No. 4/4/2007/UD/21234.� The following Bye-laws titled the New Delhi Municipal Council (Licensing and Control of Plumbers) Bye-Laws, 2008 made by the New Delhi Municipal Council under the head 'R. B·;e-laws relating to water supply, drainage and sewage collection" in sub-section (1) of section 388 read with sub-sections ( 4), (7) and (8) of section 193 of the New Delhi Municipal Council Act, 1994 (44 of 1994)1 vide Council's resolution No. 11(A- 29) dated the 22nd August, 2007, after previous publication and with the prior approval of the Gov�rnment of National Capital Territory of Delhi, as required under section 391 of the said Act, are hereby published for general Information, namely:-

1. Short title and commencement.-- (1) These Bye-laws may be called the New Delhi Municipal Council (Licensing and Contr9l of Plumbers) Bye- Laws) 2008.
(2) They shall come into force from the date of their publication in the Delhi Gazette.
2; Definitions.-- (1) In these bye-laws, unless the context otherwise requires, -
(a) '\Act" means· the New Delhi Municipal Council Act,· 1994
(b) (44 of 1994); \ �'competen't authority" me�ns any municipal officer or other municipal employee specified, by order, by the Chairperson, who i .
s charged with the responsibility of implementation of these bye-laws.
(c) "Form" means a form appended to these bye-laws;
(d) "licence" means a licence granted by the competent authority to a plumber for undertaking sanitary and filtered water supply works,
(e) "plumber" means a firm or individual who can undertake execution .of sanitary and filtered water supply works;
(f) "section" means a section of the Act.
· (2) Words and expressions used herein but not defined and defined in the Act shall have the meanings assigned to them in the Act.

3. Licensing of plumbers - (1) Ev ry plumber shall obtain a licence from the competent authority before carrying out works connected with drainage and filtered water supply of any premises in New Delhi.

4. Application form.- An application for the grant of a licence shall be submitted to the competent authority in the Form-'A'.
5. · Qualifications necessary for gr,ant of licence.- A candidate must-
(i) (a) be a' qualified · ITI plumber, or a diploma or a degree holder in civil engineering from a recognized Institution; or \
(b) have passed 12th class of a recognized Board and have a minimum three years experience of execution of sanitation or water plumbing works in any Government department, local body, licensed architect or licensed engineer; and
(ii) have smoke testing machine or hydraulic machine in proper working order.

6. Scrutiny of applications and holding of tests. - The competent authority shall arrange scrutiny of all applications received and may, if it considers it necessary, for reasons to be recorded in writing, conduct written and oral tests for judging the suitability for grant of a license, only of those applicants whose applications are found to be in order, in accordance with bye-law 5. Such a test may be held as and when considered necessary by the competent authority.
7. Approval of competent authority.- After the application of an applicant for the grant of a ncence has been approved by the competent authority, he shall be informed in writing that his application has been approved and that he should deposit licence fee ' .

Security deposit and licence fee.- (1) The ap'plicant shall make the security deposit and pay the fee at such rates which shall·not be .
less than the following, as may be determined, from time to time, by the Council :-
(a) Security Deposit
(b) Licence fee ( for the duration of the licence) Five thousand rupees.
Two thousand rupees.
(2) The security deposit and the licence fee shall be payable in the shape of Demand Draft in favour of "The New Delhi Municipal Council".
(3) If the applicant fails to deposit the prescribed security deposit or pay the prescribed licence fee within one month from the date on which intimation was sent to him that his application had been approved, his application shall be deemed to have been rejected.

list of licensed plumbers.- (1) A list of licenced plumbers �giving name, address, phone numbers and date upto which the licence is - valid, shall be displayed on the Notice Board of the office of the Executive Engineer(Water Supply) of the Council.
(2) The list so maintained shall be up-dated every quarter, i.e.
before the end of the first week of Januar-Y, April, July and October, every year.
12. - Duration of licence and issue of duplicate licence in - case of loss etc. - (1) Every licence granted under these bye-laws shall be valid ·for a period of five years- from the date of its issue ..
(2) After the expiry of the duration of the licence, an application for grant of a fresh licence may be submitted in Form 'A' as per procedure outlined above, or an application for renewal of the existing license may be submitted:
Provided that no fresh security deposit shall be necessary in the case of -an application for the renewal of the_ existing licence:
Provided further that if the licensee applies for the renewal of the existing licence with in a J)t::rioa of iess than thirty days before its ' DELI-II GAZETTE: EXTRAORDINARY expiry, no written or oral test, referred to in bye-law 6, shall, ordinarily, be conducted in his case.
(3) ·if the licence has been lost, the licensee shall make a report of the. same to police authorities and the Chairperson may, if satisfied and after holding such enquiries as he may think fit, issue a duplicate copy of the licence after charging such fees as are specified by him, from time to time, by order ..
13. Charges for plumbing work, etc.- ( 1) No licensed plumber shall, for any work done by him under or for any of the purposes under the Act or: the rules or bye-laws made thereunder demand or receive more . ' than the charges prescribed, from time to time , by the Council.
(2) A copy of the list of charges referred to in sub-bye-law · (1) above shall be qVailable free of charge in the office of the Executive Engineer (Water Supply) or the Executive Engineer (Sewerage), of the Council, as the case _may be.
14. Inspection and control on plumbers.- (1) The Chairperson may at any time without notice, inspect any work done by a licensed plumber or his place of business.
(2) Adequate control on all the licensed plumbers shall be exercised by the competent authority.
15. . Work to be done diligently and in workman like manner. Every licensed plumber shall execute the work undertaken by him diligently and in a proper workman-like manner and shall not cause any delay in the execution thereof without sufficient cause. He shall not contravene any bye-laws made in this behalf.

