और, उि प्रारूप अजधसूचना को अंतर्वाष्ट करने वाली रािपत्र की प्रजतर्ां िनता को तारीख 26 जसतंबर, 2023 को उपल्ध करा िी गई थी;

और, िाचीगाम राष्ट्रीर् उद्यान, थिवास (बालटाल) वन्र्िीव अभर्ारण्र् और ओवेरा-अरू वन्र्िीव अभर्ारण्र् 776 वगा दकलोमीटर के क्षेत्रफल में और संघ राज्र् क्षेत्र िम्मू और कश्मीर के कश्मीर प्रांत के श्रीनगर, गंडेरबल और अनंतनाग जिलों में फैला हुआ ह।ै और, िाचीगाम राष्ट्रीर् उद्यान जिसका क्षेत्रफल 141 वगा दकलोमीटर ह ैको अजधसूचना सं. एस.आर.ओ:

को एस.आर.ओ: 154, दिनांक 19 माचा, 1987 द्वारा वन्र्िीव अभर्ारण्र् के रूप में अजधसूजचत दकर्ा गर्ा ह ैऔर थिवास (बालटाल) वन्र्िीव अभर्ारण्र् जिसका क्षेत्रफल 210 वगा दकलोमीटर ह ै को एस.आर.ओ: 156, दिनांक 19 माचा, 1987 द्वारा वन्र्िीव अभर्ारण्र् के रूप में अजधसूजचत दकर्ा गर्ा ह।ै और, िाचीगाम राष्ट्रीर् उद्यान श्रीनगर िहर से उत्तर-पूवा में 21 दकलोमीटर की िरूी पर जस्ट्थत ह।ै र्ह उद्यान औसत समुद्र तल से 1600 मीटर से 4250 मीटर की ऊंचाई के बीच ग्रेट िानस्ट्कर पवात श्रेणी में जस्ट्थत है और र्ह कें द्र जहमालर्न धुरी के उत्तर पजिम उपखंड बनाता है। िाचीगाम हगंुल (कश्मीर लाल जहरण), के अंजतम िीवनक्षम और उसकी स्ट्थाजनक संखर्ा के वास के जलए प्रजसद्ध ह ैिो िजक्षण-पूवा एजिर्ा में बचा हुआ एकमात्र वास स्ट्थल ह।ै इस उद्यान की ऐसी प्रजतष्ठा ह ैदक इसे ििे में सवोत्तम प्रबंजधत राष्ट्रीर् उद्यान होने का पुरस्ट्कार प्रिान दकर्ा िा सकता ह।ै और, थिवास (बालटाल) वन्र्िीव अभर्ारण्र् श्रीनगर से उत्तर-पूवा में 105 दकलोमीटर की िरूी पर जस्ट्थत ह।ै र्ह अभर्ारण्र् 3437 उ अक्षांि और 74o29’ स े74o36’ पू ििेांतर के बीच जस्ट्थत ह ैऔर इसके िार्रे में समुद्र तल से 3015 मीटर से 5466 मीटर की ऊँचाई वाली पवात शे्रजणर्ां आती है। इसमें ससंध वन संभाग के वन कम्पाटामेंट स.ं56/एस से 62/एस तक भी आते हैं। इस क्षेत्र के मुखर् आकर्ाण कश्मीर कस्ट्तूरी मृग (मोस्ट्र्ूस कूपरेर्ूस) और जहमालर्न ब्राऊन भाल ू (अरसस अका टोस) िैसे िीविंत ु ह।ै र्ह अभर्ारण्र् अन्र् महत्त्वपूणा वन्र्िीव क्षेत्रों िैस े अरू, ऊपरी िाचीगाम और ससंध वन के साथ िडुा हुआ ह।ै र्ह वन्र्िीव अभर्ारण्र् ‘सोनमागा’ की बडी-बडी बफीली चोरटर्ों और ससंध निी से जघरा हुआ ह,ै िो दक इसकी राउट और महसीर संखर्ा के जलए प्रजसद्ध ह।ै थिवास ग्लेजिर्र पर्ाटकों के जलए एक आकर्ाण कें द्र ह,ै िहा ँपर्ाटक ग्रीष्म ऋतु में पर्ाटन पर आते हैं। और, ओवेरा-अरू वन्र्िीव अभर्ारण्र् श्रीनगर के िजक्षण-पूवा स े76 दकलोमीटर की िरूी पर जस्ट्थत ह।ै र्ह 33o55'0"उ से 34o20'0" उ अक्षांि और 75o5'0" पू स े 75o32'30" पू ििेांतर के बीच जस्ट्थत ह ै और कश्मीर घाटी के अनंतनाग जिला के अंतगात आता ह।ै इस क्षेत्र का मुखर् िीविन्तु आकर्ाण कश्मीर कस्ट्तूरी मृग (मॉस्ट्कस क्र्ूजप्रर्स), एजिर्ाई इबेक्स (कैप्रा जसजबररका), जहमालर्न सेराव (केजप्रकॉनीस् थार) और जहमालर्ी भूरा भालू (उसास आका टोस इसाबेजलनस) हैं। ओवरेा-अरू अभर्ारण्र् के वन अनेक झीलों और ग्लेजिर्रों स ेसमृद्ध ह,ै िो दक िल का बहुमूल्र् स्त्रोत का काम करत ेहैं र्ही िल कई धाराओं का रुप लेकर िहर के पररधी से होत े हुए ग्रामों के नीच ेकी ओर बहती हैं। और, िाचीगाम राष्ट्रीर् उद्यान रॉिसा ईटी एल., 2002 द्वारा दकर्े गर्े िैव-भौगोजलक वगीकरण के अनुसार 2ए प्रांत के अधीन आता ह।ै संिोजधत चैजम्पर्न और सेठ (1968) के अनुसार िाचीगाम राष्ट्रीर् उद्यान की वनस्ट्पजतर्ाँ जवजिष्ट रूप से जहमालर्न आद्रा समिीतोष्ण वन, उप-अल्पाइन वन और अल्पाइन वन प्रकार की हैं और आद्रा समिीतोष्ण पणापाती वन, परोरटर्ा (पोहू) झाडी वन, पजिम जहमालर्न जनचला स्ट्तर ्लू पाइन वन, पजिमी जमजश्रत िंकुधारी वन, पणापाती अल्पाइन झाडी, पजिम जहमालर्न उप-अल्पाइन ब्रीच- रहोडोडनेड्रोन वन, ड्वॉफा िूनीपर झाडी, िुष्क समिीतोष्ण झाडी के रुप में वगीकृत की िा सकती हैं। और, िाचीगाम राष्ट्रीर् उद्यान के कुछ जवजिष्ट वनस्ट्पजतर्ों और िंतुओं में उल्मस वाजल्लजचअना, सैजलक्स अल्बा, पोपुलुस स्ट्पा., पू्रनस आमेजनर्ा, क्र्ूरकस रोबर, रोजबना प्सेउडोअकेजिर्ा, पेरोटीओपजसस िेकाइमोंरटअना, रोसा वेज्बअना, रूबस जनवेउस, ऐस्ट्कुलुस इंजडका, िगलांस रेजगर्ा, पाइनस जग्रजफफथी, एगंारडा (लर्चजनस्ट्कोनााररर्ा (एल.) डीसर)., बािारिांत ु (पोटेंरटल्ला अरोसांगुइंनालोड्ड.), तरूम्बाि ु (जपदिजिर्रकीओइड्स), घुडखुरा (तुजस्ट्सलागो फाफेरा), डोडड (कोडोनोजप्सस ओवेटे), रत्निोत (ओनोसमाजहजस्ट्पडम वल्लीचेक्स), कश्मीर रेड जहरन (केरवुस क्षेत्र सालभर, अजधकतर मोटी बफा स े आच्छादित रहता ह।ै वृक्ष प्रिाजतर्ा ंिसैे एजबइस सपंड्रो, बेतुला उलरटजलस, िगलांस रेजगर्ा और जपकेर्ा स्ट्पा. पुष्प वाले प्रमुख वृक्षों की शे्रणी में र्ह क्षेत्र इंडीगोफेरा हतेराथं, बेरबेररइस लर्दककम, और रोसा वेज्बअना िैसी मुखर् झाजडर्ों स ेजघरा हुआ ह।ै क्षेत्र की महत्त्वपूणा िीविंत ुप्रिाजतर्ों में गे्र लंगूर (प्रस्ट्बटीस इंटेल्लुस), रहसेुस मकाक (मकाका मुलाट्टा), साधारण तेंिआु (पेन्थेरा प्रडू्यस), स्नो तेंिआु (पेन्थेरा र्ूजनका), तेंिआु जबल्ली (फेजलस [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 बेन्गालेंजसस), जसर्ार (कैजनस ऑररर्स), रेड लोमडी (वुल्पेस वुल्पेस), जहमालर्न ब्राउन भालू (उरससू अरक्टोस), एजिर्ारटक ्लैक भालू (उरसूस जथबेटानुस), र्ेल्लो थ्रोटेड माटीन (मारटीस फलाजवगुला), लॉग-टेल्ड ममोट (मन्नोटा बोबक), रोलेस जपका (ओचोटोना रोर्लेइ), एजिर्ाई इबेक्स (कपरा जसबरीका), कश्मीर मुस्ट्क जहरन (मोस्ट्चुस कुपरेउस), आदि आते हैं। और, ऊंचाई, आकृजत और मृिा में जभन्नता के कारण, ओवरेा-अरू वन्र्िीव अभर्ारण्र् में वनस्ट्पजतर्ों में जवजवधता िखेने को जमलती ह।ै अभर्ारण्र् की वनस्ट्पजत मुखर्त: नालों के जनकट जनचला ऊंच े स्ट्थान में कैल (पाइनस जग्रजफफथी) के साथ फर (एबीस ् पीड्राव) ह।ै भौजतक जवजवधताओं के कारण र्हाँ तटीर् वनस्ट्पजत (औसत समुद्र तल से 1600-2300 मीटर ऊँचाई पर), िंकुधारी वन (औसत समुद्र तल 2300-3000 मीटर), अल्पाइन झाडी और चरागाह (औसत समुद्र तल से 3000-3500 मीटर की ऊँचाई पर), रॉक फेस (औसत समुद्र तल 3500 मीटर की ऊँचाई पर) पाए िाते हैं। ओवेरा-अरू वन और्धीर् बहुमूल्र् पौधों की प्रिाजतर्ों से भी समृद्ध है। िैसे वन इस क्षेत्र में उगने वाले वन में कुछ और्धीर् पौधें भी होते हैं जिसमें अकोजनतम हटेेरोफर्ल्लुम, अरनेजबर्ा बेंथाजम, अरटेजमजसर्ा अबससंजथर्म, बेरबेररस लीजसर्म, बेरगेजनर्ा सलंगुलाटा, डातुरा स्ट्तरामोजनर्म, डोओस्ट्कोर अडेलटोआईजडर्ा, लवातेरा कासमेररअना, सौस्ट्सुरेर्ा कोस्ट्तुस और ताक्र्स वाजल्लजचना आते हैं। और, ओवेरा-अरू वन्र्िीव अभर्ारण्र् रॉिसा और पनवार (1998) के द्वारा दकए गए िैव-भौगोजलक सीमांकन के अनुसार जहमालर्न िोन के उत्तर-पजिम प्रांत (प्रांत 2ए) के अंतगात आता ह।