PART II—Section 3—Sub-section (i) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 748] ubZ fnYyh] c`gLifrokj] vDrwcj 27] 2016@dk£rd 5] 1938 No. 748] NEW DELHI, THURSDAY, OCTOBER 27, 2016/KARTIKA 5, 1938 सड़क पᳯरवहन और राजमागᭅ मंᮢ ालय अिधसचूना ubZ fnYyh] 26 vDrwcj] 2016 सा.का.िन. 1014(अ).—के᭠ᮤीय मोटर यान िनयम, 1989 का और संशोधन करने के िलए कितपय िनयमᲂ का िन᳜िलिखत ᮧाᱨप, के᭠ᮤीय सरकार, मोटर यान अिधिनयम, 1988 (1988 का 59) कᳱ धारा 110 ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करत े ᱟए, बनाने का ᮧ᭭ताव करती ह,ै उᲦ अिधिनयम कᳱ धारा 212 कᳱ उपधारा (1) कᳱ अपेᭃानुसार उन सभी ᳞िᲦयᲂ कᳱ जानकारी के िलए िजनके उससे ᮧभािवत होने कᳱ संभावना है, ᮧकािशत ᳰकया जाता ह ैऔर यह सूचना दी जाती ह ै ᳰक उᲦ ᮧाᱨप िनयमᲂ पर उस तारीख से, िजसको भारत के राजपᮢ मᱶ िजसमᱶ यह अिधसूचना ᮧकािशत कᳱ गई थी, कᳱ ᮧितयां जनता को उपल᭣ध करा दी जाती ह,ᱹ तीस ᳰदन कᳱ अविध कᳱ समाि᳙ के प᳟ात ्िवचार ᳰकया जाएगा ;
कᱶ ᮤीय सरकार ᳇ारा उ त ᮧाᱧप िनयमᲂ कᳱ बाबत, ऐसे ᳰक᭠ हᱭ आᭃेपᲂ और सुझावᲂ पर, जो ᳰकसी ᭪ यि त से पूवᲃ त अविध कᳱ समाि᭡ त से पूवᭅ ᮧा᭡ त हᲂ, िवचार ᳰकया जाएगा ;
इन ᮧाᱧप िनयमᲂ पर आᭃेप या सुझाव, यᳰद कोई हᲂ, संयु त सिचव (पᳯरवहन), (ई-मेल- js.tpt@gov.in) सड़क पᳯरवहन और राजमागᭅ मंᮢालय, पᳯरवहन भवन, संसद ्मागᭅ, नई ᳰद᭨ ली-110001 को पूवᲃ त िविन᳸द᭬ ट अविध के भीतर भेजे जा सकᱶ गे । ᮧाᱧप िनयम
1. (1) इन िनयमᲂ का संिᭃ᭡ त नाम कᱶ ᮤीय मोटर यान (..........संशोधन) िनयम, 2016 ह ै।
(2) ये राजपᮢ मᱶ अंितम ᮧकाशन कᳱ तारीख को ᮧवृ᭜ त हᲂगे ।
2. कᱶ ᮤीय मोटर यान िनयम, 1989 (िजसे इसमᱶ इसके प᭫ चात ्िनयम कहा गया ह)ै, 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 1(ड) िनयम 2 मᱶ, खंड (ध) के प᭫ चात,् िन᭥ निलिखत खंड अंत:᭭ थािपत ᳰकए जाएंग,े अथाᭅत ्:- ''(धक) "सुरᭃा पᲵा ᭭ मरण" अिभᮧेत ह,ै जो चालक और सहयाᮢी कᳱ चेतावनी के िलए ᮧणाली समᳶपत ह ैजब सुरᭃा पᲵा का उपयोग नहᱭ ᳰकया जाता ह ै;
(धख) "गित चेतावनी ᮧणाली" ऐसी ᮧणाली अिभᮧेत ह ैजो चालक वैकि᭨ पक और धाि᭜ वक चेतावनी चलक ह ैजब इसके सीिमत पर अिधक गित के साथ मोटर यान कᳱ परत ह ै;
(धग) "ह᭭ त चािलत अ᭟ यारोही" से ऐसी ᮧणाली अिभᮧेत ह ैजो मोटर यान अिधभोगी को ᳇ार खोलने वाले लीवर का ᮧयोग करत ेᱟए भीतर से ᳇ार को खोल सकता ह ैया वह बंद करन ेवाली ᮧणाली के िलए िव᳒ुत शि त सहायता से या उसके ᮩेक िनयंिᮢत कर सकता ह ै᳴कतु यह बालक सुरᭃा ताला बंद वाली ᮧणाली से सि᭔ जत ᳇ार को लाग ूनहᱭ होगा ;
(धघ) "वाहन उ᭜ ᮓमण िगयर सᱶसर" वाहन ᭭ थान से सᱶसर अिभᮧेत ह ैजो वाहन ᭭ थान करते समय कᳯठनाइयᲂ को चालक चेतावनी के िलए अिभकि᭨ पत ᳰकया गया ह ै;
(धङ) "एयर बैग ᮧणाली" अिभᮧेत ह ैजो सᱶसरᲂ, नैदािनको और एयर बैग मापांक ᮧाथिमक ᱨप से िमल कर बना ह ै जो पᳯरचालन चᮓ या िखड़कᳱ पᲵी लगान ेसे मोटर यान के स᭥ मुख चालक और याᮢी रोकने के िलए मोटर वाहन के मामले मᱶ िव᭟ वंस करता ह ैजो अंत:सᳯरत ह ै;
(धच) "एयर बैक मापांक समु᭒ चय" जो कमतर फुलाए समु᭒ चय और बैग कम से कम समु᭒ चय िमल कर अिभᮧेत ह,ै िजसके साथ आ᭒ छाᳰदत ह,ै यᳰद लागू हᲂ ;
(ii) भारत के राजपᮢ, भारत सरकार के सड़क पᳯरवहन राजमागᭅ मंᮢालय कᳱ अिधसूचना सं या सा.का.िन. 291(अ), तारीख 24 अᮧैल, 2014 ᳇ारा उ त िनयम 125 के उपिनयम (7) मᱶ इस ᮧकार अंत:᭭ थािपत उपिनयम (8) के ᱨप मᱶ पुन:सं याᳰकत और उपिनयम (8) के प᭫ चात ्इस ᮧकार सं याᳰकत िन᭥ निलिखत उपिनयम अतं:᭭ थािपत ᳰकए जाएंग,े अथाᭅत ्:- "(9) ᮧवगᭅ एम 1 के वाहन 1 अᮧैल, 2018 को या प᭫ चात् िविनᳶमत ᳰफट ᳰकया जाएगा :
