1. Short title and commencemeiot-1 I) These rules may be called the Delhi :vlctro Railway (Salary, Allowances, Other Terms and Conditions of Service of the Claims Commissioner) Rules, 2007.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Definitions.-(!) In these rules, unless the context otherwise requires:- {a) "Act" means the Delhi Metro Railway (Operation and Maintenance) Act, 2002 (60 of2002).
(b) "Claims Commissioner" means the Clailns Co1nmissioner appointed under Section 48 of the Act.
(c) ''section" means a secti(ln of the Act;
(2) All other words and expressions used herein but not defined shall have tlie same meanings respectively assigned to them in the Act.
3. Salary and allowances,-(!) The Claims Commissioner shall be entitled to such pay ,md allowances as are a<l1nissihlc to a J uclgc of a High Court :
Provided that in case of appointrncnt of a person as Clai1ns c:ommissioncr, who has retired as a Judge of a High Court and ,vho is in receipt of or has received or has becorne entitled to receive any retirement benefits, by 'w'ay of • ·1.. ' [ 'll'Til-l!� 3(i)J 3 pension, gratuity, employer's contribution to Contributory Provident Fund or other forms ofretirement benefits, the pay shall be reduced by the gross amount of pension or pensionary equivalent of employer's contribution to Contributory Provident Fund o:r other forn1s of retirement bc.nefits, if any, drawn or to be drawn by hini:
Provided further that in the case of appointment of a person as Claims Commissioner, who has retired from service after holding a post in Grade 1 of Indian Legal Service, or has retired from a civil judicial post carrying scale of pay not less than that of a Joint Secretary to the Government of India after holding that post for at least three years, and who is in receipt of, or has received or has become entitled to receive any retirement benefits, by way of pension, gratuity, employer's contribution to Contributory Provident Fund or other forms of retirement benefits, the pay shall be reduced by the gross amount of pension or pensionary equivalent of Employer's Contributory Provident Fund or other forms of retirement benefits, if any, drawn or to be drawn by him.
4. Accommodation.-( 1) The Calims Commissioner, if he is serving or a retired Judge of a High Court, shall be· entitled to residential accommodation on terms as admissible to a serving Judge of a High Court.
(2) Where the Claims Commissioner is not provided with the accommodation referred to in sub-rule(!), he may be paid, every month, a House Rent Allowanc,, at the rate of thirty per cent of his basic pay.
5. Facilities for medical treatment.-The Claims Commissioner shall be entitled to medical tr�atment and hospital facilities, applilcable to the officer of equivalent pay scale, as provided in the Central Government Health Scheme.
6. Conditions of service, etc.-Notwithstanding anything contained in these rules, the conditions of service of and other facilities available to the Claims Commissioner shall be the same as admissible to a serving Judge of a High Court.
7. Office accommodation and other facilities.-The metro railway administration shall provide necessary office accommodation, staff, conveyance and other facilities and assistance to the Claims Commissioner for the discharge of his duties under the Act.
8. Residual provision.-Matters relating to the conditions of service of the Claims Commissioner with respect to which no express provision has been made in these rules shall be referred in each case to the Central Government for its decision and the decision of the Central Government thereon shall be binding on the said Claims Commissioner.
9. Power to relax.-The Central Government may, by order, for reasolll\ to be recorded in writing, relax the provisions of any of these rules, in respect of .any class or categories of persons.

(2) They shall come into force on the date of their publication in the Official Gazette.
2. Definitions.-(!) In these tules, unless the context otherwise requires:-
(a) "Act" means the Delhi Metro Railway (Operation and Maintenance) Act, 2002 (60 of2002).
(b) "Claims Commissioner" means the Claims Commissioner appointed under Section 48 of the Act.
(c) "Section" means a section of the Act;
(d) "Judge" means the Judge of the Supreme Court appointed for conducting the inquiry under su!;,-rule (l) of rule 3;
(2) All other words and expressions used herein but not defined shall have the same meanings respectively assigned to them in the Act.