ै इस प्रांत में संपूणा कश्मीर घाटी आती ह ैऔर समिीतोष्ण और उप-उष्णकरटबंधीर् िलवार्ु कश्मीरी स्ट्टैग एवं हगंुल (केरवुस हगंलु हगंलु), कश्मीर मस्ट्क जहरन (मोस्ट्चुस कुपरेउस), जहमालर्न ्लैक भालू (उरसूस जथबेटानुस), जहमालर्न ब्राउन भालू (उरसुस अरक्टोस), सामान्र् तेंिआु (पेन्थेरा प्रड्यूस), जहमालर्न गे्र लंगूर (प्रेस्ट्बटीस अिाक्स), रीसस मकाक (मकाका मुलाट्टा), रेड लोमडी (वुल्पेस वुल्पेस), ब्राउन मुस्ट्क श्रेव (करोदकडुरा मुरीना), र्ेल्लो थ्रोटेड माटीन (मारटेस फलाजवगुला), लॉग-टेल्ड ममोट (मारमोट जहमाजलर्ना), कश्मीर वेमपॉर्र(मेरगाडेमाा स्ट्पेकटरूम), लेइसलेर हरे्री–अरमेड बेट (जनकतालुस लेस्ट्सलेरी), कश्मीर हाउस रेट (रट्टुस रट्टुस), जबरच माउस (जसक्इस्ट्टा इंजडका), कश्मीर फलाई जगलहरी (इओगलाउकोमर्स दफम्बररअतुस), सेरोव (कापररकोरजनस सुमात्रेजनस), रोर्ले जपका (ओचोटोना रोर्ेली), जहमालर्न जग्रफफोन जगद्ध (जिप्स जहमालर्ेंजसस), जबर्रजडड जगद्ध (गर्पैतुस बारबेतुस), कश्मीर फलाईकैचर (दफकेडुला सुबरूबरा) आदि, का र्हाँ पार्ा िाना इसकी जविेर्ता ह।ै और, िाचीगाम राष्ट्रीर् उद्यान, ओवेरा-अरू वन्र्िीव अभर्ारण्र् और थिवास वन्र्िीव (बालटाल) अभर्ारण्र् की प्राकृजतक सीमाएं एक िसूरे से खुले भू-समतलीर् स्ट्तर पर जमलती हैं। िाचीगाम राष्ट्रीर् उद्यान की सीमा उत्तर और उत्तर-पूवी भाग पर ओवेरा- अरू वन्र्िीव अभर्ारण्र् के साथ जमलती ह ै िबदक ओवेरा-अरू वन्र्िीव अभर्ारण्र् की सीमा उत्तर और उत्तर-पूवी भाग पर थिवास वन्र्िीव अभर्ारण्र् के साथ जमलती है। र्ह संरजक्षत क्षेत्र समृद्ध िैव-जवजवधता और पिुओं, पजक्षर्ों और वनस्ट्पजत की कुछ महत्त्वपूणा/ स्ट्थाजनक प्रिाजतर्ों की अच्छी खासी िनसंखर्ा से जमलकर बना है। प्रस्ट्ताजवत पाररजस्ट्थजतकी संवेिी िोन इन क्षेत्रों को एक ही इकाई बनाता है और इससे इन क्षेत्रों में िैव- जवजवधता के जवकास के जलए िीन प्रवाह करने में मिि जमलेगी। और, िाचीगाम राष्ट्रीर् उद्यान, थिवास (बालटाल) वन्र्िीव अभर्ारण्र् और ओवेरा-अरू वन्र्िीव अभर्ारण्र् के चारों ओर के क्षेत्र को, जिसका जवस्ट्तार और सीमा इस अजधसचूना के पैराग्राफ 1 में जवजनर्िाष्ट हैं, पाररजस्ट्थजतकी, पर्ाावरणीर् और िैव-जवजवधता की िजृष्ट से पाररजस्ट्थजतकी संविेी िोन के रूप में सुरजक्षत और संरजक्षत करना तथा उि पाररजस्ट्थजतकी संवेिी िोन में उद्योगों र्ा उद्योगों के वगों को और उनके प्रचालन तथा प्रसंस्ट्करण को प्रजतजर्द्ध करना आवश्र्क ह;ै अतः अब, केन्द्रीर् सरकार पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परठत पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) (जिसे इस अजधसूचना में इसके पिात् पर्ाावरण अजधजनर्म कहा गर्ा ह)ै की धारा 3 की उपधारा (1) तथा उपधारा (2) के खंड (v) और खंड (xiv) एवं उपधारा
(3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करत ेहुए, िम्मू और कश्मीर संघ राज्र् क्षेत्र के िाचीगाम राष्ट्रीर् उद्यान, थिवास (बालटाल) वन्र्िीव अभर्ारण्र् और ओवेरा-अरू वन्र्िीव अभर्ारण्र् की सीमा के चारों ओर 200 मीटर स े13.15 दकलोमीटर तक जवस्ट्ताररत, क्षेत्र को िाचीगाम राष्ट्रीर् उद्यान, थिवास (बालटाल) वन्र्िीव अभर्ारण्र् और ओवरेा-अरू वन्र्िीव अभर्ारण्र् के पाररजस्ट्थजतकी सवंिेी िोन (जिसे इसमें इसके पश् चात ् पाररजस्ट्थजतकी संवेिी िोन कहा गर्ा ह)ै के रूप में अजधसजूचत करती ह,ै जिसके ्र्ौरे पैराग्राफ 1 में जवजनर्िाष्ट ह,ै पर्ाावरण की क्वाजलटी की सुरक्षा और सुधार करने और पर्ाावरण प्रिरू्ण को रोकने और जनर्ंजत्रत करने और समाप्त करने के प्रर्ोिन के जलए जनम्नजलजखत उपार् करें, अथाात् :-
1. पाररजस्ट्थजतकी सवंिेी िोन का जवस्ट्तार और सीमा.-(1) पाररजस्ट्थजतकी संवेिी िोन का जवस्ट्तार िाचीगाम राष्ट्रीर् उद्यान, थिवास (बालटाल) वन्र्िीव अभर्ारण्र् और ओवेरा-अरू वन्र्िीव अभर्ारण्र् की सीमा से 200 मीटर से 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
2. 13.15 दकलोमीटर तक ह ै और इसका क्षेत्रफल 448.00 वगा दकलोमीटर का बनता ह ै और जवजभन्न दििाओं (दकलोमीटर) में पाररजस्ट्थजतकी संवेिी िोन का जवस्ट्तार जनम्नानसुार ह:ै- दििा जवस्ट्तार अवस्ट्थान पजिम 200 मीटर पीड्ल्र्ूडी िल टैंक और िलािर् िजक्षण 13.15 दकलोमीटर ख्रेव सीआर सीमा िजक्षण पजिम 5.0 दकलोमीटर खानमोह सीआर सीमा िजक्षण पूवा 1.0 दकलोमीटर ममल वन, जलड्डर नाला पूवा 1.0 दकलोमीटर जनचांग, अल्पाइन चरागाह उत्तर पूवा 1.0 दकलोमीटर सेबाल ग्राम, ससंध वन उत्तर 1.0 दकलोमीटर ससंध का वन उत्तर पजिम 4.0 दकलोमीटर जलडवास, अल्पाइन चारागाह िारा सीआर सीमा
(2) िाचीगाम राष्ट्रीर् उद्यान, थिवास (बालटाल) वन्र्िीव अभर्ारण्र् और ओवेरा-अरू वन्र्िीव अभर्ारण्र् और इसके पाररजस्ट्थजतकी संवेिी िोन की सीमा का जववरण उपाबधं-I के रूप में संलग्न ह।ै
(3) सीमा जववरण और अक्षांिों और ििेांतरों के साथ पाररजस्ट्थजतकी संवेिी िोन को सीमांदकत करत ेहुए िाचीगाम राष्ट्रीर् उद्यान, थिवास (बालटाल) वन्र्िीव अभर्ारण्र् और ओवेरा-अरू वन्र्िीव अभर्ारण्र् के मानजचत्र िमिः उपाबंध –IIक, उपाबधं –IIख, उपाबधं –IIग, उपाबंध –IIघ और उपाबधं –IIङ के रूप में सलंग्न हैं।
(4) िाचीगाम राष्ट्रीर् उद्यान, थिवास (बालटाल) वन्र्िीव अभर्ारण्र् और ओवेरा-अरू वन्र्िीव अभर्ारण्र् और पाररजस्ट्थजतकी संवेिी िोन की सीमा के भू- जनििेांकों की सूची उपाबधं -III की सारणी क और सारणी ख में िी गई ह।ै
(5) मुखर् सबंिओुं पर भू-जनििेांकों के साथ पाररजस्ट्थजतकी संवेिी िोन के अंतगात आने वाल ेग्रामों की सूची उपाबधं – IV के रूप में संलग्न ह।ै
2. पाररजस्ट्थजतकी सवंेिी िोन के जलए आचंजलक महार्ोिना.–(1) संघ राज्र् क्षेत्र प्रिासन, पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिनों के जलए रािपत्र में इस अजधसूचना के प्रकािन की तारीख से िो वर्ा की अवजध के भीतर, स्ट्थानीर् व्यजिर्ों के परामिा से और आंचजलक महार्ोिना तैर्ार और सूजचत करेगी।
(2) पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना ऐसी रीजत से िो इस अजधसूचना में जवजनर्िाष् ट दकए गए ह ैतथा ससुंगत कें द्रीर् और तत्समर् प्रवृत्त जवजधर्ों के अनुरूप तथा कें द्रीर् सरकार द्वारा िारी दकर्े गर् े मागाििाक जसद्धांतों, र्दि कोई हों, के अनुसार तैर्ार होगी।
(3) आंचजलक महार्ोिना उि र्ोिना में पाररजस्ट्थजतकी और पर्ाावरण संबंधी बातों को समाकजलत करने के जलए संघ राज्र् क्षेत्र प्रिासन के जनम्नजलजखत जवभागों के परामिा से तैर्ार होगी, र्था:-
(i) पर्ाावरण;
(ii) वन;
(iii) कृजर्;
