1. Short title and commencement:- (1) These Bye-laws may be called the New Delhi Municipal Council (Sanitation and Public Health) Bye- Laws, 2008.
(2) They shall come into force with effect from the date of their publication in the D~lhi Gazette.
2. Definitions:- (1) In these bye-laws, unless the context otherwise requires,-
(a) "Act" means. the New Delhi Municipal Council Act, 1994 (44 of , 1994) ~ ,
(b) "section" means a section of the Act.
(2) Words and expressions used and not defined in these · bye-laws, but defined in the Act shall, have the meanings assigned to them in the Act.
A. WHITE-WASHING OF BUILOINGS
3. Duty of the owner to lime-wash, etc. of the buildings.--- (1) It shall be the duty of the owner or the occupier of a building to have the building (including out-house, if any) lime-washed or colour-washed at least once in two years and the wood-work and non-lime washable portion of the 'building to be oil painted at least once in four years.
(2) If it appears to the Chairperson necessary for sanitary reasons or as a measure of disinfection so to do, he may, at any time, by written notice, require the owner or occupier of any building which is inspected\ to caus the sarne or some portion thereof to be lime-washed or otherwise cleansed and the woodwork and the non-lime washable portion of the premises oil painted either externally or internal[y or both externally and internally to his satisfaction.

PART IV] DELHI GAZEITE : EXTRAORDINARY r· (3) If the owner or the occupier of a building of an area thereof under his possession fails to have lime washed or colour washed or oil painted, as the case may be, the Chairperson may, after giving him a reasonable opportunity for doing so, get such building or area lime washed, colour washed or oil painted as may be necessary. All the expenses incurred by the Chairperson on this account shall be payable to him by the owner or occupier, as the case may be, on demand and if not paid within ten days after such demand shall be recoverable from the person concerned as an arrear of tax under the Act.
I B. SPECIAL MEASURES TO PREVENT SPREAD OF DANGEROUS DISEASES

of dangerous disease.--- The Chairperson may, at any time, by day or by night, either after giving st lcfl notice of his intention as shall in the circumstances, appear to h1m to be reasonable or without notice, inspect any place in which any dangerous disease is reported or suspected to exist, to ascertain and determine what measures should be taken to prevent the spread of the said disease beyond such place.
Child li~ble to carry dangerous disease may be ordered not to attend school.--- A person having the care of a child who is, or who has been exposed to infection of a dangerous disease, shall not. after receiving notice from the Medical Officer of Health of the Council that the child is not to be sent to school , permit the child to attend school, until he has obtained from the said officer a certificate for which no charge shall be made, that in his opinion the child may attend school without undue risk of communicating the disease to others.

7. Special measures.--- (1) The special measures to be taken anddirections to be given by the Chairperson under section 287 may include any of the following matters, namely:---
(a) The evacuation of any infected building used as a dwelling or of any part thereof. by the person or persons residing whether habitually or temporarily therein, provided sufficient , accommodation-for all the persons affected is available, or is provided elsewhere.
(b) Compulsory vaccination, or preventive inoculation of person, entering, residing in, or leaving specified areas.
(c) . The examination l;ly a medical officer of persons, and, if necessary, the disinfection of the clothing, bedding or other articles suspected of being infected belonging to persons either arriving from outside a specified area or residing in any building adjacent to any infected building in that area, the recording of the address of such persons, and the daily presentation of such persons for medical examination at a specified time and place, for a period not exceeding ten days.
(d) The prohibition either generally or by special order in any individual cas~ . of assemblages consisting of any number of persons exceeding fifty, in any place, whether. public or private, or in any circumstances, or for any purposes.
(e) The closure for a period to be specified of any theatre, cinema-house or other place of entertainment.
(f) The closure of an educational institution , oy a written noti ce to the authorities 1n charge of such ir. tu tion, for such period as is specified 1n the not1ce.

