Barwa Adda Expressway Limited having its registered office at IL & FS financial Centre, Plot C-22, G Block, Bandra Kurla Complex, Bandra (E), Mumbai-400051, Maharashtra, India (hereinafter referred to as the “Concessionaire”), for bids submitted on 11th February, 2013 for the operation and Maintenance of Barwa Adda- Panagarh section from Km. 398.240 to Km. 521.120 (Authority has confirmed that the old chainage was from Km.

Now, therefore, in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008, vide G.S.R. 838(E) dated the 5th December, 2008 and amended vide G.S.R. 950(E) dated 3rd December, 2010, G.S.R 15(E) dated 12th January, 2011 and G.S.R. 756(E) dated 12th October 2011 (hereinafter referred to as the “Rules”), and in supersession of the notification of the Government of India in the Ministry of Road Transport and 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Highways number S.O. 593(E), dated the 8th March, 2013. except as respects things done or omitted to be done before such supersession, the Central Government, having regard to the expenditure involved in building, maintenance, management and operation of the said section, interest on the capital invested, reasonable return, the volume of traffic and the period of the agreement entered into between the authority and the Concessionaire, hereby notifies that there shall be levied and collected fees on mechanical vehicles for the use of the said section at the rate specified in column (2) of the Table 1 for net road section length of 116.486 Kilometre during the construction period and 114.76 Km. after the construction of six lanning for use of the six lane sections and operation and maintenance of the section (Barwa Adda-Panagarh) from Km. 398.240 to Km. 521.120 in the State of West Bengal (hereinafter referred to as “base rate”) and at one and one half times the base rate for bypass of length 8.12 Kilometre costing Rupees ten Crore or more on the Type of Vehicles specified in column (1) of the Table 1 below, and authorizes the said Concessionaire to collect and retain the fee on and from the date of commercial operation or publication of this notification in the Official Gazette, whichever is later, till the termination date as specified in the agreement;

2. The rate of monthly pass for a person who owns a mechanical vehicle registered for non- commercial purposes and resides within a distance of twenty kilometers from the toll plaza is Rs.215.00 (Rupees Two Hundred Fifteen only) for the year 2013-14 and is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008.
3. For multiple journeys on the highway section, passes shall be issued at the following rates, namely.

4. Fee for commercial vehicle (excluding vehicles plying under national permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicle.
5. Mechanical vehicle which is loaded in excess of permissible load specified for its category under the Rules, shall be liable to pay fee equal to ten times of the fee applicable to such category of mechanical vehicles and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.
6. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the said Rule.
7. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said Rule.
8. The increase in the rates of the fee shall in no case be more than 25% of the rates of the fee applicable in the immediately preceding year.
9. Based on the Base rate of fee per km for the base year 2007-08 as mentioned in Table-1, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority. The same shall be got published by the Authority through the Concessionaire in at least one newspaper, each English and vernacular language. The fee shall be revised annually on April 1 in accordance with the provisions of the Fee rules; provided, however, that such revision shall not be effected until a period of (Six) months has elapsed from COD and the same shall be published.
