Section 38: Agreement to abide by Commlssioaer'a deciaion

(1) If a party states In writing his willingness _to abide by the decision of the Commissioner, the Commissioner shall tnquire whether the other party is willtng to abide by his decision. '

(2) If the other party agrees to abide by the Commissioner's decision, the fact of hts agreement shall be recorded tn writing and signed him.

(3) If the other party does not agree to abide by the Commissioner's decision, the first party shall not remain under an obligation so to abide.
