No. 9-12/2002/ncte—in ezXercise of the powers conferred by section 10 (1) & (2) read with Section 32(2) ( c) of National Council for Teacher Education (NCTE) Act 1993 the NOTE hereby makes the following regulations to regulate the conditions of service of every employee appointed by the Council namely

1. Short title and commencement These regulations ''may be called the National Council for Teacher Education (conditions of service of every employee appointed by the Council) Regulations, 2002. These shall come into force with effect from the date of their publication.

2. Definition The words and expressions used herein shan nave the same meaning respectively assigned to them in the NCTE Act.

3. Ap'' ,ability These Regulations shall apply to every employee appointed b$-"V& Council.

4. In regard to all matters concerning the service conditions of every employee appointed by the Council, the Fundamental and Supplementary Rules framed by the Government of India and such other rules and orders issued by the Government of India from time to time shall mutatis mutandis apply to every employee of the Council.

Provided that such rules and orders issued by the Government of India as are specifically not made applicable to autonomous organizations like NCTE shall not apply to every employee appointed by the Council.

5. Every temporary employee appointed by the Council holding regular post at NCTE HQ. or in any of its regional offices shall be declared permanent in accordance with the orders issued by the Government of India from time to time.

6. Every regular employee of the Council shall be entitled to gratuity benefits according to the rules and orders of the Government of India as amended from tirr. ; to time.

7. Ev y regular employee appointed by the Council shall be entitled to the benefits of the CPF Scheme as per provisions of NCTE CPF Regulations 2002.

8. The Central Civil Services (Classification, Control and Appeal) Rules and the Central Civil Services (Conduct) Rules for the time being in force course and as amended from time to time shall mutatis mutandis apply to every employee appointed by the Council.

9. The appointing authority, disciplinary authority and the appellate authority for the particular group of posts are specified in the Annexure.

Provided that appointment of Group ‘A’ level posts shall be subject to the approval of the Central Government.

10. The Central Civil Services (Temporary Service) Rules 1965 of the Government of India as amended from time to time shall mutatis mutandis apply to every temporary employee of the Council.

11. Every employee appointed by the Council on contract basis shall be ''verned by the same rules as applicable to contract officers of the Central Govei ^nt.

^.Notwithstanding anything contained in these Regulations, the Council may make appointments by taking officers from Central / State Governments / Universities / Recognized Research Institutions I Public Sector Undertakings / Statutory, Semi Government, Autonomous or other organizations on deputation basis (including short term contract) on terms and conditions similar to those laid down by the Government of India from time to time for Central Government employees transferred on deputation to Central / State Governments / Universities / Recognized Research Institutions / Public Sector Undertakings / Statutory, Semi Government, Autonomous or other organizations.

13. Interpretation Where any doubt arises as to the interpretation of any of the rules, regulations/instructions of the Central Government, it shall be referred to the Central Government for decision.
