(1050)/2009-SB/591-591.—In exercise of the powers conferred by sub-section (1) of section 31 •read with section 30 ofthe Delhi Technological University Act, 2009 (Delhi Act 6 of 2009), the Government of National Capital Territory of Delhi, after obtaining the prior approval of the Chancellor, hereby, makes the following Statutes of the Delhi Technological University, Delhi, namely :— I. Short title and commencement,— (1) These Statutes may be called the Delhi Technological University (First) Statutes, 2009.
(2) They shall come into force on the date of their publication in the official Gazette.
2. Definitions.— (1) In these Statutes, unless the context otherwise requires,—
(a) "Act" means the Delhi Technological University Act, 2009 (Delhi Act 6 of 2009);
(b) "academic staff " shall means Professor, Associate Professor, Assistant Professor, Librarian, Deputy Librarian, Assistant Librarian, Programmer, System Manager, Foreman Instructor, Director Physical Education and such other academic posts as may be decided by the'Board of Management;
(c) "Board of Studies" means Board of Studies of a Department / School;
(d) "clause" means the clause of a Statutes in which that expression occurs;
(e) "Faculty" means a faculty of the University comprising one or more departments or schools grouped together for academic functions;
(I) "Head" means Head of the Department or School;
(g) "Head of College" means the Principal or Director ofthe College;
(h) "non-teaching staff" includes Registrar, Controller of Finance, Controller of Examinations, technical staff, administrative, ministerial and other staff, as may be decided by the Board of Management;
O "section" means a section of the Act.
(2) Words and expressions used but not defined in these Statutes and defined in the Act, shall have the same meanings as assigned to them in the Act.
3(A) The Chancellor and his functions.—The Chancellor, by virtue of his office shall be the Chairman of the Court. • 3(B)The'r rce-Chancellor.—(1)The Vice-Chancellor shall be a whole-time salaried officer of the University.
(2) The Vice-Chancellor shall be appointed by the Chancellor from a panel of throe names (written in the alphabetical order) recommended by the search-cumselection committee constituted under sub-clause (3).
(3) The search-cum-selection committee referred to in sub-clause (2) shall comprise of
(a) an eminent academician Chairman.
(b) former or present Director of a Indian Institute of Technology —Member.
(c) former or present Director of Indian Institute of Management —Member.
(d) tatacademician ofthelevel ofa Vice-Chancellor, present or former, as a nominee of the University Grants Commission—Member.
(e) Secretary, in the Technical Education, Department of the Government—Member Seaany (ex-officio).
(4) The sesuch-cum-selection committee shall forward the names (in the alphabetical order) to the member secretary of the committee.
(5) The Vice-Chancellor shall hold office fora term of five years from the date on which he/she enters upon his office and shall be eligible for reappointment for not more than one term :
Provided that the person appointed as Vice- Chancellor shall, on completion of seventy years of age, during his/her term of office, cease to hold office.
(6) The emoluments and other coalitions of service of the Vice-Chancellor shall be as follows;
(i) The Vice-Chancellor shall be paid a salary of Rs. 25,000 per month or the salary paid to the Vice-Chancellor of a Central University, whichever is higher, which may be subject to enhancement on mutually agreed terms and he shall be entitled to the free use of the University car and, without payment of rent, to the use of thrashed residence throughout his/her term of office and no charge shall fall on the Vice-Chancellor personally in respect of the maintaumce of such car and residence:
Provided that if a person in receipt of any pension is appointed as Vice-Chaneellor, his/ her salary shall be fixed after taking into consideration such pension.
(u) In addition to the salary specified in sub clause
(i), the Vic,e4bancellor shall be entitledto such leave, benefits and other allowances as are admissible to the University employees from time to time,
(in) The Vice-Chancellor shall be entitled to such terminal benefits and allowances as may be fixed by the Board of Management with the approval of the Chancellor from time to time :

Provided that where an employee of the University or of any other University or any college maintained by or affiliated to such other university is appointed as the Vice-Chancellor, he may be allowed to continue to contribute to any provident fund of which he is a member and the University shall contribute to the account of such person in that provident fund at the same rate at which such person had been contributing immediately before his appointment as Vice-Chancellor
Provided Anther that where such employee bad been a member of any pension scheme, the University shall make necessary contribution to such scheme.
