FlO (13)1 Env/2015/1610-1632 dated 04.03.2016 issued by Department of Environment, Govt. of NCT of Delhi in compliance of the Hon'ble Supreme. Court's orders dated 09.10.2015 and 16.12.2015 regarding Environment Compensation Charge (ECC)'and in pursuance of directions of the Environment Pollution (Prevention and Control) Authority (EPCA) as per minutes of meeting held on 10.03.2016 the following decisions are hereby notified:

I. The toll collector shall flash the vehicle number of the violator, who do not comply with notifications on levy of Environment Compensation Charge, on Police Control, Room No. 100 immediately after the incident.

2. The toll collector shall file a FIR at the concerned police station and the police .shall take appropriate action at the earliest.

3. If a vehicle is caught either without paying ECC/ nor-destined to Delhi/ pre-2006 registered, then a fine of 10 times of the applicable ECC shall be impoSed. In cas� the offence of unauthorized entry is committed more than three times. the vehicle shall be impounded for a minimum period of 01 month and the Registration Certificate of the vehicle wifl be suspended.

No. 6/59/2002/DISMH/Admn/1356 - In exercise of the powers conferred under article 309 of the Constitution of India read with the Government of India, Ministry of Home Affairs O.M. No. 24/78/68-DH(S), dated the 24th September, 1968 and in supersession of the Delhi Health Service Rules of General Duty Medical Officer (Indian System of Medicine) Rules 2012 notified on 31'1 December, 2012 except as respects things done or omirted to be done before such supersession, the Lt. Governor of the National Capital Territory of Delhi, after prior consultation with the Union Pubiic service Commi�sion, is pieased to frame the Delhi Health Services Rules of General Duty Medical Officer (Indian System of Medicine), in the Directorate of A YUSH, under the Health and Family Welfare Department, Government of the National Capital Territory of Delhi, namely:- I. Short title and commencement.- (i) These rules may be called the Delhi Health Services Rules of General Duty Medical Officer (Indian System of Medicine), 2016

(ii) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions.- In these rules, unless the context otherwise requires,-

(a) 4'Commissioq" means the Union Public. Service Commission;

(t::) HDevarhncnhti Prumuiion Committee" means a Group ''A" Departmentai Promotion Committee specified i� the Schedule IV for considering cases of promotion or confirmation in Group "A" posts of the service;

(d) �·outy Post" means any post, whether permanent or temporary, specified in the Schedule- II;

(e) "Government'"" m_eans the Lt Governor of the National Capital Territofy of Delhi appuint�;;d by th�;;

President under article. 239 and designated as such under article 239 AA of the Constitution;

(!) "Grade" means any of the grades specified in the Schedule-!;

(g) "Schedule" means a Schedule appended to these rules; and

(h) "Service" means the Delhi Health Service of General Duty Medical Officer Indian System of Medicine.

3. Constitution of Service.-There shall be constituted a Service known as the Delhi Health Service of General Duty Medical Otficers Indian System of Medicine (Group 'A') consisting of persons, appointed under rule 7 of these rules.

4. Composition of the Servic_e.-AII duty posts, included in the Service shall be classified as General Central Civil Service Group '"A" Gazetted; non-ministerial and the grades. scales of pay, non-practicing allowance and other matters connected therewith shall be aS: specified in Schedule- L

5. Authorized Strength of the Service.-(1) The aut!10rized strength of the duty posts included in the various grades of the Service on the date of commencement of these rules shall be as specified in the Schedule- II.

(2) After the commencement of these rules, the authorized permanent strength of the duty posts in the various grades shall be such as may from time to time be determined by the Government.

(3) The Government may make temporary addition to, or reduction in the strength of the duty posts in the various grades as deemed necessary from time to time.

(4) The Government may, in consultation with the Commission, include in the Service any post other than those included in Schedule- ll or exclude from the Service a post included in the said Schedule.

