5.0. 2228 (E).— Whereas by notification ofthe Government oflndia in the erstwhile Ministry ofRoad 'I‘ranspon and Highways number 8.0. 452 (E) dated 16.03.2012, issued under Section 11 ofthe National Highways Authority of lndia Act, 1988 (68 of 1988), the Central Government has entrusted the stretch from kilometer 7.469 to kilometer 66.482 (Meerul to Bulandshahar section) ofNational Highway No. 235 (New National Highway No. 334) in the State of Uttar Pradesh tn the National Highways Authority ofIndia (hereinafter referred to as the “Authority”);
And whereas, pursuant to the provision of Section 14 of the National Highways Authority of India Act, 1988 (68 of 1988), the Authority has entered into an Agreement on 04.01.2012 (hereinafter referred to as said agreement) on with M / s C&C Western UP Expressway Ltd. having its registered office at plot No. -70, Sector-32, Gurgaon-l22001, India (hereinafter referred to as the “Concessionaire”), for bids submitted on 15.07.2011 for the development of Meerut to Bulandshahar section from km 7.469 (desing ch. 7.469) to km 66.482 (desing ch. 73.512) on National Highway No. 235 (hereinafter referred to as the “said section”) to four lane standards and operation and maintenance of the said section on Design, Build, Finance, Operate and Transfer (DBFOT) basis.
Now, therefore, in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 published vide G.S.R 838(E) dated 5th December, 2008 and amended vide G.S.R 950(E) dated 3““1 December, 2010, G.S.R 15(E) dated 12Lh January, 2011 (hereinafter referred to as the “Rules”), the Central Government, having regard to the expenditure involved in building, maintenance, management and operation of the said section, interest on the capital invested, reasonable return, the volume of traffic and the period of the agreement entered into between the Authority and the Concessionaire, hereby notifies that there shall be levied and collected fees on mechanical vehicles for the use of the said section at the rate specified in columns (2) of the Table 1 for net road section length of 36.618 km for use of the four and more lane sections (hereinafter referred to as “base rate") and at one and half times the base rate for four numbers of bypasses having an aggregate length of 25.903 km costing on the Type of Vehicles specified in Table 1 below, and authorizes the said Concessionaire to collect and retain the fee on andfrom the Date of Commercial Operation (COD) declared by the Authority and on getting the Completion Certificate or the Provisional Certificate, as the case may be, from the Authority or publication of this notification in the Official Gazette, whichever is later, till the termination date as specified in the agreement;

3. The rate of monthly pass for a person who owns a mechanical vehicle registered for noncommercial purposes and resides within a distance of twenty kilometers from the toll plaza is Rs.
215.00 (Rupees Two Hundred only) for the year 2013-14 which is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008.
4. For multiple journey on the highway section, passes shall be issued at the following rates, namely.

5. Fee for commercial vehicle (excluding vehicles plying under national permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles.
6. Mechanical vehicles which is loaded in excess of permissible load specified for its category under the Rules, shall be liable to pay fee at such rates which is applicable for the next higher category of the vehicles and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.
7. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the Rules.
8. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said Rules.
9. Based on the Base rate of fee per km for the base year 2007-08 as mentioned in Table-1, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the completed portion of the length of the Project Highway. The same shall be got published by the Authority through the Concessionaire in at least one newspaper, each in English and vernacular language and thereafter revised annually in accordance with the rule 5 of the said rules and provisions of the Concession Agreement provided that no revision shall be effected within a period of six months from the date of the preceding revision of fee.