16. Pipes and fittings to be approved.- In execution of any work no pipes, fittings, appliances or material shal l be used unless the same are of specified standard duly approved by the Chairperson.

I Other obligations of licensed plumbers. - (1) Every licensed plumber shall report to the 'ChairJ}�rson any defect noticed by him in any ,premises or building in regard to any water pipe, fitting or other appliance causing wastage of water or in connection with any drain, water closet, privy, urinal or any fitting, appliance connected therewith rendering such drain, privy or urinal insufficient or otherwise objectionable for sanitary reasons.
(2) A licensed plumber, in all matters in which he may be employed, shall afford ever.; assistance in his power to the Chairperson . .
in �arrying out and enforcing the bye�laws and orders br the time being in force.
(3) A licensed plumber shall, in every work in which he may be employed, comply 'with the �ye-laws in force and such orders as may be issued by the Chairporson and are applicable · to the circumstances of the case.
19. licence not transferable.� The licence issued to a plumber shall not be transferable and no licensed plumber shall allow his name to be used by another p.erson either for the purpose of obtaining permit or for doing business under his licence.

20. Suspension and cancellation of licence.- The licence issued under these bye-laws. may at any time be suspended or cancelled by ' the competent authority if it is satisfied that it has been secured thrQugh mis-representation or fraud� or the licensee has indulged in breach of any condition of the licence or any provision of these bye laws or if it is satisfied that the licensed plumber has executed . carelessly or negligently any work or has made use ·of bad materials, appliances or fittings. In the. event of cancellation, such plumber shall not be entitled to the refund of security or any portion of the licence fee. The person whose licence has been cancelled shall not be .
permitted to apply for a licence again within two years from the date of . such cancellation:

Provided that---- , .Ca) . before making · any order of suspension or cancellation reasonable opportunity shall be accorded to the licensee;
and .
(b) every such order shall contain a brief statement of.
reasons for the suspension or cancellation.
21. Surrender of licence.- If any licensed plumber desires to surrender his licence due to any rea�on he shall surrender his licence for cancellation to the competent authority and he will' have to clear _all the .
. ' · dues. No r�fund in respect of licen·ce fee shall be allowed, but the amount of the security deposit, after adjustment, if any, is liable to be refunded.
22. Hearing and disposal of complaints.- All complaints made by the owner or occupier of premises and received in the office of the Council with regard to the quality of work done, material used, delay in execution of work or the chqrges made, by a licensed plumber shall be . .
heard and decided by the competent authority, after observing, as far as possible, the rules of natural justice.

23. Penalty.- Whoe ve r contravenes any provision of these bye-, To laws shall be liable for punishment in accordance with the provisions of section 390 and 1 or cancellation of his licence.

1. Short title and commencement. - (1) These bye-laws may be cal led the "New Delh i Municipal Counci l (Execution of Contracts) Bye-laws, 2008."

(2) They shal l come into force on the date of their publ ication in the Delh i Gazette .
2. Definitions. In · these bye-laws, unless the context otherwise requ i res,--
(a) "Act" means the New Delh i Municipal Counci l Act, 1994 (44 of 1994);and
(b) "section" means a section of the Act .
. 3 . Provision in respect of contract. - ( 1 ) Every contract entered into by the Cha i rperson on behalf of the Counci l shal l be entered i nto such manner and form as would b ind h im if such contract were made on his own ber1a lf and may i n the l ike manr'er and form be va ried or d ischarond :

Provided that the contract may be signed by the 01a i rperson or by a ny municipa l officer authorized by h im in this beha lf:
Provided further that.-
(a) · the common seal for the Counci l shal l be affixed to every co1 1 U deL involving an expenditure exceeding . Rs. 50,00,000 (Rupees fifty lakh) only or any instrument exceeding the said amount; and
(b) every contract for the execution of any work or the supply of any materials or. goods which wil l i nvolve an expenditure exceeding Rs.

15,000/- (Rupees fifteen thousand) only or such h igher amount as the Council may from time to time fix, and every contract or other instrument relating to the acquisition of immovable property, shall \ be in writing and shall specify -- .
( i) the work to be done or the materials or goods to be suppl ied qr the immovable property to be acquired, as the case may be;
(U) the price ·to be paid for any such work, materia ls, goods or immovable property; and . ' .
(i i i) in the case of a contract for works or for supplies, · the period with in which the contract or specified portion thereof shal l be carried out.
(2) The common seal of the Council sha l l remain in the custody of the Secretary of-the Council or any other municipal officer authorized by him in this behalf and shal l be affixed to .every contract or other instrument, referred to in clause (a) of the second proviso to sub-byelaw ( 1) .

· (4) Notwithstanding anything contained in sub-clause (b) of the second proviso to sub-bye-law (1) , it shall be lawful for - , ( i ) the Counci l to authorize the Chairperson to enter i nto a contract -for the supply of any materia ls or goods without the execution of a written contract for reasons which shall be recorded in the proceedings of the Counci l ;
( i i ) the Chai rperson to dispense with the execution of a written contract _relating to the execution of any work or the supply of any materials or goods, i f such work has already been performed or the materials or goods have a lready been suppl ied to h is satisfaction.