(g) Restrictions on the export from, or import into, or transport '• within, a specified area of any goods or articles exposed to, and likely to retain infection from a dangerous disease, or likely to infect persons with any such disease, or· the destruction of any such goods or the articles.
(h) . Th.e examination, unloading and disinfection, if necessary, at any place within New Delhi of any consignment of grain or other goods stuff, cotton or clothing imported into New Delhi by road or rail.
(i) Closure of all or any existing markets and bazaars and ~ppointment of special placffs where markets or bazaars may be held.
The Chairperson may, in his discretion, give compensation to any person who, sustains substantial loss by· the de·struction of any property under this bye-law, but, except _as allowed by the Chairperson, nO' claim for compensation shall lie for any loss or damage CQused by the exercise of the powers specified herein.
C. . DISPOSAL OF DEAD BODIES IN CERTAIN CASES Di~posal of dead bodies in certain cases.---- (1) No person shall , without the written sanction of the Medical Officer of Health of the Council; retain in any place other than a public mortuc;~ry , for more than twelve hours the body of any person who has died while suffering from a dangerous disease.

(3)-Any expenses reasonably incurred by the Chairperson in so doing shall be paid by any person legally liable to p:ay the expenses of the disposal of the body unless the Chairperson waives recovery on the ~round of poverty.
D. REGISJRA TION, ETC. OF BURNING OR BURIAL GROUNDS
9. Registration of burning or burial places~etc.--- . Every owner or person having control of' place used for burning, or otherwise disposing of the dead, shall cause the same to be registered in a register which shall be kept by a municipal officer charged by the Chairperson with the duty, and shall deposit in the Council office at the time of registration a plan of the. said place, showing the extent and boundaries thereof, bearing the signature of a licensed architect or engineer in token of it having prepared by, or under the supervision of, such architect or engineer.
10. Provisions of new places for disposal of the dead.---. If the existing places for the disposal of dead bodies shall at any time appear to be insufficient, or if any such place is closed under section 302, the Chairperson shall, with the Sqnction of the Council, ·provide other fit and convenient places for the said purpose and shall cause the same . to be registered in the register kept under bye-law 9 and shall deposit in the Council office, at the time of registration of each place so proYided a plan thereof, showing the extent and boundaries of the same and bearing the signature of the Chief Architect of the Council. ,. .
•=Pm==·I~====================D=E=LID==G=AlliTT====E=:=EX=1=~=A=O=R=D=~=AR=Y=======================I7 1 ~ Chairperson may sanction the reopening of places which have been closed for the disposal of the dead.--- If, after personal inspection, the Chairperson is at any time of the opinion that any place formerly used for the disposal of the dead bodies which has been closed under section 302, or under any other law or authority, is by lapse of time or otherwise no longer dangerous to health and may without risk or danger be again . used for the said purpose, he may make a report in that behalf to the Council which may direct that such place be reopened for the disposal of the dead. Every order so made shall be noted in the register kept under bye-law 9.
E. ACTS PROHIBITED FOR DISPOSAL OF THE DEAD , _ ' A2. Acts prohibited in connection with the disposal of the dead.---No person shall---
(a)' retain a corpse on any premises , without burning , burying or otherwise lawfully disposing of the same, for so long a time after death as to create a nui~ance;
(b) carry a corpse or part of a corpse along any street without having and keeping the same decently covered or without taking such precautions to prevent risk of infection or injury to the public health as the Chairperson may by public notice, from time to time, think fit to require;
(c) except, when no other route is available, carry a corpse or part of a corpse along any street along which the carrying of corpses is prohibited by a public notice issued by the Chairperson in this behalf;
(d) remove a corpse or part of a corpse, which has been kept or used for purposes of dissection otherwise than in a closed receptacle, or vehicle;
(e) whflst conveying a corpse or part of a corpse, place or leave the same on or near any street without urgent nece,sity.