(7) lfthe office ofthe Vice-Chancellor becomes vacant due to death, resignation or otherwise, or if he is unable to perform his duties due to ill health or any other reason, the senior-most Pro Vice-Chancellor shall perform the duties of the Vice-Chancellor, and if there is no Pro Vice-Chancellor, the senior-most Dean shall perform the functions of the Vice-Chancellor until the new Vice-Chancellor assumes office or until the existing Vice-Chancellor resumes the duties of his office, as the case May be.
4. Powers and functions of the Viee-Chancellor.— (1 ) (a) The Vice-Chancellor shill be ex-officio Chairman of the Board of Management, the Academic Council, the Planning Board and the Finance Committee.
(b) The Vice-Chancellor shall chair the meetings of the Court, in case Chancellor is unable to do so.
(2) The Vice-Chancellor shall be entitled to be present at, and address, any meeting of any other authority or any other body of the University but shall not be entitled to vote thereat unless he/she is a member of such authority or body.
(3) It shall be the duty of the Vice-Chancellor to see that the Act, the Statutes, the Ordinances and the Regulations are duly observed and he shall have all the powers necessary to ensure such observance.
(4) The Vice-Chancellor shall exercise control over the affairs of the University and shall give effect to the decisions of all the authorities of the University,
(5) The Vice-Chancellor shall have all the powers necessary for the proper maintenance of discipline in the University and he may delegate any such power to such officer or officers as be may deem fit
(6) The Vice-Chancellor shall be empowered to grant leave to any officer of the University and make necessary arrangements for the discharge of the functions of such officer during his absence.
(7) The Vice-Chancellor shall grant leave of absence to any employee of the University in accordance with the rules and, if he so decides, may delegate such power to another officer of the University.
(8) The Vice-Chancellor shall have the power to convene or cause to be convened the meeting of the Court, with the approval of Chancellor. and the meetings of the Board ofManagement, the Academic Council, the Planning Board and the Finance Committee.
(9) The Vice-Chancellor shall have the power to make short-term appointments, with the approval of the Board of Management, for a period not exceeding six months, of such persons as he may consider necessary for the functioning of the University.
5. The Pro Vice-Chorreellors.— (I) Every Pro Vice- Chancellor shall be appointed by the Board ofManagement on the recommendation ofthe Vice-aiancellor
Provided that if the recommendation of the Vice- Chancellor is not accepted by the Board of Management, the matter shall be referred to the Chancellor who may either appoint the person recommended by the Vice- Chancellor or request the Vice-Chancellor to recommend another person for consideration of the Board of Management
(2) The term of office ofa Pro Vice-Chancellor shall be three years or until the expiration ofthe term of office of the Vice-Chancellor, whichever is earlier, and he/she shall be eligible for reappointment :
Provided that a Pro Vice-Chancellor shall retire on attaining the age of sixty five years :
Provided further that a Pro Vice-Chancellor shall, while performing the Sanctions ofthe Vice-Chancellor under clause 3(B) sub clause 7 of Statute, continua in office notwithstanding the expiration of his term of office as Pro Vice-Chancellor until a new Vice-Chancellor assumes office or until the existing Vice-Chancellor resumes his duties, as the case may be. -
(3) (a) The salary ofa Pro Vice-Chancellor shall be as decided by the Board of Management with the approval of the Chancellor.
(b) Every Pro Vice-Chancellor shall be entitled, without payment ofrent, to the use ofa furnished residence throughout his term of office and no charge shall fall on the Pro-Vice-Chancellor personally in respect of maintenance of such residence.
(c) In addition to the salary specified in sub-clause
(a), a Pm Vice-Chancellor shall be entitled to such leave, benefits and other allowances as are admissible to the employees of the University from time to time.
