(1) इन िनयम5 का संिBC नाम कंपनी (िनदशेक5 क" िनयुि4 और अह;ता) तीसरा सशंोधन िनयम, 2019 ह।ै (2) ये राजपE म� उनके 1काशन क" तारीख को 1वृ2 ह5गे। 2. कंपनी (िनदेशक5 क" िनयुि4 और अह;ता) िनयम, 2014 (इसके पHात् िनयम कह ेजाएंगे), के िनयम 11 के उप-िनयम (2) और उप-िनयम (3) म� “ई-1पE डीआईआर-3-केवाईसी” अBर5, शJद5 और अकं5 के बाद शJद, अBर और अंक “या वेब सेवा डीआईआर-3-केवाईसी-वेब” जैसा भी मामला हो, अंतःLथािपत �कए जाएंगे। 3. उ4 िनयम5 के िनयम 12क म�,- (i) “िजस ेआबं'टत �कया गया ह”ै शJद5 के Lथान पर “िजसके िनयंEण म� ह”ै शJद रखे जाएंगे। (ii) “तOकाल आगामी िव2ीय वष; क" तारीख 30 जून को या इससे पूव; क� �ीय सरकार को ई-1पE डीआईआर-3-केवाईसी 1Lतुत कर�” शJद5, अBर5 और अंक5 के Lथान पर “तOकाल आगामी िव2ीय वष; क" तारीख 30 िसतंबर को या इससे पूव; क� �ीय सरकार को उ4 िव2ीय वष; के िलए ई-1पE डीआईआर-3-केवाईसी 1Lतुत कर�” शJद, अBर और अंक रखे जाएंगे। (iii) परंतुक के पHात्, िन<िलिखत परंतुक अंतःLथािपत �कए जाएंगे, अथा;त:्- 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] “परंतु यह भी �क य�द �कसी वैयि4क िजसने �कसी पूव; िव2ीय वष; स ेसंबंिधत ई-1पE डीआईआर-3 केवाईसी पहल ेसे ही 1Lतुत कर �दया ह,ै वह अनुवतS िव2ीय वष; स ेसंबंिधत वेब सेवा के माTयम से वेब-1पE डीआईआर-3-केवाईसी-वेब 1Lतुत करता ह,ै तो उ4 िव2ीय वष; के िलए इस िनयम के उपबंध5 का उिचत अनुपालन �कया गया समझा जाएगा:- परंतु यह भी �क य�द कोई वैयि4क अपना िनजी मोबाइल नंबर या ई-मले पता, जैसा भी मामला हो, अVतन करने क" इWछा रखता ह,ै तो वह केवल ई-1पE डीआईआर-3 केवाईसी 1Lतुत करके उसको अVतन करेगा : परंतु यह भी �क ई-1पE डीआईआर-3 केवाईसी-1पE का वेब 1पE डीआईआर-3 केवाईसी-वेब जैसा भी मामला हो, फाइल करने के िलए कंपनी (रिजLZीकृत काया;लय और शु�क) िनयम, 2014 म� �दए 1ावधान5 के अनुसार, शु�क वेब सेवा के माTयम से देय होगा।”। 4. उ4 िनयम5 के अनुल[क म�, ई-1पE डीआईआर-3 केवाईसी के पHात् िन<िलिखत वेब-1पE अंतःLथािपत �कया जाएगा, अथा;त्:- ““““डीआईआरडीआईआरडीआईआरडीआईआर----3333----केवाईसीकेवाईसीकेवाईसीकेवाईसी----वेबवेबवेबवेब [कंपनी (िनदशेक5 क" िनयुि4 और अह;ता) िनयम, 2014 के िनयम 12क के अनुसरण म�] िनदशेक5 का केवाईसी

1. (1) These rules may be called the Companies (Appointment and Qualification of Directors) Third Amendment Rules, 2019. 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Companies (Appointment and Qualification of Directors) Rules, 2014 (hereinafter referred to as the said rules), in rule 11, in sub-rule (2) and sub-rule (3), after the letters, words and figure “e-form DIR-3-KYC” the words, letters and figures “or the web service DIR-3-KYC-WEB” as the case may be” shall be inserted.
3. In the said rules, in rule 12A,-
(i) for the words “who has been allotted”, the words “who holds” shall be substituted;
(ii) for the words, letters and figures “submit e-form DIR-3-KYC to the Central Government on or before 30th June of immediate next financial year”, the words, letters and figures “submit e-form DIR-3-KYC for the said financial year to the Central Government on or before 30 th September of immediate next financial year” shall be substituted;
(iii) after the proviso, the following provisos shall be inserted, namely:- “Provided further that where an individual who has already submitted e-form DIR-3 KYC in relation to any previous financial year, submits web-form DIR-3 KYC-WEB through the web service in relation to any subsequent financial year it shall be deemed to be compliance of the provisions of this rule for the said financial year:
Provided also that in case an individual desires to update his personal mobile number or the e-mail address, as the case may be, he shall update the same by submitting e-form DIR-3 KYC only:
Provided also that fee for filing e-form DIR-3 KYC or web-form DIR-3 KYC-WEB through the web service, as the case may be, shall be payable as provided in Companies (Registration Offices and Fees) Rules, 2014.”.
4. In the said rules, in the Annexure, after e-form DIR-3 KYC, the following web-form shall be inserted, namely:- “DIR-3-KYC -WEB [Pursuant to rule 12A of The Companies (Appointment and Qualification of Directors) Rules, 2014] KYC of Directors