(iv) रािस्ट्व;

(4) आंचजलक महार्ोिना अनुमोदित जवद्यमान भ-ूउपर्ोग, अवसंरचना और दिर्ाकलापों पर कोई जनबंधन अजधरोजपत नहीं करेगी िब तक इस अजधसूचना में इस प्रकार जवजनर्िाष्ट न हो तथा सभी अवसंरचनाओं और दिर्ाकलापों में िो अजधक िक्षता और पाररजस्ट्थजतकी-अनकूुल हो का संवधान करेगी।
(5) आंचजलक महार्ोिना में अनाच्छादित क्षेत्रों के िीणोद्धार, जवद्यमान िल जनकार्ों के संरक्षण, आवाह क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भ-ूिल के प्रबंधन, मृिा और नमी के संरक्षण, स्ट्थानीर् समुिार्ों की आवश्र्कताओं तथा पाररजस्ट्थजतकी एवं पर्ाावरण के ऐसे अन्र् पहलुओं, जिन पर ध्र्ान दिर्ा िाना आवश्र्क ह ैके जलए उपबंध होंगे।
(6) आंचजलक महार्ोिना जवद्यमान और प्रस्ट्ताजवत भूजम उपर्ोग जविेर्ताओं के ्र्ौरे से अनुसमर्थात मानजचत्र के साथ सभी जवद्यमान पूिा स्ट् थलों, ग्रामों और िहरी बजस्ट्तर्ों, वनों के प्रकार तथा दकस्ट् मों, कृजर् क्षेत्रों, ऊपिाऊ भूजम, उद्यानों एवं उद्यानों की तरह के हररत क्षेत्रों, उद्यान कृजर् क्षेत्रों, फलोउद्यान, झीलों और अन्र् िल जनकार्ों का अभ्र्ंकन करेगी।
(7) आंचजलक महार्ोिना पाररजस्ट्थजतकी संवेिी िोन में जवकास को जवजनर्जमत करेगी और सारणी में सूचीबद्ध पैराग्राफ 4 में प्रजतजर्द्ध एवं जवजनर्जमत दिर्ाकलापों का अनुपालन करेगी और स्ट् थानीर् समुिार्ों की आिीजवका को सुरजक्षत करने के जलए पाररजस्ट्थजतकी-अनुकूल जवकास को भी सुजनजित और अजभवृजद्ध भी करेगी।
(8) आंचजलक महार्ोिना, प्रािजेिक जवकास र्ोिना की सह-जवस्ट्तारी होगी ।
(9) आंचजलक महार्ोिना, मानीटरी सजमजत के जलए एक संिभा िस्ट्तावेि प्रस्ट्ताजवत और सूजचत करेगी तादक वह इस अजधसूचना के उपबंधों के अनुसार मानीटरी के अपने कार्ो का जनवाहन कर सके ।
3. सघं राज्र्क्षते्र सरकार द्वारा दकए िान ेवाल ेउपार्.- संघ राज्र्क्षेत्र प्रिासन इस अजधसूचना के उपबंधों को प्रभावी करन ेके जलए जनम्नजलजखत उपार् करेगी, अथात्ा:-
(1) भ-ूउपर्ोग.– (क) पाररजस्ट्थजतकी संवेिी िोन में वनों, उद्यान कृजर् क्षेत्रों, कृजर् क्षेत्रों, मनोरंिन के जलए जचजन्हत उद्यानों और खुल ेस्ट्थानों का वृहि वाजणजज्र्क र्ा आवासीर् पररसरों र्ा औद्योजगक दिर्ाकलापों के जलए प्रर्ोग र्ा संपररवतान नहीं होगा:
परंत ुपाररजस्ट्थजतकी संवेिी िोन के भीतर, ऊपर भाग (क), में जवजनर्िाष्ट प्रर्ोिनों से जभन्न के जलए, कृजर् और अन्र् भूजम के संपररवतान को मानीटरी सजमजत की जसफाररि पर और प्रािजेिक नगर र्ोिना अजधजनर्म तथा र्था लाग ूकेन्द्रीर् सरकार एवं संघ राज्र्क्षेत्र प्रिासन के अन्र् जनर्मों और जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन से तथा इस अजधसूचना के उपबंधों के अनुसार स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् आवश्र्कताओं को पूरा करन ेके जलए अनुज्ञात दकर्ा िाएगा, िैस:े-
(i) जवद्यमान सडकों को चौडा करना, और उन्हें सुिढृ़ करना तथा नई सडकों का जनमााण करना;
(ii) बुजनर्ािी ढांचों और नागररक सुजवधाओं का जनमााण और नवीकरण;
(iii) प्रिरू्ण उत्पन्न न करन ेवाले लघु उद्योग;
(iv) कुटीर उद्योग जिनके अंतगात ग्राम उद्योग भी ह;ै पाररजस्ट्थजतकी पर्ाटन में सहार्क सुजवधा भण्डार और स्ट्थानीर् सुजवधाए ंतथा गृह वास भी ह;ै और
(v) पैराग्राफ-4 में दिए गए संवर्धात दिर्ाकलाप:
6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] परंतु र्ह और दक प्रािजेिक िहरी र्ोिना अजधजनर्म के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन तथा संघ राज्र्क्षेत्र प्रिासन के अन्र् जनर्मों एवं जवजनर्मों और संजवधान के अनुच्छेि 244 तथा तत्समर् प्रवृत्त जवजध के उपबंधों, जिसके अंतगात अनुसूजचत िनिाजत और अन्र् परंपरागत वन जनवासी (वन अजधकारों की मान्र्ता) अजधजनर्म, 2006 (2007 का 2) भी ह,ै का अनुपालन दकए जबना वाजणजज्र्क र्ा औद्योजगक जवकास दिर्ाकलापों के जलए िनिातीर् भूजम का उपर्ोग अनुज्ञात नहीं होगा। परंतु र्ह भी दक पाररजस्ट् थजतकी संवेिी िोन के भीतर भूजम के अजभलेखों में उपसंिात दकसी त्रुरट को, मानीटरी सजमजत के जवचार प्राप्त करन ेके पिात्, संघ राज्र्क्षेत्र प्रिासन द्वारा प्रत्र्ेक मामले में एक बार सुधारा िाएगा और उि त्रुरट को सुधारे िान े की सूचना कें द्रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को िी िाएगी:
परंतु र्ह भी दक उपर्ुाि त्रुरट को सुधारन ेमें, इस उपपैरा के अधीन र्था उपबंजधत के जसवार्, दकसी भी ििा में भ-ूउपर्ोग का पररवतान सजम्मजलत नहीं होगा। (ख) अनपु्रर्िु र्ा अनुत् पािक कृजर् क्षेत्रों में वनीकरण तथा पर्ाावासों की बहाली के दिर्ाकलापों के द्वारा पुन:
वनीकरण के प्रर्ास दकए िाएगें।
(2) प्राकृजतक िल स्रोत.- आंचजलक महार्ोिना में सभी प्राकृजतक िलस्त्रोतों के िलग्रहण क्षेत्रों की पहचान की िाएगी और उनके संरक्षण और नवीकरण की र्ोिना सजम् मजलत की िाएगी और संघ राज्र्क्षेत्र प्रिासन द्वारा ऐसे क्षेत्रों में र्ा उनके जनकट जवकास दिर्ाकलापों प्रजतजर्द्ध करने के बारे में िो ऐस ेक्षेत्रों के जलए अजहतकर हो ऐसी रीजत से मागाििाक जसद्धांत तैर्ार दकए िाएगें।
(3) पर्ाटन र्ा पाररजस्ट्थजतकी पर्ाटन.– (क) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पाररजस्ट्थजतकी पर्ाटन दिर्ाकलाप र्ा जवद्यमान पर्ाटन दिर्ाकलापों का जवस्ट्तार पर्ाटन महार्ोिना के अनुसार पाररजस्ट्थजतकी संवेिी िोन के जलए होगा। (ख) र्ह पर्ाटन महार्ोिना संघ राज्र्क्षेत्र प्रिासन के पर्ाटन जवभाग द्वारा ही संघ राज्र्क्षेत्र के पर्ाावरण और वन जवभाग के परामिा से तरै्ार की िाएगी। (ग) पर्ाटन महार्ोिना आंचजलक महार्ोिना का ही एक घटक होगी। (घ) पर्ाटन महार्ोिना पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता के आधार पर तैर्ार की िाएगी। (ङ) पाररजस्ट्थजतकी पर्ाटन सबंंधी दिर्ाकलाप जनम् नानुसार जवजनर्जमत दकए िाएगें, अथाात्:-
(i) नए होटलों और ररसॉट्सा की स्ट्थापना जसफा पर्ाटन महार्ोिना के अनुसार पाररजस्ट्थजतकी पर्ाटन सुजवधाओं के जलए केवल पूवा-पररभाजर्त और अजभजहत क्षेत्रों में ही अनुज्ञात की िाएगी;
(ii) एक सजमजत जिसमें प्रधान सजचव (पर्ाावरण और वन), अध्र्क्ष, प्रिरू्ण जनर्ंत्रण सजमजत, आईआईटी, िम्मू िैसे प्रजतजष्ठत संस्ट्थान से पाररजस्ट्थजतकी और पर्ाावरण तथा नागररक जनमााण के एक-एक जविेर्ज्ञ सजम्मजलत होंग ेऔर होटल और ररसॉट्सा के नए जनमााण के जलए पर्ाावरणीर् सुरक्षा र्ा उपार्ों का सुझाव िेने के जलए पर्ाावरण और वन जवभाग के एक प्रजतजनजध का गठन दकर्ा िाएगा, िो पर्ाटन महार्ोिना का एक घटक होगा। उि सजमजत भूस्ट्खलन, ढलान जस्ट्थरता और भूकंपीर्ता पर िोजखम जनधाारण अध्र्र्न करेगी और अपनाए िान ेवाल ेपर्ाावरण अनुकूल और सुरजक्षत जनमााण उपार्ों की जसफाररि करेगी।
