5.0. 1017(El-7Whereas by notification of the Government of IndiaIn the erstwhile Ministry of Road fiansport and Highways number S. O 1035 (E), dated 07/05/2010’ issued under Section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), the Central Government has entrusted the stretch from kilometer 129.300 to kilometer 215.900 (Godhra — Gujarat/Madhya Pradesh Border Section) of National Highway No. 59 in the State of Gujarat to the National Highways Authority of India (hereinafter referred to as the ‘Authority”);
And whereas, pursuant to the provision of Section 14 of the National Highways Authority of India Act, 1988 (68 of 1988), the Authority has entered into an Agreement (hereinafter referred to as said agreement) with M / s BSCPL Godhra Tollways Limited having its registered office 6-2-913/914, 5"1 Floor, Progressive Towers, Khairacabad, Hyderabad — 500004 (hereinafier referred to as the “Concessionaire’), the successful bidder for bids submitted on 30/ 11/2009 for the development of , [Godhra — Gujarat/Madhya Pradesh Border Section] section from Km 129.300 to Km 215.900 on ‘ National Highway No. 59 (New National Highway Not 47) (hereinafler referred to as the "said j section”) to four lane operation and maintenance of the said sectioni Now, therefore, in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 ( hereinafter referred to as the ‘Rules'), the Central Government, having regard to the e enditure involved in building, maintenance, management and operation of the said , section, interest on the capital invested, reasonable return, the volume of traffic and the period of the agreement entered into between the authority and the concessionaire, hereby notifies that there ", shall be levied and collected fees on mechanical vehicles for the use of the said section at the rate specified in columns (2) of the Table 1 for not mad section length of 78.660 km. for use of the four I and more lane sections ( hereinafter referred to as “base rate”) and at the base rates specified in the Table No. 2 for bridges/structure/ bypass costing Rupees Fifty crore or more on the Type of 1 Vehicles specified in Table 1 and 2 below. and authorizes the said Concessionaire to collect and retain the fee on and from the date of commercial operation (COD) declared by the Authority and on getting the work completion certificate from the Authority or publication of this notificationIn the Oilicial Gazette, whichever is later, till the termination date as specified in the agreement;

4. For multiple journey on the highway section, passes shall be issued at the following rates, namely.

5. Mechanical vehicle which is loaded in excess of permissible load specified for its category under the Rules, shall be liable to pay fee at such rates which is applicable for the next higher category of the vehicles and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.
6. All definitions including category of mechanical vehicles, its permissible load, category of ex upte‘d veliiclee, service road, alternative mud etc. shall be as p61 definitions :chified in the Rules.
7. The fee rates shall be displayed for information of the users in accordance with rule 12 of the said Rules,

Based on the base rate of fee as mentioned in Table-l as 2, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the completed portion of the length of the Project Highway, will be published and thereafter revised annually in accordance with mle 5 of the said Rules and provisions of the Concession Agreement provided that no revision shall be effected within a perio'd of six months from the date of the preceding revision of fee, The actual amount of fee and the discounts shall be published in at least one newspaper, each in English and vernacular language accordingly.