3. Committee for investigation of CODI plaints.-(!) The Central Government, on receipt of a complaint alleging any definite charges of misbehaviour in respect of or incapacity to perform the fimctions of the office in respect of Claims Commissioner, shall make a preliminary scrutiny of such complaint.
(2) If, on preliminary scrutiny, the Central Government considers it necei,sary to investigate into the allegation, it shall place the complaint together with supporting material as may be available before .a Committee consisting of the following persons to investigate the charges of allegations made in the complaint:-
(i) Secretary (Coordination andP1�blic Grievances) Cabinet Secreianat
(ii) Secretary, Ministry of Urban Development
(iii) Secretary, Department of Leg,J Affairs Ministry of Law and Justice 1838 tJI/o 1- -:i.

(3) TI1e Committee shall devise its OV/n procedure and method of investigation which may include recording of evidence of the complainant and collection of material relevant to the inquiry which may be conducted by a Judge of the Supreme Court under these rules.
( 4) The Committee shall submit its findings to the Central Government as early as possible within a period that may be specified by the Central Govenmcnt in this behalf.
4. Judge to conduct inquiry .--(1) If Central Government is of the opinion that there are reasonable grounds for making an i11quiry into the truth_ of any imputation of misbehaviour or incapacity of Claims Commissioner, it shall make a reference to the Che if Justice oflndia requesting him to nominate a Judge of the Supreme Court to conduct the inquiry.
(2) The Central Government ;;hall by order appoint the Judge of the Supreme Court nominated by the Chief Justice of India (hereinafter referred to as Judge) for the purpose of conducting the inquiry.
(3) Notice of appointment of a Judge under sub-mlc (2) shall be given to the Claims Commissioner.
(4) The Central Government shall forward tq the Judge a copy of-
(a) the articles of charges against the Claims Commissioner concerned and the statement of imputation;
(b) the statement of witnesses, if any; and
(c) material documents relevant to the inquiry.
(5) The Judge shall compclct,o the inquiry within such time or further time as may be specified by the Central Government.
(6) The Claims Commissioner concerned shall be given a reasonable opportunity of presenting a written statement of defence within such time as may specified in this behalf by the Judge.
(7) Where it is alleged that the Claims Commissioner is unable to discharge the duties of his office efficiently due to arzy physical or mental incapacity and the allegation is demed, the judge ruay arrange for the medical examination of the Claims Commissioner by such Medical Board as may be appointed for the purpose by Central Govenrment and the Claims Commissioner concerned shall submit himself to such Medical Examination within the time specified in this behalf by the J11dgc.
(8) The Medical Board shall undertake such medical examination of the Claims Commissioner as may be considered necessary and submit a report to the Judge stating therein whether the incapacity is such as to render the Claims Com1nissioner unfit to continue in office.
(9) If the Claims Commissioner ref use� to w1dcrgo such medical examination as considered necessary by the Medical Board, the Board shall submit a report to tlte Judge stating therein the examination which the Claims Commissioner has refused to undergo and the Judge n1ay on receipt of such report presume that the Claims Commssioner suffers from such physical or mental ineapcity as is alleged in the complaint.
(I 0) The Judge may, after considering the written statement of the Claims Commissioner and the Medical Report 1f any amend the charges referred to in clause (a) to sub-mle (4) and in such a case the Claims Commissioner shall be given a reasonable opportunity of presenting a fresh written statement of defence.
( 11) The Central Government shall appoint an officer of that Government or any advocate to present the case against tlie Claims Commissioner.
( 12) Where the Central Government has appointed an advocate to present its case before the Judge, the Claims Commis,;ioner shall also be allowed to present his case by an advocate chosen by him.
5. Inquiry Report.-After the conclusion of the investigation, the Judge shall submit his report to the Central Goverrunent stating therein his findings and the reasons thereof on each of the articles of charge separately with such observa�i�nf.l on the whole case as he thinks fit.