(iii) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पर्ाटन दिर्ाकलापों र्ा जवद्यमान पर्ाटन दिर्ाकलापों का जवस्ट्तार, केन्द्रीर् सरकार के द्वारा िारी मागाििाक जसद्धांतों तथा पाररजस्ट्थजतकी पर्ाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल िेन ेवाल ेराष्ट्रीर् व्याघ्र संरक्षण प्राजधकरण द्वारा िारी पाररजस्ट्थजतकी पर्ाटन संबंधी मागाििाक जसद्धांतों (समर्-समर् पर र्था सिंोजधत) के अनुसार ही दकर्ा िाएगा;
(iv) आंचजलक महार्ोिना का अनुमोिन होने तक, पर्ाटन के जवकास और जवद्यमान पर्ाटन दिर्ाकलापों के जवस्ट्तार के जलए वास्ट्तजवक स्ट्थल-जवजिष्ट संवीक्षा तथा मानीटरी सजमजत की जसफाररि के आधार पर संबंजधत जवजनर्ामक प्राजधकरणों द्वारा अनुज्ञात दकर्ा िाएगा ।
(4) नसैर्गाक जवरासत.– पाररजस्ट्थजतकी संवेिी िोन में बहुमूल्र् नैसर्गाक जवरासत के सभी स्ट्थलों िैस े दक िीन कोि आरजक्षत क्षेत्र, िैल जवरचनाए, िल प्रपात, झरन,े धारा मागो, उपवन, गुफाए,ं स्ट्थल, वनपथ, अश्वरोहण [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 मागा, उत्प्रपात आदि की पहचान की िाएगी और उनके सुरक्षा एवं सरंक्षण के जलए आंचजलक महार्ोिना के भाग के रूप में एक जवरासत संरक्षण र्ोिना भी तैर्ार की िाएगी।
(5) मानव जनर्मात जवरासत स्ट् थल.- पाररजस्ट्थजतकी सवंेिी िोन में भवनों, संरचनाओं, कलाकृजत-क्षेत्रों तथा ऐजतहाजसक, स्ट्थापत्र् संबधी, सौंिर्ाात्मक और सांस्ट्कृजतक महत्व के क्षेत्रों की पहचान की िाएगी और उनके संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप में एक जवरासत सरंक्षण र्ोिना भी तैर्ार की िाएगी।
(6) ध् वजन प्रिरू्ण.- पर्ाावरण के अजधन ध्वजन प्रिरू्ण (जवजनर्मन और जनर्ंत्रण) जनर्म, 2000 के उपबंधों के अनुसार पाररजस्ट्थजतकी संवेिी िोन में ध्वजन प्रिरू्ण के जनवारण और जनर्ंत्रण के जलए पालन दकर्ा िाएगा और समर् समर् पर र्थासंिोजधत दकर्ा िाएगा।
(7) वार् ुप्रिरू्ण.- पाररजस्ट्थजतकी संवेिी िोन में, वार्ु प्रिरू्ण का जनवारण और जनर्तं्रण, वार् ु(प्रिरू्ण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और तद्धीन बनाए गए जनर्मों के उपबंधों के अनुसार दकर्ा िाएगा ।
(8) बजहस्राव का जनस्ट्सारण.- पाररजस्ट्थजतकी संवेिी िोन में उपचाररत बजहस्राव का जनस्ट्सरण, पर्ाावरण अजधजनर्म और उसके अधीन बनाए गए जनर्मों के अधीन आन ेवाले पर्ाावरणीर् प्रिरू्ण के जनस्ट्सारण के जलए साधारण मानकों र्ा संघ राज्र्क्षेत्र सरकार द्वारा जनर्त मानकों, िो भी अजधक कठोर हो, के उपबंधों के अनुसार होगा।
(9) ठोस अपजिष्ट.- ठोस अपजिष्ट का जनपटान और प्रबन्धन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन में ठोस अपजिष्ट का जनपटान और प्रबंधन, ठोस अपजिष्ट प्रबंधन जनर्म, 2016 और तद्धीन बनाए गए जनर्मो के अनुसार दकर्ा िाएगा; अकाबाजनक पिाथो का जनपटान पाररजस्ट्थजतकी संवेिी िोन स ेबाहर जचजन्हत दकए गए स्ट्थानों पर पर्ाावरण-अनुकूल रीजत से दकर्ा िाएगा;
(ख) पाररजस्ट्थजतकी संवेिी िोन में मान्र् प्रौद्योजगदकर्ों का प्रर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप ठोस अपजिष्ट का सुरजक्षत और पर्ाावरण अनुकूल प्रबंधन अनुज्ञात दकर्ा िा सकेगा।
(10) िवै जचदकत्सा अपजिष्ट.- िैव जचदकत्सा अपजिष् ट का प्रबंधन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन में िैव जचदकत्सा अपजिष्ट का जनपटान िैव जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016 के और तद्धीन बनाए गऐ जनर्मो के अनुसार दकर्ा िाएगा। (ख) पाररजस्ट्थजतकी संवेिी िोन में मान्र् प्रौद्योजगदकर्ों का प्रर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप िैव जचदकत्सा अपजिष्ट का सुरजक्षत और पर्ाावरण अनुकूल प्रबंधन अनुज्ञात दकर्ा िा सकेगा।
(11) प्लाजस्ट्टक अपजिष्ट का प्रबधंन.- पाररजस्ट्थजतकी सवंेिी िोन में प्लाजस्ट्टक अपजिष्ट का प्रबंधन, प्लाजस्ट्टक अपजिष्ट प्रबंधन जनर्म, 2016 के और तद्धीन बनाए गऐ जनर्मो के अनुसार दकर्ा िाएगा।
(12) सजंनमााण और जवध्वसं अपजिष्ट का प्रबधंन.- पाररजस्ट्थजतकी संवेिी िोन में संजनमााण और जवध्वंस अपजिष्ट प्रबंधन, संजनमााण और जवध्वसं अपजिष्ट प्रबंधन जनर्म के और समर् समर् पर र्थासिंोजधत उपबंधों के अनसुार दकर्ा िाएगा।
(13) ई–अपजिष्ट.- पाररजस्ट्थजतकी संवेिी िोन में ई–अपजिष्ट का प्रबंधन, ई–अपजिष्ट प्रबंधन जनर्म, 2016 के और तद्धीन बनाए गऐ उपबंधों के अनुसार दकर्ा िाएगा।
(14) र्ानीर् गजतजवजधर्ा.ं- र्ातार्ात की र्ानीर् गजतजवजधर्ां पर्ाावास-अनुकूल रीजत से जवजनर्जमत की िाएगी और इस संबंध में आंचजलक महार्ोिना में जविेर् उपबंध दकए िाएगें और आंचजलक महार्ोिना के तैर्ार होन े और संघ राज्र्क्षेत्र सरकार के सक्षम प्राजधकारी से अनुमोदित होने तक, मानीटरी सजमजत सुसंगत अजधजनर्मों और तद्धीन बनाए गए जनर्मों एवं जवजनर्मों के अनसुार र्ानीर् गजतजवजधर्ों के अनुपालन को मानीटर करेगी।
(15) र्ानीर् प्रिरू्ण.- र्ानीर् प्रिरू्ण की जनवारण और जनर्ंत्रण लाग ूजवजधर्ों के अनपुालन में दकर्ा िाएगा और स्ट्वच्छतर ईंधन के उपर्ोग के जलए प्रर्ास दकए िाएगें।
(16) औद्योजगक ईकाइर्ा.ं- (क) रािपत्र में इस अजधसूचना के प्रकािन की तारीख को र्ा उसके पिात पाररजस्ट्थजतकी संवेिी िोन के भीतर दकसी नए प्रिरू्णकारी उद्योग की स्ट्थापना की अनुज्ञात नहीं होगी। 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ख) केन्द्रीर् प्रिरू्ण जनर्ंत्रण बोडा द्वारा फरवरी, 2016 में िारी समर्-समर् पर र्था संिोजधत मागाििाक जसद्धान्तों में उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना में इस प्रकार जवजनर्िाष्ट न हो, पाररजस्ट्थजतकी संवेिी िोन के भीतर केवल गैर- प्रिरू्णकारी उद्योगों को अनुज्ञात दकर्ा िाएगा और इसके अजतररि, गैर प्रिरू्णकारी कुटीर उद्योगों को बढ़ावा दिर्ा िाएगा।
(17) पहाडी ढलानों का सरंक्षण.- पहाडी ढलानों का सरंक्षण जनम्नानुसार दकर्ा िाएगा:- (क) आंचजलक महार्ोिना में पहाडी ढलानों के उन क्षते्रों को ििाार्ा िाएगा जिनमें दकसी भी जनमााण की अनुज्ञा नहीं होगी। (ख) जिन ढलानों र्ा जवद्यमान खडी पहाडी ढलानों में अत्र्जधक भू-क्षरण होता ह ैउनमें दकसी भी जनमााण की अनुज्ञा नहीं होगी।
4. पाररजस्ट्थजतकी सवंेिी िोन के भीतर प्रजतजर्द्ध र्ा जवजनर्जमत दकए िान े वाल े दिर्ाकलापों की सचूी- पाररजस्ट्थजतकी संवेिी िोन में सभी दिर्ाकलाप, पर्ाावरण (संरक्षण) अजधजनर्म, 1986 के उपबंधों और तद्धीन बनाए गए जनर्मो और पर्ाावरण, वन और वन्र्िीव से संबंजधत भारत सरकार की अन्र् अजधसूचनाए,ं जवजधर्ों और अजधजनर्म, तत्कालीन पर्ाावरण और वन मंत्रालर् में, संखर्ांक 1533 (अ), दिनांक 14 जसतंबर, 2006 और ऐसी रीजत में तत्समर् प्रवृत जवजधर्ों के उपबंधो द्वारा िाजसत होंगे और समर्-समर् पर र्था संिोजधत नीच ेिी गई सारणी में जवजनर्िाष्ट दकए गए ह,ै अथाात:्- सारणी ि. स.ं दिर्ाकलाप जववरण क. प्रजतजर्द्ध दिर्ाकलाप