(5) The Govcr�ment may, in cOnsultation with the Commission, appoint an officer whose post is included in the Service under sub-rule (4), to the appropriate grade of the Service in a temporary capacity or in a substantive capacily, as 91ay be deemed fit, and fix his seniority in the grade after taking into account "continuous regular service in the analogous grade.

(6) Five percent of the total number of posts of the Senior Medical Officers and. Chief Medical Officers shall be included in the Service as "leave reserve'�.

6, Members-of the Service.-(1) The following persOns shall be members of the Service, namely

(b) persons appointed to duty posts under rule 7;

(2) A person appointed under clause (b) of sub-rule (1) shall, on such appointment, be deemed to be the member of the Service in the appropria\e-Grade applicable to him in the Schedule- II.

(3) A person appointed under clause (c) of sub- rule (I) shall, be the Member of the Service in the appropriate grade applicable to him in the Schedule- II from the date of such appointment.

7. Future Maintenance of Service.-(!) The vacancies in any of the grades referred to in the Schedule- II shall be filled in the manner as hereinaf.ier provided under these rules.

(2) The -method of recruitment, the field of selection for promotion including the minimum qualifying service in the .immediate lower grade for appointment or promotion to the posts in the respective sub­ . cadres shall be as specified in the Schedule- Ill.

(3) (a) The Departmental Promotions shall be confined to officers of the cadres.

(b) The Departmental Promotions to higher posts shall be made on the basis of selection from amongst the officers of the Service in the immedi_ ate lower grade on the recommendations of the Departmental Promotion Committee constituted as at the Schedule- IV.

(5) . (a) Except while appointing a serving officer on non-selection basis (seniority -<:urn fitness), the sel�ction of officers for maintenance of the service shall be made in consultation with the Commission, and wherever necessary, on the basj.s/of the recommendation made by the Departmenta1 Promotion Committee as specified. in the S'?hedule--- �V.

- (� {a)The minimum educational and other qualification, experience and age limit for appointment of various duty posts in the Service by direct recruitment shall be as specified in the Schedule-- V.

(b)The promotion to the grades (other than entry grades) mentioned above shall be without linkage to vacancies.

(6) For functional purposes.-( a) A Senior Medical Officer when posted in a Dispensary/Hospital or in the Directorate of A YUSH shall be designated as Senior Medical Officer or as Assistant Director as the case may be.

(b) A Chief Medical Officer when posted in a Dispensary/Hospital or in the Directorate of Indian System of Medicine and Homoeopathy shall be designated as Chief Medical Officer, or as Deputy Director as the case may be.

(c) The existing Assistant Director in the scale of pay Rs. 10,000 -15,200/- plus NPA(pre-revised)/ Rs. 15,600-39,100/- plus Grade pay Rs 6600/- (revised) plus NPA and Deputy Director in the scale of · pay of Rs. 12,000-16,500/- (pre revised)/ Rs 15,600-39,100/- plus Grade pay Rs 7600/-(revised) plus NPA, shall be deemed to have been included in the General Duty Medical Officers Cadre at the level of Senior Medical Officers in the scale of pay Rs. 10,000 - 15,200/- plus NPA(pre-revised)/ Rs. 15,600- 39,100/- plus Grade pay Rs. 6600/- (revised) plus NPA and Chief Medical Otlicer in the scale of pay of Rs. 12,000-16,500/- (pre revised)/ Rs. 15,600-39,100/- plus Grade pay Rs. 7600/-(revised) plus NPA respectively. The Assistant Director, so ilicluded in the General Duty Medical Officers Cadre at the level of Senior Medical Officers shall be eligible to be considered for appointment as Chief Medical Officers in the scale of pay of Rs. 12,000-16,500/- (pre revised)/ Rs. 15,600-39, I 00/- plus Grade pay Rs. 7600/-(revised) plus NPA on completion of five years of regular service as Assistant Director. The Deputy Director, so included in th� General Duty Medical Officers Cadre at the level of Chief Medical Ofticer shall be eligible to be considered for appointment in the grade of Chief Medical Officer (Non­ functional Selection Grade) in the scale of pay ofRs. 14,300-18,300/- plus NPA (pre revised)/ PB IV, Rs. 37,400-67,000/- plus Grade Pay Rs 8700/- plus NPA (revised) on completion of four years regular service in the grade.

