NOTIFICATION In e,;ercise of the powers con ferred under sub-section (2) of section 6 of Indian Port Act 1908 (Central Act XV of 1908). the Administrator of Daman and Diu and DNH hereby makes the following Rules and funner to amend the Goa, Daman end Diu Port Rules, 1983 namely:-
1. (i) These rules may be called Damen and Diu Amendment Port Rules
1999.
fii) They shall come Into force on the dale of their pubncation In the OffICial Gazette.
2. In the Goa, Daman and Diu Port Rules, 1983 (here in after referred to as lt1e Principal Rule).
(A) In Rule 64 for Schedule 1,5 &. 6 the foHowil'lg Schedule shall be substitu ted namely :- \ •

1. Annual License Fees:-
(a) Inland Non-Mechanized Craft
(i) Upto 2.00 tons per annum Rs. l21- (II) Above 2.00 Ions and upto RS.161-
5.00 tons per annum {iiI Above 5.00 tons and upto Rs.20f-
10.00 tons per annum (iM) Above 10.00 tons and uPIO Rs.301-
25.00 tons per annum (Iv) Above 25.00 tons FlI"St 25 Rs.35,1- tons per annum Every addition 20 tons per annum Rs.05l· NOTE: The license Fees for the Craft shall be levied 20% less as shown above if the vessel Is registered in Daman and Diu Ports.
Bonds, Sureties, etc. each Rs. 101- Change of T1ndel 01 a Craft each Rs. 101- (B) In Rule 64 for Schedule No.7 to 20 and Schedule No25 and 54, Port Dues and other fees shall be levied at all the Potts, 30% mOfe as specified in the said schedule.
(C) In Rule 64 for Schedule No. 22 to 25 as well as 27 10 53 and 55 Port dues and other fees shall be levied al aU ports, 50% more as specified In the said schedule.
(0) In Rule 64 for Schedule No.21, the Port duas and other fees shall be lavled at all Ports 30%, es specified In sub-schedule (1) to (4) and the following sub-schedule In the sekl schedule of 21 shall be added ;-

(II) If any Meehanlcalty propelled vehide bringing or removing goods to or from or plying lor hire within the Port premises enters In the Port without license, temporary permit .shall be iSsued on payment of Rs.101- pet'vehlcle per clay.
(F) In Rule 37, the following shall be substituted namely:-
37. Appe.l.g.lnst ordtr 01 the Port Authority :- An Appeal aoains! an ord&r of the Port Authority undBf these rules lie to the Secretary Transport to the U.T. Aclminlslnltion of Daman and Diu and ONH, Secretarial, Mati-Oaman. Every such appeal shan be preferred In wrt\ing fourteen days from the date on which the on:ler of the Port Authority has been communicated In wriijng to the person concemed.
The decision of the Secretary Transport to the U.T. AdminiStration of Daman and Diu and DNH thereon shall be fmaland binding.
Provided thai the Secretary Transport to the U.T.
Administration of Daman & Diu and DNH may entertain the appeal after the expiry of the said period of fourteen days If he is satisfied that the appellant was prevented by sufflcieflt cause from fdling the apPeal In ~me.

(H) After Rule 65, the following rule shall be inserted, namely :- 56- Impropet1y dischuglng Ball .. t or Rubbish :- Any person who by himself or another so casts or throws any ballast or rubbish or any such other thing (or so discharged any oU or watermlxed with oil) and the master of any vessel from which the same Is so cost (Thrown or discharged) shall be punishable with fine which may extend to (Five Lekh IlJpees) which may Impose by the Port Authortty by an order.
