Under the, fust proviso to ssction 10(1) oI the Comptroller and Auditor General's (Duties, Powers and Conditions of Servlce) Act, 19?1, the President in resp€ct oI the accounts of the Union moy, after con8ultetion with the Comptroller and Auditor-Gqneral, by order relieve him from the responsibility for compiling the accounts of any particulat service or deparlment oI the Union- As the Comptloller and Auditor- General is to be relieved oI the responsibility lor compiling the accounts oI aU the Ministries of the Union, it was considered necessary to amend suitably the proviso to section l0(l) referrefl to sbove.
3. So lar as the accounts of a State are concerned, lt is, however, necessary to provide lor prior epproval of the President before the Governor of the State issues an order relieving the Comptroller and Auditor-Gdneral of the responsibility of compillng the accounts of the State ln order to make sure that due provision is made by the State Government lor absorption of the employees of the Indian Audit and Accounts Department under the State Government end for safegllarding their scales of pay and other conditions of service on absorption.
4- In order to facilitate the separation of accounts from audit in some Mjnistries with effect {r'om 1st April, 1976 the Comptroller and Auditor- General's (Duties, Powers and Conditions of Service) Amendment Ordinance, 1976 (1 of 1976) \vas promulgated by the President on lst March, l9?6.
5. When the Comptroller and Auditor-General is relieved of the responsibilitv for compiling the accounts completely of the Union or of a State, it is but logical to relieve him of the responsibility for the preparation and submission of annual finance accounts of the Union or of the State concerned showing the annual receipts and dlsburs*nents under the respective heads oI acc$unt For thls purpose, sectlon 1l of the principal Act will requlre sultable amendment.

SUBRAMANIAM, 770 THE OAZETTE OF INDIA EXTRAORDINARY lPrnr II- T.INANCIAI MEMORANDUM Clause 2 of the BilI proposes to substitute two new provisos for the existing first proviso to sub-section (1) of section 10 of the Comptroller and Auditor-General's (Duties, Powers and Condition5 of Service) Act,
1971. The ne\l' first ploviso enables the President by order, to rdlieve the Comptroller and .A.uditor-General from the responsibility for compiling the accounts of the Union. Clause 3 of the Bill proposes to insdrt two provisos in section 11 ol the said Act, The new ffrst proviso enables the President, by order, to relieve the Comptrolldr and Auditor-General from the responsibility for the pleparstlon and submission of the accounts relating to annual recerpts and disbursements for the purpose, of the Union or of a Union te1'ritory having a Legislalive Assembly. When orderg &re issued relieving the Comptroller and Auditor-Gendral of the said responsibilities, additronal posts will be requirdd in ths various Mlnistries, Departments, etc., of the Gove nment for assuming the said responsibllities. These additional posts are proposed to be fllled up only by persons transferred from the Indian Audit and Accounts Department.
Accordingly, no additional ekpenditure from the Consoljdated Fund of India will be involved on this account merely as a result of thc lransfer of the accounting functions from the Comptrollel and Auditor-General to the Minisrties. Departments, etc.
2. Mostly, the existing ollce accommodatlon including furnitrre will be utilised for the persons so transferred. However, it may be necessary to provlde some additional accomnodation in some places as a ?esult of departmehtalisation of accounts. For thls purpose, it is estimated that an eypenditu/e of not more than Rs. 15 lakhs per annum is llketv to be lncurred. fo meet some urgent requirements of additional furniture.

Provided further that nothing in this sub-section shall affect the ri8ht of any such olficer or employeg to resign or retire from service in accordance wtth the,r'ules appllcable to, him in the Indlan Audit and Accounts Department.
(2) The Central Government may. by order, dstablish one or more Advisory Committees consisting of such number of members as it thinks flt for the purpose of essisting it in regard to the transfer of of;acers and employees under sub-section (1).
(3)1 An officer or other emplovee trarsferred to any Minlstrv, Department or office of the Central Government by an order made unde!
sub-.section (1) shall, on and frorn the date of transfer, cease to be an officer or employed in the Indian Audit and Aecounts Department and sha1l, subject to the provisions of sub'section (4) and of anv law or rules made under Chapter I of Part XW of the Constitution, hold ofHce ln such Ministry, Department or office with such designation as the Central Goveg'nment may specify,
(4) Every officer o. empilol.ee transfered under sub-section (1) shall be entitled to be appointed to a post carrying a scale of pay not less favourable than that of the post which hd held immedlately before tle date of such transfer and in the same capacitv (whether substantive or ofnciating) in whjch he held the post last mentioned:
Provided that if immediately before the date of such transfer any such olncer or employee is officiating in a higher post in the Indian Audit and Accounts Depaltment either in 6 leave vacancy or in any other vacancy of a specifle8 duration, his pay, on transfer, sha11 be protected for the unexpired period of such vacancy.
3. (I) The Departmentalisation of Union Accounts (Transfer o{ Personnel) Ordinance, 1976, ,is hereby repealed.
(2) Notvrithstanding such repdal, anything done or any action taken under the said Ordinance shall be deemed to have b€en done or taken under the correspondlng provisions of thls Act.

SEc. 2l' THE GAZETTE OF INDIA EXTRAORDINABY 725 STATEMENT OF OBJECTS AND BEASONS The presernt accounting system applicable to most Ministries and Departments is essentially external to financial management functions in that payments are made by the treasuries an-d accounts are compiled by the Audit and Accounts offices under the control of the Comptroller and Auditor-General on the basis of initial and subsidiary accounts received by them fronr the treasuries. This system u'orJ<ed fairly weII when Governmental business was linrited. With thd increase in the volume and variety of Governmental business and the continual step-up of developmental outiays the system has proved inadequate to the administration's tasks.
2. The echerrre of separation of accounts from autdit is to be implemented in the lVlinistry of Communications, Ministry of Tourism and Civil Aviation and the Ministry of Industry and Civil Supplies from 1st April,
1976. The remaining Ministries rvill also be col,ered gradually by the lst October, 19?6. The taking over of accounting functions from the Comptroller and Auditor-Genera1 ilvolves the' transfer of a large ntrmber of employees of the Indian Audit and Accounts Department to the Ministries and Departmefrts of the Government of India and offices under them. The transfer of so many ernployees working tinder the Comptroller and Audi' tor-General has to be effectdd in such 8. manner that it does not entail serious administrative problems. To achieve this object, the Department' alisation of Union Accounts (Transfer of Personnel) Ordinance, 1976 (2 of 19?6) was promulgated by the'President on 1st March, 1976.
3. The Ordinance empowers the Central Government to transler o{Ecers and employees from the Indian Audit and Accounts Department to any Ministry or Department of the' Central Go\ret'nment or any of its attached and subordinate offices, on the advice of a Committee. It provides for constitution of one or more Advisory Committees to assist the Government in the seleetion of personrrel to be transfen'ed. Persons transferred from the Indian Audit and Accounts Department will cease to be employees of the said Departrnent cnd will hold offi.ce in the MinistrY, Department or office thereunder with such designations as the Central Government may specify. The transferred oilicers and employees will be entitled to be appointed to posts carrying scales of pay not less favourable than those of thet posts held by them imrnediately before the dete of such transfer, Substantive status, if any, will be protected.