(d) The Chief Medical Officer (NFSG) in the scale of pay of Rs. 14,300- 18,300/- plus NPA (pre-revised)/ PB-IV 37,400-67,000/- plus Grade Pay Rs. 8700/- plus NPA (revised) on completion of the seven years in Grade Pay of Rs. 8700/- in PB IV including service rendered in the pre-revised scale of Rs. 14,300- 18,300/- or twenty years of regular service shall be promoted to Senior Administrative Grade in the pay scale of Rs. 14,300-18,300/- plus NPA (pre-revised)/ PB IV, Rs. 37,400- 67,000/- plus Grade Pay Rs.

10,000/- plus NPA (revised).

Seniority.-(a)The seniority of members of the service appointed to a grade at the time of initial constitution of the service under rule 6, shall be as obtaining on tfte date of commencement of these rules:

Provided that if the seniority of any such member had not been specifically determined on the said date, the same shall be determined on the basis of the rules governing the fixation of seniority as were applicable to the members of the Service prior to the commencement of these rules.

(b) The seniority of officers recruited to posts other than those appointed under rule 6 shall be determined in accordance with the orders issued by the Centra] Government in the matter from time to time.

(c) The seniority of persons recruited to the Service in accordance with sub-rule (5) of rule 5 shall be fixed in the matter provided therein.

(d) In cases not covered by the above provisions, seniority shaH be determined by the Government in consultation with the Commission.

Provided that the controlling authority may extend the period of probation in accordance with the instructions issued by Government from time to time:

Provided further that any decision for extension of a probation period shall be taken ordinarily within eight weeks after the e�piry of the previous probationary period an.d communicated in_ \Vriting to the concerned officer together with the reasons for so doing within the said period.

(2) On completion of the probation or any extension thereof, officers shall if considered fit, may be con finned against the post, if not already confirmed in the entry grade.

(3) If during the period of probation or any extension thereof, as the case may be Government is of the opinion that an officer is not fit for permanent �ppointment, Government may discharge or revert the officer to the post held by him prior to his appointment in the Service, as the case may be.

(4) During the period of probation, or any extension thereof candidates may be required by Government to undergo such courses of training and instructions and to pass such examinations and tests (including examination in Hindi) as Governtncnt may deem tit as condition for satisfactory completion of probation.

(5) As regards other matters relating to probation, the members of the Service will be governed by the in�ti-uctions isSued by the Government of India in this regard from time to time.

Appointment to the Service.- All appointments to the Seryice shaH be made by the Controlling Authority.

Liability for service and other conditions of service.- ( l) Officers appointed to the Service shall be liable to serve anywhere in Delhi.

(2) Private Practice prohibited:- i.Persons appointed io the service shall not be allowed private practice of any kind whatsoever including any consultation and laboratory practice.

ii.Such persons shall be entitled to a Non- practicing allowance at the rate specified in Schedule -I.

(3) The conditions of service of the members of the service in respect of matters not expressly provided for in these rules, shall, mutatis mutandis and subject to any special orders issued by the Gov�mrnent in respect of the Service, be the same as those applicable to Officers of the Central Civil Services in general.

Disqualification.- No person, shall be eligible for appointment to the Service,-

(i) who has entered into or contracted a marriage w_ith a person having a spouse living or

(ii) who, having a spouse living has entered into or contracted a marriage with any person:

Provided that the Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

Powers to relax.- Where the Government is of the opinion·that it is necessary or exp ' edient so w·da, it may, by order for- reasons to be recorded in writing, and in consultation with the Commission, relBx any of the provisions of these rules with respect to any class or category of persons.

