PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY पर्ाावरण, वन और िलवार् ुपररवतान मतं्रालर् अधिसचूना नई दिल् ली, 6 नवम् बर, 4202 सा.का.जन. 690(अ).—कें द्रीर् सरकार, राष्ट्रीर् रािधानी और जनकटवती क्षेत्रों में वार् ुगणुवत्ता प्रबंधन आर्ोग अजधजनर्म, 2021 (2021 का 29) की धारा 25 की उप-धारा (2) के खंड (ि) द्वारा प्रित्त िजिर्ों का प्रर्ोग करत ेहुए, राष्ट्रीर् रािधानी और जनकटवती क्षेत्रों में वार् ु गुणवत्ता प्रबंधन आर्ोग (पराली िलाने पर पर्ाावरणीर् प्रजतकर का अजधरोपण, संग्रह और उपर्ोग) जनर्म, 2023 में संिोधन करने के जलए जनम्नजलजखत जनर्म बनाती ह,ै अर्ाात:्-
1. सजंक्षप्त नाम, लाग ूऔर प्रारंभ होना - (1) इन जनर्मों का संजक्षप्त नाम राष्ट्रीर् रािधानी और जनकटवती क्षेत्रों में वार् ु गुणवत्ता प्रबंधन आर्ोग (पराली िलान े पर पर्ाावरणीर् प्रजतकर का अजधरोपण, संग्रह और उपर्ोग) संिोधन जनर्म, 2024 ह।ै
(2) र् ेरािपत्र में उनके प्रकािन की तारीख को प्रवृत्त होंगे।
2. राष्ट्रीर् रािधानी और जनकटवती क्षेत्रों में वार् ुगुणवत्ता प्रबंधन आर्ोग (पराली िलाने पर पर्ाावरणीर् प्रजतकर का अजधरोपण, संग्रह और उपर्ोग) जनर्म, 2023 (जिसे इसमें इसके पश्चात उि जनर्मों कहा गर्ा ह)ै में, जनर्म 3 के स्ट्र्ान पर, जनम्नजलजखत जनर्म को रखा िाएगा, अर्ाात्:- स.ं 632] नई दिल्ली, बुधवार, नवम् बर 6, 2024/कार्ताक 15, 1946 No. 632] NEW DELHI, WEDNESDAY, NOVEMBER 6, 2024/KARTIKA 15, 1946 सी.जी.-डी.एल.-अ.-06112024-258498 CG-DL-E-06112024-258498 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] “3. आर्ोग अजधजनर्म के उपबंधों के अनुसार जनम्नजलजखत िरों पर पराली िलान ेवाल ेकृषकों पर पर्ाावरणीर् प्रजतकर अजधरोजपत और संगृहीत कर सकता ह,ै अर्ाात्:- (क) िो एकड़ से कम भूजम वाल ेकृषक, प्रजत घटना के जलए पांच हिार रुपर् ेके पर्ाावरणीर् प्रजतकर का संिार् करेंग;े (ख) िो एकड़ र्ा उससे अजधक दकन्तु पांच एकड़ से कम भूजम वाल ेकृषक, प्रजत घटना के जलए िस हिार रुपर्े के पर्ाावरणीर् प्रजतकर का संिार् करेंग;े (ग) पांच एकड़ से अजधक भूजम वाल ेकृषक, प्रजत घटना के जलए तीस हिार रुपर्े के पर्ाावरणीर् प्रजतकर का संिार् करेंगे”।
3. उि जनर्मों में, जनर्म 4 के उप-जनर्म (4) में, "उप-जनर्म (4) में जनर्िाष्ट अजधकारी" कोष्ठक, िब्िों और आंकड़ों के जलए, कोष्ठक, िब्ि और आंकड़ े"उप-जनर्म (3) में जनर्िाष्ट अजधकारी" प्रजतस्ट्र्ाजपत दकए िाएगंे।"
4. उि जनर्मों के प्ररूप के जलए, जनम्नजलजखत प्ररूप रखा िाएगा, अर्ाात:्- “प्ररूप (जनर्म 3 और 4 िेखें) चालान संख्र्ा……………… तारीख: ../../…. चालान राष्ट्रीर् रािधानी और जनकटवती क्षेत्रों में वार् ुगणुवत्ता प्रबंधन आर्ोग अजधजनर्म, 2021 (2021 का 29) की धारा 15 और राष्ट्रीर् रािधानी और जनकटवती क्षेत्रों में वार् ुगुणवत्ता प्रबंधन आर्ोग (पराली िलाने पर पर्ाावरणीर् प्रजतकर का अजधरोपण, संग्रह और उपर्ोग) जनर्म, 2023 के अनपुालन में, नीचे दिए गए वणान के अनुसार कृषक के पराली िलान ेकी सूचना जमली र्ी/की गई ह ैर्ा इस आिर् का कोई साक्ष्र् ह ैदक उसकी भूजम में पराली िलाई गई है और पररणामस्ट्वरूप अजधजनर्म और उजल्लजखत जनर्मों के अनुसार पर्ाावरणीर् प्रजतकर का अजधरोपण दकर्ा गर्ा ह,ै और उसे जनम्नजलजखत जववरण के अनुसार ऐसे पर्ाावरणीर् प्रजतकर को िमा करने का जनिेि दिर्ा िाता ह,ै अर्ाात:्-

11. कृषक की भूजम का क्षेत्रफल, जिस पर पराली िलाई गई ह:ै (उपर्ुि बॉक्स पर जनिान लगाएं)

(ii) 2 से 5 एकड़ के बीच
(iii) 5 एकड़ से अजधक
