posts. If lhe sufficient number of Scheduled Castes and Scheduled Tribes Government Servants arc not available for promotion U1en the area of consideration may extend uplo 7 limes of the total vacant posts and filling up of reserved post may be made from lhc persons belonging to reserved category above mentioned area of consideration . Committee shall consider to fill lhc vacancies existing under each category in said area of consideration and lhe anticipated vacancies on account of retirement and promotion lhe course of 1 year.

(3) The name of public servant in requisite number for each cadre shall be considcn;d for the purpose of inclusion of his name upto 25 percent of numl>er of public scrv,ml included in lhe selection lis l or to lhal of Lwo public servant, whichever is more to fill the unexpected vacancies during above said duration aparl from expected vacancies under sub-rule (2) .

(4) Promotion shall be made as per Reservation Roster prescribed by U1e Government.

(5) Olhcr provisions of the Ch hattisgarh Public Service (Promotion) Rules. 2003 and U1e order issued by U1c General Administration Departmen t from lime lo lime shall be applicable for promotion.

15.