Saving Clause.-- Nothing in these rules shall affect reservations, relaxation of age·limit and other concessions required to be provided for the Scheduled Caste, Schedule Tribes, other backward class! Ex· servicemen .and other special categories of persons in accordance with the orders issued by the Government from time to time in this regard.

15. Interpretation.· If any question relating to the interpretation of these rules arises, the Government shall decid� it in consultation with the Commission.

PART IV] DELHI GAZETTE : EXTRAORDINARY DEPARTMENT OF URBAN DEVELOPMENT ORDER Delhi, the 26th April, 2016 19 F.N0.13!73N-DFC/MB!UD!l016[643.-In exercise of the powers conferred by Section 3 of the Delhi Finance Commission Act, 1994 (Delhi Act 10 of 1994) and on the recommendation of the council of Ministers, the Lt.

Governor of the National Capital Territory of Delhi, hereby, constitutes the Fifth Finance Commission for the National Capital Territory of Delhi to cover the five financial years period 2016-2021 commencing from 1" April, 2016 (herein referred to as "the Commission"). The commission shall comprise of the following as Chairma.'1 a.'1d Member Secretary:- I . Shri Sudhir Krishna . 2. Shri K.R. Kishore Chairman Member Secretary The name of the other two members shall be notified separately by the Government.

2. The Chairman and Members of the Commission shall hold office for the period of 18 months commencing from the date of issue of notification constituting the Commission.

· 3 . The Chairman and Member Secretary shall render full time service.

4. The Commission shall review the financial position ofthe Municipalities and make recommendations as to -

(a) the principles which should govern

(i) the: distrib�1tion between the, Government of National Capita! Territory of Delhi and the Municipalities of the net proceeds of the taxes. duties. · tolls and fees leviable bv the government ofNationai Capitai TerritOry of Delhi which may be divided between them,

(ii) the determination of the taxes, duties, toiis and fees which may be assigned to the Municipalities. "" .

. (iii) · the grants-in-aid to the Municipalities from the Consolidated Fund of the National Capital Territory of Delhi, and {b) the measures needed to improve th� financial position of the Municipalities.

In making its recommendations, the Commission shall have regard, among other considerations, to ­ the overall resource position of the Government ofNational Capital Territory of Delhi;

the scope for economy in the municipal administration;

the scope 'for improvement in resource mobifization by the Municipalities;

tax effort made by the Municipalities;

adequate maintenance and upkeep of capital assets including those created or likely to be created under:

the Plan schemes till the end of March, 2016 (the expenditure provided therefor and the norms, if any, on the basis of which such expenditure is provided for maintenance of different categories of capital assets and the manner in which such maintenance expenditure could be monitored may be indicated), the requirements of t�c MunicipaJ bodies for modernization of administration (for example e­ govemance) and upgrading the standards of services (the detai�s for such expenditure provided for and manner fn which this could be monitored may be indicated).

6. The Commission may Review the functions assigned to Municipalities keeping in view the availability of resources, and the limitation of capacity especially with regard to the discretionary functions.

7. The Commission may make an assessment of th� debt position of Municipalities as on 3 1st March, 2016 and suggest such corrective measures as deemed necessary, keeping in view the financial- requirements of the Government of National Capital Territory of Delhi.

8. The Commission may make recommendations on the financial devolution _to the Delhi Cantonment Board out of .the Consolidated Fund of the National Capital Territory of Delhi, as a special case.

9. The Commission·must also focus on the following asP?cts which are essential for the long term strengthening of the local bodies:- i . securing effective linkages between asset creation and asset management, so that infrastructural services created are not only mai.ntained effectively but also become self-sustaining over time;

ii. scaling of delivery of civic amenities;

iii. Introduction of e-govemance applications in core functions of municipal bodies;

iv. Capacity building programmes for better financial management;

v. Accounting reforms, .adoption of double entry system and up-to-date accounting I audit system; and vi. e-procurem�nt and development of a well organized administrative system.