12. ऊपर नाजमत कृषक चालान की तारीख से तीस दिनों के भीतर पर्ाावरणीर् प्रजतकर संबजन्धत राज्र् प्रिषूण जनर्ंत्रण बोडा र्ा प्रिषूण जनर्ंत्रण सजमजत , िैसा भी हो , के पक्ष में, नकि र्ा जडमांड ड्राफ्ट र्ा इलेक्राजनक मोड के द्वारा _________________ रुपर्े (िब्िों में ____________________________ केवल) िमा कर सकता ह।ै हस्ट्ताक्षर : नाम : पिनाम : पता : अजधकारी की मुहर : संपका नंबर : [फा. सं. क्रू् -15014/10/2021-सीपीए/इ-160523] वेि प्रकाि जमश्रा, संर्ुक् त सजचव नोट- मूल जनर्म भारत के रािपत्र, असाधारण, भाग II, खंड 3, उपखंड (i) में सा.का.जन. 322 (अ), तारीख 28 अप्रलै, 2023 द्वारा प्रकाजित दकए गए र्े। MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 6th November, 2024 G.S.R. 690(E).— In exercise of the powers conferred by clause (h) of sub-section (2) of section 25 of the Commission for Air Quality Management in National Capital Region and Adjoining Areas Act, 2021 (29 of 2021), the Central Government hereby makes the following rules to amend the Commission for Air Quality Management in National Capital Region and Adjoining Areas (Imposition, Collection and Utilization of Environmental Compensation for Stubble Burning) Rules, 2023, namely:-
1. Short title and commencement.- (1) These rules may be called the Commission for Air Quality Management in National Capital Region and Adjoining Areas (Imposition, Collection and Utilization of Environmental Compensation for Stubble Burning) Amendment Rules, 2024.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Commission for Air Quality Management in National Capital Region and Adjoining Areas (Imposition, Collection and Utilization of Environmental Compensation for Stubble Burning) Rules, 2023 (hereinafter referred to as the said rules), for rule 3, the following rule shall be substituted, namely:- “3. The Commission may impose environmental compensation as per the provisions of the Act for stubble burning, at the following rates:-
(a) the Farmer having an area of land of less than two acres shall pay an environmental compensation of five thousand rupees, per incidence; 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
(b) the Farmer having an area of land of two acres or more but less than five acres shall pay an environmental compensation of ten thousand rupees, per incidence;
(c) the Farmer having an area of land of more than five acres shall pay an environmental compensation of thirty thousand rupees, per incidence.”.
3. In the said rules, in sub-rule (4) of rule 4, for the bracket, words and figures “The officer referred to in sub-rule
(4)”, the bracket, words and figures “The officer referred to in sub-rule (3)” shall be substituted.
4. For the Form to the said rules, the following Form shall be substituted, namely:- “FORM (See rule 3 and rule 4) Challan No……………… Dated: ../../…. CHALLAN In pursuance of the section 15 of the Commission for Air Quality Management in National Capital Region and Adjoining Areas Act, 2021 (29 of 2021) and the Commission for Air Quality Management in National Capital Region and Adjoining Areas (Imposition, Collection and Utilization of Environmental Compensation for Stubble Burning) Rules, 2023, the Farmer described below was found/ has been reported to burn stubble or there is an evidence to the effect that Stubble Burning has happened in his land, and consequently Environmental Compensation has been imposed as per the Act and the rules mentioned above, and is directed to deposit such Environmental Compensation as per the following details, namely:-
