Section 41: Inquiry and award

On the date fixed under section 40 or on such other date to which inquiry may be adjourned, the officer concerned shall, after holding a formal inquiry in the manner provided by the Goa, Daman and Diu Land Revenue Code, 1968 (9 of 1969) and after hearing the objections, if any, stated by the persons as required by the notice under section 40 make an award, which shall specify,— Manual of Goa Laws (Vol. II) – 720 – Irrigation Act and Rules

(a) the lands under irrigable command of the canal,

(b) the increase in value of such lands by the completion of the construction of a new canal or the improvement or extension of an existing canal,

(c) the amount of betterment charges leviable on each of the land,

(d) the date from which the betterment charges shall be leviable:

Provided that no betterment charges shall be leviable in respect of any land which is unarable (kharaba).