(i) अित गितयᲂ के मामले मᱶ चेतावनी चालक के िलए गित चेतावनी ᮧणाली ;
(ii) सुरᭃा पᲵा ᭭ मरण ;
(iii) कᱶ ᮤीयता ताला ᮧणाली के िलए ह᭭ तचािलत अ᭟ यारोही ;
(iv) वाहन उ᭜ ᮓमण िगयर सᱶसर :
परंतु गित चेतावनी मᱶ चालक को सावधान करेगा यᳰद वाहन 80 ᳰकलोमीटर ᮧित घंटᱶ से अिधक ह ैऔर ᳰफर लगातार ᭟ विन ह ैयᳰद वाहन गित 100 ᳰकलोमीटर ᮧित घंटᱶ से अिधक हो :
परंत ुइस उपिनयम के अधीन िविन᳸द᭬ ट ᮧणाली, यथाि᭭ थित, िविनमाᭅता या उसके ᭪ यौहारी ᮧािधकृत ᳰफट ᳰकया जाएगा, इन िनयमᲂ के उपबंिधत मानकᲂ के अनुसार हᲂगे ।
(10) मोटर वाहन ᮧवगᭅ एम 1 के नए मॉडल, 1 अ तूबर, 2017 को िविनᳶमत और उसके प᭫ चात् और उ त मोटर वाहन ᮧवगᭅ 1 अ तूबर, 2018 को या इसके प᭫ चात् चालक और पᳯरचालन चᮓ िखड़कᳱ चᲵा लगान े से स᭥ मुख याᮢी रोकने के िलए आशय ᱨप मᱶ समय-समय पर यथा संशोिधत एआईएस-098 कᳱ अपेᭃाᲐ को अनुपालन के साथ स᭥ मुख एयर बैग ᮧणाली समुिचत अिभकि᭨ पत के साथ सुसि᭔ जत ᳰकया जाएगा । ¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 3
(11) 1 अᮧलै, 2018 को या उसके प᭫ चात् िविनᳶमत ᮧवगᭅ एम 2, ᮧवगᭅ एम 3 और ᮧवगᭅ एन के वाहन िन᭥ निलिखत ᮧणािलयां उ᭜ ᮓमण िगयर सᱶसर या सुरᭃा वाहन वाहन-᭭ थान सहायता से और वाहन के युि त चालक सुरᭃा उ᭜ ᮓमण के साथ सुसि᭔ जत ᳰकया जाएगा ।" [फा. सं. आरटी-11028/16/2016-एमवीएल] अभय दामल,े संयु त सिचव ᳯट᭡ पण: मूल िनयम, भारत के राजपᮢ, असाधारण, भाग II , खंड 3, उपखंड (i), अिधसूचना सं. सा.का.िन. 590(अ), तारीख 2 जून, 1989 ᳇ारा ᮧकािशत ᳰकए गए थ ेऔर अिधसूचना सं. सा.का.िन. सं. (अ), तारीख ᳇ारा अंितम बार संशोिधत ᳰकए गए । MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 26th October, 2016 G.S.R. 1014(E).—The following draft rules further to amend the Central Motor Vehicles Rules, 1989, which the Central Government proposes to make in exercise of the powers conferred by sub-section (1) of section 110 of the Motor Vehicles Act, 1988 (59 of 1988), is hereby published as required by sub-section (1) of section 212 of the said Act, for the information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of a period of thirty days from the date on which copies of this notification as published in the Gazette of India, are made available to the public;
Any objection or suggestion which may be received from any person with respect to the said draft rules before the expiry of the aforesaid period shall be considered by the Central Government;
Objections or suggestions, if any, may be forwarded before the aforesaid period of thirty days to the Joint Secretary (Transport), (Email: js.tpt@gov.in ), Ministry of Road Transport and Highways, Transport Bhawan, Parliament Street, New Delhi-110001.
DRAFT RULES
1. (1) These rules may be called the Central Motor Vehicles (………………Amendment) Rules, 2016.
(2) They shall come into force on the date of their final publication in the Official Gazette.
2. In the Central Motor Vehicles Rules, 1989, hereinafter referred to as the said rules, (I) in rule 2, after clause (s), the following clauses shall be inserted, namely:— ‘(sa) “safety-belt reminder” means a system dedicated to alert the driver and co-passenger when the safety-belt is not used;
