(2) They shall come into force on the date of thcir publication in the Official Gazette.
2. Delinitions.- (I) In these rules unless the conlcxt othc ise requircs,-
(a) "Act" means thc Commercial Courts Act,2015 (4 of 20t6);
(b) "applicant" means a p€rson who approachcs the Authority under rulc 3 for thc initiation of mediation Process:
(c) "Authority" means the Authority notified by the Central Governmcnt under sut!.section (2) of scction I 2A of the Act;
(d) "commercial dispute" means the commercial dispute as defined in clause (c) of sub-section (l) of secrion 2 of the Act;
(d) "Form" meaos the Form sp€cified in the Schedule to these rules:
(e) "mediatioD" means a process undertaken by a Mediator to resolve, reconcile aod settle a commelcial dispute between the pafiies thercto, (0 "Mediator" means a person empanelled by the Authority fbr conducting the mediationi G) "oppositc part/' means a pany against whom relief is sought in a commcrcial dispute;
(h) "Schedule" means the Schedule appended to these rules: and
(i) "settlemcnt" mcans thc settlcment of commercial dispute arrived at by the partics to thc modiation;
(2) The words and expressions used and not defined in these rules, shall have the same meanings rcspectively as assigned to them in the Act or the lJgal Services Authorities Act, 1987 (39 of 1987) or in any other law for the time being in force,
3. (2) The Authority shall. having regard to the territorial and pecuniary jurisdiction and thc nalure of conmercial dispute, issue a notice, as per Form-2 specitied in Schedule-l through a registered or speed posr and elecrronic mcans including e-mail and the likc to the opposite parly to appear and give consenl to participalc in the mcdiation process on such date not beyond a period of tcn days from thc datc of issuc ofthc said noticc.
(3) Whcrc no responsc is rcceivcd from lhe oppositc party cilher by posl or b!, e-nrail, lhc Authority shall issuc a final notice to it in thc manner as specified iri sub-rule (2).
(4) Wlcre the notice issued under sub-rule (3) remains unacknowledgcd or rvhcre the opposite pafly reluses to palticipate in the mediation prccess, the Authority shall treat the mediation preess to be a lon-staner and orake a rcporl as pcr Form 3 spccilicd in the Schedule-I and cndorse thc same to lhc applicant and thc oppositc pruly.
(5) where the opposite party. after recciving the notice under suh-rule (2) or (3) seeks funher time for his appeannce. the Authority may. if it thinks fit, lix an olternate d e not later than teD davs lrom the dnte of receipt of such rcquest from thc opposite party.
(6) Wherc the opposite party fails to appear on the date fixed under sub-rulc (5). the Aurhoriry shall treat the flediation process to be a non-starter and make a report tr this b€half os per Form 3 specilied in Schedulel irnd endorsc thc same to the applicant and the opposite pany.
(7) Where both the parties to the commercial dispute appear belbre the Authority and givc consent to purticipute in lhe mediation process. the Authority shall assiSn the connnercial clisputc to a Mediator and lix a date lbr their appearance before the said Mediator. (E) Thc Anthority shall ensure that the mediation process is completed within a period of threc months tionr thc date of reccipt of application tbr prc-institution mcdiation unles$ thc period is extended for further two months with thc consent ol thc apltlrcant and thc uppo(itc pany.
4. Venue for conducting mediation.- The venue for conducting of the mediation shall be the premises of the Authority.
5. Role of Mediator.- The Mediator shall, on receipt of the assignment under sub-rule (7) ot rule 3. Iacilitate the voluntary resolution of the commercial dispute between the parties and assist them in caching a setllemeol.
6. Repr€s€ntation of paities.- A party lo a commercial dispute shall appear before the Authority or Mediator, as the cas€ may be, either personally or through his duly authorised representative or Counsel.
7. Procedure of mediation.- ( t) The mediation shall be conducted as pcr the following procedure-
(i) At lhe commcncenrent of mcdiation. the Mcdiator slrall explain to llre panies the nl.dialion proccss;

(vi) During the prucess ol mediation, the Mediator shall nuintain confidentiaiity ol discussions madc in the separate sittings with each party and only thdse fhcts which a party pernits can be sharcd with the other party;
(vii) Once both thc partics rcach to a mutually agrccd sclllcmcnt, thc samc shall bs rcduccd in wiling by thc Mediator and shall bc signed by ihe parties to the conlmercial dispute and the Mediator as p€r Fornr-4 specified ir the Schedule-l:
(viii) Thc Mcdiator shall provide the lcttlenlcnt agrccnrcnt, ir original. to all the panics to a conrmcrcial disputc and shall also forward a signed copy of lhe same to lhe Aulhority; and (ixi Where no seltleme[t is xrrived ut between the parties within thc time specified in the sub-s€ction (3) of section l2A of the Act or where the Medixtor is of the opinion that the settlemcnt is not possible. the Mediator shall submit a report to the Authority, with reasons in w ling. as pcr Form-5 spccified in Schedule-I.
(2) The Authority or the Mediator, as the case may be, shall not rctain the hard or soft copies of the documents exchanged between the panies or submitted to the Mediator or notes prepared by the Mediator beyond a p€riod of six months other than the application for mediation under sub-rule (l) of rule 3, notice issued under sub-rul€
(2) or (3) of rule 3, setllement agrcement under clause (vii) of sub-rulc (l) of rule 7 and the Failure report under clause (ix) of sub-rule (l) of rule 7. E. Parties to act in good frith.- All the piuties to a commercial dispute shall panicipate in the mediation process in good faith wilh an intention to s€ttle the dispute.
9. CotrIidetrttality of mediation,- The Mediator, parties or thcir authorized representatives or Counsel shall maintain confidenliality about the mediation and the Mediator shall not allow stenographic or audio or video recording of thc mcdiation sittings.
10. Mairtenance and publication of mediation data.- (l) The District [-€gal Services Authority shall forward the detailed data of the mediation deatt by it under the Act to lhe State lrgal Services Authority.
(2) The State l.egal Service$ Authority shall, maintain the data of all mediations carried out by it or under its jurisdiction and publish lhe same, on quaflerly basis. on its website as per Form-6 specified in the Schedulej. ll. Mediation Fee ,- Before lhe commencenrent of the mediation, the partics to the commercial dispute shall pay to the Authority a one-time ruediation fee, to be shared equally, as per the quantum of claim as specified in Sch€dule-Il.
12. Ethics to b€ folloeed by Mediaaor.-Thc Mcdiator shall- (D uphold the integrity and faimess of the mediation process: (iD ensure that the parties involved in the mediation are fairly informed and have an adequate underslanding o[ the procedural aspects ofthe mediation process:
(iii) disclosc any financial interest or other interest in the subject-maner ofthe commercial dispute;
(iv) avoid any impropriety, while communicating with the parties to the commercial disputel

(vii) conduct mediation related to the resolutiod of a commercial dispute, in accordance with the applicable laws for the time being in force: recognise that the m€diation is based on the pdnciples of self-determination by the parties and that mediation Focess relies upon the ability of parties to reach a voluntary agreement: refrain from promises or gu:uantees of results; not meet the parties, their representatives. or their counsels or communicate with them, privately except during the medialion sittings in the premises of the Aulhorilyi not interact with the media or make public the details of commercial dispute case, being mcdiatcd by him or any other allied activity carried out by him as a Mediator, which may prejudice the interests of the parties to the commercial dispute.
