2. 4जस Y य?I का अपना यां?�क वाहन, गैर-वा4ण46यक CयोजनA के िलए पंजीकृत हुआ हो और वह टोल V लाजा से बीस >क.मी. तक क� दरू� म7 ह� रहता हो उसके िलए वष� 2013-14 के िलए मािसक पास क� दर 215.00 Tपए (दो सौ प� �ह Tपए मा�) होगी और रा% &�य राजमाग� शुE क (दरA का अवधारण और संBहण) िनयम, 2008 के उपबंधA के अनुसार उसम7 CH येक वष� संशोधन >कया जायेगा ।
3. राजमाग� ख* ड पर बहुया�ाओं हेतु पास िनQ निल4खत दरA पर जार� >कये जायेगा, अथा�त:्- संदेय रािश अनु[ात एकतरफा या�ाओं क� अिधक तम सं$ या ?विधमा� यता क� अविध एकतरफा या�ा के िलए शुE क का डेढ़ गुना दो संदाय के समय से चौबीस घंटे पचास या अिधक एकल या�ाओं के िलए संदेय शुE क क� रािश का दो-ितहाई पचास या अिधक संदाय क� तार�ख से एक माह
4. 4जस 4जले म7 शुE क V लाजा पड़ता है उस 4जले म7 पंजीकृत वा4ण46यक वाहन (रा% &�य अनु[ा प� के अधीन चल रहे वाहनA को छोड़कर) के िलए शुE क उस _णेी के वाहन के िलए िनधा��रत शुE क का 50% होगा बशत ̀के ऐसे वा4ण46यक वाहनA के उपयोग के िलए कोई स?व�स रोड अथवा वैक4Eपक सड़क उपलa ध न हो ।
5. जो यां?�क वाहन िनयमA के अधीन अपने Cवग� के िलए िनधा��रत अनु[ेय भार क� अपेbा अिधक भार से लदे हुए हAगे उन दरA पर शुE क का संदाय करना होगा जो उनसे अगली उc च _णेी के वाहनA के िलए लागू होता है और उ� ह7 तब तक राजमाग� ख* ड का उपयोग करने का अिधकार नह�ं होगा जब तक >क ऐसे यां?�क वाहन से अिधक भार को हटा न >दया जाए।
6. यां?�क वाहनA के Cवग�, उनके िलए अनु[ेय भार, छूट CाV त वाहनA के Cवग�, स?व�स रोड, वैक4Eपक सड़क आ>द स>हत सभी प�रभाषाए ंिनयमA म7 ?विन>द�% ट प�रभाषाओं के अनुसार हAगी । 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
7. उ' त िनयमA के िनयम 12 के अनुसार, उपयो' ताओं क� जानकार� के िलए शुE क क� दरA को Cदिश�त >कया जाएगा ।
8. ऊपर सारणी 1 म7 यथा उ4Eल4खत, आधार वष� 2007-08 के िलए Cित >क.मी क� आधार दरA के आधार पर, यां?�क वाहनA से िलए जानेवाले वाR त?वक शुE क और कटौितयA क� गणना Cािधकरण Gारा क� जाएगी और उसम7 उ' त िनयमA के िनयम 5 के अनुसार वा?ष�क तौर पर संशोधन >कया जायेगा तथा उसे तदनुसार, अBेंजी और R थानीय भाषा के कम-से-कम एक समाचारप� म7 Cकािशत >कया जाएगा।
9. प�रयोजना क� अनुमािनत पूंजीगत लागत 422.02 करोड़ Tपये हP। Cािधकरण Gारा उपयोगकता�ओ ं से वसूल >कए गए शुE क के ज�रए पूंजीगत लागत क� वसूली का अिभलेख रखा जाएगा और पूंजीगत लागत क� वसूली हो जाने के बाद लगाए गए शुE क क� दरA को घटाकर 40% कर >दया जाएगा और उ' त िनयमA के अनुसार इसम7 वा?ष�क तौर पर संशोधन >कया जाएगा। >दनांक 31.03.2012 क� 4Rथित म7 उगाह� गई उपभो' ता शुE क क� रािश से कुल 14.82 करोड़ क� वसूली हुई । [iQk- la- भाराराCा/13013/443/09-10/सीओ/जीसी-िसलीगुड़�(507-551) ] संजय बंदोपाX याय, संयु' त सिचव MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 3rd May 2013 S.O. 1131(E).—Whereas by notification of the Government of India in the Ministry of Road Transport and Highways number S.O. 465 (E), dated the 26th April, 2002 issued under section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), the Central Government has entrusted the stretch from kilometer 500.000 to kilometer 634.000 (Chalsa to Siliguri to Dalkola section) of National Highway No. 31 in the State of West Bengal to the National Highways Authority of India (hereinafter referred to as the “Authority”);
And whereas, in exercise of the powers conferred by section 7 of the National Highway Act 1956 (48 of 1956) read with National Highways Fee (Determination of Rates and Collection) Rule, 2008, the Central Government by notification of the Government of India in the Ministry of Road Transport and Highways number S.O.358 (E) dated 1st March, 2012, authorized Authority for levying and collecting fee on mechanical vehicles for the use of four and more lane sections from Kilometer 522.700 to Kilometer 551.000 on National Highway No. 31 in the State of West Bengal at the rates and category of vehicles specified in its schedule.