1. वाजणजज्र्क खनन, पत्थर उत्खनन और अपघर्ाण इकाइर्ां। (क) पाररजस्ट्थजतकी संवेिी िोन के भीतर वास्ट्तजवक स्ट्थानीर् जनवाजसर्ों की घरेल ूआवश्र्कताओं, जिसमें मकानों के जनमााण र्ा मरम्मत के जलए धरती को खोिना सजम्मजलत है, के जसवार् सभी प्रकार के नए और जवद्यमान खनन (लघु और वृहत खजनि), पत्थर उत्खनन और अपघर्ाण इकाइर्ां तत्काल प्रभाव स े प्रजतजर्द्ध होंगी;
(ख) खनन प्रचालन, 1995 की ररट र्ाजचका (जसजवल) सं. 202 में टी.एन. गौडाबमान जथरुमूलपाि बनाम भारत संघ के मामल े में माननीर् उच्चतम न्र्ार्ालर् के आििे और 2012 की ररट र्ाजचका (जसजवल) सं. 435 में गोवा फाउंडिेन बनाम भारत संघ के मामले में आििे का अनुपालन होगा और 2003 के आईए स.ं 1000 का जनणार् दिनांक 03-06-2022 और तत्पिात आईए सं. 131377 का जनणार् दिनाकं 26-04-2023 और 28-04-2023 को हुआ।
2. प्रिरू्ण (िल, वार्ु, मृिा, ध्वजन, आदि) उत्पन्न करने वाले उद्योगों की स्ट्थापना । पाररजस्ट्थजतकी संवेिी िोन में कोई नर्ा उद्योग लगाने और वतामान प्रिरू्णकारी उद्योगों का जवस्ट्तार करने की अनजु्ञा नहीं होगीः परन्तु र्ह दक केन्द्रीर् प्रिरू्ण जनर्ंत्रण बोडा द्वारा फरवरी, 2016 में िारी समर्-समर् पर र्था संिोजधत मागाििाक जसद्धान्तों में उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना में ऐसा जवजनर्िाष्ट न हों, पाररजस्ट्थजतकी संविेी िोन के भीतर गैर-प्रिरू्णकारी उद्योगों को अनुज्ञात दकर्ा िाएगा और इसके अजतररि गैर-प्रिरू्णकारी कुटीर उद्यागों को बढ़ावा दिर्ा िाएगा। [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9

6. नई आरा जमलों की स्ट्थापना। पाररजस्ट्थजतकी संवेिी िोन के भीतर नई और जवद्यमान आरा जमलों के जवस्ट्तार की अनुज्ञा नहीं होगी ।
7. ईंट भट्टों की स्ट्थापना। प्रजतजर्द्ध।
8. पर्ाटन से संबंजधत अन्र् दिर्ाकलाप िैसे गमा वार्ु, गु्बारें, हलेीकॉप्टर, ड्रोन, माइिोलाइटस्, आदि द्वारा पाररजस्ट्थजतकी संवेिी िोन क्षते्र के ऊपर स े उडना िैस े दिर्ाकलाप करना। प्रजतजर्द्ध।
9. िलावन लकडी का वाजणजज्र्क उपर्ोग । प्रजतजर्द्ध। ख.जवजनर्जमत दिर्ाकलाप
10. होटलों और ररसोटों की वाजणजज्र्क स्ट्थापना । नए होटलों और ररसोटों का जनमााण और जवद्यमान का जवस्ट्तार सखती से अनुमोदित महार्ोिना के अनुसार होगा, िो वन्र् पिु के संचालन पर कोई जनबंधन नहीं होने वाले पर्ाावासों की िखेभाल करता ह ैऔर पैरा 6 के उपपैरा (ङ) में जवजहत उपबंधों के अनुरूप ह।ै
11. जनमााणकारी दिर्ाकलाप । (क) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक िो भी जनकट हो, उपरोि िम संखर्ांक 10 में र्थाजवजनर्जमत नए होटलों और ररसोटों से जभन्न दकसी भी प्रकार के वाजणजज्र्क जनमााण की अनुज्ञा नहीं िी िार्ेगी। परंतु स्ट् थानीर् लोगों को पैरा 3 के उप पैरा (1) में सूचीबद्ध दिर्ाकलापों सजहत उनके उपर्ोग के जलए उनकी भूजम में स्ट्थानीर् जनवाजसर्ों की आवासीर् आवश्र्कताओं को पूरा करन े जलए जनमााण करने की अनुज्ञा भवन उपजवजधर्ों के अनुसार िी िा सकेगी। परन्तु ऐसे लघ ु उद्योगों िो प्रिरू्ण उत् पन् न नहीं करते हैं, स े संबंजधत जनमााण दिर्ाकलाप जवजनर्जमत दकए िाएगें और लागू जनर्मों और जवजनर्मों, र्दि कोई हों, के अनुसार तथा सक्षम प्राजधकारी की पूवा अनुज्ञा स े ही दकर् े िा सकें गे और ऐस े दिर्ाकलाप कम से कम ही दकर्े िार्ेंगे। 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ख) एक दकलोमीटर से परे आंचजलक महार्ोिना के अनुसार जवजनर्जमत होंगे ।
12. गैर प्रिरू्णकारी लघ ुउद्योग। फरवरी, 2016 में केन्द्रीर् प्रिरू्ण जनर्ंत्रण बोडा द्वारा िारी, समर्-समर् पर र्था संिोजधत उद्योगों के वगीकरण के अनुसार गैर-प्रिरू्णकारी उद्योग और अपररसंकटमर्, लघु और सेवा उद्योग, कृजर्, पुष्प कृजर्, बागवानी र्ा पाररजस्ट्थजतकी सवंेिी िोन से ििेी सामग्री से उत्पािों को उत्पन्न करने वाले कृजर् आधाररत उद्योग सक्षम प्राजधकारी द्वारा अनुज्ञात होंगे।
13. वृक्षों की कटाई । (क) संघ राज्र्क्षेत्र के सक्षम प्राजधकारी की पूवा अनुज्ञा के जबना वन भूजम र्ा सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर वृक्षों की कटाई नहीं हो सकेगी । (ख) वृक्षों की कटाई संबंजधत कें द्रीर् र्ा संघ राज्र्क्षेत्र के अजधजनर्म र्ा तद्धीन बनाए गए जनर्मों के उपबंधों के अनुसार जवजनर्जमत होगी ।
14. वन उत्पािों और गैर काष्ठ वन उत्पािों का संग्रहण । लागू जवजधर्ों के अधीन जवजनर्जमत होगा ।
15. जवद्युत और संचार टॉवर लगाने, तार-जबछाने तथा अन्र् बुजनर्ािी ढांचे की व्यवस्ट्था । लागू जवजधर्ों के अधीन जवजनर्जमत होगा (भूजमगत केबल जबछाने को बढ़ावा दिर्ा िाएगा)।
16. नागररक सजुवधाओं सजहत बुजनर्ािी ढांचा। लाग ू जवजधर्ों, जनर्मों और जवजनर्मनों और उपल्ध मागाििाक जसद्धांतों के अनुसार न्र्ूनीकरण उपार् दकए िाएगें।
17. जवद्यमान सडकों को चौडा करना, उन्हें सुिढृ बनाना और नई सडकों का जनमााण। लाग ूजवजधर्ों, जनर्मों और जवजनर्मनों और उपल्ध मागाििाक जसद्धांतों के अनुसार िर्नात्मक उपार् दकए िाएगें।
18. पहाडी ढलानों और निी तटों का संरक्षण । लागू जवजधर्ों के अनुसार जवजनर्जमत होगा ।
19. राजत्र में र्ाजनक र्ातार्ात का संचलन । लागू जवजधर्ों के अनुसार वाजणजज्र्क प्रर्ोिन के जलए जवजनर्जमत होगा ।
20. स्ट्थानीर् समुिार्ों द्वारा अपनार्ी िा रही वतामान कृजर् और बागवानी पद्धजतर्ों के साथ िगु्धिाला, िगु्ध उत्पािन, िल कृजर् और मत्स्ट्र् पालन। स्ट्थानीर् िनता के उपर्ोग के जलए लागू जवजधर्ों के अनुसार अनुज्ञात होंगे।
21. फमों, कारपोरेट और कंपजनर्ों द्वारा बड े पैमाने पर वाजणजज्र्क पिुधन संपिा और कुक्कुट फामों की स्ट्थापना । स्ट्थानीर् आवश्र्कताओं को पूरा करने के जसवार् लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे ।
22. प्राकृजतक िल जनकार्ों र्ा भू क्षेत्र में उपचाररत अपजिष्ट िल/बजहस्रााव का जनस्ट्सारण । िल जनकार्ों में उपचाररत अपजिष्ट िल/बजहस्रााव के जनस्ट्सारण स े बचा िाएगा और उपचाररत अपजिष्ट िल के पुनचािण और पुन:उपर्ोग के प्रर्ास दकए िाएगें अन्र्था उपचाररत अपजिष्ट िल/बजहस्रााव का जनस्ट्सारण लागू जवजधर्ों के अनुसार जवजनर्जमत दकर्ा िाएगा। [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 11
23. सतही और भूिल का वाजणजज्र्क जनष्कर्ाण । लागू जवजधर्ों के अनुसार जवजनर्जमत होगा ।

