8.0. l355(E).——Whereas, by notification of the Government of India in the erstwhile Ministry of Shipping Road Transpon and Highways ( Department of Road Transport & Highways) .number 5.0. 126705), dated the 16th November, 2004, issued under section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), the Central Government, has entrusted the stretch from kilometer 0.000 to kilometer 125.000 (Trichy-Malur-Madurai Section) of National Highway No. 453, in the State of Tamil Nadu, to the National Highways Authority of India ( hereinafler referred to as the “Authority");
And whereas, in exercise of the powers conferred by section 7 of the National Highway Act, 1956 (48 of 1956) read with Rule (3) of the National Highway Fee (Determination of Rates and Collection) Rules, 2008, the Central Government by notification of the Government of India authorized Authority for levying and collecting fee on mechanical vehicles for the use of stretches as follows:
I. Vide 8.0. No. 409 (E) dated 13th March, 2012 for the stretch from km. 0000 to km. 60.950 (Trichy- Tovarankurichi Section) on NH-45B in the State ofTamilnadu.
II. Vide 8.0. No 455 (E) dated 16th March, 2012 for the stretch from km. 60.950 to km. 124.840 (Tovarankurichi-Madurai section) on NH-4SB in the State of Tamilnadu.
And whereas, pursuant to the provision of section 14 of the National Highways Authority of India Act, 1988 (68 of 1988), the Authority has entered into an Agreement on February 21, 2013 (hereinafier referred to as said agreement) with M/s. Eagle Deep Trichy Bypass Tollways India Private Limited, having registered office at Flat No. M-2, Regency Garden Apartment Opp Ratandeep, Ulhasnagar — 421003, Maharashtra (hereinafier referred to as the “Coneessionaire”), for the bid submitted on 26.ll.2012 for the development of Trichy Bypass - Tovarankurichi - Madurai section from kilometer 0.000 - kilometer 124.840 on National Highway No. 458 (hereinafter referred to as the “said section”) on Operate, Maintain and Transfer (OMT) basis.
Now, therefore, in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 and amended from time to time (hereinafter referred to as the “Rules”), and in supersession of the notifications of the Government of India in the Ministry of Road Transport and Highways number 8.0. 40903), dated the 13th March, 2012, and 8.0. 455(E), dated the 16th March, 2012 except as respects things done or omitted to be done before such supersession, the Central Government, having regard to the expenditure involved in building, maintenance, management and operation of the said section, interest on the capital invested, reasonable return, the volume of traffic and the period of the agreement entered into between the authority and the concessionaire, hereby notifies that there shall be levied and collected fees on mechanical vehicles for the use of the said section at the rate specified in columns (2) of the Table 1 for net road section length of 94.980 Kms for use of the four and more lane sections (hereinafter referred to as “base rate”) and at one and one half times the base rate for six nos. ofbypasses having aggregate length of 29.543 km. and costing Rupees ten Crore or more on the Type of Vehicles specified in column (I) of the Table 1 below, and authorizes the said Concessionaire to collect and retain the fee on and from the date of commercial operation or publication of this notification in the Official Gazette, whichever is later, till the termination date as specified in the agreement;

3. The rate ofmonthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance oftwenty kilometers from the toll plaza is Rs. 215.00 (Rupees Two Hundred Fifteen only) for the year 2013-14 and is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008.
4. For multiple journey on the highway section, passes shall be issued at the following rates. namely.

5. Fee for commercial vehicle (excluding vehicles plying under national permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicle.
6. Mechanical vehicle which is loaded in excess of permissible load specified for its category under the Rules, shall be liable to pay fee at such rates which is applicable for the next higher category of the vehicles and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.
7. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the said Rule.
8. The fee rates shall be displayed for information ofthe users in accordance with rules 12 of the said Rule.
9. Based on the base rate of fee per km for the base year 2007-08 as mentioned in Table-l above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority. The same shall be got published by the Authority in at least one newspaper, each in English and vernacular language through the Concessionaire and thereafter revised annually in accordance with rule 5 of the said Rules and provisions of the Concession Agreement and published provided that no revision shall be effected within a period ot‘six months from the date of the preceding revision of fee.

10. The present value of Capital Cost of the Project to be recovered from the date of COD is Rs. 1024.75 Crores (Rupees One Thousand Twenty Four Crores and Seventy Five Lakhs only). From the Commercial Operation Date (COD) toll shall be collected by the Concessionaire at the applicable rates provided under the National Highways Fee (Determination of Rates and Collection) Rules, 2008 and further amendments till bid due date. Afier the day on which the Capital Cost is recovered the toll rates chargeable shall be reduced to 40% of rate being charged. in case, due to any reason, COD is advanced/postponed upto 90 days, the Capital Cost to be recovered shall be reworked and intimated to the Concessionaire within 30 days after actual COD, by the Engineer/Independent_Engineers.