(d) Every Pro-Vice-Chancellor shall be entitled to such =mina! benefits as may be fixed by the Board of Management from time to time.
(e) Every Pro-Vice-Chancellor shall be entitled to subscribe to the contributory provident fund of the University till the end of his tenure:
Provided that where an employee of the University or a college or of any other university or institution maintained by or affiliated to such other university is appointed as Pro Vice-Chancellor, he shall continue to be 16 DELHI GAZETTE : EXTRAORDINARY [Parr IV governed by the same retirement benefit scheme to which he/she was entitled prior to his appointment as Pro Vice- Chancellor till he continues to hold his/her lien on that post. However, the pay for the purpose of subscription to the General Provident Fund or subscription to the University Contributory Fund shall be the pay drawn by him as Pro-Vice-Chancellor.
(1) Every Pro Vice-Chancellor shall assist the Vice- Chancellor in respect of such matters as may be specified by the Vice-Chancellor in this behalf from time to time and shall also exercise such powers and perform such functions as may be delegated to him by the Vice-Chancellor.
6. The Deans.— (I) There shall be Deans to deal with academics, research, consultancy and student welfare and to deal with such other aspects as the Board of Management deans it necessary.
(2) Every Dean shall be appointed by the Vice- Chancellor from among the professors of the University for a period of three years and he shall be eligible for reappointment :
Provided that a Dean on attaining the age of sixtytwo years, shall cease to hold office as such :
Provided furdierthat if at anytime, there is no professor in a department or school, the Vice-Chancellor, or a Dean authorized by the Vice-Chancellcc in this behaff, shall exercise the powers of the Head of the Department or school.
(3) When the office of the Dean is vacant or where the Dean is by reason of illness, absence or any other cause unable to perforni the duties of his office, the duties of his office shall be performed by such person as the Vice- Chancellor may appoint for the purpose.
(4) The Dean shall be the head of the functional cluster assigned to him and shall be responsible for the conduct and maintenance of the standards of work in the functions assigned to him.
(5) The Dean shall perform such other functions as may be prescribed by the Ordinances.
(6) The Dean shall have the right to be present and to speak at any meeting of the Board of Studies or a committee of the Department / School but shall not have the right to vote thereat unless he is a member thereof.
7. The Registrars.—(l) The Board of Management shall constitute a selection committee for the appointment of Registrars.
(2) Every Registrarshalt be appointed by the Board of Management on the recommendation of the selection committee constituted under clause (I) and he shall be a whole-time salaried officer of the University.
(3) The emoluments and other condidons of =vice of a Registrar shall be such as prescribed by the Ordinances :
Provided that a Registrar shall retite on attaining the age of sixty years.
(4) When the office of the Registrar is vacant or when the Registrar is, by reason of ill health, absence or any other cause, unable to perform his functions as the Registrar, his functions shall be performed by such person as the Vice-Chancellor may appoint for the purpose.
(5) A Registrar designated specially in this behalf by the Board of Management shall be the power to take disciplinary action against such ofthe employees, excluding teachers, as may be specified by the Board of Management by general or special order made in this behalf.
(6) An appeal shall lie to the Vice-Chancellor against any order made by the Registrar in pursuance of clause (5).
(7) In cases where an inquiry discloses that a punishment beyond the powers of the Registrar is called for, the Registrar shall, consequent to the inquiry, make a report to the Vice-Chancellor along with his recommendations for such action as the Vice-Chancellor may dean ft :
Provided that in such a case an appeal shall lie to the Board of Management against an order of the Vice- Chancellor imposing any penalty on an employee.
(8) The Board of Management shall designate a Registrar to act in one or more of the following capacities, namely :--
(i) Secretary to the Court
(ii) Secretary to the Board of Management
(iii) Secretary to, the Academic Council.
(iv) Secretary to the Planning Board.