5. पाररजस्ट्थजतकी-सवंिेी िोन अजधसचूना की जनगरानी के जलए मानीटरी सजमजत.- इस अजधसूचना के उपबंधों की प्रभावी मानीटरी के जलए सजमती एक मानीटरी सजमजत का गठन करती ह ैिो जनम्नजलजखत स ेजमलकर बनेगी, अथाात:

6. मानीटरी सजमजत के कार्ा:- (1) उन दिर्ाकलापों की, िो भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संखर्ांक का.आ. 1553 (अ), तारीख 14 जसतंबर, 2006 की अनुसूची में सजम्मजलत ह,ै और िो पाररजस्ट्थजतकी सवंेिी िोन में आते ह ै जसवार् इसके पैरा 4 के अधीन सारणी में र्थाजवजनर्िाष्ट दिर्ाकलापों के, मानीटरी सजमती द्वारा वास्ट्तजवक जवजनर्िाष्ट स्ट्थलीर् ििाओं के आधार पर संवीक्षा की िाएगी और उि अजधसूचना के उपबंधों के अधीन पूवा पर्ाावरण अनापजत्त के जलए र्थाजस्ट्थजत, कें द्रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् र्ा राज्र् पर्ाावरण समाघात जनधाारण प्राजधकरण को जनर्िाष्ट दकर्ा िाएगा।
(2) उन दिर्ाकलापों की, िो भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संखर्ांक का.आ. 1533 (अ), तारीख 14 जसतंबर, 2006 की अनुसूची में सजम्मजलत नहीं ह ै और िो पाररजस्ट्थजतकी संवेिी िोन में आते ह ै जसवार् इसके पैरा 4 के अधीन सारणी में र्थाजवजनर्िाष्ट दिर्ाकलापों के, मानीटरी सजमती द्वारा वास्ट्तजवक जवजनर्िाष्ट स्ट्थलीर् ििाओं के आधार पर संवीक्षा की िाएगी और उसे संबद्ध जवजनर्ामक प्राजधकरण को जनर्िाष्ट दकर्ा िाएगा।
(3) मानीटरी सजमजत के सिस्ट्र्-सजचव र्ा संबद्ध कलेक्टर र्ा संबद्ध उप वन संरक्षक पर्ाावरण (संरक्षण) अजधजनर्म, 1986 की धारा 19 के अधीन इस अजधसूचना के उपबंधों का उल्लंघन करने वाल ेदकसी भी व्यजि के जवरुद्ध जिकार्त ििा करने के जलए सक्षम होंगे। [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 13
(4) मामले िर मामले के आधार पर मानीटरी सजमजत सबंद्ध जवभागों र्ा जविेर्ज्ञों, औद्योजगक संगमो र्ा संबंद्ध पणधाररर्ों के प्रजतजनजधर्ों को अपने जवचार-जवमिा में सहार्ता के जलए आमंजत्रत कर सकती ह।ै

AND WHEREAS, the Dachigam National Park, comprising an area of 141 sq.km. has been notified as National Park, vide notification No. S.R.O:134, dated the 10 th April, 1990 and the Overa Aru Wildlife Sanctuary comprising an area of 425 sq.km has been notified as Wildlife Sanctuary vide S.R.O: 154 dated the 19 th March, 1987 and Thajwas (Baltal) Wildlife Sanctuary comprising an area of 210 sq.km has been notified as Wildlife Sanctuary vide S.R.O: 156 dated the 19 th March, 1987;
AND WHEREAS, the Dachigam National Park is located at a distance of 21 km, North-East from Srinagar city. The park lies in the great Zanskar mountain range between altitudes of 1600 metres to 4250 meters above mean sea level and forms the North-West branch of the Central Himalayan axis. The Dachigam is famous for harbouring the last viable and endemic population of Hangul (Kashmir red deer), the only abode left in South-East Asia. The park has the prestige to be the recipient of the award for the best managed National Park in the country;
AND WHEREAS, the Thajwas (Baltal) Wildlife Sanctuary is located at a distance of 105-kilometer North- East from Srinagar. The sanctuary lies between 34 0 37’ N Latitude and 74 o 29’ to 74 o 36’ E Longitude and covers an altitudinal range of 3,015 m to 5,466 m above mean sea level. It comprises of forest compartment numbers from 56/S to 62/S of Sindh Forest Division. The main faunal attraction of this area is the Kashmir musk deer (Moschus cupreus) and Himalayan brown bear (Ursus arctos isabellinus). The sanctuary is connected with other important wildlife areas, like Aru, Upper Dachigam and the Sindh Forest. The Wildlife Sanctuary is flanked by the large snow laden peaks of ‘Sonamarg’ and the Sindh River, which is famous for its trout and mahseer population. Thajwas glacier is one of the tourist attractions visited by tourists in the summer months;
AND WHEREAS, the Overa-Aru Wildlife Sanctuary is located at a distance of 76 kilometers from South- East of Srinagar. It lies between 33 o 55'0"N to 34 o 20'0" N Latitude and 75 o 5'0" E to 75 o 32'30" E Longitude and falls in the Anantnag District of the Kashmir Valley. The main faunal attraction of this area is the Kashmir musk deer (Moschus cupreus), Asiatic Ibex (Capra sibirica), Himalayan Serow (Capricornis thar) and Himalayan brown bear (Ursus arctos isabellinus). The forests of Overa-Aru sanctuary are blessed with a number of lakes and glaciers, which happen to be invaluable sources of water, feeding numerous streams that flow down into the villages situated near the periphery;
AND WHEREAS, the Dachigam National Park comes under 2A province of bio-geographic classification as suggested by Rodgers et al., 2002. As per revised Champion and Seth (1968), the vegetation of Dachigam National 28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Park is typically Himalayan moist temperate forest, sub-alpine forest and alpine forest type and can be classified into moist temperate deciduous forest, Parrotia (pohu) scrub forest, west Himalayan low level blue pine forest, western mixed coniferous forest, deciduous alpine scrub, west Himalayan sub-alpine birch-rhododendron forest, dwarf juniper scrub, dry temperate scrub;
AND WHEREAS, some of the notable flora and fauna of the Dachigam National Park include Ulmus wallichiana, Salix alba, Populus sp., Prunus armeniaca, Quercus robur, Robina pseudoacacia, Parrotiopsis jacquemontiana, Rosa webbiana, Rubus niveus, Aesculus indica, Juglans regia, Pinus griffithi, Lychniscornaria (L.)Desr)., Bajardantu (Potentilla atrosanguina Lodd.), trumbadu (Picrishieracioides),Ghudkhura (Tussilago farfara), dodad (Codonopsis ovate), ratanjot (Onosmahispidum wallichex), Kashmir red deer (Cervus hanglu hanglu), Kashmir musk deer (Moschus cupreus), common leopard (Panthera pardus), Himalayan brown bear (Ursus arctos isabellinus), Asiatic black bear (Ursus thibetanus), Kashmir gray langur (Semnopithecus ajax), Himalayan griffon vulture (Gyps himalayensis), bearded vulture (Gypaetus barbatus), Kashmir flycatcher (Ficedula subrubra), etc;
