Governor of the National Capital Territory of Delhi. is pleased to make the following rules for financial assistance to the senior citizens of Delhi who are without any or adequate means of support.
1. Short Title, Extent and Commencement: . a.. These roles may be called the 014Age Assistance Rules, 2009. b .. They shall extend to the whole of the National Capital Territory of Delhi. c. They rules shall 'come into force with. effect from the date of their publication in the Delhi Gazette.
2. Aims & Objective: 0 The aim of these rules Is to provide social security by way of financial assistanceto destitute, old persons, who are with out .any means .of subsistence and nobody is there such nosition to support them in the evening. of their lives. . ,~ ~~'i,'
3. DermitioDs: .' a. "Applicant" means the person seeking assistance. b. "Application form" means fonn prescribed' under these rules. . c.. "Family" 'means wife !husband, minor children, disabled children, unmarried, or divorced! separated daughters/ sisters, parents who are .solely dependent on the applicant and earning children sharing a kitchen with the applicant? d. "Financial Assistance" means recurring financial aid till death as prescribed in these rules. e. "Investigator' means an official appointed by the Department of Social Welfare. f.. "Old" means any person who has anainedthe age of60 years. g. "SanctioningAuthority" means District Social Welfare Officer, Department of Social Welfare, GNCTofDelhi. '.
4. . Eligibility: The applicant.shall be entitled for financial assistance ifhelshe is- 8_ above 60 years; 1 f'. h. a resident of the National Capital Territory of Delhi for at least five' years preceding the date of submission of application; . c. his/her annual family income is not morethan Rs, 60,000/- p.a, (Rs, sixty thousand) from all sources; . d. has a 'singly-operated' account in any Bank or Post Office for receiving the payment through electronic clearing system, This provision. may be relaxed in the case of mentally challenged applicants or those who come under the purview of Legal , Guardianship as per rules of National Trust. e. not receive any pension! financial assistance from Centrall State Govt.IMCDINDMC or any other source for this purpose. 5~ . a) b) AppticatioD for fmanew assistance: An application for financial assistance under these rules shall be made on prescribed form, which shall be available from GRC~SK., Deputy Commissioner's. Office (District Resource Centre), the office of the District SOcial Welfare Officer, area MLAI MP, Financial Assistance Section, Department of Social Welfare; GNCT of Delhi, OLNS Complex, DelhiGate, New Delhi or may be electronically downloaded from official websites of Samajik Suvidha Sangam or Department of Social We]~are. . The applicant shall submit the duly filled application form to the concerned District Social Welfare Officee' ORe-SKI DRe Unit, alongwith the following documents:-' . Gazetted Officer of the Centrall Delhi Govt ... iv) Along with the witness's statement, therelevant document for the photoidentity proof, resldence and .length of' stay .for .the witnesses shall'· also .bave to· be . appended with-the appliCatio~. clear,ly. 6. Verification and sanction of 88sistsnce: The District Social Welfare Officer Shall be the competent authority for verification and sanction of the payment of allowance, The Competent Authority may satisfy .him/herself about the contents of the application by screening the documents submitted .. AJ; a test check, in 5% of all cases submitted by the GRC-SKlDRC or in doubtful cases only, the Competent Authority may get the verification conducted _through the departmental investigators or other officials or Anganwadi Workers specially deputed for the purpose.
7. Quantum of assistance & Mode of payment: . a) Subject to the fulfillment of the provisions of the scheme •. an allowance will. be remitted quarterly in the bank/ post office account of the beneficiary @ RI. 1000/- per month (Rs, one thousand per month) per headthrough ECS afRBI. b) The assistance shall become payablefromtbe month· from which-it is sanctioned.
8. Stopping of Assistance.! . a) The Sanctioning Authority shallhave the right to stop payment of assistance if at any stage it is found that it was sanctioned on furnishing of fake information or 'the conditions for. which the assistance was granted no longer exist. b) Also, if the assistance was sanctioned on furnishing of false documents, penal action shall be initiated and appropriate' liability fixed against people furnishing false d~um~~. . ~ c) If a person resorts to professional begging, i.e, if the. person has been apprehended \ and warned or any other proceedings conducted by the court in this 'regard against him! her, the assistance shall be forfeited. r d) Assistanceshall ceaseto be payable·-oIL~e death of thebeneficiary and if the person dies before receivingassistence for epertlculerperiod, thesame shall lapse. , .
9. Change of Address: _ a) It shall be. obligatory for the person receiving assistance to intimate any .change .of address. alongwith proof,' to -the Sanctioning Authority within one month. of such change. b) Persons shifting to a place outside Delhi permanently 'shall not be eligible for this assistance.
10. Appellate' Authority: . In case of any grievance, the' applicant may 'appeal to the Director. Deptt. of Social Welfare for redressalof his /her grievance in this regard. The decision of the .Director shall be flQal. .'
