And whereas, pursuant to the provision of Section 14 of the National Highways Authority of India Act, 1988 (68 of 1988), the Authority has entered into an Agreement (hereinafter referred to as said agreement) with M/s. Patna Bakhtiyarpur Tollway Limited, having its registered office at 6-2-913/914, V Floor, Progressive Towers, Khairatabad, Hyderabad-500004, Andhra Pradesh, India, (hereinafter referred to as the “Concessionaire”), the successful bidder for bids submitted on 30-6-2010 for the development of Patna—Bakhtiyarpur section from Km 181.300 to Km 231.950 on National Highway No. 30 (hereinafter referred to a the “said section”) to four laning with paved shoulder operation and maintenance of the said section.
Now, therefore, in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 published vide G.S.R.
838(E) dated 5th December, 2008 (hereinafter referred to as the “Rules”), the Central Government, having regard to the expenditure involved in building, maintenance, management and operation of the said section, interest on the capital invested, reasonable return, the volume of traffic and the period of the agreement entered into between the authority and the concessionaire, hereby notifies that there shall be levied and collected fees on mechanical vehicles for the use of the said section at the rate specified in columns (2) of the Table 1 for net road section length 14.200 km for use of the four and more lane sections (hereinafter referred to as “base rate”) and at the base rates mentioned in Table 2 for the realignment of
36.4 Km length from Km 195.000 to Km 231.400 on the Type of Vehicles specified in Table 1 & 2 below, and authorizes the 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] said Concessionaire to collect and retain the fee on and from the Date of Commercial Operation (COD) declared by the authority and on getting the work completion certificate from the authority of publication of this notification in the Official Gazette, whichever is later, till the termination date as specified in the agreement :

3. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometre from the toll plaza is Rs. 200.00 (Rupees Two Hundred only) for the year 2012-13 which is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008.

4. For multiple journey on the highway section, passes shall be issued at the following rates, namely :

5. Mechanical vehicles which is loaded in excess of permissible load specified for its category under the Rules, shall be liable to pay fee at such rates which is applicable for the next higher category of the vehicles and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.
6. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, services road, alternative road etc. shall be as per definitions specified in the Rules.
7. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said Rules.
8. Based on the Base rate of fee per km for the base year 2007-08 as mentioned in Table-1 & 2, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority and published thereafter revised annually in accordance with the rule 5 of the said rules provided that no revision shall be effected within six months and the same shall be published in at least one newspaper, each in English and vernacular language accordingly.