AND WHEREAS, the area of Thajwas Wildlife (Baltal) Sanctuary is covered mostly under thick snow, round the year. The tree species such asAbies pindrow, Betula ultilis, Juglans regia and Picea sp. constitute the major assemblage of tree flora. Indigofera hetranth, Berberies lycicum, and Rosa webbiana constitute the major shrub cover of the area. The important faunal species of the area are grey langur (Presbytis entellus), Rhesus macaque (Macaca mulatta), common leopard (Panthera pardus), snow leopard (Panther unica), leopard cat (Felis bengalensis), jackal (Canis aureus), red fox (Vulpes vulpes), Himalayan brown bear (Ursus arctos), Asiatic black bear (Ursus thibetanus), Yellow throated martin (Martis flavigula), long-tailed marmot (Mannota bobak), Royle’s pika (Ochotona roylei), Asiatic ibex (Capra sibrica), Kashmir musk deer (Moschus cupreus) etc;
AND WHEREAS, due to variation in altitude, aspect and soil, a diversity of vegetation is discernible in the Overa-Aru Wildlife Sanctuary. The vegetation of the Sanctuary is mainly fir (Abis pindrow) with kail (Pinus wallichiana) in the lower elevations near Nallas. On varied physical variations the forest types found are Riverian Vegetation (1600-2300meters above mean sea level), Coniferous Forests:(2300-3000 meters above mean sea level), Alpine Scrubs and Pastures:(Beyond 3000-3500meters above mean sea level), Rock Faces:(Beyond 3500meters above mean sea level). The Overa-Aru forests are blessed with numerous plant species of great medicinal value.Some of the medical plants growing wild in the area include Aconitum heterophyllum, Arnebia benthamii, Artemisia absinthium, Berberis lycium, Bergenia lingulata, Datura stramonium, Dioscore adeltoidea, Lavatera cashmeriana, Saussurea costus and Taxus wallichina;
AND WHEREAS, the Overa-Aru Wildlife Sanctuary falls in the North-West province (Province 2A) of the Himalayan Zone as per the bio-geographic demarcation by Rodgers and Panwar (1998). This province includes the whole Kashmir valley, characterized by temperate and sub-tropical climate Kashmiri stag or hangul (Cervus hanglu hanglu), Kashmir musk deer (Moschus cupreus), Himalayan black bear (Ursus thibetanus), Himalayan brown bear (Ursus arctos), common leopard (Panthera pardus), Himalayan grey langur (Presbytis ajax), Rhesus macaque(Macaca mulata), red fox (Vulpus vulpes), brown musk shrew (Crocidura murina), yellow throated martin (Martes flavigula), long-tailed marmot (Marmot himaliyana), Kashmir vampire(Mergaderma spectrum), Leisler’s Hairy – armed bat (Nyctalus lessleri), Kashmir house rat(Rattus rattus), birch mouse (Sicista indica), Kashmir flying squirrel (Eoglaucomys fimbriatus), serow (Capricornis sumatraensis thar), Roule’s pika (Ochotona royelii), Himalayan griffon vulture (Gyps himalayensis), bearded vulture (Gypaetus barbatus), Kashmir flycatcher (Ficedula subrubra) etc;
AND WHEREAS, the natural boundaries of Dachigam National Park, Overa-Aru Wildlife Sanctuary and Thajwas Wildlife (Baltal) Sanctuary are connected at landscape level. The boundary of Dachigam National Park on North and North Eastern side merges with Overa-Aru Wildlife Sanctuary while as Overa–Aru Wildlife Sanctuary on its North and North-Eastern side merges with Thajwas Wildlife Sanctuary. The protected areas together form a landscape of rich biodiversity and hold good population of some of the important/endemic species of animals, birds and vegetation. The Eco-sensitive zone proposed makes these areas as one unit and will help gene flow across these areas to flourish the biodiversity;
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of Dachigam National Park, Thajwas (Baltal) Wildlife Sanctuary and Overa-Aru Wildlife Sanctuary which are specified in paragraph 1 as Eco-Sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-Sensitive Zone;
NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act), read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area of 200 meters to 13.15 kilometers from the boundary of Dachigam National Park, Thajwas (Baltal) Wildlife Sanctuary and Overa-Aru Wildlife Sanctuary, in the Union territory of Jammu and Kashmir as ‘Dachigam National Park, Thajwas (Baltal) Wildlife Sanctuary and Overa- Aru Wildlife Sanctuary Eco-sensitive Zone’ (hereafter in this notification referred to as the Eco-sensitive Zone), the [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 29 details of which are specified in paragraph 1, for the purpose of protecting and improving the quality of environment and preventing, controlling and abating environment pollution and takes the following measures, namely:
1. Extent and boundaries of Eco-Sensitive Zone. – (1) The extent of Eco-Sensitive Zone shall be of 200 m to 13.15 km from the boundary of Dachigam National Park, Thajwas (Baltal) Wildlife Sanctuary and Overa- Aru Wildlife Sanctuary and comprising of an Eco-sensitive Zone area of 448.00 sq.km and the extent of Ecosensitive Zone in different directions (kilometres) are as given below: - Direction Extent Location West 200 m PWD Water Tank and Reservoir South 13.15 km Khrew CR Boundary South-West 5.0 km Khanmoh CR Boundary South-East 1.0 km Mamal Forest, Lidder Nala East 1.0 km Nichhang, Alpine pasture North- East 1.0 km Serbal Village,Sindh Forest North 1.0 km Forest of Sindh North-West 4.0 km Lidwas, Alpine Pasture Dara CR Boundary
(2) The boundary description of the Dachigam National Park, Thajwas (Baltal) Wildlife Sanctuary and Overa-Aru Wildlife Sanctuary and its Eco-Sensitive Zone is appended as Annexure-I.