(9) A Registrar so designated shall, in relation to the authority concerned,—
(a) be the custodian of the records, the common seal andsuch other properties ofthe University as the Board of management may commit to his charge;
issue notices and convene meetings of that authority and the committees appointed by it;
keep the minutes of the meetings of that authority and the committees appointed by it;
(d) conduct the official proceedings and correspondence; and
(e) supply to the Chancellor a copy each of the agenda of the meetings of the authorities of the University as soon as it is issued and the minutes of such meetings.
(10) Any Registrar may be designated by the Vice- Chancellor to represent the University in suits or proceedings, by or against the University, sign povlers of attorney, verify pleadings and depute his representative for the purpose.
(I1) The Registrar shall bold and manage the properties ofthe University, including trust and immovable properties, for fulfilling any ofthe objects of the University.
(12) The Registrar shall ensure that the registers of properties of the University are maintained properly and that stock checking is conducted of the equipment and other material in the offices and branches attire University including colleges and the institutions maintained by the University.

(13) The Registrar shall perform such other functions as may be specified in the Statutes, Ordinances or Regulations or as may he required from time to time by the Board of Management or the Vice-Chancellor :
0. The Controller of Finance.—(1) The Board of Management shall constitute a selection committee for the appointment of the Controller of Finance.
(2) The Controller of Finance shall be appointed by the Board of Management on the recommendation of the selection committee constituted under sub clause (1) and he shall be a whole-time salaried officer of the University and shall work under the control of the Vice-Chancellor,
(3) The emoluments and other conditions of service of the Controller of Finance shall be prescribed by the Ordinances :
Provided thai the Controller of Finance shall retire on attaining the age of sixty years.
(4) When the office of the Controller of Finance is vacant or when the Controller of Finance is, by reason of ill health, absence or any other cause, unable to perform his functions as the Controller of Finance, his functions shall be performed by such person as the Vice-Chancellor may appoint for the purpose.
(5) The Controller of Finance shall—
(a) exercise general supervision over the funds of the University and advise it as regards its financial policies; and
(b) perform such other financial functions as may be assigned to him/her by the Board of Management or as may be prescribed by the Statutes or the Ordinances :
Provided that the controller of Finance shall not incur any expenditure exceeding three lakh rupees or such other amount as may be fixed by the Board of Management, without the prior approval of the Competent Authrority.
(6) Subject to the control of the Vice-Chancellor and the Board of Management, the Controller of Finance shall—
(t) be responsible forthe preparation of the annual accounts and the budget of the University and for their presentation to the Board of Management after they have been considered by the Finance Committee;
(g) keep a constant watch on the cash and bank balances and investments;
(h) watch the progress of collection ofrevenues and advise on the methods of collection employed;
(D bring to the notice of the Vice-Chancellor any expenditureunanithorized or any other financial irregularity and suggest appropriate action against person at fault; and
(j) call from any office of the University, including colleges maintained by the University, any information or reportthat he/she may consider necessary for the performance of his functions.
(7) Any receipt given by the Controller of Finance or by the person or persons duly authorized in this behalf by the Board of Management shall be a sufficient discharge for payment of moneys to the University.
9. The Libra rian.—The Librarian shall be a wholetime salaried officer appointed by the Board of Management on the recommendation of a selection committee constituted for the purpose, and shall possess such qualifications and exercise such powers and perform such duties, as may be determined by the Board of Management
10. The Board of Management--(l) The Board of Management shall have the power of management and administration of the revenues and properties of the University and the conduct of all administrative affairs of the University not otherwise provided for.
