PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY सड़क पररवहन और राजमागग मतं्रालय अजधसचूना नई ददल्ली, 11 फरवरी, 2022 सा.का.जन. 106(अ).—कें द्रीय मोटर यान जनयमावली, 1989, जनम् नजलजखत प्राूपप जनयम, जजसे कें द्र सरकार, मोटर यान अजधजनयम, 1988 (1988 का 59) की धारा 109, 110 द्वारा प्रदत्त िजियों का प्रयोग करत ेहुए और संिोधन करन ेका प्रस्ट्ताव करती ह।ै इसको उक् त अजधजनयम की धारा 212 की उप-धारा (1) द्वारा यथापेजित उनके द्वारा प्रभाजवत होने की संभावना वाले सभी व्यजियों की जानकारी के जलए प्रकाजित दकया जाता है और एतद् द्वारा नोरटस ददया जाता ह ै दक प्राूपप जनयमों को उस तारीख से तीस ददन की अवजध समाप्त होन ेके बाद जवचाराथग स्ट्वीकार कर जलया जाएगा जजसको सरकारी राजपत्र में यथा-प्रकाजित इस अजधसूचना की प्रजतयां जनता के जलए उपलब्ध करायी जाती हैं। आपज तयां एवं साझाव, यदद कोई हो, को संयाि सजचव (एमवीएल, पररवहन और टोल), सड़क पररवहन और राजमागग मंत्रालय, पररवहन भवन, संसद मागग, नई ददल्ली-110001 को ईमले: comments-morth@gov.in पर भेजा जा सकता ह।ै उपरोि अवजध समाप्त होने से पहले उक् त प्राूपप जनयमों के संबंध में दकसी भी व्यजि से प्राप्त होने वाली आपजत्तयों या साझावों पर कें द्र सरकार द्वारा जवचार दकया जाएगा;
प्राूपप जनयम
1. संजिप् त नाम एवं प्रारंभ - (1) इन जनयमों को केन्द्द्रीय मोटर यान (... ... .. संिोधन) जनयम, 2022 कहा जाएगा।

2. कें द्रीय मोटर यान जनयमावली, 1989 में, जनयम 125 के उप-जनयम (1) और (1-क) में अंक, अिर और िब्द "आईएस:
15140-2003" और "आईएस: 15139-2002", जहां भी वे हैं, के स्ट् थान पर अंक, अिर और िब्द "आईएस: 15140-- 2018" और "आईएस: 15139-2002 (पान:पाजि 2018)" को प्रजतस्ट्थाजपत दकया जाएगा।
3. केन्द्द्रीय मोटर यान जनयमावली, 1989 में जनयम 125 के उप-जनयम (1-क) के दसूरे परंताक के पश् चात् जनम्नजलजखत परंताकों को अंत:स्ट्थाजपत दकया जाएगा, अथागत:्- "बिते दक, 01 अक्टूबर, 2022 को और उसके बाद जनर्ममत एम1 श्रेणी के मोटर वाहनों के जलए सारिा बेल्ट असेंबजलयों के जवजनदेि, समय-समय पर यथा-संिोजधत आईएस:15140:2018 के अनाूपप होंगे। बिते यह भी दक 01 अक्टूबर, 2022 को और उसके बाद जनर्ममत एम1 श्रेणी के वाहनों में सभी फं्रट फेससग सीटों पर थ्री पॉइंट बेल्ट लगाए जाए।ं बिते दक 01 अक्टूबर, 2022 को और उसके बाद जनर्ममत एम1 श्रेणी के वाहनों में सेफ्टी बेल्ट, रेस्ट्रेंट जसस्ट्टम और सेफ्टी बेल्ट ररमाइंडर, समय-समय पर यथा-संिोजधत आईएस 16694: 2018 के अनाूपप लगे होंगे।"
4. कें द्रीय मोटर यान जनयमावली, 1989 में जनयम 125 के, उप-जनयम (9) और (10) में अकं, अिर और िब्द "एआईएस- 145-2017" के स्ट् थान पर अंक, अिर और िब्द "एआईएस-145 -2018" को प्रजतस्ट्थाजपत दकया जाएगा।
5. अंजतम अजधसूचना के प्रकािन की तारीख से 6 माह पश्चात ्केन्द्द्रीय मोटर यान जनयमावली, 1989 में जनयम 125ज के उप-जनयम (2) और उप जनयम (3) में िब्दों एवं अंकों, समय-समय पर यथा-संिोजधत,"एआईएस-140:2016 के स्ट् थान पर, जब तक भारतीय मानक ब्यूरो अजधजनयम, 1986 (1986 का 63) के तहत संबंजधत बीआईएस जवजनदेिों को अजधसूजचत नहीं दकया जाता ह"ै िब्द और आंकडे़ "समय-समय पर यथा-संिोजधत आईएस: 16833-2018" को प्रजतस्ट्थाजपत दकया जाएगा। [फा. सं. आरटी-11036/15/2022-एमवीएल] अजमत वरदान, संयाक् त सजचव नोट : मूल जनयम भारत के राजपत्र, असाधारण, भाग II, खंड 3, उप-खंड (i) में अजधसूचना संख् या सा. का. जन. 590(अ), ददनांक 02 जून, 1989 द्वारा प्रकाजित दकए गए थे और जपछली बार अजधसूचना संख् या सा.का.जन.......