(sb) “speed alert system” means a system which gives the driver optical and acoustic warning, when motor vehicle ply with excess speed beyond its limits;
(sc) “manual over-ride” means the system that enables the motor vehicle occupant to open the door from inside using door release lever or control with or without electric power assistance to door locking system but shall not be applicable to the door equipped with child safety lock system and the child safety lock system;
(sd) “vehicle reverse gear sensor” means parking sensors that are designed to alert the driver to obstacles while parking;
(se) "airbag system” means inflatable restraint system consisting primarily of a sensor or sensors, diagnostics, and air bag module which inflates a bag in case of motor vehicle crashes to prevent the front driver and passenger of the motor vehicle from striking the steering wheel or a window;
(sf) “air bag module assembly” means the assembly consisting of at least inflator assembly and a bag with a cover if applicable;
4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (II) in rule 125, of the said rules, sub-rule (7) as so inserted vide notification of the Government of India in the Ministry of Road Transport and Highways number G.S.R 291(E), dated the 24th April, 2014 shall be renumbered as sub-rule (8) thereof and after sub-rule (8) as so numbered, the following sub-rules shall be inserted, namely:- “(9) Vehicles of category M1, manufactured on and after the 1st day of April, 2018, shall be fitted with following:
(i) speed alert system to alert driver in case of over speeds;
(ii) seat belt reminder;
(iii)manual override for central locking system;
(iv) vehicle reverse gear sensor:
Provided that the speed alert shall warn the driver if the vehicle speed exceeds 80 kilometres per hour and then a continuous audio alert if the vehicle speed exceeds 100 kilometres per hour:
Provided that the system specified under this sub-rule shall be fitted by the manufacturer or their authorised dealer, as the case may be, in accordance with the standards provided under these rules.
(10) New models of M1 category motor vehicles, manufactured on and after the 1st October, 2017 and existing models of the said category of motor vehicles, manufactured on and after the 1st October, 2018 shall be equipped with appropriately designed frontal airbags system complying with the performance requirements of AIS-098 as amended from time to time intended to prevent the driver and front passenger from striking the steering wheel or a window.
(11) vehicles of Category M2, Category M3 and Category N, manufactured on and after the 01st April 2018, shall be fitted with the following systems vehicle reverse gear sensor assisting safe parking and safe reverse manoeuvres of the vehicle.”.