(2) Subject to the provisions of the Act, the Statutes and the Ordinances, the Board of Management shall, in addition to the other powers vested in it by and under the Statutes, have the following powers, namely :
(a) to create teaching and other academic posts in the University and colleges and to define the functions and conditions of service of the Professors, Associate Professors, Assistant Professors, other teachers and the academic staffemployed by the University after taking into consideration the recommendations of the Academic Council;
(b) to prescribe qualifications and other conditions of eligibility for teachers and other academic staff after taking into account the recommendations of the Academic Council;
(c) to make appointments of such Professors, Associate Prof:essors, Assistant Professors, other teachers and such academic staff as may be necessary, on the recommendations of the selection committees constituted for the purpose;
(a) ensure compliance of financial rules and regulations as prescribed by the university;
(b) be responsible for proper and timely investment of university funds with the approval of the Vicechancellor;
(c) be responsible to get formats of books of accounts approved by the finance committee;
(d) be responsible for getting internal and external audit of the books of accounts of the university;
(e) see that the limits fixed by the Finance Committee for recurring and non-recurring expenditure for a year are not exceeded and the money is expended or spent for the purposes for which it was granted or allotted;

(d) to make appointments to temporary vacancies of any academic and non-teaching staff;
(e) to specify the manner of appointment to temporary vacancies ofthe academic and nonteaching staff;
(f) to provide for the appointment of visiting profestiors, chaired professors and determine the terms and conditions ofsuch appointment;
(g) to create administrative, ministerial, technical and other necessary posts after taking, into account the recommendations of the Finance Committee and to specify the manner of appointment thereto;
(h) to prescribe qualifications and other conditions of eligibility for non-teaching staff;
(i) to make appointments of non-teaching staff as may be necessary, on the recommendations of the selection committees constituted for the purpose;
(i to regulate and enforce discipline amongst the employees in accordance with the Statutes and the Ordinances;
(k) to transfer or accept transfers ofany immovable ' or movable property on behalf of the University;
(I) to entertain, adjudicate upon or redress the grievances of the employees and the students of the University who may, for any reason feel aggrieved;
(m) to fix the remuneration payable to invigilators and travelling and other allowances payable after consulting the Finance Committee;
(n) to select a common seal for the University and to provide for the use of such seal;
(o) to delegate any of its powers to the Vice- Chancellor, and on the recommendations of the Vice-Chancellor to the Pro Vice- Chancellors, Registrars, the Controller of Finance or any other Officer, employee or authority of the University or to a Committee appointed by it;
(p) to institute fellowships, scholarships, studentships; and
(q) to exercise such other powers and perform such other functions as may be conferred or imposed by the Act or the Statutes.
(3) The Board of Management shall exercise all the powers of the University not otherwise provided for by the Act, the Statutes, the Ordinances and the Regulations for the fulfilment of the objects of the University.
(4) The Board of Management shill meet atleast once, in every three months.
11. The Academie Councle—(1) The academic council shall :
(a) exercise general supervision over the academic policies ofthe University and to give directions regarding methods of instruction, evaluation or research or improvement in academic standards;
(b) consider matters of general academic interest either on its own initiative or on a reference from the Planning Board or a Department/ School ofstudies or the Board of Management and to take appropriate action thereon; and
(c) frame such regulations as are consistent with the Statutes and the Ordinances regarding the academic functioning of the University, including discipline, admissions, award of fellowships and studentships, fees and other academic requirements.
(2) The academic council shall meet at least once, in every four months.
(3) The academic council shall draw up a list of experts/professionals to be members of selection committees constitutedunder Clause 16(2) and 16 (3). Such a list of experts/professionals shall be submitted to the Government, through Secretary, Departmentof Training & Technical Education and as may be required by the Oovenunent, experts/professionals would be dropped/ substituted in the list drawn up by the academic council.
12. The Planning Board.—(1) The Planning Board shall consist ofthe Vice-Chancellor and not more than six members to be nominated by the Board of Management.
(2) All the members of the Planning Board, other than the Vice-Chancellor, shall bold office for a term of three years.
(3) The Planning Board shall design and formulate appropriate plans for development and expansion of the University, and it shall, in addition, have the right to advise the Board of Management and the Academic Council on any matter which it may deem necessary for the fulfilment of the objects of the University.
(4) The Planning Board may constitute such committees as may be necessary for planning and monitoring the programmes of the University.
(5) The Planning Board shall meet at such intervals as it deem expedient, but it shall meet at least twice in a year.
13. The Departments and the Schools.— (I) The University shall have such departments and schools of studies as may be specified in the Ordinances.
