(4)] THE CONTIGENCY FUND OF INDIA RULES SRO 1358. - tn exercise of lhe powers conferred by Section 4 o{ ihe Contingency Fund of lndio Act, 1 950 (XLlXof 1 950), the Cenhol Government hereby mokes the {ollowing rules: - CONTINGENCY FUND OF INDIA RUTES I . These rules moy be colled the Contingency Fund of lndio Rules.
2. The Contingency Fund of lndio sholl be held on beholf o{ lhe President by the Secretory to theGovernmenl of lndio, Minislry of Finonce, Deporlment of Economic Affoirs.
3. From out o{ lhe Bqlqnce in the Fund, such omounts os moy be ogreed upon from time to time sholl be ploced ot lhe disposol of ihe Finonciol Commissioner o{ Roilwoys for the purpose of meeting lhe un{oreseen expenditure ofihe Roilwoys.
4. Subject to fhe provisions of Rule 5 below, oll opplicolions for odvonces from the Fund sholl be mode io the Secrelory to the Governmen't of lndio, Ministry of Finonce, Deportmen'f of Economic Affoirs. The opplicotions shollgive -
(i) brief porticulorsof theoddiiionolexpenditure involved, {ii) the circumstonces in which provision could nol be included in ihe budget,
(iii) why ils postponement is nol possible,
(iv) lhe omountrequired to be odvonced {rom'the Fund with fullcostofthe proposol for the yeor or port of the yeor, os the cose moy be, ond
(v) the g ronl or oppropriolion under which supplementory provision willeventuolly hove to be obtoined.
5. Applicolions for odvonces required by Roilwoys sholl be mode lo the Finonciol Commissioner of Roilwoys in the monner provided {or in Rule 4.
6. Advonces from the Fund sholl be mode for the purpose o{ meeting unJoreseen expendilure including expenditure on o new service nol contemploled in lhe onnuol finonciol slolement.
7. A copy of the order sonctioning lhe odvonce, which sholl specify the omount, the gront or oppropriotion lo which it relotes ond give brief porliculors by sub-heods ond unils of oppropriolion of the expendilure for meeting which i'l is mode, sholl be forworded by the Minisfry of Finonce or the Finonciol Commissioner of Roilwoys, os the cose moy be, to lhe Audit ond Accounts Officers concerned. ln odditjon, the Minislry of Finonce o1d lhe Finonciol Commissioner of Roilwoys sholl forword copies o{ such orders lo lhe Accounlonl- Generol, Cenlrql Revenues ond lhe Direclor of Roilwoy Audit respectively.
8. (1) Supplementory Eslimotes for ollexpenditure so finonced sholl be presented to Porliomenl ol lhe firsl session meefing immediotely ofier the odvonce is sonclioned unless such odvonce hos been resumed lo lhe Conlingency Fund in occordonce wiih lhe provisions of sub-rule (2).

All odvonces sonclioned from the Contingency Fund lo meet expendilure in excess of the provision {or the service included in on Appropriolion (Vote on Accounts) Act sholl be resumed to lhe Conlingency Fund os soon os lhe Approprioiion Acl in respect o{ lhe expenditure on the service {or lhe whole yeor, including lhe excess mel from lhe odvonces from the Conlingency Fund hos been possed.
8. C. lf during on Election yeor, two Budgets ore presented to lhe Porlioment, oll odvonces, sonctioned from lhe Conlingency Fund of lndio during ihe period between the presenlotion o{ {irsl ond second Budgets or during lhe period between lhe presenlolion o{ the second Budget ond lhe possing of lhe connected Appropriotion Act to meet expendiiure on o service not included in on Appropriotion (Vole on Account) Act ond lhe odvonces outslonding ot lhe end of the preceding finonciol yeor being odvonces lhe estimoles {or which qre included in the second Budgef, sholl be resumdd lo the Coniingency Fund os soon os the Appropriolion Acl in respect oI the expendilure on lhe service for the whole yeor hos been possed.
NOTE. -A suitob/e explonotion regording the odvonce ond the recoupment thereof sholl be incorporoted in the "Notes on Demonds {or Gronts", Wherever required, such o cose will be included in the slolemeni of 'New Service'/ 'New lnstrument ol Service' oppended ot lhe end of the demonds.
9. A copy of lhe order resuming the odvonce, which sholl giveo reference to the number ond doleof lheorder in which lhe originol odvonce wos mode ond lo the Supplemenlory Appropriotion Act referred lo in Rule 8, sholl be forworded by the Minislry of Finonce ond the Finonciol Officers concerned, in oddi'tion, lo the Audil ond Accounis Officers concerned. ln oddition, lhe Ministry of Finonce sholl forword copies of such orders to the Accounlonl Generol, Centrol Revenues, ond lhe Director of Roilwoys Audit i{ perloining to the Roilwoys.
