O. 651(E).—Whereas, the Central Government by the notification of the Government of India in the erstwhile Ministry of Shipping, Road Transport and Highways number S.O. 1097(E), dated the 4 th August, 2005, issued under section 11 of the National Highways Authority Act, 1988 (68 of 1988), entrusted the stretch from km 239.000 to km 282.000 of National Highway No. 6 in the State of Chhattisgarh to the National Highways Authority of India (hereinafter referred to as the “Authority”);
AND, WHEREAS, the Authority has entered into an agreement on 13.10.2005 with M/s Raipur Expressway Ltd. having its registered office at C-66, South Extension Part-II, New Delhi-110049 (hereinafter referred to as the Concessionaire), for the bids submitted on 09.03.2004, for the Improvement, Operation and Maintenance, Rehabilitation and Strengthening of existing 2-lane road and widening to 4 lane divided highway from Km 239.000 to Km 281.000 (design chainage from Km 238.535 to Km 282.000) (hereafter referred to as the ‘said section’) of the Raipur- Aurang section of the National Highway No. 6 on Build, Operate and Transfer (BOT) basis;
NOW, THEREFORE, in exercise of the powers conferred by the section 8A of the National Highways Act,1956 (48 of 1956), read with the rule 3 of the National Highways (Collection of Fees by any person for the use of section of National Highways/ permanent bridge/ temporary bridge on National Highways) Rules, 1997, the Central Government, having regard to the expenditure involved in building, maintenance, management and operation of the said section, interest on the capital invested, reasonable return, the volume of traffic and the period of the agreement entered into between the Authority and the Concessionaire, hereby notifies that there shall be levied and collected fees on mechanical vehicles for the use of the section starting from Km 239.000 to Km 281.000 (Design Chainage from Km.238.535 to Km.282.000) of the National Highways No. 6 in the State of Chhattisgarh at the rates specified in the Schedule below and authorizes the said Concessionaire to collect and retain the said fee on and from the date of commercial operation or publication of this notification in the Official Gazette, whichever is later, till the termination date as specified in the agreement, namely:
SCHEDULE The concessionaire shall collect and retain the fee on mechanical vehicles specified in column (2) of the following table, for use of the said section, at the base rate specified in column (3) of the said table:- TABLE S. 1. For the purpose of this notification-
(i) “Actual Fees” means the fees actually charged from the road users of the said section as approved by the Authority calculated on the basis of
(a) length of the project highway, and
(b) base fee given in the above Table duly indexed;
(ii) “Date of Commercial Operation” means the date on which the commercial operation of the said section starts, which shall be the date on which the Independent Consultant issues the Completion Certification or the Provisional Certificate, as the case may be, upon completion of four laning of the said section in accordance with the provisions of the agreement entered into between the Authority and the Concessionaire;
(iii) “Local Personal Traffic” means and includes a personal vehicle which is registered with the Concessionaire, by any person who normally resides or works at a place that can normally be approached only by using a part of the said section and such person is, therefore, required to use such vehicles for commuting on a part of the said section, without crossing more than one of the toll plazas; in the course of normal travel to and from his place of work or residence;
(iv) “Local Commercial Traffic” means any commercial vehicle including buses, trucks, light motor vehicles or taxis engaged in carrying goods and passengers registered with the Concessionaire as plying routinely on the said section without crossing more than one of the Toll Plazas;
(v) “Termination Date” means the date on which the agreement entered into between the Authority and the Concessionaire expires pursuant to the provisions of the said agreement or is terminated by termination notice;
(vi) Words and expressions used in this notification but not defined but defined in the agreement entered into between the Authority and the Concessionaire in respect of the said section shall have the same meanings as assigned to them respectively in the said agreement.
2. Multi Axle Vehicle includes earth-moving equipments and heavy construction machinery.
3. The rate of fee and the revision thereof effective from 1 st July every year shall be calculated as follows:- WPI-B Base Fee X ____ WPI-A Where • WPI-A = is the Wholesale Price Index on March, 31, 1997.
• WPI-B = is the Wholesale Price Index on March 31 preceding the fee- revision date.
The actual fees to be charged shall be rounded off to nearest five rupees.
4. No fee shall be payable or collected in respect of the following vehicles, namely: -
(a) Defense vehicles;
(b) Police vehicles;
(c) Fire fighting vehicles;
(d) Ambulances;
(e) Funeral vans;
(f) Post and Telegraph Department’s vehicles;
(g) Central and State Government vehicles on duty;
(h) Vehicles having “VIP” symbols or officially belonging to —
(i) President of India;
(ii) Vice-President of India;

(iii) Governor of a State and Lieutenant Governor of a Union territory
(iv) A Foreign dignitary on State visit to India, and
(v) A Foreign Diplomat stationed in India using cars with “CD”/ “CC” symbols
(vi) Chairman of Rajya Sabha, Speaker of Lok Sabha, Chairman of a State Legislative Council or Speaker of a State Legislative Assembly, a Minister for the Union or State, Leader of Opposition in Lok Sabha or Rajya Sabha, State Legislatures having the Status of Cabinet Minister if he is sitting in the vehicle;
(vii) Members of Parliament in the entire country , a Member of Legislative Assembly of a State , a Member of Legislative Council of a State, in the respective State if he produces his Identity Card issued by the Parliament or concerned Legislature of a State as the case may be;
(viii) Vehicles belonging to Winners of Gallantry Awards such as Param Vir Chakra, Ashok Chakra, Maha Vir Chakra, Kirti Chakra, Vir Chakra and Shaurya Chakra, if such awardee produces his photo Identity Card duly authenticated by the Competent Authority for such award.
5. The rates of fees, the categories of vehicles exempted from payment of fee and the name, address and telephone number of the Concessionaire to whom complaints, if any, should be addressed, shall be conspicuously and prominently displayed 500 meters ahead of the toll booths, 100 meters ahead of the toll booths and at the toll booths also, the height of the display boards and size of letters being such that the drivers can easily read the display boards.
6. The Concessionaire shall not collect fees from Local Personal Traffic and Local Commercial Traffic in excess of the following discounted rates, namely:-
(a) Local Personal Traffic: Twenty Five per cent of the applicable fees for the specific category of vehicle;
(b) Local Commercial Traffic: Fifty per cent of the applicable fees for the specific category of vehicle.
7. The Concessionaire shall publish substance of this notification in two local newspapers (one of which shall be in vernacular language), which shall also state the date of commercial operation as per the provision of this notification, at least ten days prior to the date of commercial operation. Such substance shall also be repeated, ten days prior to giving effect to revised fees as per this notification.
8. The actual fees to be charged from users shall be computed by the Concessionaire and sent to the Authority for validation as soon as possible after 31st March, in every year, but at least forty-five days before the revised rate is to be effective so as to enable the Authority to provide any comments or seek clarifications within a period of fifteen days from the date of receipt of the said proposal and if the Authority does not offer comments or seek clarification during this period, the revised fee, as proposed by the Concessionaire, shall be deemed to have been confirmed by the Authority.