10. The Commission may in the first instance thoroughlY analyze the Internal and External Revenue position of the local bodies for the last 10 to 15 years and then make realistic projections on the basis of some assumptions and Additional Resources Mobilization based on revision ofrcites of tax and.rion-tax revenue.

11. The expenditures and revenues of local bodies to be assessed based on actual and normative expenditure needs. While assessing expenditure needs the differences among the local bodies in fiscal capacity and expenditure need may also be considered.

12. The GNCTD will also furnish their projections of Tax revenue and proposed capital investment under Plan on outgoing works and new works atter meeting the expenses of UNCTU under Non-Plan.

1 3 . A comprehensive approach to the assessment of expenditure needs by taking both Plan and non-Plan expenditure of .GNCTD may be adopted by the Commission before recommending the outgo of Tax revenUe in the form of BTA to local bodies.

14. The Commission may also study the present activities of local bodies and-see whether some of their functions i.e. Major HOspitals etc. can be transferred to GNCTD which may reduce their expenditure.

15. The Commission may also look into tlie scope for better fiscal management consistent with efficiency and economy in major components of recurring and nonrecurring items of expenditure of local bodies.

17. The Commission shall submit its report within 18 months from the date of issue of notification constituting the Commission on each of the matters aforesaid and covering a period of five financial years starting from April 1, 2016.

No. 4 of 1 99&) approved vide Competent Authority orders dated 1 2.02.20i5 and concurred by the Union Public Service Commission vide letter F. Nn. 3/24(3Y201 5-RR @ted 08.05.20 1 5 and in supersession of the Chemist recruitment and promotion regulations notified vide notification No. F. 9/30/81-LSG/7797 dated 26. 1 1 . 198 1, except as respects things done or omitted to be Qone before such supersession, the Regulations for recruitment to the post of Chemist in the Delhi Water Board, Delhi are hereby published, namely:-

1. Short liile and commencement - These Regulations may be called the Chemist in Delhi Jal Board Recruitment and promotion Regulation, 20-i 6.

· 2. Number of Posts, Classification and scale of pay · The number of posts, their classification and pay Band and Grade Pay/ scale of pay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these regulations.

3. Method of recruitment, age limit and other qualifications ·The method of recruitment, age limit, qualifications and other matters relating to the said posts� shall be as specified in columns 5 to 13 of the said Schedule.

4. Disqualifications - No person, -

(a) Who has entered into or contracted a n:'arriage with a person having a spouse living; or

(b) Who having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to any of the said posts:

Provided that Government may, if satisfied that such marriage is permissible under the personal law applicable to such persons and the other party to the marriage and that there are other grounds for so doing, exempt any persons from the operation for this regulation.

5. Power to Relax - Where the Government of National Capital Territory of Delhi is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving · Nothing in these Regulations shall affect reservations and other concessions required to be provided tOr the Scheduled Castes and Scheduled Tribes and other special categories of persons in accordance with orders issued by the Central Government from- time to time in this regard.

Promotion:- Assistant Chemist in PB·2 Rs. 930().34800/· with Grade Pay of Rs. 4600/· with 2 . years' regular service in the grade and have undergone one weeks training from Delhi jal Board Training Institute.

� Where juniors who have completed their qualifying/ eligibility service are being considered for prOmotion, their seniors would also be considered provided they are not short of the requisite qualifying/eligibility service by more than half of such qualifying/eligibility service, or two years, whichever is less, and have successfully completed their probation perjod for promotion to the next higher grade along-with their juniOrs who have already completed such qualifying/eligibility service.

Note: For the purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to 1 . 1 .2006, the date from which the revised pay structure based on the 61h ·CPC recommendations has been extended. shall be deemed to be service rendered in the corresponding grade pay/pay scale extended based on the recommendations of the pay !2.