6. Provisions of Civil Procedure Code not binding.-The J udgc, while conducting an inquiry wtder mle 4, shall not be bound by the procedure laid down by the Civil Procedure, 1908 (5 of 1908), but shall be guided by the principles of natural justice and shall have power to regulate his own procedure including the fixing of places and times of his enquiry.

7. Suspension of Claims CommisSioner .-Notwithstanding anything cootained in rule 4 and without prejudice to any action being taken in accordance wici1 the said rule, the Central Governrment keeping in view the gravity of charges may suspend the Claims Commissior,er against whom a complaint is nnder investigation or inquiry.
S. Subsistence allowance.-The payment of subsistence allowance to Claims Commissioner uuder suspension shall be regulated in accordance with the rule:, and orders for the time being applicable to an officer of the Government oflndia drawing an equivalent pay.

['!ii. ,:i. cf:-14011/52/2003-1<'!��] 1B'f. si. <'ilw:n, fmr'f> < mu fflTB J G.S.R237 (E).-In exercise of the powers conferred by clause (iii) of Suh-.,cction (2) of Section 56 and clause (d) of Sub-section (2) of section 100 read with Sub-section (3) of Section 53 and Section 57 of the Delhi Metro Railway (Operation and Maintenance) Act, 2002 (60 of 2002), the Central Government hereby makes the following rules, namely:-
1. Short title and commencement-( I) These rules may be called the Delhi Metro Railway (Procedure to be followed by the Claims Commissioner and amount of compensation payable in case of death and injuries due to accidents) Rules, 2007.

(2) They shall come into force on the date of their publication in the Official Gazette.
2. Defioitlons-(1) In these rules, wiless the context otherwise requires,
(a) "Act" means the Delhi Metro Railway (Operation and Maintenance) Act, 2002 (60 of2002);
(b) ''Claims Commissioner" mean, the Claims Commissioner appointed under Section 48 of the Act;

(c) "accident'' means accident whi,oh is _of the )1llture described in sub-section (1) of Section 38 of the Act and which involves death or personal injury to passengers;
(d) "applicant" means a person making an application to the Claims Commissioner under Section 58 of the Act;
(e) "Form" means a form appended to these rules;
(f) "legal practitioner" shall have the same meaning assigned under Clause (i) of Section 2 of the Advocates Act, 1%1 (25of1%1);
(g) "legal representative" means a person who in law represents the estate of the deceased;
(h) "Schedule" means a Schedule appended to these rules;
(i) "Section" means a Section of the Act.
(2) All other words and expressions used herein but not defined shall have the same meanings respectively assigned to them in the Act.
:3. Procedure for filing applications--{ 1) The application for payment of compensation in respect of accidents involving death of, or bodily injury to person or damage to any property arising out of the working of the Metro Railway to the Claims Commissioner shall be presented in 1he form given in the Annexure either by the applicant in person or by hiduly authorized person.
(2) Au application referred to in sub-rnle (1) may also be sent by registered post to Claims Commissioner.
(3) The application under sub-rule (I) or sub-rule (2) shall be presented in duplicate.
(4) Every application shall be typed legibly in double space on one side of paper of good quality.
4. Scrutiny of application-(!) The Claims Commissioner or the staff authorized by him hall endorse on every application the date on which it is represented or received through post.under rule 3 and sign the endorsement.
(2) If the application on scrutiny is found to be in order, it shall be registered and given a serial number.
(3) If the applicati<m on scrutiny is found to be defective and the defect noticed is formal in nature, the Claims Commissioner may allow the applicant to rectify the same in his presence and if the defect is not formal in nature, the Claims Commissioner or the staff authoriud by him may allow the applicant such time to rectify the defect as he may deem fit.
(4) If the applicant fails to rectify the defect within the time allowed under sub-rule (3), the Claims Commissioner may, by order and for reasons to be recorded in writing. Decline to register the application and notify the applicant accordingly.
(5) Au appeal against the order passed under sub-rule (4) may be preferred by the person aggrieved within 15 days from the date of such order and such appeal shall be dealt with and disposed of by the Claims Commissioner whose decision thereon shall be final.