(अ), ददनांक......... के माध् यम से सिंोजधत दकए गए थे। MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 11th February, 2022 G.S.R. 106(E).—The following draft rules further amend the Central Motor Vehicles Rules, 1989, which the Central Government proposes to make in exercise of powers conferred by sections 109, 110 of Motor Vehicles Act, 1988 (59 of 1988), is hereby published as required by sub-section (1) of section 212 of the said Act for information of all persons likely to be affected thereby and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of a period of thirty days from the date on which the copies of this notification, as published in the Gazette of India, are made available to the public.
Objections or suggestions, if any, may be sent to the Joint Secretary (MVL, Transport, Toll), Ministry of Road Transport and Highways, Transport Bhawan, Parliament Street, New Delhi-110 001, Email: comments-morth@gov.in.
Any objections or suggestions which may be received from any person with respect to the said draft rules before the expiry of the period aforesaid will be considered by the Central Government;
Draft Rules
1. Short title and commencement. – (1). These rules may be called as the Central Motor Vehicles (……… Amendment) Rules, 2022.
(2) Save as otherwise provided in these rules, they shall come into force on the date of their final publication in the Official Gazette.

2. In the Central Motor Vehicles Rules, 1989, in rule 125, in sub rules (1) and (1-A) for the figures, letters and words ―IS: 15140-2003‖ and ―IS: 15139-2002‖, wherever they occur, the figures, letters and words ―IS:
15140-2018‖, and ―IS: 15139-2002 (reaffirmed 2018)" shall be substituted.
3. In the Central Motor Vehicles Rules, 1989, in rule 125, in sub-rule (1-A), after the second proviso, the following provisos shall be inserted, namely: - "Provided further that, for motor vehicles of category M1 manufactured on and after 01st October 2022, the specifications of Safety Belt Assemblies shall conform to IS:15140:2018, as amended from timeto-time.
Provided also that all front facing seats in vehicles of M1 category manufactured on and after 01st October 2022 be provided with three point belt.
Provided further that the installation of Safety Belts, Restraint Systems and Safety belt reminder on vehicles of M1 category manufactured on and after 1 st October 2022 shall conform to IS16694:2018 as amended from time-to-time."
4. In the Central Motor Vehicles Rules, 1989, in rule 125, in sub rules (9) and (10) for the figures, letters and words ―AIS-145-2017‖, the figures, letters and words ―AIS-145-2018‖ shall be substituted.
5. After 6 Months from the date of publication of final notification, in Central Motor Vehicle Rules, 1989, in rule 125 H, in sub-rule (2) and in sub-rule (3), for the words and figures "AIS-140:2016, as amended from time to time, till such time the corresponding BIS specifications are notified under the Bureau of India Standards Act, 1986 (63 of 1986)" the words and figures " IS:16833-2018,as amended from time to time" shall be substituted.