(3) The maps of the Dachigam National Park, Thajwas (Baltal) Wildlife Sanctuary and Overa-Aru Wildlife Sanctuary demarcating Eco-Sensitive Zone along with boundary details and latitudes and longitudes are appended as Annexure-IIA, Annexure-IIB, Annexure-II C, Annexure-IID and Annexure-II E respectively.
(4) Lists of geo co-ordinates of the boundary of Dachigam National Park, Thajwas (Baltal) Wildlife Sanctuary and Overa-Aru Wildlife Sanctuary and Eco-Sensitive Zone are given in Table A and Table B of Annexure- III.
(5) The list of villages falling in the Eco-Sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure-IV.
2. Zonal Master Plan for Eco-Sensitive Zone - (1) The Union territory administration shall, for the purposes of the Eco-Sensitive Zone prepare and notify a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people.
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared in the manner as specified in this notification and also in consonance with the relevant Central and laws for the time being inforce and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the Union territory administration, for integrating the ecological and environmental considerations into the said plan, namely: -
(i) Environment;
(ii) Forests;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation & Flood Control;

(ix) Pollution Control Board;
(x) Municipality;
(xi) Panchayati Raj; and
(xii) Public Works Department.
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall regulate development in Eco-Sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities’ livelihood.
(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
(9) The Zonal Master Plan so proposed and notified shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.
3. Measures to be taken by the Union Territory Government -The Union territory administration shall take the measures for giving effect to the provisions of this notification, namely: -
(1) Land use – (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-Sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities:
Provided that the conversion of agricultural and other lands, for the purposes other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or Union territory administration as applicable and provisions of this notification, to meet the residential needs of the local residents and for activities such as-
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and
(v) promoted activities given in paragraph 4:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the Union territory administration and without compliance of the provisions of Article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-Sensitive Zone shall be corrected by the Union territory administration, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:

Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph.
(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural water bodies-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the Union Territory Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Tourism or eco-tourism - (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be as per the Tourism Master Plan for the Eco- Sensitive Zone.
(b) The Tourism Master Plan shall be prepared by the Department of Tourism, Union territory administration in consultation with the Departments of Environment and Forests of the Union Territory.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The Tourism Master Plan shall be drawn based on carrying capacity study of the Eco- Sensitive Zone.
(e) The activities of eco-tourism shall be regulated as under, namely: -
(i) Establishment of new hotels and resorts shall be permitted only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;
(ii) A Committee comprising of the Principal Secretary (Environment and Forests), Chairman, Pollution Control Committee, an expert each in ecology and environment and civil constructions from an institute of repute such as IIT, Jammu, and a representative from the Department of Environment and Forests, shall be constituted for suggesting the environmental safeguards or measures for new construction of hotels and resorts, which shall form a component of the Tourism Master Plan. The said Committee shall put in place a risk assessment study on landslide, slope stability and seismicity and recommend environmental friendly and safe construction measures to be adopted.
(iii) all new tourism activities or expansion of existing tourism activities within the Eco- Sensitive Zone shall be in accordance with the guidelines issued by the Central Government and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on ecotourism, eco- education and eco-development;
(iv) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the regulatory authorities concerned based on the actual site specific scrutiny and recommendation of the Monitoring Committee.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-Sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-Sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan.
(6) Noise pollution.- Prevention and control of noise pollution in the Eco-Sensitive Zone shall be carried out in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 and as amended from time to time under the Environment.
(7) Air pollution.- Prevention and control of air pollution in the Eco-Sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made there under.

(8) Discharge of effluents.- Discharge of treated effluent in Eco-Sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made there under or standards stipulated by the Union territory Government, whichever is more stringent.
(9) Solid wastes.-Disposal and Management of solid wastes shall be as under:-
(a) the solid waste disposal and management in the Eco-Sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules 2016, and the rules made there under. The inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-Sensitive Zone;
(b) safe and Environmentally Sound Management of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone.
(10) Bio-Medical Waste.– Bio-Medical Waste Management shall be as under: -
(a) the Bio-Medical Waste disposal in the Eco-Sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 and the rules made there under.
(b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco- Sensitive Zone.
(11) Plastic waste management.- The plastic waste management in the Eco-Sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 and the rules made there under
(12) Construction and Demolition waste management.- The construction and demolition waste management in the Eco-Sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules and as amended from time to time.
(13) E-waste.- The e - waste management in the Eco-Sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016 and the rules made there under
(14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the competent authority in the Union territory Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(15) Vehicular pollution .- Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels.
(16) Industrial units.– (a), No new polluting industries shall be permitted to be set up within the Eco- Sensitive Zone on or after the publication of this notification in the Official Gazette.
(b) Only non-polluting industries shall be allowed within Eco-Sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time unless so specified in this notification, and in addition, the non-polluting cottage industries shall be promoted.
(17) Protection of hill slopes.- The protection of hill slopes shall be as under: -
(a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;
(b) Construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted.
4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 the rules made there under and other notifications, laws and acts of the Government of India pertaining to environment, forests and wildlife, in the erstwhile Ministry of Environment and Forest, vide number 1533(E), dated the 14th September, 2006 and laws for the time being in force in the manner and as amended from time to time specified in the Table below, namely:- [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 33 TABLE Sl. (b) The mining operations shall be carried out in accordance with the order (s) of the Hon’ble Supreme Court in the matter of T.N.
Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012 and IA No. 1000 of 2003 judgment dated 03.06.2022 and subsequent IA No. 131377 of 2022 judgment dated 26.04.2023 and 28.04.2023 espand.
2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.).
New industries and expansion of existing polluting industries in the Eco-sensitive Zone shall not be permitted:
Provided that, non-polluting industries shall be allowed within Eco- Sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification and in addition, the non-polluting cottage industries shall be promoted.
3. Establishment of major hydroelectric project.
Prohibited.
4. Use or production or processing of any hazardous substance.
Prohibited.
5. Discharge of untreated effluents in natural water bodies or land area.
Prohibited.
6. Setting up of new saw mills. New or expansion of existing saw mills shall not be permitted within the Eco-sensitive Zone.
7. Setting up of brick kilns. Prohibited.
8. Undertaking other activities related to tourism like over flying over the Eco-sensitive Zone area by hot air balloon, helicopter, drones, Microlites, etc.
Prohibited.

9. Commercial use of Firewood Prohibited.
B. Regulated Activities
10. Commercial establishment of hotels and resorts.
Construction of new hotels and resorts and expansion of existing shall be strictly in accordance with the approved Master Plan, which takes care of habitats allowing no restriction on movement of wild animals and in conformity with the provisions prescribed in subparagraph (e) of paragraph 6.
11. Construction activities. (a) New commercial construction of any kind other than new hotels and resorts as regulated at serial number 10 above, shall not be permitted within one kilometer from the boundary of the Protected Area or upto extent of the Eco-Sensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 3 as per building byelaws to meet the residential needs of the local residents:
Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.
(b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan.
12. Small scale nonpolluting industries.
Non-polluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016, as amended from time to time, and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority.
13. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the Union territory administration.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or Union territory administration Act and the rules made there under.
14. Collection of Forest Produce or Non-Timber Forest Produce.
Regulated under applicable laws.
15. Erection of electrical and communication towers and laying of cables and other infrastructures.
Regulated under applicable laws of underground cabling may be promoted.
16. Infrastructure including civic amenities.
Taking measures of mitigation, as per applicable laws, rules and regulation and available guidelines.
17. Widening and strengthening of existing roads and construction of new roads.

6. Functions of the Monitoring Committee : (1) The Monitoring Committee shall, based on the actual sitespecific conditions scrutinize, the activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1553 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, and referred to the Central Government in the Ministry of Environment, Forest and Climate Change or the State Environment Impact Assessment Authority, as the case maybe, for prior environmental clearances under the provisions of the said notification.
(2) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 37 specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.
(3) The Member Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(4) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue-to-issue basis.
(5) The Monitoring Committee shall submit the annual action taken report of its activities as on 31 st March of every year by 30 th June of that year to the Chief Wildlife Warden in the state as per proforma appended at Annexure V.
(6) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
Additional measures -The Central Government and Union Territory Government may specify additional measures, if any, for giving effect to provisions of this notification.