S. Notice to Metro Railway Administration--{!) The Claims Commissioner shall issue notice to Metro Railway Adminisbcation to show cause against the application on a date of hearing to be specified therein. Such notice shall be accompained by a copy of the application.
(2) If the representative of Metro Railway AdminisJration does not appear on the date specified in the notice, or appears and admits the claim, the Claims Commissioner shall forthwith proceed to dispose of the applifation.
(3) If the Metro Railway Administration contests the claim, it may file a reply along with'copy of such document on which it relies on or before the date of hearing and sqch reply and copies of the document shall form part of the record.
6. }'ilingof ao Affidavit.-(!) The Claims Commissioner may direct the party to give evidence, if any, by affidavit
(2) Notwithstanding anything contailled in sub-rule (I) where the Claims Commissioner if considers necessary for JUSt decision of the case, he may order cross-examination of any deponent.
?'. Filing of reply and other document by the respondents.-{!) Metro Railway Administration may file its reply to the application and copies of the documents on or before the date of hearing of the application.
(2) 1n reply filed under sub-rule(!), thf: Metro Railway Administrati<m shall specifically admit, deny or explain the facts stated in the application and state addition.alfacts necessary in its reply.
S. Summary disposal of applicatlon.--The Claims Commissioner may, after considering the application, summarily dismiss the application, if for reasons to be reco:ded in writing, he is of the opinion that there are not sufficient grounds for proceeding therewith.

9. Ex-parte bearing and disposal ofapplication.-(1) Where on the date fixed for bearing the application or any other date to which such bearing may be adjourned, the applicant appears and the representative of Metro Railway Administration does not appear, the Claims Commissioner may, in his discretion adjourn the hearing or hear and decide the application c�-parte.
(2) Where an application bas been heard ex-parte against the Metro Railway Administration, the latter may apply to the Claims Conunissioner for an order to set aside it and if the Metro Railway Administration satisfies the Claims Commissioner that the notice was not duly served or that its representative was prevented by any sufficient cause from appearing, the Claims Commissioner may make au order setting aside the ex-parte hearing upon such terms as it thinks fit and shall appoint the day for proceeding with the application.
10. Disposal of application in default.-( I) Where on the date fixed for hearing the application or auy other date to which such hearing may be adjourned, the representative of Metro Railway Administration appears and the applicant docs not appear, the Claims Commissioner rnay, in his discretion adjourn the hearing or hear and decide the application in default.
(2) Where an application has been heard and disposed in default against the applicant, the latter may apply to the Claims:Comnrissioner for any order to set aside it and if the applicant satisfies the Claims Commissioner that the notice was not duly scrvc<l or he was prevented by any sufficient cause from appearing, the Claims Commissioner may make an order setting aside the dismissal in default, upon such terms as he thinks fit aud shall appoint the day the proceeding with the application.
11. Powers of Claims Com missioner .-The Claims Commissioner shall have, for the purposes of discharging his functi011s under the Act, the same powers as are vested in a civil court under the Code of Civil Procedure, 1908, while trying a s11it, in respect of the following matt,ers, namcly:--
(a) summoning and enforcing the attendance of any person and examining him on oath;
(b) requiring the discovery and production of documents;
(c) receiving evidence on affidavit;
(d) subject to the provisiorcs of Sections 123 and 124 of the Indian Evidence Act, 1872, requisitioning and public record or document or copy of such record or document from any office;
(c) issuing commissions for the examination of witness or documents;
(!) reviewing his decisions;
(g) dismissing an application for default or cx-parte; and
(h) setting aside any order of dismissal of any application for default or any order passed by it ex-parte.
12. Summoning of witnesses and method ofrecording evidence.-,)) If an application is presented by any party to the proceedings for summoning of ·witnesses, the Claims Commissioner shall issue sum mom for the appearance of such witne�es unless the considers that their appearance is not necessary for the just decision of the case.