(2) Each department or school of studies shall be headed by the Head of the Department as prescribed in the Ordinances.
(3) The composition and functions of the departments and schools and other related matters shall be such as are specified in the Ordinances:

14.The Board of Stedies.--(1) Each Department and School of studies shall have a Board of Studies to advice on academic matters of the Department or School, as the case may, including matters relating to formulation of curriculum and its regular update.
(2' The composition of Board of Studies and its functions will be as specified in the Ordinances.
15. The Finance Committee.— (1) The Finance Committee shall develop financial policies of the University and to oversee the revenues and expenditures of the university .
tZ) The Finance Committee shall make recommendations on generating revenues through the university 's activities and these recommendations of the Finance Committee shall be placed before the Board of Management fora decision.
(3 The Finance Committee shall make recommendations on improving the operational efficiency of the University's activities, measures for revenue generation. and on major expenditure proposals of the university. as may be required by the Board of Management.
(41 The Controller of Finance shall be the ex-officio Member-Secretary of the Finance Committee.
(5j The annual accounts and the budget of the university prepared by the Controller of Finance shall be placed before the Finance Committee for approval before being submitted to the Board of Management.
16. Selection Committees.—(1) There shall be constituted selection committees for making recommendations to the Board of Management for appointment to the posts of Professors, Associate Professors, Assistant Professors, other teachers, other academic staff and heads of colleges maintained by the University.
(2) Each of the selection committees for appointment to the posts of Professors, Associate Professors, Assistant Professors, other teachers and other academic staff shall consist of the following members, namely :
(i) The Vice-Chancellor:
(ii) One of the Deans of the related discipline nominated by the Board of Management;
(iii) Three experts not connected with the University to be nominated by the Vice- Chancellor from a panel of not less than seven names approved by the Academic Council for each department/school;
(iv) Four members of the selection committee (who shall include at least two experts) shall form a quorum for a meeting ofthe selection comm' tee constituted under clause (2).
(3) Each of the selection committees for appointment to the posts of heads of colleges maintained by the University shall consist °fete following members, namely—
(i) The Vice-Chancellor,

(iii) Three eminent professionals to be nominated by the Vice-chancellor, out ofa panel approved by the Academic Council for the post of Principal/Director.
(iv) A member of the Board of Management to be nominated by Vice Chancellor.
Four members shall form the quorum and it should include at least one person from category (iii) above.
(4) Each of the Selection Committees for appointment to the posts of various categories of staff, other than the academic staff shall consist ofthe following members namely (0 the Vice-Chancellor or his nominee not below the rankofPro Vic.e-Chancellorofthe university,
(h) the Registrar,
(di) the Secretary, Technical Education of the Government of Delhi or his nominee not below the rank ofJoint Secretary,
(iv) a representative of the scheduled castes or scheduledttims °Miens* ofaGazetted Officer :
Provided that whenever necessary, two experts may be nominated by the Vice-Chancellor in the above Selection Committees.
(5)The goon= for a meeting ofa selection committee constituted under clause (4) shall be three.
(6) The procedures to be followed by the selection committees constituted under this statute shall, in making recommendations, bench as laid down in the Ordinances.
17. Special mode of appointment— (1) Notwithstanding anything contained in Statute 16, the Board of Management may invite a person of high academic distinction and professional attainments to accept the post of a professor!Associate professor or any other equivalent academic post in the University on such terms and conditions as it may deem fit, and appoint the person to such post.
(2) The Board of Management may appoint any member of the academic staff working in any other university or organisation on *teaching assignment or for undertaking a project or any other work on such terms and conditions as may be determined by the Board of Management in accordance with the manner specified by the Statutes.
18. Recognized tea hers.--(1) The qualifications and other conditions of eligibility for recognition of teachers working in the colleges maintained by the University shall be such as are prescribed by the Ordinances.
(2) All cases of recognition of teachers in a college shall be dealt with and approved by the selection committees as constituted under clause (2) of Statute 16.

19. Committees.—(1) Any authority of the University may appoint as many standing or special committees as it may deem fit and may appofie on such committees such persons as are not members of such authority.