(i) Grave yard ---l , Jry or cause to be buried, the buuy of any person or, being the owner or person in charge of a burial ground, shall permit to be buried the body of any person in a burial ground in New Delhi otherwise than in accordance with the following conditions:
(a) the body shall be interred within six hours after its arrival at the burial ground which may be extended to eight hours in special cases where delay is due to rockiness of the ground;
(b) the body shall not be buried in any grave in which another body has been interred during such previous period as may be determined by the Chairperson ; and
(c) the grave shall be of such a depth that every part of every coffin or body is at least 1.3 metres below the surface level , if confined in masonry; and 1.83 metres if not so confined and the body shall be buried not less than 0.6 metre from any other body interred during the last ten years.
(2) No person shall remove or, being the owner or person in charge of a burial ground, permit to be removed from such burial ground in New Delhi the bier or other thing on which "the dead body of any person who has died of any infectious or contagious disease was brought to such burial ground or any clothes or bedding or other thing with which such body has been in contact. (3) No person shall, without sanction of -the Chairperson, exhume a dead body or re-open a grave .
. (ii) Crematorium
14. Disposal of dead bodies by burning. (1) .No person shall burn the ' dead body of any person or cause a dead body to be burnt, or, being the owner or person in charge of a burning place, permit a dead body to be burnt in New Delhi otherwise than in accordance with the following conditions:- ~ ,
(a) The body shall be burnt within six hours after its arrival at the burning place.
(b) No part of the body. shall remain unconsumed unl,ess in any case the rules or custom of religion demand that the whole or a portion of corpse shall be thrown in a river.
(c) No part of the bodx except the ashes shall be removed fr.orn the burning place until it is completely reduced to c;1shes.
(2) No person shall remove wood, coal or other fuel thaf has been used in the pyre from the burning ground and the owner or person in charge of the ground shall see that all such wood, coal or other fuel is reduced to ashes.
(3) No person shall remove or, being the owner or person in charge of a ·burning ground, permit to be removed from such burning ground in New Delhi the bier or other thing on which the dead body of any person who has died of any infectious or contagious disease was brought to such burning ground or any clothe.s or bedding or other thing with which such . burial or burning ground of s.Uch lawful funeral rites and ceremonies as the relatives and friends of the deceased wish to perform.
(2) (i) At each burial and burn.ing· ground there shall be stationed a municipal empioyee and in every case of burial or burning, he shall . , . .
enter in register, the name, age, sex, caste, religion, occupation, full address of deceased, the cause of death, the disease, the date, place of death, the name and ~ddress of person bringing the corpse and the dat~ and hour of burial or burning of the corpse, as the case may be.
He shall furnish a copy of the register to the Medical Officer of Health of the Councii'on the first of each month ..
(~:>) No person shal!. except with the written permission of the Chairperson, erect any masonry tomb exceeding 1.83 metres in length; 1.3 metres in breadth and 0.9 metre in height from the ground level or any Samadhi within the limits of ·any burial or burning ground within New Delhi.
(4) lt the Chai rperson so requires, the owner or person in charge of every burial or burni.ng ground shall enclose it with walls, fences, or hedges, to the satisfaction of the Chairperson.
(5) No person shall without the special permission of the Chairperson or an officer duly authorized by him bury or burn , or cause to be buried or burnt-, the dead body of any 'person any where except in or at a burial or burning ground specia lly assigned for H·e pu rpose.

(7) No person shall bu ry and burn, or cause to be buried or burnt the dead body of any person in or at any burial or burning ground which has been closed by a notice issued by the Chairperson under section 302 .
No person shal l make, or cause to be made, a grave in any burial ground , except within the limits marked out for the purpose by a person ' . duly authorized in this behalf by the Chairperson .
H. EXEMPTION
16. Bye-laws not applicable to Christian cemetery.--- These bye-laws ·· shall not apply to any Christian cemetery regulated under orders of the Central Government.
I. PENAL TIES
17.- Penalties.-Whoever-
(a) contravenes any provision of any of the bye-laws mentioned in the first . \ "' column of the Table below; or
(b) fails to comply with any order or directions lawfully given to him or any requisition lawfully made upon him under any of the said provision , shall be · punishable :-
(i) with fine which niay extend to the amount specified in the second column of the said Table; and (i i) in the case of continu ing contravention or failu re , yvith an additional fi ne which may extend to the amount specified in the third column of that .