And whereas, now the construction of stretch from Km 507.000 to Km 522.700 has been completed.
Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 and amended from time to time ( hereinafter referred to as the “said Rules”), and in supersession of the notification number S.O. 358 (E), dated the 1st March, 2012 except as respects things done or omitted to be done before such supersession, the Central Government hereby levies the fee at the base rate specified in column (2) of the Table 1 for net road section length 44.000 Km (hereinafter referred to as “base rate”) for use of the four and more lane sections on the Type of Vehicles specified in column (1) of Table 1 below, for the use of the section from kilometer 507.000 to kilometer 551.000 (hereinafter referred to as the “said stretch”) on the National Highway No. 31 in the State of West Bengal and ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5 authorises the Authority to collect, either through its officials or through a contractor, the said fee, namely:- Table 1 Type of vehicle Base rate of fee per km for the base year 2007-08 (in Rupees)
(1) (2) Car, Jeep, Van or Light Motor Vehicle 0.65 Light Commercial Vehicle, Light Goods Vehicle or Mini Bus 1.05 Bus or Truck (Two Axles) 2.20 Three-axle commercial vehicles 2.40 Heavy Construction Machinery (HCM) or Earth Moving Equipment (EME) or Multi Axle Vehicle (MAV) (four to six axles)
3.45 Oversized Vehicles (seven or more axles) 4.20
1. The fee levied and collected hereunder shall be due and payable at the following Toll Plaza for net road length specified for such Toll Plazas:

2. The rate of monthly pass for a person who owns a mechanical vehicle registered for noncommercial purposes and resides within a distance of twenty kilometers from the toll plaza is Rs. 215.00 (Rupees Two Hundred Fifteen only) for the year 2013-14 and is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008.
3. For multiple journey on the highway section, passes shall be issued at the following rates, namely;

4. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles.
5. Mechanical vehicle which is loaded in excess of permissible load specified for its category under the rules, shall be liable to pay fee at such rates which is applicable for the next higher category of the vehicles and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.
6. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the said rules.
7. The fee rates shall be displayed for information of the users in accordance with rule 12 of the said rules.
8. Based on the base rate of fee per km for the base year 2007-08 as mentioned in Table- 1, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the authority and published and will further be revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper, each in English and vernacular language accordingly.
9. The capital cost of the project is Rupees 422.02 crores. The Authority shall maintain a record of the recovery of capital cost through user fee realised and after recovery of the capital cost, the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules. A total of Rs 14.82 crore has been recovered from user fee realized till 31.03.2013.