(2) Any committee appointed under clause (1) may deal with any subject delegated to it and before taking action, if any, shall seek confirmation of it from the authority appointing it.
20. Terms and Conditions of service and code of ethics for the teachers and other academie staff of the University.—(1) All the teachers and other academic staff of the University shall, in the absence of any contract to the contrary, be governed by the terms and conditions of service and code of ethics,as are specified by the Statutes and the Ordinances.
(2) Every teacher and member of the academic staff shall be appointed on a written contract.
(3) A copy of every contract referred to in clause (2) shall be deposited with the Registrar.
21. Terms and conditions of service and code of conduct for other employees of the University.—All the employees of the University, other than the teachers and other academic staff shall, in the absence of any contract to the contrary, be governed by the terms and conditions of service and the code of conduct as specified in the Statutes and the Ordinances.
22. Removal of employees of the University.—(1) Where there is an allegation of serious misconduct against a teacher, a member of the academic staff or any other employee of the University, the Vice-Chancellor may, in the case of a teacher or a member of the academic staff; or the authority competent to appoint (hereinafter referred to as appointing authority) in the case of any other employee, as the case may be, by order in writing, place such teacher, member of the academic staff or other employee as the case may be, under suspension and shall forthwith report to the Board of Management the circumstances in which the order was made.
(2) Notwithstanding anything contained in the terms of the contract of appointment or in a other terms of conditions of service of the employees, the Board of Management in respect of teachers and other academic staff, and the appointing authority, in respect of other employees, as the case may be, shall have the power to remove a teacher or a member of the academic staff or other employee, as the case may be, on grounds of misconduct.
(3) Save as aforesaid, the Board of Management, or the appointing authority, as the case may be, shall not be entitled to remove any teacher, any member of the academic staff or any other employee except for a justified cause and after giving three months' notice to the person concerned or on payment of three months' salary to him/her in lieu thereof.
(4) No teacher, member of the academic staff or other employee shall be removed under clause (2) &clause (3) unless he has been given a reasonable opportunity of showing cause against the action proposed to be taken in regard to him/her.
(5) The removal of a teacher, a member of the academic staff or other employee shall take effect from the date on which the order of removal is made.
(6) Notwithstanding anything contained in the foregoing provisions Ofthis Statute, a teacher, a member of the academic staff or other employee may resign after giving one month's notice in writing to the Board of Management or the appointing authority, as the case may be, or by paying one month's salary in lieu thereof; Provided that such resignation shall take effect only front the date on which the resignation is accepted by the Board of Management, or the appointing authority, as the case may be.
23. Maintenance of discipline amongst the students of the University.—(I) The powers regarding discipline and disciplinary action in regard to the students of the University shall vest in the Vice-Chancellor who may delegate all or any of his powers to such officers of the university, as he may deem fit.
(2) Without prejudice to the generality of his/her powers relating to the maintenance of discipline and taking such action as he/she may deem appropriate for the maintenance of discipline, the Vice-Chancellor may, in exercise of his/her points, by order, direct that any student or students be expelled or rusticated for a specified period and not admitted to a course or courses of study in the University or college maintained by the University for a stated period, or be punished with a fine for an amount to be specified in the order, or debarred from an examination or examinations conducted by the University for one or more years or that the result of the student or students concerned in the examination or examinations, in which he/ she has or they have appeared, to be cancelled.
(3) The heads of colleges shall have the authority to exercise all such disciplinary powers over the students in their respective colleges as may be necessary for the proper and efficient functioning of such colleges.
24. Other provisions in respect of employees transferred from erstwhile Delhi College of Engineering.—(a) The Vice-Chancellor will exercise all the powers of the erstwhile Director, Delhi College of Engineering inrespect of all the employees of the erstwhile Delhi College of Engineering.
(b) Until the University is able to make specific Statutes or Ordinances or Regulations on this subject, general regulations or pmoedures applicable to thethen Delhi College of Engineering shall continue to apply to these employees.