(2). The Claims Commissioner shall make a brief memorandum of substance of the evidence of every witness as the examination of the witness proceeds and such 1nemorandum shall fon:r, part of the record:
Provided that if the Claims ('.01nmissioncr does not make such me1norandum, he sha11 record the reasons for his inability to do so and shall cause such memorandum to be made in vlriting from his dictation and shall sign the same, and such memorandum shell form part of the record.
13. Decision of the Claims Commissioner.-The Claims Commissioner shall decide every application as expeditiously as possible on perusa] of document-;, affidavits and other evidence, if any, and after hearing such oral argument as may be advanced.
14. Order to be passed and signed.--{ I) The ClailllS Commissioner, after hearing the applicant and the Metro Railway Administration, shall pass an order as he thinks fit either at once or, as soon as thereafter as may be practicable.
(2). Every order of the Claims Commissioner shall be in writing and shall be signed by him.
(3). An order made by the Claims Commissioner shall be executed as a decree of civil court and the provisions of the code of Civil procedure, 1908, so far may be, shall apply as they apply in respect of decree of a civil court.
15. Review of decision.-( I) Any person comidering himself aggrieved by any order of the Claims Commissioner, on account of some mistake or error apparent on the face of the record, or for any other sufficient reason, desires to obtain review of such order, may apply for teview of a final ordernot being an interlocutory order, to the Claims Conunissioncr.
(2). Where it appears to the Claims Commissioner that there is no sufficient ground for a review, he shall reject the application.
(3). Where the Claims Commissioner is of the opinion that the application for review should be granted, he shall grant the same:

Provided that no such application shall be granted without previous notice to the Metro Railway Administration or to enable it to appear and be heard in supp,rt of the order, a review of which is applied for.
16. Orders or directions by the Cllaims Commissioner.-The Oaims Commissioner may pass such orders or give such directions as may be necessary or c,xpedient to give effect to his orders or to prevent abuse.pf the process or to secure the ends of justice.
17. Inherent powers of the Claims Commissloiler.-Nothing in these rules shall be deemed to limit or otherwise affect the inherent powers of the Claims Commissioner to make such orders as may be necessary for the ends of justice or to prevent abuse of the process of the office of the Claims Commissioner.
18. Association of experts.-( 1) The Claims Commissioner may, for the purpose of determining any claim for compensation choose one or more experts possessing any knowledge of any matter relevant to the inquiry.
(2) Compensation, if any, to be pa.id to the persons associated with the inquiry, as per sub-rule (1) shall be determined by the Claims Commissioner and paid by Metro Railway Administration.
19. Amonntof compensation.-(1) The amount of compensation payable in respect of death or injuries, shall be as specified in lhe Schedule.
(2) The amonntof compensation payable for an injury not specified in Part IT or Part III of the Schedule but which, in the opinion of the Oaims Commissioner, i,; such as to deprive a person of all his capacity to do any kind of work, shall be Rs. 4 lakh (four lakh rupees).
(3) The amonnt of compensation payable in respect of any injury (other than an injury specified in the Schedule or referred to in sub-rule (2) resulting in pain 1,nd suffering, shall be such as the Claims Commissioner may, after taking into consideration medical evidence, besides other circumstances of the case, determine to be reasonable :
Provided that if more than one injury is cansed by the same acciden� compensation shall be payable in respect of each such injury :
Provided further that the total compensation in respect of all such injuries shall not exceed Rs. 80,000 (eighty thousand rupees).
(4) Where compensation has beeu paid for any injury which is less than the amonnt which would have been payab1e as compensation if the injured person has died or the person subsequently dies of the injury, a further compensation equal to difference between the amount payable for death or amount already paid, shall become payable.
(5) Compensation for loss, destruction or deterioration of goods being carried by the passenger as his personal baggage, shall be paid to such an extent as th,e Claims Commissioner may, in all circumstances of the case, determine to be reasonable.
20. Limit of compensation.-Notwithstanding anything contained in rule 19, the total compensation payable under 1ltat rule shall in no case exceed Rs. 4 lakh (four lakh rupees) in respect of any one person.
