‘ And whereas, pursuant to the provision of section 14 of the National Highways Authority of India Act, 1988 ( 68 of 1988), the Authority has entered into an Agreement on 16.11.2009 (hereinafter referred to as said agreement) with M /s IRB Pathankot Amritsar Toll Road Private Limited, having its registered office at IRB Complex, Chandivli Farm, Chandivli Village, Andheri (East), Mumbai-400072, (hereinafter referred to as the “Concessionaire”), for the bid submitted on
19.06.2009 for the development of Pathankot — Amritsar section from km
6.082(Design Chainage) to km 108.502 (Design Chainage) on National Highway No. 15 (hereinafter referred to as the “said section”) to four lane divided carriageway and operation and maintenance of the said section in the state of Punjab on Design, Build, Finance, Operate and Transfer(DBFOT) basis.
Now, therefore, in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 (hereinafter referred to as the “Rules”), the Central Government, having regard to the expenditure involved in building, maintenance, management and operation of the said section, interest on the capital invested, reasonable return, the volume of traffic and the period of the agreement entered into between the authority and the concessionaire, hereby notifies that there shall be levied and collected fees on mechanical vehicles for the use of the said section at the rate specified in column (2) of the Table l for net road section length 68.281 km for use of the four and more lane sections and at the base rates specified in the Table No.2 for bypasses having an aggregate length of 34.139 km, costing Rupees Ten Crore or more for the base year 2007 -08 on the Type of Vehicles specified in Table 1 and 2 below, and authorizes the said Concessionaire to collect and retain the fee on and from the date of commercial operation (COD) declared by the Authority and on getting Completion Certificate 2868 Hills—l 5 > THE GAZETTE OF INDIA : EXTRAORDINARY [PART lI—SEC. 3(ii)] ‘from the Authority or publication of this notification in the Official Gazette, whichever is later, till the termination date as specified in the agreement;

3. The rate of monthly pass for a person who owns a mechanical vehicle registered for non — commercial purpose and resides within a distance of twenty kilometer from the toll plaza is Rs. 215.00 (Rupees Two Hundred Fifteen only) for the year 2013-14 which is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008.
4. For multiple journeys on the highway section, passes shall be issued at the following rates, namely:

5. Mechanical vehicle which is loaded in excess of permissible load specified for its category under the Rules, shall be liable to pay fee at such rates which is applicable for the next higher category of the vehicles and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.
3|"!le il THE GAZETTE OF INDIA : EXTRAORDINARY [PART ”#SEC. 3(ii)] . All definitions, category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the Rules.
. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said Rules.
. Based on the base rate of fee per km for the base year 2007—08 as mentioned in Table-1 85 2 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of completed portion of the length of the Project Highways. The same shall be got published by the authority in at least one newspaper, each in English and vernacular language through the concessionaire and thereafter revised annually in accordance with the Rule 5 of the said rules and provisions of the concession agreement and published provided, however, that such revision shall not be effected until a period of 06 (six) months has elapsed from COD.