11. ~eeU.neo~: .4· i) If the applicant has already taken' one-time assistance .under the scheme 'Financial Assistance to Socially andPhysically Disadvantaged- Old & Infirm Persons' he/she can still avail of assistance .under this scheme if" they fulfil~ the other eligibility criteria; . ii) The beneficiaries of the scheme shall not be debarred from seeking assistance in tile following schemes of financial assistance- Ladli, NFBS.. Jan' Shree Beema .yojana, Widows' daughter marriage and/or any other financial assistance schemes in existence in, the Department of Social Welfare and 'Wome~' and Child Development simultaneously, provided ~ey fulfill the' norms, iii) A.reviewand evaluation of the scheme as well as verification of the beneficiaries Will be conducted every three years. (1) Short Title and Commencement-e-ra) These rules may be called The Old Age Assistance (Amendment) Rules, 201 I.
(b) They shall come into force on the date of their publication in the Delhi Gazette.
(2) Amendment of Rule 3 (c)--In the Old Age Assistance Rules, 2009, for rule 3 (c), the following shall be substituted, namely- 3 (c) "rami ly" means wife/husband, minor ch ildren, disabled ell i ldren, unmarried, or divorced/separated daughters/sisters, parents who are solely dependent on the applicant. No. F 41 (21)IDSW/FAS/Sch. Arnendl09 .. 10I1892 ..1904~datedNovember 4, 2009, and its subsequent- amendment titled The Old Age Assistance (Amendment) Rules, 2011 published in the Delhi Gazette· vide notification no. F 41(22)IDSW/F~\S/Sch. Amend/09-10J2004-14 dated October 18,2011 ~s following, namely:- .
(1) Short Title and Commencement: . (a) These rules may be called, The Old Age Assistance (Amendment) Rules, 2011 ..
(2) Amendment-of Rule 7: In the Old Age Assistance Rules! 2009, in rule 7, the clause (a) shall be substituted and clauses (c) and. (d) shall be added as following, namely- . 7 (a) Subject to the fulfillment of the provisions of the scheme, an allowance will be remitted quarterly in the hank account of the beneficiary aged 60- 69 years at the. rate ofRs. 1000/- per morth (Rs. one thousand per month) Per head through ECS of RBI. All beneficiaries aged 70 years and above shall be paid Rs. 1,5001 .. per month (Rs4 one thousand and five hundred per month) per head remitted quarterly through ECS of RBI.
(c) The enhanced assistance to beneficiaries aged 70 years and above shall become payable with effect from October l~ 2011, remitted in Quarter 3, 2011~12t
(d) From financial year 2012-~013 onwards, the age upgradation will be undertaken from the start of financial year i.e, April of each year itself. 1. (1) These rules may be called the Old Age Assistance (Amendment) Rules, 2014.
(2) They shall come into force on the date of their publication in the Delhi Gazette.
2. Amendment of Rule 7 (b) in the Old Age Assistance Rules 2009 in rule 7, for clause 7 the following shall be substituted, namely:- "New applications under the Old Age Pension Scheme shall be received within the ov ceiling applicable at the time, subject to the approval of the Competent Authority. Governor of Delhi is pleased to make the following amendment in the below-mentioucd schemes:
1. The Old Agt~ Assistance Rules, 2009 as published in the Delhi Gazette vide Notification No. 1: 41 (2IVDS\V/FAS/Sch. i\melld/09-l0/1~92-190L1 dated November 4,2009 ancl subsequent amendments, including amendment vide notification No. F 41 (8)!FAS/DSWIEnhance/2007·· 08/2358-2368 dated November 11~201 I. In Rule :.1(c), the family income of the applicant is modified £0 be not more than Rs. 1,00,000/- p.a. (Rs. Ol"lV lakh per annum) and the rule shall now read as under: "Thr applicant shall be entitled for financial assistance if his/her annual family income is not more than Rs. 1,00,000/- p.a. (Rs, One lakh per annum) from all sources." in Rule 7 (a) the quantum or assistance has been enhanced by Rs. 1000/.· per month and the rule sliall now read as IInder: "Subject to the fulfillment of the provisions of the scheme, an allowance of Rs, 2000/- per month (R:-;. two thousand per month) to beneficiuries aged 60- 69 years and Rs, 2,500/- p(~r month (Rs. t wo thousand and five hundred per month) to beneficiaries of age 70 years and above will be remitted on monthly basis to the bank accounts of the beneficiaries. This enhanced q ua nturn will he payable only to those beneficiaries who have linked their bank n cco u nts with Aadhaar and an? receiving pension through Aadhaar Payment Bridge System (Direct Benefit Transfer after seeding/linking with Aad haa r). All addjtie~- -ll amount of Rs. 500/- per month will be given to 60-69 year old beneficiaries belonging to SC/ST/M'inodty communities who provide their relevant dcoumeuts.' OIH:~lakh per annum) from all sources. In Rule 7 (a) the quantum of assistance has been enhanced by Rs. 1,0001- per month and the rule shall now be read as under: . "Subject to the fu lfillment of the provisions of the scheme, an allowance of Rs, 2,500/- per month (lb. two thousand and five hundred per month) will be remitted on monthly basis to the bank accounts of the hcncficiaries. This enhanced quantum will be payable only to those beneficia des who have linked their bank accounts with Aadhaar and are receiving pension through Aad hau r Payment Bridge System (Direct Benefit Transfer after seeding/linking with Aadhaar)."
